on capitol hill. nancy pelosi experts votes on the infrastructure bill and the social spending bill. pelosi can only lose three votes on her side. >> you cannot underestimate how difficult that makes your maneuvering ability in leadership. that say, this is one of the most difficult situations she's ever been in. >> as we say, it's about the math. democrat scott peters voted against the social spending bill in committee over the weekend. some liberals are threatening to vote no. at least ten republicans will vote in favor of infrastructure. >> all this bill does in a bipartisan way, i don't believe anyone, any faction of the democratic party will vote against the key legislative party that is good for the country. >> there's one estimate the social spending bill will cost $5 trillion. the price tag could shrink to court the votes of joe manchin. >> spoker pelosi didn't want to talk about the numbers saying it's paid for. it's paid for by putting a debt on the next generation of americans. that's how it's paid for. >> there's a test vote at 5:30 eastern time on the debt celling. charles? >> now to aishah hasnie on what is in the bill. i'm not sure we want to know. >> charles, there's never been a bill like this in the history of our country. we still don't know the parts of it. right now based on the parts that have been revealed, it's chocked full of progressive wish lists, items that they want to see come to fruition. let's take a look at them together. $79 billion with a b goes to the irs. it goes to strengthen tax enforcement, this is how they're going to pay for the entire thing. $12 billion for electric christmas for federal employees. $3 bill for tree equity. 4 billion for schools, $25 million for bias training. a lot of things have not been priced out. medicare and medicaid, big ticket items likely to cost $300 billion each. the likely hold if this whole thing will exceed that $3.5 trillion price tag. it's not going to go over well with moderates. on top of that, today's deadline for a vote on infrastructure has been delayed and progressives want something iron clad on this spending bill before they're ready to move forward. it's not looking great. speaker pelosi thinks she can make progress as critics weigh-in. >> what i'm watching i think is the transition from the donkey to the lemming. she's move from twisting arms to breaking them. i think she's on the edge now of kneecapping people. but she's getting them inch by inch to go where she wants them to go. >> charles, the pressure is on the house democratic caucus. it will be meeting tonight and tomorrow in the white house as the president is going to try to meet with democrats tonight. charles? >> thanks so much. i might start identifying with a tree with those kind of numbers. democrats insist it's going to be paid for. indiana republican senator mike braun telling neil cavuto that all of this massive spending is nothing more than an inflation bomb. take a listen. >> orchestrated by one party and it's at a magnitude much larger. it's a debt bomb that will go off and we're seeing it already. >> here to discuss, lee carter, market watcher larry glazer and laura fink. lee, let's start with you. in june of 2010 in a poll, terrorism most people said, 40% thought it was the most serious problem in this country. followed by inflation. same score. 40%, 39% said it was very serious. gallup says that number is around 1%. i feel like republicans might have overplayed their hand when obama was in office and nobody cares anymore. >> well, i think the bottom line when it comes to inflation, the more around more people will be concerned about it. 70% of americans are saying they're feeling the impact of inflation right now. yes, infrastructure is wildly popular when you talk about it. the impacts of it will be real and felt very, very quickly. the short term impacts of a infrastructure plan have going to be something that is going to be felt on the inflation in all of our pocket books. think about what will happen. you're trying to build roads. there's more traffic. what will happen as a result of more traffic? going to increase the cost of getting things. going to slow down production times. we're already at an issue. so it's an increasablely important issue and we know 2/3s of voters are concerned about inflation. we know they're not sure that spending our way out of it is not the right thing the all eyes are on this. the more people feel it in their pocket books is the harder it will be for the democrats to sell this to the american people. >> no doubt. on the inflation side, women you 1,000%. i'm not so sure people are looking at the government debt. before $6 trillion, $10 trillion, 13 trillion. now you say 28 trillion, people don't bat an eye. i guess that is what president biden and nancy pelosi think they have going for them on this, right? >> well, the american jobs plan is going to grow the economy. so we know that by investing in americans and growing that middle class, that is what will help our economy soar over the long-term. there's in argument from anyone that examines the roads and bridges, broad band, any experts say we don't need to improve it to be a strengthened global economy. these are long-term investments, not short