>> bret: peter doocy live on the north lauren. thanks. we now a little more about president biden's massive social spending and tax plan. we have just received in the past few minutes the final cost estimated from the congressional budget office. the cbo. the congressional correspondent chad pergram tells us where things stand tonight. good evening, chad, what do the cbo numbers tell us? >> good evening, bret. the cbo says the bill will adds 367 billion to the deficit over a decade. they will make up revenue catching tax cheats. those figures are crucial. members can use the evaluation as a fig leaf to vote yes or justify a nay vote. the house is expected to vote on the bill later tonight. those numbers are important to unlock the votes to pass the bill. nod democrat democrats held out for analysis from the cbo. >> we are taking into account the cbo's score before we vote on any bill regardless of the size. and so when we are looking at a bill that's likely to be close to $2 trillion, it's responsible thing to get the best nonpartisan estimate we can. >> there have been efforts by some democrats to dismiss the cbo's score. of the numbers don't lie. >> the cbo has a political agenda. it builds its estimates not on what it thinks the truth is but what the research literature says is the consensus. >> the g.o.p. says some of the cbo figures are cbo oh no. >> i can't help but wonder what my so-called moderate colleagues on the other side of the aisle are waiting for with baited breath for a cbo score. you don't need a cbo score to know that $500 billion of unicorn climate agenda energy policies are going to drive up heating costs, drive up the cost of gasoline and cripple our economy. >> republicans say democrats misjudge the economy and president biden and democrats are overplaying their electoral mandate. they have narrow congressional majorities. but democrats believe they were too timid in responsing to the financial crisis of 2008. some wanted bolder action. democrats are now processing these numbers. a vote could come late tonight, bret. >> bret: you know, chad, it says that the cbo thinks the irs will get 127 billion from tax cheats. the administration had said that number was 400 billion. there is a difference there. this is kind of the easy part on the house side. the senate has a ton of work ahead it seems like a different game over there. >> yeah, absolutely. senate majority leader chuck schumer clear calendars promised a vote for christmas. look for joe manchin ton try to address inflation in this bill. they probably cut family leave. an altered senate bill goes back to the house, maybe, in january. we could be two months away from final passage of this bill. bret? >> bret: okay. we will follow it all. chad, thank you. we are still waiting for a verdict in the trial of the illinois teenager accused of murdering two people injuring a third at a protest in kenosha, wisconsin during the summer of 2020. the judge in the kyle rittenhouse trial has dismissed the jurors for the day. day that saw another major announcement from the judge. correspondent garrett tenney is live in kenosha with the latest. good evening, garrett. >> bret, good evening to you. after day three of deliberations, the jury has still not reached a decision but we now know that when they do, one cable news network will not be in the courtroom to hear it. today judge bruce schroeder banned msnbc from the courtroom for the rest of the trial. last night kenosha police detained a freelance producer for msnbc who they believe was following the jury's bus to take according to the judge when officers pulled the producer over, he told them he had been instructed by supervisor in new york to follow the bus. with blacked out windows that's been carrying the jury to and from the courthouse every day of the trial. that case is now under investigation. >> i have instructed that no one from msnbc news will be permitted in this building for the duration of this trial. this is a very serious matter and i don't know what the ultimate truth of it is. >> msnbc news issued a statement saying while the traffic violation took place near the jury van the freelancer never contacted or intended to contact the jurors during deliberations never photographed or intended to photograph them. we regret the incident and will fully cooperate with the authorities on any investigation. the jury has not been sequestered at any point during this trial and even after this latest incident, there no indication that plan is going to change going forward. after nearly 23 hours of deliberation, now, there is also no indication when this jury might reach a verdict as kenosha continues to brace for that decision. bret? >> bret: we will follow it garrett, thank you. meantime another trial, the defense has rested in the trial of three white men accused of murdering a black man in southern georgia. today the man who shot ahmed arbery conceded the victory did not threaten him in any way when they first met correspondent steve harrigan is live in brunswick, georgia, good evening, steve. >> good evening, bret. sundayenly this trial is moving quickly today was travis mcmichael cross-examination under the stand. the prosecutor really trying to undercut the idea that michael might have painted in self-defense. she'll painted a portrait on the one side you a ahmad arbery 25 years old running shorts and shirt empty-handed by no backpack by no accounts never threatened anyone, never brandished a weapon. on the other side two trucks. one pickup truck rammed arbery at least four times according to the police report and the other truck mcmichael father and son. father standing in the back with a pistol shouting cut him off. son driving with a shotgun. the prosecutor painted a picture of a man being hunted. here's that exchange. >> so you are telling this jury that a man who has spent five minutes running away from you, you are now thinking is somehow going to want to continue to engage with you, someone with a shotgun, and your father, a man who has just said stop or i will blow your [bleep] head off by trying to get in their truck? >> that's what it shows, yes, ma'am. >> cell phone video of the final moments was also used to try and reconstruct what exactly happened. the prosecutor saying arbery had a chance to try to run away, tried to use that chance instead those pickup trucks pinned him. in also mcmichaels social media accounts have been brought to light. the prosecutor trying to show that he is a potentially violent vigilante from some of those posts. here's that exchange. >> he said we have had a lot of trouble with thieves. it just worries me because my daddy is slap old crazy, lol. is he old as dirt and doesn't care about jail you responded that's what this world needs more of. my old man is the same way. >> did i say that yes, ma'am. >> says have to make an example out of somebody. you said that's right. i hope you all catch the vermont, correct? 