and for john roberts. the details are horrendous. if you have children in the room, you might not want them seeing something so horrific. seen witnesses say was marked by bodies flying through the air. chilling video from the city of waukesha's own facebook live stream showing the speeding suv speed past the crowd of onlookers. witnesses said they couldn't believe they were saying. the suv plowing through families. >> sandra: the suv drives through the crowd. members of the band looking on in horror. mass confusion erupts as people scream to get out of the way. five people dead and dozens wounded. the chaos and carnage leaving locals shocked. >> that was the worst thing i've ever seen. >> hit a whole crowd of kids. >> kids involved. my mom was trying to help one of them. one of the kids. there was blood everywhere. >> everyone is in shock. everyone started screaming. people over for five blocks. i thought maybe a driver didn't stop. someone said they definitely did it deliberately. i feel like it's watching a movie. i've never seen anything this bad before. >> sandra: awful. we are learning more about the person of interest. police are questioning an ongoing investigation we are seeing his lengthy criminal history. also awaiting news conference had to happen in less than an hour. >> trace: while we wait for that, senior correspondent mike tobin's life for us on the ground and waukesha, wisconsin. what have you learned about this person of interest. >> the first thing, being held according to law enforcement sources, david brooks. the chief year, daniel thomas has identified him as only a person of interest. he is not called him a suspect, at least not yet. that was at last notification. court documents show that brooks bonded out of jail on friday. a further search of court records going back two decades shows multiple run-ins with police, concealed weapons, drug charges, strangling someone. battery, resisting arrest, drug charges. law enforcement sources have told our david spunt that local police responded to call for a fight at a park. they saw the red suv speeding away and that was shortly before the suv came to this location and crashed to the barriers and rammed through the parade, injuring spectators and participants alike. >> everyone is in shock. everyone started screaming. the image that keeps going through my head is the car going to the girls. the only reason why i didn't break down was i had the other kids around me. >> overnight the city confirmed that five people were killed. children's hospital has updated information about the kids treated from the scene. 18 patients were brought to children's hospital, their injuries included facial abrasions, serious head injuries and broken bones. six underwent surgery last may, two are undergoing surgery today. the wounded include, sadly, three sets of siblings. as far as the scene here, it was secured with crime tape all night long. we saw the police had come through here and they started leaning up the debris that had been left behind. as of now what you can see is some traffic moving behind me because this very long crime scene on mainstream, at least part of it is open. >> trace: mike tobin on the ground in waukesha. thank you. >> sandra: thank you. joining us now by phone, kimberly coronado. she was at that parade with her 12-year-old daughter and her nieces. she was just feet away from the suv as it plowed through the crowd. kimberly, welcome. thank you for being here. what did you see first as you are watching the parade before you realized that that vehicle was going to inflict so much harm? >> we were sitting, my daughter was sitting at my feet and i was standing above her. what i saw was a red suv run over a gentleman. i think it was a gentleman in the costume. his body was trampled by the front and back wheels. it was at that point where i realized this isn't an accident. and then the hot air balloon, the re/max hot air balloon made a big puff of fire. at that moment where i felt the heat, the red suv was right in front of us. arm's length away. my sister-in-law pulling my niece out of harm's way. i felt my daughter's arms on me and we just moved back. >> sandra: wow. kimberly, showing the moment that vehicle plowed through the crowd, just a moment ago we were showing images of you and your daughter and your sister-in-law imagine just moments before all this happened. smiley faces, you have no idea obviously what was about to happen. how is your family doing, considering your daughter and your young nieces were right there with you? >> we were trembling and in shock. it was a nightmare. it was something that every time i close my eyes, i see. it's horrific. it really is. >> sandra: i think about the small midwest town that is waukesha. how is your community doing? if you've been able to reach out to others who were there or saw it happening or heard about it. >> yeah. so many of my friends, their daughters were dancing in the extreme dance group. my heart was filled with the joy when i was watching the dancing grannies go by and knowing that some of them are not here with us, it's horrible. our community is trying to pull together. reaching out, there is so much prayers and love coming out. they won't replace what happened. it won't cover the loss. they were here with us smiling minutes before it happened. all the children that were there that were hoping to give letters to santa and see santa, enjoy their hot cocoa and be with family and celebrate. it will be different now. >> sandra: so fresh, i can imagine how hard it is to talk about it. thank you for calling you and thank you for sharing with us what you saw and experienced. our best to you and your family. >> yes, my daughter especially. she was videoing the whole thing and that's the video that you saw today. we have a counselor that we work with already that we were in touch with. there is so much need. so many prayers. so many people fighting for their lives right now. >> sandra: the latest update that those children fighting for their lives in the hospital right now. kimberly, it's incredibly difficult. thank you. >> you're welcome, thank you. >> sandra: her daughter, just 12 years old, witnessed it. >> trace: i can imagine the agony of the parents of the children in the hospital right now. waiting to find out how their children who are injured are doing. one of america's great towns. it's a horrific event. >> sandra: praying for all of them. >> trace: flying over thanksgiving usually means long lines and lots of hassles. this year could have added headaches thanks to a vaccine mandate and a bizarre choice of deadline day. tsa agents have to get the vaccine by the end of today as we enter the busiest time for travel all year long. fox business madison all worth his life for us to newark liberty international airport with the latest on how this could impact your travel plans. >> hey, yeah. that deadline is today, coming up on one of the busiest travel weeks of the year. much busier than this time last year for travelers really returning back to the airports. we do have some good news regarding that mandate. tsa tweeting that 93% of their workforce is compliant with the vaccine mandate. and then for those that aren't compliant, tsa telling fox business that unvaccinated employees will be educated on the vaccine and for the time being will still be paid and able to work. it's a big change. we thought it was a hard cliff deadline. despite today being the deadline, unvaccinated workers are still on the job. this is all happening at one of the busiest travel times of the year. tsa expects to screen around 20 million travelers this thanksgiving week. because of that, they are recommending that travelers arrive at least two hours before their domestic flight. people we have spoken to here at newark have already seen delayed flights and long lines. >> right now it's pretty smooth. i checked online. i didn't want to do the lines. look how long it is. >> one more hour than i normally would. it's smooth right now. >> we got here on time. apparently our flight is delayed 45 minutes. >> even for those travelers we spoke to today, some who have had the delays and things like that, they are actually in good shape because we have not yet hit the busiest stage for a thanksgiving travel. those days are tuesday and wednesday and then again on sunday when everyone travels home. if those are the days that you're expecting to fly to thanksgiving plans, definitely count for longer lines and there could be some storms coming through so you definitely want to be prepared. at the very least, it's going to be hectic. thank you. sandra, you talk about the tsa, even tsa acknowledges a lot of their employees are trying to get exemptions for religious and medical reasons. some of those people could be pulled off the job the next two or three days if those exceptions don't work. see do you think about it it's the first thanksgiving. i was a since before covid wherever but he feels like they can finally -- we are vaccinated, we but at the same time saying the decision