term. discussing them in terms of inflation if you talk to any economist doesn't make sense. we saw the consumer price index cool in the hot month of august. it's clear these are short term problems as articulated by jerome powell and others. inflation is cooling down. we need that infrastructure bill to help consumers out more. it's child car, help with prescription drugs costs. bottom-line things that americans need so their pocket books go to what they want and not the drug companies. >> it's one thing to cool from 500 degrees to 498 degrees. it cold but as inflation is running away, people are feeling it and it will have dire consequences. every time the president says he's going to pay for it, they never talk about a yielding growth. they talk about it by confiscating wealth from other americans. that's not the growth that makes us the greatest country in the world, is it? >> charles, in the words of ronald reagan those that think that a tookes boost can be paid for have another anything coming. paid for monies different things to different people. the middle class is paying for these increased costs. they're paying for it in rising food, rising rent. 0 for 3. the middle class is at risk of striking out here, this idea that it's an inconvenient truth to think that you can spend $3.5 trillion of additional spending and have it be paid for because it's already paid for on the backs of a regressive tax for middle class families. it will be paid for generations by my children's children. we see this relationship. the middle class is very smart. they know every time they go by the corner gas station, they see the rises prices. they get a paid in their stomach. the sentiment factor is coming down all summer. it's going to spill over. washington better take notice. mid-terms are coming. if you vote the wrong way, it will haunt you. >> the gift that keeps giving but for the wrong reasons. larry brought up a great point. a lot of politicians that went along with president obama and obamacare fell on their sword. they sacrificed their political careers. what is the feeling in d.c. that anyone that goes along with this probably many of them will probably lose in these mid-terms? >> the infrastructure plan at the moment is still popular. the problem -- >> i'm not talking about infrastructure. i'm talking about the social spending, really $5.5 trillion. >> i think that what we're going to see is that what is happening in the president's polling right now is that he's having a significant drop. it's not because of afghanistan. if you look at his polling on covid, polling on the economy, it's really starting to shift. over the next year, if this starts to pass and we start to see rising inflation and see slowing of goods, see some of these things that will continue to impact the american people, it's going to make it more and more difficult for democrats to win a seat, to keep the seats that they have. it's more likely that republicans will offer an alternative plan that will be more popular. >> lee, laura and larry. >> i agree that infrastructure is popular. why don't we vote on the infrastructure plan if it's so popular? bottom line. that's what people want to know. >> you want to know what is popular? >> nancy pelosi has -- we have to go. sorry, laura. but we know low pressure has to appease the left. >> i'll just say this. the elements in the infrastructure plan, both of them, the human -- >> we love the infrastructure plan. talking about the social spending plan. >> child care. yes. i'm talking about child care, wildly popular. lowering prescription drugs costs, popular. elder care, wildly popular. investing in education and job training. biden's numbers will increase which is why the pom poms on the panel are out against it. >> is that an -- >> we have 11 million jobs out there. please take them. take the jobs that are out there right now. thank you all very much. the administration is saying 12,000 migrants from the del rio camp now in the united states. thousands more are on their way. what does this mean for the officials on the ground? >> if republicans will have a conversation about comprehensive immigration reform, we'll have it. we have not seen any appetite to do that. all we've seen is speeching and talking points to date. >> so how far that conversation goes, if it ever happens is anyone's guess. secretary mayorkas said again on fox news sunday that the position of the biden administration, they're against a border wall that is something that a lot of republicans are saying needs to be there in order to have talks. they keep saying there's other ways to do this, but we have not seen that process play out very much, neil. >> charles: yeah, thanks very much, appreciate it. so with 12,000 haitian migrants in, will other follows? sheriff a.j. lauderback joins us. we did call dhs secretary alejandro mayorkas and have not heard back. it seems like a well-coordinated plan. all of a sudden 30 haitian my grants emerge at the same time, the same overpass for them, the same bridge. they were going back and forth to mexico, getting provisions and food and things like that. and now we're hearing that more reports are on the way. what are you hearing? >> i'm hearing the same, charles. good