3 million personnel across 2,000 hospitals. it found the highest rate of worker vaccination in children's hospitals the lowest in critical access facilities. our just released fox news poll shows 5% economy right there in the middle approval 36%. these numbers have to worry the white house. democrats heading into obviously an election year next year. let's bring in our panel byron york chief rules and donald trump did it the way he wants. to say. >> and they have had to clean up a little bit some of what the president said. >> they often have to clean up after him. but i don't know if having a press conference would make that any different. he has had one. he should have more. look, the press corps wants him to do more. he is going to decide what he wants. i don't think the american people really care one way or the other. >> bret: what about those numbers? >> the numbers are just terrible. what's interesting is i don't know whether people have just soured.if you don't like what ty is doing of course you don't like what he is doing on the economy or covid you will not separate those things out. the specific items of a president's agenda are only as popular as he is. but, it's bad. and democrats think they can turn it around by passing their agenda and by selling it to people. we're going to see if that happens or not. >> bret: yeah, byron, speaking of that, we will have a vote probably in the house late tonight on the build back better or the reconciliation bill. however you want to call it the cbo saying that it is going to add to the deficit if they calculate the irs is not going to be able to get tax cheats at 400 billion. but it might add some 300 plus billion to the deficit. so it would cost something potentially. >> it is odd for a bill that was not supposed to cost anything. but, you know, as far as this vote tonight or tomorrow is concerned, the public has had a chance to digest the bipartisan infrastructure bill that has been passed and been signed and that really hasn't made any difference in the president's ratings. the ratings reflect his job approval ratings reflect the substance of what he is doing on these issues. they don't like what he is doing on the border. they don't like inflation. they thought coronavirus should be over by now but it's not. so, all of these issues, very important issues, coronavirus being the one he really got elected for. the public is unhappy with what's going on. this is not a communications problem. this is a substance problem for the white house. >> bret: should point out the overall approval number is 44 in our poll. other polls have had 36, 37 as well. so there is the overall approval. when you look at the vice president's approval rating, we have that at 40% and you can see it will say for kamala harris. the kamala harris problem is not a kamala harris problem. it's a joe biden problem. they are looking at this, you know, the things that joe biden can count as an achievement, passing his infrastructure bill or the covid -- those are washington achievements. people want to see improvements in their own lives. and i think what they see is not just the president going in the wrong direction, but looking incredibly incompetent. certainly that's what we saw in afghanistan first they dismissed inflation. everybody in the administration telling us not something they should be worried about. they didn't predict it would be here at this level today. i think it's very hard to come up with an achievement. a concrete achievement that joe biden can point to and say because of this, americans are better off. as byron said covid is still raging. i believe more people died this year than last year. there are a lot of things he led us to believe that he was going to fix that he was the solution and i think a lot of people are just concluding a lot of people jimmy carter the job too big. >> bret: on the list of issues under water. the second one from the interesting. joe biden said today he was open to an diplomatic boycott which is kind of half a loaf. it means athletes can still go but there would be a kind of symbolic boycott from the united states government. >> bret: how does that work sim doll bowl lick boycott of the olympics. >> it doesn't work. i think it was stunning to learn that in a three and a half hour conversation the president did not wring up with president xi stonewalling on the origin of covid. and what we are hearing today with the meetings of the leaders of canada and mexico as far as mexico is concerned the president didn't bring up the remain in mexico issue. the white house said well it's under litigation we can't talk about it. the most important factor, really in this -- the flow of illegal immigrants across the border is biden's rescission of the remain in mexico program. it doesn't even come up. so, you wonder whether the president is really on the mark on some of these issues. >> bret: i mentioned earlier, bill, that the white house has had to have a bit of a clean-unjust in the past few days about some of the things president biden has said. now, the decision not to have a press conference. the canadian prime minister had his own press conference. what do you make about this? you have been inside white houses. >> well, look, it's because joe biden leaves a lot of question marks on things. you know, on china you can't just solve this by having dialogue. if you don't convey a message i don't know what the purpose is. i think it's very unclear what joe biden's china policy is. it's very difficult. i think he took a good step on the submarines and the deal with australia and so forth. but there is a lot left to do. and right now i would say for me the key test of a policy is does it strengthen our friends in the region like australia and taiwan whom china is trying to bulling or does it weaken them. the first thing we have to do is keep our friends, keep them secure. keep them safe safe, and keep them strong. >> bret: bill, if you are in this white house now are you saying yes, let's have this press conference or are you saying this president is not good at that format and not good in articulating in that way and don't have it? >> yeah. as a person that wrote speeches for president, i don't really believe communication is ever the problem. i always belief that behind the communications problem is the substance problem. what he needs is a clear policy and one that's going to work. >> bret: last thing quickly, mara, if they pass this in the house, the build back better, they have a long way to go in the senate. >> they have a long way to go. progressives failed to get the kind of commitment they wanted from rend joe manchin he still has the whip hand in