and his initial statement has left him "angry and concerned." easier way, it's a past tweet from president biden coming out her scrutiny. rich edson's life from the white house. >> president biden says he stands by with the jury concluded. he says the jury system works and we have got to abide by it. he also released a longer statement right after the verdict that says "while the verdict in kenosha will leave many americans feeling angry, concerned, myself included, we must acknowledge that the jury has spoken. i remain steadfast in my commitment to do everything in my power to ensure that every american is treated equally, with fairness and dignity under the law." vice president, here is in tweeting "i spent a majority of my career workrking to make our criminal justice system more equitable. it's clear there's still a lot more work to do." about a month before the 2020 election, then candidate biden said then president biden donald trump refused to disavow white supremacist in their debate the previous night, he tweeted a photomontage of white supremacist, militia groups, and included a photo of kyle rittenhouse. the white house was asked about that video just ahead of the jury's decision. >> what i can reiterate for y yu is the president's view that we shouldn't have broadly speaking vigilantes patrolling our communities with assault weapons. we shouldn't have opportunists disrupting peaceful protest by rioting and burning down the trinity's they claim to represent anywhere in the country. >> perhaps we can hear more from the president later today. he's heading to fort bragg, north carolina, and he will meet with service members and their families. >> sandra: rich edson live at the white house. thank you. >> trace: no matter the jury's decision, many of the media say the rittenhouse case is far from over. take a listen to some of the rhetoric from over the weekend after the verdict as many in the media refused to budge from their original positions. >> rittenhouse, then 17, killed two men with his ar-15 style assault rifle. he claimed self-defense. rittenhouse drove in from illinois armed for battle. >> what we know now is that the jury bought the narrative of kyle rittenhouse being a victim. >> the fact that white supremacists roam the halls of congress freely and celebrate this murderous white supremacist and the fact that he gets to walk the streets freely, it led to know these people have access to instituting laws. >> welcome to the modern republican party. this is what these people want. this is what a majority of white people vote for. a majority of white people in favor of this kind of violence. it's because a majority of white people consistently vote republican. it's a warning to every white suburbanite with a black lives matter poster in their window. those people now know that they too can be shot by a white 17-year-old within ar-15 if he feels threatened by their desire to see america live up to its potential. >> trace: let's bring in the host of "media buzz," howard kurtz. it's great to see you. you listen to some channels and he reads newspapers and brett kavanaugh is a gang rapist and kyle rittenhouse has a white ceramicist. they offer no evidence and yet they face very few consequent this. >> listening to these clips, i'm shaking my head. as bad as the coverage was when kyle rittenhouse was being speared and vilified before the verdict in alan dershowitz and emotional yesterday it was the worst coverage he's seen about trial. it's far worse now, you have somebody. you showed msnbc calling him a little murderous white supremacist. a jury found that he is an innocent man. they are clinging to their narrative in the face of lots of evidence presented at trial that led to the acquittal on all counts against kyle rittenhouse. it seems to me a criminal trial is meant to do one thing and one thing only. determine the guilt or the innocence of the person charged. it is not supposed to be a vehicle to send a message. it's not supposed to be part of a broader social justice movement. >> trace: we have some breaking news. sandra. >> sandra: real quickly here is president biden commenting on the parade tragedy in wisconsin. he's also addressing his reappointing of the federal reserve chair jerome powell. we are going to listen. >> we have gone from small businesses being shuttered to a record number of new small businesses starting up. we have gone from devastating job destruction to record new job creation. don't get me wrong. we still have a long way to go. to fully recover from the pain in the destruction caused by the pandemic. we are still dealing with the difficult challenges and complications caused by covid-19. they are driving up costs for american families. i know for a lot of americans, things are still very hard, very hard. if you look at all the facts, all the facts, you can only come to one conclusion. we have made enormous progress in this country. first and foremost, our economy is creating jobs, lots of jobs. in fact we have seen a record new job growth in america this year. 5.6 million jobs just since i was sworn in in january. more jobs created at this point in the new presidency than ever before in american history. we have seen a dramatic drop in the unemployment rate from a high of 14.8% in april of 2020 to 4.6% today. earlier this year, independent experts were predicting it would take until the end of 2023 does the unemployment that low. our economy is crating new businesses, lots of new businesses. americans are starting small businesses at a record rate of 30% compared to before the pandemic. and increases in new businesses one of the best science in a new economy. more dynamic. small businesses are just a heart and soul of america, not just the bedrock of so many a america small businesses are the primary job creators, innovators and drivers the power our economic progress. that's why it's a powerful statement about the faith that we have in our country. small business creation is surging, surging in america today. it's why i am proud to say you look at my presidency so far, it's a jobs presidency. it's a small business presidency. you look at the facts, here's what the record shows. record job creation, record economic growth, record new small business creation. that's the story that should give us confidence about the economy that we are building. confidence in ourselves, confidence in the future. now after years of wages being flat or falling behind, we are also seeing something else. things are getting better for american workers, higher wages, better benefits, more flexible schedules, balance sheets for american families are better as well. savings are up, home equity is up, credit card balances are down. if you continue and combine the wage increases we see with the direct relief my administration has provided for middle-class families. the typical middle-class families disposable income has actually gone up 2% this year even after accounting for higher prices. that's the kind of recovery, just one year after a crippling worldwide economic crisis that's unprecedented. it takes us -- it makes us stand out from the rest of the world. america is the only major economy, the only one of the world where the economy is bigger today and families have more money in their pockets today than before the pandemic hit. that's even after accounting for inflation. none of our competitors can say that. none. it's a testament to the hard work and perseverance of the american people. it's a testament to the effectiveness of the vaccines and our vaccination efforts. it's a testament to the economic policies we have fought so hard to pass and put in place, especially the american rescue plan. it's a testament to the federal reserve. for all the progress we have made we know we still face challenges, serious challenges. we know there's a lot of fear and uncertainty in the country. we know it's tough for families to keep up with rising cost of gasoline. food, housing, other essentials. it's not just an american problem. it's a worldwide problem. doesn't make it easier for americans but it's a worldwide problem. every country is dealing with the same problems emerging from the pandemic. supply chain bottlenecks, disruptions caused by spikes in covid-19. elevated prices. they are all taking a bite out of our family budgets. perhaps no entity pays a more important role -- plays a more important role than the federal reserve. it's the fed's job to achieve maximum employment, to get as many american workers, mayor americans working as possible. the second is to keep inflation low and stable. to meet these goals was going to require patience, skill, and independence. that's why today i am nominating jerome powell for a second term as chair of the federal reserve. i am nominating another person as the vice chair of the federal reserve. when the country was hemorrhaging jobs and there was panic in the financial markets, j's steady and decisive leadership helped stabilize markets and put our economy track to a robust recovery. jay is a believer in what