afternoon to you. good to see you again. you know, it's obvious, very clear that the only thing the biden administration here is for is a wide open border. with as many people as you can possibly bring in the united states knowing full well that most will not report to an ice agent or ice station where they are in the united states. they know this. this is all very orchestrated, very strategic situation that we've seen. yes, we have another 15,000, 20,000 that are headed to the area. headed to the texas border. you know, our secretary of our national security, alejandro mayorkas, who really -- we probably should hand that title over to susan rice who is calling the shots from the white house. so this is a situation that border patrol knows. texas sheriffs know this as we're completely inundated with lack of resources from the policies of the biden administration. >> charles: i think your job will get harder. friday when president biden spoke about the incident with the border patrol on horseback, you know, broke my heart to hear his comments. i have to be frank with you, but i want this point out, you know, he never misses an opportunity to make black people feel bad that republicans or others hate them. he knew that that patrol man wasn't using that to strap those folks. yet he made the border patrol a agent and the agency bad guys. when they say they don't want anyone coming to the border, the message from the campaign on has been hey, we're the nice guys. you can come, wink wink. we'll say something in public. but you're invited. get up here and we'll keep you in. that's the way it comes across to me. again, i thought he had a great chance to be presidential friday, to be honest about something and not make it a political point and not make people of a certain raise or nationality or color feel like they're not wanted because of that. isn't your job going to get harder now? border patrol will lean back a little bit. they're not going to be aggressive at all. >> certainly our jobs are all going to grow. our resources will be further expended on exactly what this administration wants to do. we see no credibility with this administration on what they say. anything that is effective, anything that the men and women of border patrol and our ice agents do here on our border, they're going to be criticized for. it's not what they want. what we saw with the use of horse there's is the border patrol being effective on trying to control this border, which is not what the administration wants. it's not what they plan for, not what they intend to do. the vision is clear that the federal government, this federal administration wants an open border and will do everything that they can to complete that mission. >> charles: yeah, the last line of defense is to shame those in xharge -- in charge. and coming up, a possible worker shortage. we have dr. marty makary on that. what if i told you there's price spikes that have many companies worried about the holiday shopping season? >> hi, charles. get the shot or get fired. that's the decision for many of the medical workers across the state today as they need to make this decision. governor kathy hochul said she would prefer to make it a personal choice but protecting the hospitals, the most vulnerable patients just takes precedent. we're seeing hospitals in long-term care facilities across the state put this policy into action. northwell, the state's largest medical system says 100% of the workers are fully vaccinated. they let go of two dozen employees this morning that renewed to get their shot. the governor says she will sign an executive order and bringing in medical workers from other states to help overworked employees here in new york. >> my heart breaks for the nurses and the other individuals that have done the right thing, who now know because people -- not everyone was being persuaded to do the right thing. they have to work harder and have more sacrifice. it's unfair. we'll have to bring in people to help at all levels. >> meanwhile, a vaccine mandate for all teaches and staff in new york city schools was scheduled to also go into effect today. however, a federal judge blocking the rule this weekend putting it in limbo. a three-jump panel was hearing the case wednesday. major de blasio took time to thank the 87% of the department of education employees that have already rolled up their sleeves to get the vaccine. so for now, because of this ruling, teachers will still be able to opt out by getting tested for covid-19. medical workers will not be able to do the same. charles? >> well, hospitals and businesses for that matter need to be more flexible. many hospitals have started to do so because they're not following the blind guidance of the government. they're following the guidance of science. these shortages are a failure of government. they're not a failure of science. science makes it clear that natural immunity, which many healthcare workers had from risking their lives on the front line, many of them recognize that this is a form of immunity and may be more durable than vaccinated immunity. so st. luke's hospital in pennsylvania, spectrum health in detroit and many others say if you have natural immunity, we credit that. that is what