economists call maximum employment. that's an economy where companies have to compete to attract workers instead of workers competing with each other for jobs. american workers get steady wage increases after decades of stagnation. and where the benefits of economic growth are broadly shared by everyone in the country. not just concentrated for those at the top. jay said it well last month and i'm going to quote him. he said and i quote "on the economy healthier and stronger when his many people as possible are able to work. if entrenched inequities prevents americans from purchase meaningfully in our labor markets, not only will they be held from opportunities but the economy overall will not realize its potential. those who have historically been left behind stand the best chance of prospering in a strong economy with plentiful job opportunities." as chair, jay took a landmark review to reverse the federal reserve's mission toward delivering full employment, making strong progress towards that goal now. i believe jay is the right person to cs through. and finish that effort while also addressing the threat of inflation that it poses to our families and economy. jay and i have had a chance to discuss his views on priorities for the federal reserve in the years ahead. he has made clear to me that the top priority will be to accelerate the fed's effort to address and mitigate the risk that climate change poses to our financial system in our economy. extreme weather has cost our economy over $600 billion over the last ten years. we have to make sure our financial system can withstand climate change and is prepared to transition to clean energy. the fed must be a leader among central banks globally in addressing climate related financial risk. he's also underscore the importance of the fed taking a more proactive role in the months and years ahead and making sure that our financial regulations are staying ahead of emerging risk be they from innovations and cryptocurrency or the practice of less regulated nonbank financial institutions. having served as vice president during the depths of the 2009 financial crisis, having worked with president obama to put in place a stronger financial rules of the road. i understand the stakes of regulations, regulators falling asleep at the switch. jay along with the other members of the federal board that i will nominate must ensure that we never get exposed in our economy and american families of those kinds of risks. i respect jay's independence my trustee will follow through on his commitment to prioritize with the skill that he has show. some no doubt question why i am re-nominating j. when he was the choice of a republican predecessor. why am i not picking a democrat, why am i not picking fresh blood. taking the fed in a different direction? put directly, at this moment both enormous potential and enormous uncertainty for our country. we need stability and independence at the federal reserve. jay has proven the independence that i value in the fed chair. the last administration, he stood up to unprecedented political interference and in doing so successfully maintain the integrity and credibility of this institution. it's one of the many reasons why jay has support from across the political spectrum. in 2018 he was confirmed with 84 votes in the united states senate. his approach as fed chair has earned the respect and support of groups from the afl-cio to the business roundtable. which brings me to one more reason i've chosen to renominate jay. i believe having fed leadership with broad bipartisan support is important, especially now that such a politically divided nation. i believe we need to do everything we can to take the bitter partisanship of today's politics out of something as important as the independence and credibility of the federal reserve. this is vital to maintaining public trust and an independent institution like the federal reserve. that's why i am so proud as well to nominate dr. lael brainard. to serve as vice chair of the federal reserve. you know, by promoting lael today as vice chair, i am elevating one of the country's most qualified and dedicated public servants. she is one of the nation's leading macroeconomists. she spent years of the treasury department representing american capitals around the world on international economic issues. she spent nearly the last decade as a member of the fed, most recently working side-by-side with jay as the fed navigated historic economic and financial crisis and reaffirmed his commitment to a full employment economy. throughout her time at the fed, lael has been a steadfast voice for tough rules to protect the investments and savings of the american people. she has led the fed's efforts to make sure the banking system serves everyone in the communities they serve so that regardless of where you live or your background, every american can have access to the credit they need to start a business, buy a home, and have a fair chance in life. she has done pioneering work on how the fence should account for the emerging risk of climate change to our financial system. like today, her expertise in leadership have earned her the respect and support of republicans and democrats alike. i am proud to nominate her to the vital role of vice chair of the federal reserve. beyond jay and lael i look forward to dominating additional members of the federal reserve board of governors including a new vice chair for supervision. they will help safeguard our financial system and along side jay and lael's leadership, help continue this historic economic recovery. while jay and lael bring continuities and stability to the fed, my additions will bring new perspectives and new voices. i also pledge that my additions will bring new diversity to the fed which is much needed and long overdue. last year the pandemic shutdown much of the global economy. there is a worldwide reawakening and its grading both in incredible opportunities and tough challenges. economies all across the world come back from this pandemic. america's leading the way. like every country in the world, we have to deal with these issues of rising costs. we should remember we have the skill and the tools to get it under control. while other countries are stumbling out of this pandemic, we are racing ahead. because so much of the rest of our economy is doing well. because we have created so many new jobs as fast as we have. we're in a position to attack inflation. we are in the position of strength, not weakness. times like these these we need steady, tested, principal leadership of the fed. we need people with sound judgment, proven courage to preserve the independence and we need people of character and integrity who can be trusted to keep the focus on the right long-term goals. i'm confident that jay and lael are those people. i would like to give both jay and lael an opportunity to say a few words and we're going to start with jay and then i'm going to turn to lael. jay, the floor is yours. >> sandra: you have been listening to president biden with his announcement of the renomination of federal reserve chair jay powell. you can see him taking to the microphone. the president calling his way as federal reserve chair with a steady and decisive leader. although prices have spiked, jay powell has called them transitory, as you know. said that they are only temporary. and said that they are factors. inflation is due to factors due to the pandemic. really interesting. as you know, i'm knee-deep in most of this stuff. here the president, after jay powell, through all these price spikes and inflationary concerns that we are all living through, jay powell has not acknowledged them as serious as we are experiencing them. in fact, he has said that what we are seeing should ease on its own. president biden just said we are now in a position to attack inflation. it sort of contradicts what jay powell has said. jay powell by the way has been criticized by many on the left including larry summers who said that the fed has completely missed the inflationary red flags that popped up very early on. even elizabeth warren is not have the with his handling of the economy, calling it a dangerous -- calling him a dangerous man, saying he has water down the banking regulations that were imposed in the wake of the financial crisis. this is happening. he is re-nominating jay powell. they are speaking there from the white house. >> trace: i know that you are very much immersed in this, the whole concept of this is that you're going to have this with your financial panel. we should mention the lael brainard connection. a lot of people thought she might be the top job. he was nominating her to the vice chair of the fed. some controversy there because she is refusing to say on a couple of occasions whether or not she is a capitalist or socialist. that was kind of raising some eyebrows across the country. >> sandra: not a tough question. one or the other. when the president first began speaking, he did acknowledge that massacre in waukesha, wisconsin, yesterday. listen. >> president biden: we don't have all the facts and details yet, we know this morning that five families in waukesha are facing fresh grief of a life without a loved one. at least 40 americans are suffering from injuries, some of them in critical condition. an entire community is struggling, struggling to cope with the horrific act of violence. last night people in waukesha were gathered to celebrate the start of a season of hope and togetherness and thanksgiving. this morning, jill and i and the entire biden family and i'm sure all of us pray that that same spirit is going to embrace and lift up all the victims in this tragedy. bring comfort to those recovering from the injuries and wrapping the families of those who died in the support of their community. we are all grateful to the extra ordinary work of the first responders from law enforcement to the emergency room doctors who are working around-the-clock to deal with the terrible consequences of what happened last night. my administration is monitoring the situation very closely. >> sandra: that was the president a short time ago. fresh off that happening yesterday with the mother who was there with her 12-year-old daughter and nieces that we spoke to at the top the hour. children still fighting for their lives in the hospital. >> trace: 18 children were affected by this. and then you have a whole concept of some of these are in surgery right now. some are critical and three sets of siblings are among the 18 children who are -- >> sandra: you can see on the bottom right portion of the screen, we're going to have a news conference on that parade of horror. top of the hour 2:00 eastern time. we do expect to learn a whole lot more. hopefully a whole lot more about the person of interest. they have not yet named a suspect. we will likely learn a whole lot more that begins at 2:00. >> trace: chocolates. the the prepresident re-nominating jerome powell. someone who's been integral in how we have handled this inflationary supply chain crisis situation. >> i do like the idea that we are returning to the tradition of reappointing chairs who have done a good job and i think on the whole jay powell has done a good job. job going forward will be different. he has inflation as a top economic problem. he is going to have to change forces for the fed i think quickly. accelerating the taper. taking on residual inflation. that's a different job than he's done in the past several years. my hope is that he will change course quickly. >> sandra: jason, do you expect they have the tools they need to fight inflation? are you seeing the white house and the federal reserve acknowledge how serious this problem is. >> jay powell and lael brainard are excellent picks. they continue the bipartisan tradition. that's really important. the same person president trump picked had put into that job four years ago. i agree with doug, they need to prove it. they need to change. you heard some more serious speeches about inflation coming from the fed lately. the sooner the act, the less they'll have to do. if they get too far behind the curve, that's when you have to take dramatic steps. they should try to avoid that. >> sandra: do you have a confidence that's going to happen, douglas? i am reading through some of the twitters fear reaction. i'll give you katie pavlich. "president biden explaining how the federal reserve chapman will address climate change, how about inflation?" he did acknowledge both. i'll give everybody that. shouldn't there be a bigger emphasis on inflation especially as we are about to set our tables for thanksgiving and we have the highest priced thanksgiving ever this year? >> no question. i think chairman powell, number one the white house is looking actively for people to move the focus off them. the first choice, the federal reserve always. the president a few weeks back noted he didn't support the independence of the of the fed to combat inflation. it says these guys because inflation, they need to fix it. i think the fed internally is rethinking what it thought was transitory. we have heard a lot of regional fed board members worrying about inflation. the chairman himself. >> sandra: a little bit of fuzz on your microphone, if you want to address that while i take up this question. miranda devine points out, good fully in the universe is not immune. the cdc just recently updated their data on breakthrough cases involving hospitalizations and deaths. the good news is here about six times as likely that the test positive for covid if you're unvaccinated, you're still 14 times as likely to die from covid if you're on vaccinated compared to those who are vaccinated. so the vaccines are still doing some work. however, the gap is narrowing and that's because multiple studies as well as just real-time data, people are saying, your seymour breakthrough cases. that's because the immunity is waning from vaccines the longer we get out. that's why boosters are being recommended. here's the question, what about all the people who are fully vaccinated and then got a breakthrough infection? should that be considered fully immune or fully vaccinated question of me know that natural immunity from the breakthrough infection likely boosted their immunity. so do they also need to get a booster? it can't be to recap and provide an update. at 4:39 p.m. on sunday, novemben subject intentionally drove his maroon suv through barricades into a crowd of people was celebrating the waukesha christmas parade. it resulted in killing five individuals and injuring 48. additional individuals. i just received information with the two of the 48 our children and their in critical condition. we have information that the subject was involved in a domestic disturbance minutes prior. the suspect left the scene just prior to our arrival. to the domestic disturbance. when the suspect was driving into the crowd, one officer did discharge his firearm and fired shots at the subject to stop the threat. due to the amount of people had to stop and not fire additional shots. officers on administrative leave as part of department protocol. no one was injured as a result of the officer discharging his firearm. the subject was taken into custody a short distance from the scene and we are confident that he acted alone. there is no evidence that this is a terrorist incident. due to the wind yesterday there was a power outage in downtown waukesha that further comp located the response. i want to identify the victims that we know of at this time. i say this with great sorrow. virginia sorenson, 79-year-old female. leanna owens, 71-year-old female. demar durrant, 52-year-old female. jane coolidge, 52-year-old female. wilhelm hosple. the tragic trick of the suspect involved, darrell brooks the suspect of the tragic incident, darrell brooks. counts of homicide, additional charges based on the investigation that will come in time. there are many roads in the downtown area that are close to as investigators work through the crime scene. those roads have since been opened. i will say minutes after the incident occurred, i responded to the scene and what i saw out of the chaos and tragedy was heroes. first responders in the community working together on triaging victims, the fire department, working in partnership with the fire department, getting these victims to the hospital. fire department transported multiple victims. officers picked up victims and put them into squad cars and rush them to the hospital. there was also off-duty law enforcement, fire and ems personnel that were attending this event who immediately got involved in took part in saving lives. i want to thank our community partners. i want to dispel some rumors. there was no pursuance that led up to this incident. this is not a terrorist event. i want to thank our first responder partners. it's a long list and i fire department responded to a mass casualty incident yesterday afternoon. all 26 on-duty personnel responded to the incident from five stations. our closest downtown station was within sight of the parade route. our units started to spontaneously respond based on radio traffic and dispatch information. we immediately activated our mass casualty protocol and utilized the mutual aid system, mutual box alarm system to the second level to provide us with additional resources to treat the victims. we received resources from 12 area fire departments. we were also aided greatly by off-duty firefighters and ems personnel. medical personnel and civilian bystanders. they greatly assisted us with our initial treatment and triaging of patients. patients were transported to six area hospitals with fire department, ems transporting 22 patients. law enforcement personnel, bystanders also transported additional personnel, additional victims to the hospital. at this time we believe 48 people were treated at local hospitals. the number might increase based on information being gathered. like chief thompson, i also had an opportunity, did respond to the incident. got there a little bit after the