they've done in europe and israel and need to move to here or we'll have severe supply shortages of staff. >> charles: you've been out front and well ahead of the curve when it comes to this topic of natural immunity. i feel like the reason it doesn't get its due, the proper due diligence from our government is political, doctor. i have to say, feels like they're so vested in these vaccines. even getting ahead of the fda and the science on the booster shot. people will look back when everyone says, yeah, dr. makary was rights. how much damage will be done though? >> yeah, a lot of damage. tens of thousands of americans that needed to dee when the government ignored natural immunity. also now it's ruining lives of soldiers and nurses and teachers who are saying i've got immunity and i don't feel comfortable getting it and making a difficult decision including dishonorable discharge from the military. we have to recognize we've had a small group of people politically appointed loyal physicians in the government who have been subscribing to a political edict that we have to vaccinate every american. the reality, that's not a precise way to look at it. it's not the vaccinated and the unvaccinated. it's the immune and nonimmune. as we measure, we'll recognize it. it was a terrible hypothesis that stemmed from the highest level of government physicians. they need to have the humility and evolve your position. >> charles: the science evolves. it's okay to be wrong as long as you're looking forward. dr. makary, president biden getting his covid booster shot today. he continues to call this the pandemic of the unvaccinated. does that help the goal of getting more people that are hesitant to take the jab? >> you know, it's a mischaracterization and it's inaccurate and imprecise. if we really want to do everything we can to reduce the avoidable harm. that's where we need to focus our efforts. if you look at the blanket and vaccine mandates that came from the white house after they were announced, vaccination rates on a daily basis have gone down 20%. that is we were doing about 810,000 a day. now we're down to 650,000 a day. that is because it hardened people that see the overreach of government. those are the people that we want to encourage to get vaccinated, not alienate. >> charles: thanks, doctor. always appreciate it. now to the deadly amtrak derailment in montana. ntsb giving new details in the investigation. to dan springer with the latest. >> the national transportation safety board is holding a new conference. they're starting a long investigation into the cause. the train was headed to seattle from chicago when it went off the track close to the border in canada. 141 passengers were on board with 16 crew. it happened near a rail switch on a straight piece of track near joplin, montana. the section of track had been inspected two days earlier the back eight cars derailed with the last one topping over. three people were killed including a 28-year-old man who was with his wife going to portland. investigators will look at the track, any mechanical issues and whether there was human error. trains are still considered the safest way to travel but six fatal accidents on amtrak trains killing 19 people. according to the department of transportation, track defects account for a third of all derailments. in saturday's crash, speed is not likely a factor. all trains are equipped with positive train control, which keeps trains at the speed limit and can automatically a fly the brakes. we know the train was traveling 78 miles per hour on that section of tracks. 79 miles per hour is the speed limit. you can take speed out of the equation. seven people were taken to the hospital. two are in critical condition. charles? i want to bring in mercedes colwin to discuss. we heard that the fbi took some things out of the home. brian laundrie's things, check for dna. stands to reason his dna would be in their home. what would they be looking for? >> there's certainly rumblings that the parents have been involved in his disappearance. so probably looking for any digital evidence there is linking the parents to brian laundrie's evasion of law enforcement. so they're going to look at any of their laptops, searches, perhaps he didn't go to the preserve because as you know, his parents have said that they didn't say that he was unseen by the parents for 72 hours after he allegedly went hiking, this targeted approach might be just maybe that he didn't go to the preserve to begin with. maybe he went to another country, traveled to another country. by the time law enforcement discovered that he was missing, it chaz been 72 hours. so he may be out of the country for all we know. obviously the man hunt will continue, this digital approach looking for any sort of digital evidence is anything that the fbi is well-equipped at. let's take a look at what they have done with the preserve. there's so much that they can use in terms of technology. they can fly across the preserves with heat sensors to see if they can determine if there's a person in that particular spot. so you can conclude that they've exhausted the search at the preserve and now looking for other evidence that he left the country. >> charles: i have less