chief did. based on my observations, very, very overwhelmed by the response of the community to this tragedy. people banded together to do the best they could to deal with this incident. last night going out and visiting the fire stations and the people that responded overwhelmingly our personnel express their sincere thanks for everyone who stepped up and assisted with the treatment of the citizens that were injured. again, our hearts go out to the families and the victims of this senseless tragedy and we appreciate all the assistance and support that's been offered to the city horrific tragedy. we have so much healing that needs to occur. waukesha, though, will not be defined by the horrific events of last night. we are a community that will come together. we will help those who experienced the loss of a loved one or were injured. we will work together to bring healing. that healing needs to begin now. with that in mind, i share the following. our prayer vigil will services. in my role i work closely with our emergency departments, our critical care units and our mass casualty incident command process. i'd like to start by expressing my sympathies and those of everyone at pro health care for the victims and their families. this was truly a tragedy for entire community. i'd like to thank all the first responders and the others who came together to do what was required last night. all involved did outstanding work. among both 48 victims of the parade tragedy who were transported to area hospitals, 29 arrived at waukesha memorial hospital. the hospital is just blocks away from the parade route and victim started arriving very quickly after the incident. in fact many of prohealth care staff were attending the parade and witness to this tragedy and provided immediate first aid to victims. there were many children among the victims brought total waukesha memorial. after our initial assessment, stabilization, and treatment, we transferred 11 of those to children's of wisconsin. four victims were admitted to waukesha memorial. they are all currently stable and many of them will likely discharge from the hospital today. those patients admitted included both children and adults. 12 people were treated in our emergency department and released. one patient presented to us and left without being seen. sadly, one of the victims who was brought to waukesha memorial was pronounced dead on arrival. in addition to those who were on duty at waukesha memorial last night, many others rushed to the hospital to help. they included nearly every one of our emergency department physicians, countless surgeons, anesthesiologists, hospitalists, and nurses. what i saw on display last night in response to this crisis was nothing less than the highest level of professionalism. our coordination with local fire and local ems worked flawlessly in the face of this incident and on behalf of prohealth care, i want to thank everyone for participating. thank you. >> at this time we will open it up for a few questions but the mindful. i will start with you from channel 12. be mindful we are going to be in limited scope with the information we can release due to maintaining the integrity of the investigation. we want to be transparent but we are also mindful that we are not going to compromise in any aspect of this investigation. we are dealing with five counts of intentional first degree homicide. please be mindful of those when you ask questions. >> can you tell us about the arrest. where was he located? was there an incident? was he injured? did he say anything about what led up to it or what happened? >> first of all, five questions in that one question. i'm going to do my best to try to answer that. we can tell you the investigation indicates there i- there isn't any type of national terrorism. there was a incident between the suspect and another individual. at a different location prior to the incident. shortly after this tragedy occurred, officers immediately identify the suspect vehicle and shortly after that they apprehended the suspect. the suspect had no injuries. and after he was detained, he was taken into custody. >> did he say anything -- >> still ongoing. this is a fluid investigation. what we do not want to do is jeopardize the integrity of this investigation at any point. right now our focus, waukesha police departments focus, the city of waukesha's focus is the families, the victims, and due process. that's important. >> reporter: can you elaborate -- >> is this for the chief? go ahead. >> reporter: the domestic situation. [indistinct] >> we have no information that brooks knew anybody in the parade. but i will say this. we weren't able even to respond to that domestic call. we couldn't even investigate it. was there an initial complaint, yes. do we know if there was one, we don't know. we didn't even make it there. we ended up immediately responding to the crisis. this >> reporter: confusion about how this person got through the parade, barricades. can you speak to how he got through? >> i will tell you this. we had a squad and barricades up and he drove right through. then the barricades and the officers. an officer tried to engage and stop the threat, he still continued through the crowd. >> channel 4 next. >> reporter: the names that you mentioned earlier. >> give me a moment. >> i will come to you. go ahead. who is this for? >> reporter: [indistinct] >> the parade route where the vehicle entered was in the area of hartwell and main street. the end of the parade route where the vehicle took off from was around veterans park. main and maple. maine and wisconsin avenue. >> back to 4. >> i'm going to repeat the names. again, i apologize for getting emotional about it. >> actually we're going to put it, i will put the names out on the press release. i will post it on the internet so we get all outlets. your agency and who you would like to speak to. >> reporter: chief, your first responders. many of them were there. [indistinct] >> for lack of a better -- carnage. likening it to a war zone. there were adults, children that were injured. some of our first responders were there with their families. they left their families to treat people, helped with instant command, help transport, along with many other medical personnel and people that were there. i guess what stands out in my mind from our conversations is we have people who have military backgrounds and likened it to a war zone. >> two more questions. your agency and who you would like to question. >> the suspect's previous record, allegations... [indistinct] >> our focus right now. this tragic incident is what we are focused on. the families in the victims of the incident. thank you. >> who would you like to speak to? >> reporter: talk to us about those families who are grieving. >> i will talk about the incident itself and being there. i will give you, as i am watching officers and fire personnel triaging and taking victims, putting them in the ambulance of the squad cars. i have a nurse who walks up to me and says my mother was injured. can we get her help? sure enough, we helped her get her mother into a vehicle when we escorted her, the vehicle out to the scene safely. for the family, i want to ask for respect for the family. it's a tragic incident. again, so fluid. ongoing. >> we're going to stop the questions. we will put a press release out shortly probably within the next 60 minutes that's going to identify the links, it's going to identify some phone numbers that people can reach out to. at this time, we do not have city hall. thank you very much. >> sandra: officials and waukesha, wisconsin. a man driving a vehicle plowed into the parade crowd, killing five people and injuring 48. it was an update for the press conference detailing two children still in hospital in critical condition. the officials describing the investigations as fluid and ongoing, naming the suspect, call him a suspect for the first time that we have heard a person of interest before the press covers, darryl e brooks. police say they will pursue five counts of intentional homicide against the suspect. it was a tragically sad moment. four women ages 52 to 79 and an 81-year-old man. again, children tragically injured in all this, the motive has been the big question. the suspect they said was in a domestic disturbance prior to this happening, just minutes before. was not pursued because it had been first reported. they also said very definitively that they are not calling it a terrorist event. >> trace: they said in a couple times. they couldn't go out and investigate it because they were so busy with the tragedy of the parade. what they did say the first time is you bring up the five counts of intentional homicide. they said this was deliberate. he went through a police barrier at a very high rate of speed and when police tried to stop him he continued on. they didn't talk about if he targeted anybody. they didn't talk about the rate of speed, the distance that he went. we know the numbers of people that were affected by this, you see the video right there. it was a high rate of speed. there was no questions, no talk about if he was actually targeting certain groups or if he was randomly hitting people as he went through. he clearly fled the scene and was arrested a short time later. sandra, i want to bring in if we can form a police commissioner. welcome, commissioner. they were very specific to say this is not terrorism, no connection to terrorism. what would you call it. >> that will be the subject of the police investigation going on. their motivation of this is central to what the suspect was thinking when he did what he did. there was an incident that occurred beforehand. maybe he was infuriated by it. maybe there are other mitigating factors. the police are going to have to look at why he was where he was just before this incident happen. they are going to have to look at statements of these made in the past. these other incidents that are extremely troubling. the three incidents that occurred, one involving a motor vehicle, it's an indicator this was going to happen again. the d.a.'s office has a lot to explain. finally they look at mitigating factors like drugs and alcohol on board to see if there are other things that play into it. it's terrible tragedy for the community in my heart goes out to everybody victimized by this. >> sandra: it's gotten many of us when we heard the mayor of that small town america, waukesha, wisconsin, describe what has been a tradition, the parade for six decades. said that it's a scene out of a norman rockwell painting anything about the horror for the families. we spoke to one of them at the top of the last hour. when i saw this approaching, some said they thought it was part of the parade until the vehicle rammed over men, women, children. i just think we see it here as we digest more new details on this, you've got what motives we don't know about. what more we are going to learn about the suspect. he was just freed on bail three days prior to this happening. one has to also ask what he was doing and was able to carry out this horrible crime. >> it's remarkable to the district attorney's office has said that he should event held on higher bail. it's of the early stages of this. it's clearly a problem. what he was thinking when the incident happened is going to be central to this. you look at the raw video footage of him not only mowing down been driving over people. all he had to do was stop that car, just stop doing what he was doing. the intent to murder was clearly there after he had the first person. this is a very serious case. this guy should have been separated from society. we learned in the 90s that these individuals who commit violent crimes, the only way to stop further victimization is to lock them up. unfortunately the das offices around the country are acting as if no one should go to jail in some cases. so they have to look closely at what happened here and make sure the innocent people don't suffer because of these new theories. >> trace: you make a good point. a lot of these left-wing das are against putting people in jail and in prison. we have examples, not on this scale but we have several examples around the country of these types of things happening, people who should be in jail creating chaos. do you feel like this might swing the pendulum a little bit in the other direction? >> it certainly is a cautionary tale for those who think everybody should be let out of jail. we learn these lessons in the past. we are relearning them tragically through further victimization. we need to stop this. we need to rethink what we are doing, separate those individuals who prey on other individuals with violence. i understand there's tumult of people in jail. let's reduce the numbers. minimum mandatory drug sentences, i get that. people who are like this guy who are hurting people over and over again, you've got to separate them. >> sandra: real quick last question, the suspect fleeing the scene, as you heard the police chief describing. he also detailed how one officer did fire a gun but had to stop due to the sheer number of people, the crowds at the parade made it very difficult to try to approach the suspect, driving its glee as he was. those kinds of things. 26 on-duty police officers arrived at the scene, everyone on-duty. what is it like to decide whether or not the police on the scene can do more to stop that suspect while also balancing the risk of having a very large crowd on the streets around them? >> there's two things to think about. one is that a bullet doesn't necessarily stop a speeding car so police know that and they think about that in a situation like that. no one in this environment right now wants to fire too many shots because a shot can go wild and inter-someone. a police officer is always looking at the backdrop to where the suspect is. and that's really motivating factor. thankfully no one else was injured. no one, no police officer right now wants to use fatal force unless it's absolutely necessary. in this particular case, the circumstances didn't allow that to happen. >> trace: what is standard operating procedure? that's the question. as this truck is going town, the video was horrifying to watch. you have police officers in and around the area. what in your estimation should be or is the standard operating procedure. you try to go after tires? there's a lot of people but what do you do in that scenario to get this person to slow down? >> your responsibilities to use your firearm to stop the assault. you can use fatal force against an individual who is killing, whose immediate threat to your life for the my five other individuals. the officers could have shot into the windshield to kill the suspect as he was driving down but the attendant issues with that, bullets bouncing off cars into a crowded field of people, you need to be very, very careful when you use that type of force. in this particular case, my heart goes out officer. he saw an opportunity. he got one round off safely. then he stopped. hopefully it affected the suspect to the point where he left. i don't know exactly what happened here. clearly police can use fatal force in an assault like this. >> sandra: former boston police commissioner, we appreciate you joining us. the police chief just detailed, the mayor detailed, the community has a lot of healing to do. they are meant to be holding a prayer vigil tonight. commissioner, thank you. matt finn is on the ground live in waukesha. it's going to take some time for that community to deal and process with what just happened. >> right behind me was the parade route yesterday. to set the scene for you in downtown waukesha, it really is a classic all-american town main street usa, charming shop and cafes, well manicured and prepared for the holidays. hard to wrap your mind around what just happened here. i walked up the sidewalk in one of the sidewalks is -- it still has red stains on it. i want to focus. a short while ago we got an update from the wisconsin children's hospital. they said this afternoon 18 children in total were taken to the hospital ages three to 16 after the parade incident here yesterday. three patients are still in serious condition and the remaining patients children are considered fair. just imagine three days before thanksgiving right now, at least six patients, six children are in a hospital cleaning for their life. >> three sets of siblings that are currently hospitalized. this is a unique and it truly demonstrates a devastating effect of this on our community. >> we now know that the suspect is potentially going to be charged with multiple counts of intentional homicide, according to a police update. the man in question, darryl e brooks jr. has a criminal history dating back to 1999. most recently he was in court on november 5th and he was bailed out on $1,000 last friday. one eyewitness who was here yesterday describes what she saw as brooks drove through the crowd. >> nothing to make sense of. the car didn't stop. he went completely to the end of the block. he kind of turned to the left and that's when i saw him go. i can see the whole street. he went completely to the end without stopping. >> there's the visual here in downtown. we'll keep you updated. >> sandra: we will continue to listen to the new details. the investigation is ongoing. >> trace: continuing coverage of america's crime crisis. police dealing with retail thefts on a scale like they have never seen before. the bay area is the latest city hit by a flash mob of criminals. dozens of thieves targeting a nordstrom and walnut creek, california a day after a group of thieves targeted a louis vuitton store. some cities that pushed defined police like seattle now facing a reckoning. voters shot that message down but progressives are not giving up. still pledging to slash the police budget. in the nation's capital, homicide hit a 16 year high better programs that took curb gun crimes being shot down over concerns that it was targeting minority neighborhoods. in new york city, the father of a man killed in a senseless act of violence is now speaking out, pleading with city officials to not let his son's death be in vain. we have team fox coverage. david spunt, david springer. claudia cowan is just outside san francisco and walnut creek, california. >> you can only imagine how terrifying it must've been for customers and employees when a gang of 80 people wearing masks stormed in and ransacked this nordstrom, some carrying crowbars, others with pepper spray. cell phone video shows dozens of people flooding into the street after the robbery happened on saturday night with as much merchandise as they could carry, jumping into a line of cars waiting at the curb and then speeding off. police say three people were arrested including a suspect with a gun. at least two employees were assaulted. the looting here coming a day after gangs of shoplifters hit a dozen stores in san francisco including louis vuitton, bloomingdale's and burberry, stealing a million dollars worth of clothing, jewelry, handbags and other goods that thieves know will sell fast online. police were on site in minutes. they managed to stop at least one of the getaway cars and arrest eight people. he also seized several firearms. >> their plan was to overwhelm us. their plan, hoping we wouldn't be here but we were. some of them think they got away with it but i have confidence. i am confident there will be more arrests to follow. >> organized retail crime in san francisco has only gotten worse despite viral videos and recent closures of cvs and walgreens stores were brazen shoplifting is a daily occurrence. critics say nothing will change without a vigorous prosecution and the repeal of the state law that classifies theft of under $950 as a misdemeanor. in just the last 24 hours, police reporting to more large-scale looting incidents in the bay area. all of these attacks carefully coordinated so that all of the stolen goods can be resold online in time for black friday at far less than retail prices. >> trace: claudia cowan live in the bay area. thank you. >> sandra: now to seattle where voters delivered a clear mandate in citywide elections. progressives are still trying to cut the police budget. dan springer following the story from the streets of seattle. >> hi, sandra. these are the current city council members. either they didn't hear what voters said or they didn't care. the vote to defund the seattle police department is set for later today but last week four members of the city council voted to eliminate 101 positions from the police force. this comes just after the voters overwhelmingly rejected three of the four citywide candidates who supported defunding police and allowing homeless tends to remain in city parks and sidewalks. the winners were more centrist, the first republican elected in seattle in 34 years. violent crime including murders have been spiking for two years, shootings are at an all-time high end drug use especially in downtown seattle is out in the open. business leaders say there's a mandate for enforcing the laws but progressives say not so fast. they are still calling for fewer police than activists vowed to try to block the removal of homeless from city parks and another big test comes on december 2 -- december 7, excuse me. people in the third district here in seattle will vote whether to recall one of the council members, one of the two council members who was a socialist, on that council. back to you, sandra. >> david spunt's life for us at the justice department. >> good afternoon. d.c. is a huge tourist destination. mayor muriel browser wants to stop crime, not just for tourists but for people who live and work of the nation's capital. she says we are throwing every resource at the rise in violent crime d.c. we will keep pushing on all fronts until we see positive results. two and half years ago, then attorney general stood alongside bowser hoping to curb gun violence. moving pieces from superior court to federal court but now the current u.s. attorney, channing phillips, has the program under review. concerned about its future. d.c. district attorney karl racine reportedly wants to keep gun cases in local courts and districts arguing that the program disproportionately affects african-americans. >> i find that unacceptable as an excuse. i think law-abiding citizens in the black community clearly would like to do anything to eradicate guns from the streets. >> there is a private frustration among some of those who work for the u.s. attorney's office and department of justice. several telling fox news they asked not to be named but they feel frustrated this program is slowing down. the d.c. police chief said to be in favor of the program. muriel bowser saying she's happy courts are open and covid is slowly fading and that's helping crime. she's putting more money into the program. >> trace: david spunt, thank you. >> sandra: the father of the new york city crime victim pleading with city officials to fight violent crime. his son ethan williams was killed by a stray bullet last year. ethan's dream trip to the big apple before tragedy struck. his killer has not been caught. his father writing that the city must do more to protect innocent children like it is. ethan's father joins us now. thank you for coming on the program, sir. we are extremely sorry for your loss. >> thank you. it's a huge honor to be here today. thank you for allowing me to come and talk about my son. >> sandra: what is it that you want to share about that and what's your message to a city that continues to deal with this. >> one thing that i need to say out of the gate is the initial narrative that came out about my son who was sitting on the stoop of the airbnb he and his friends had rented. a stray bullet. making it seem as if it was a random event when in fact he was ambushed. a gunman walked up to them and fired six bullets towards them. the boys ran into the house, check each other, make sure that they were okay and someone said where is ethan? ethan never got off the step. it was not a stray bullet. that narrative needs to be corrected. i understand that there are politics involved in all of this. at the end of the day, my son was ambushed and murdered. it could have been way worse. he could have been his friends as well. >> sandra: showing pictures of your son, your family. she's a beautiful boy. so sad. he's a beautiful boy. so sad for your family. hard for any parent to imagine this. you feel compelled to put this message out there because you see such a urgency. this could be anyone's child that this happens too. and you penned this in "the new york post," save our sons saint don't let the shooting death of my innocent child be in vain. you are pleading in which you say do something. seeing eric adams elected mayor, we are encouraged to learn the people of new york have prioritized attacking the city's crime problem. it's too late to save our child. perhaps it's not too late to save your own. all it takes is for someone to do something. what is it that you are urging the city to do. >> we are encouraging that the city spoke up by voting for eric adams. pledging to be tough on crime. the mayor elect, former cop. he's talked about the need for reforms but not of the expense of protecting innocent civilians. i heard in your previous segment about how many individuals are mosquito for domestic abuse and released back into the streets to go on to commit murder. the pretrial freedom that allowed -- that a lot of these criminals have had is not ending well for people. we want reform to happen. we understand systemically that there are things going back to the educational system. i am an educator myself. then we can do on the front and to help curb some of this. when someone chooses to create a violent act against an innocent person going about their daily business whether they are tourists or just regular new yorkers. the city needs to crack down. eric adams has said he's not interested in defunding the police that he wants to keep people safe and we are pleased to hear that. i have learned too much about new york in the last year and how the justice system works. the d.a.'s office has been great. they often feel i think as if there may be downstream from the policy and public opinion. i will be honest, the people that i have spoken with, they want to do their jobs. they want criminals off the streets. they need the truth. they need the truth. they need to know that there is a way to handle crime. it's been done before. it may seem unsavory to certain groups within the city to say maybe we need to detain some violent criminals until trial versus bailing them out early. i don't know exactly was going to happen with ethan's case. he is still an open investigation. we still have words. we would like to have words with airbnb. they refused to accept any responsibility for her death on their property. we have several news publications still running the stray bullet story. i am thankful to nicole at the manhattan institute and "the new york post" forgetting our story out there and letting us pick this up. one of the things that frustrates me as well as a parent and my wife and ethan siblings, there are a lot of stories that focus on the initial shock and horror of all, this is terrible. look at what's happened to this person. what does lincoln followed up on is the pain in the suffering that we have to deal with. he has two siblings. my wife and i were high school sweethearts and all we ever wanted to be were parents. ethan was a fantastic kid. he served on the mayor's youth leadership council of indianapolis as a high schooler. one of his areas of interest, he was troubled by poverty and violence and homelessness and wanted to help people. went to college, he became very interested in these sorts of things and wanted to know more about how people and their stories and so to lose someone like him who would have been an advocate for people, it's devastating. we are without a son. his girlfriend of six years, medical student, is without possibly a future husband and a lot is stolen from these families in the subsequent months following the crimes. the focuses is on the event and not what happens next, the public and forget there's a lot of pain right now. a lot of pain. >> sandra: you're trying to give his voice. we appreciate you. so sorry for your loss and all the family is going through. >> thank you. again, it was a huge honor to be here to talk about this. thank you for having me. >> sandra: we remember ethan. thank you. tough story. mccue. ethan, to his father's point, he had so much life left to live in so much good to do when he's gone way too soon. >> trace: a very strong man. coming on and fighting for his son's memory. noble thing to do. we have breaking news. we have talked about darrell e. brooks, the suspect facing five counts of intentional homicide with the vehicle in waukesha. professor jonathan turley. i want to point this out quickly. we have just confirmed that he was out of jail after apparently deliberately trying to run down the mother of his child. the report says "eap, an acronym to talk about the victim, the alleged victim, refused to get into the vehicle and brooks intentionally and without consent struck eap and the feast with a close to fist. eap walked away from brooks. eap reported that brooks then intentionally and without consent ran eap over with his vehicle while eap was walking through the parking lot of a bp gas station." that is the man they are, darrell e brooks who mowed down dozens of people in waukesha, wisconsin, yesterday. allegedly. again, let's bring in professor jonathan turley. when you hear this, professor, we just talked to a police chief who said this has got to stop. when you hear that he was actually in jail and released for trying to mow down the mother of his child. what do you think? >> this is really considerable disconnect with what a bail hearing is supposed to address. this type of crime, if these allegations are true, represents a real depraved mind. it represents somebody who was out of control. you can't just treat this as some type of vehicular accident. this was according to the victim and the alleged effort to kill her and almost could have succeeded. $1,000 in bail isn't -- doesn't hardly capture the gravity of that offense. the concern that we are seen across the country, movement against imposing bail, you just heard from mr. williams whose son was lost in new york. new york has been one of the leading jurisdictions. they are getting rid avail, forcing the release of individuals, there is even an effort to prevent judges from seeing prior criminal conduct in some cases and making decisions on bail. so all of that is raising real concerns. when you look at someone like brooks, you just are left with this baffling inexplicable result. if this is reported as true, the judge was looking at someone who tried to kill a person using his car. clearly unstable. to say just come up with $1,000 and you can literally drive away is not going to sit well with most of the public. one of the things that's going to come out of this, as a criminal defense attorney, whether he will allege some type of mental deficiency. the insanity defense is often overplayed. it's more difficult for people in bringing. that may be his only course of response. the problem from his lawyer's perspective is that he clearly intended proceed to more people down, according to these reports. he went through a police barricade. that alone shows an intent that then continued on with running over a large number of people. he could have stopped at any point. we have seen some cases involving elderly who hit the wrong pedal. but they come to a terrible conclusion. they tend to stop. this is not that case. it shows somebody who seems totally unhinged but also intent on maximizing casualties if these reports are true. >> sandra: to that point, you heard, this is sandra here, to that point when the police were detailing how he came through and how he started ramming that crowd, there was no slow down in his speed. clearly seeing people in front of him. they plan to pursue, the detailed it in the news conference, five counts of intentional first-degree homicide. jonathan, question that we were having all morning, knowing everything that we knew about the suspect which we can now say, why was he a person of interest as long as he was and why were police not naming him as a suspect earlier than 2:00 eastern time? >> yeah, that baffled me. i don't know -- the status of a person of interest is a relatively recent vintage. it seems to cover a wide variety of people. it would not seem to cover somebody who you pull out of a car that just ran over a large number of people. you can at least elevate that to a suspect. the key is that once he crashed through the barrier, he crashed through the intent element of homicide. because when you crashed through a barrier like that and you continue, you're clearly intending to proceed with what carnage followed. so i have no idea why they are referring to him as a person of interest. but he was clearly a suspect as soonest he went through the barrier. >> trace: professor, i want to keep going if i can. i want to bring up this arrest report again. for the crime of allegedly going after his girlfriend, trying to run over his girlfriend. it continues saying that after that incident, officers observed brooks exiting the driver's seat, officers gave lawful commands to stop and brooks walked away. officers commanded brooks not to enter the residence. brooks quickly ran into the residence and close four doors on officers as officers were behind him and try to approach them. it ends officers observed the alleged victim with swelling on her lip and tire tracks on her left pants leg. not only attempt at murder but he went after police, slammed the door and police, you would think as you said earlier, 1,000 bucks wouldn't cut it. >> i don't see how i judge could have possibly read that report and suggested that this was someone i can safely release on bail. even if half of that is true, this is someone who is clearly unhinged, someone who was clearly a danger to others. he is not even limited in being able to drive. you didn't just give him bail. you effectively give him keys to his car. >> sandra: as far as a motive is concerned, because that was the other big question all morning, because it seemed that they ruled out this not being a terrorist event clearly on, they reiterated that at the top of the hour. they don't believe it's a terrorist event. some type of disturbance is what they said. they also confirmed they believe he was not pursued before this premade rampage. but they did say he was in a domestic disturbance just minutes before. so we are left wondering where they go with this investigation next. i don't know about you, jonathan, how long you think it's going to take before we know about emotive. >> i think at this point the option for the defense quickly whittled down within seconds of his breaking through that barrier. intent is going to be very easy for the prosecution to establish on the facts. the question is his mental state. but often states look at whether the person could judge right from wrong. some states allow irresistible impulse. that's been abandoned by many states. it's very hard to make that standard work. it seems to me that capacity hearing is likely to be in his future. i think a judge is very likely to have him analyze as to his mental capacity. >> sandra: all right, jonathan turley. appreciate you joining us. thank you. >> trace: thank you so much. i think the important thing is when the professor talks about this, it's not just this pattern across the country of living violent people out and not having them post any bail. it's the content here where not only was he let out and put back on the street but the judge for some reason decided to give him back his khakis and allow him to drive after allegedly using -- giving him back his khakis and allowing him to drive after allegedly using the vehicle to run over the mother of his child. >> sandra: as we begin this holiday week, sadly to start off the story. great to be