than a minute. maybe other people know why. the difference between being a suspect and a person of interest, seems to nonlawyers, legal folks that he would be a suspect. >> well, it's interesting. all we know right now is that he had engaged in fraud. the credit card fraud. he used -- they used the credit card or the debit card, i should say. brian landry used her credit card after she was deceased. so there he's a suspect. in terms of whether or not he was involved in her murder or her homicide, that is left with forensics. i spoke to dr. boden and i said why did they rule this a homicide in why is it an intentional killing? he said probably because the neck bones were broken. that would be evidence of the fact that she was manually strangled and now it's about connecting the dots to brian laundrie, the last person with her. that's why he's a person of interest regarding her homicide but a suspect with respect to the credit card fraud. >> charles: mercedes, thanks very much, a busy week on capitol hill. house lawmakers set to start the debate on the biden infrastructure bill tonight and working on the high cost social spending bill. we'll talk to ro khanna as lawmakers try to iron out the details next. lowe's showrooms have a variety of stylish flooring you'll love for years to come. like stainmaster lifetime stain resistance limited warranty. order now, get your flooring installed with help from lowe's. home to any budget. home to any possibility. it's an important time to save. with priceline, you can get up to 60% off amazing hotels. and when you get a big deal... you feel like a big deal. ♪♪ priceline. every trip is a big deal. >> charles: the work on capitol hill intensifying this ahead of the debate on the bipartisan infrastructure bill tonight. lawmakers looking to vote on the larger and more costly social spending plan. will democrats have the votes to get both bills passed? grady. >> charles, president biden's vaccine mandate could affect the holiday. we'll see what the retailers are worried about and what they want done about it. that's next. you have the best pizza in town and the worst wait times. you need to hire. i need indeed. indeed you do. indeed instant match instantly delivers quality candidates matching your job description. visit indeed.com/hire >> forget about price fights, retailers are worried about potential vaccine mandates and test rules for workers as stores prepare for the holiday shopping season. grady trimble with the latest. >> charles, to industry groups represent some of the largest retailers in the country like target, walmart and a host of others are asking for 90 days on the vaccine comes down from osha to win the retailers actually have to put it in place. they know it will be complicated to implement the mandate and they say they are around 4 million retail workers across the country who need to be tested on a week weekly basis because of this mandate and they know there are a whole host of questions that retailers still need answers to that are hoping for that three weeks to get questions answered mike who pays for the testing and what if an underage employee 18 or younger and the need to parental consent to get tested. that's why they say more time would be beneficial not only to the retailers but also the white house. listen. >> we think we could achieve the administration's call which is a broader adoption to the vaccinations more effectively and more efficiently, with a lot less cost and a lot less drama. unfortunately, at least to this point they are choosing to go the ready, fire and aim path. >> there any guidance as expected as retailers are gearing up for the holidays. companies like target, walmart and macy's are looking to hire hundreds of thousands of employees all told so they are worried that this could complicate that hiring process in an already tight labor market. >> grady, thank you very much. let's get right to steve moore on this. businesses obviously, they want to do their thing without the government on their back and this is a golden opportunity. at but this will be a challenge. >> in the industry got crushed by the covid lockdown and amazingly, many of them survived. they are just getting their feedback on the ground and by the way they are still having problems getting workers back because of the high unemployment benefits. just things are getting back to normal, william. they get hit with this new mandate. it will help bridge the small businesses and restaurants and bars, and the mom-and-pop shops and i know you're talking about the targets and the walmarts i worry more about the little guy. >> steve, here's the thing. the small businesses, to your point, we have a million retail jobs opening and wages are near $22 on average right now. it's the small businesses, they can't compete anyway and then they layered this on top of them. maybe they will wait, maybe they will find a weight whose stall at least until after christmas. >> well they should. this is a critical period for retailers obviously and this is where they do 40 and 50% of the business. my heart goes out to those small businesses. we went out to a restaurant last night and we waited 45 minutes for our food and the manager said it, we only got three people in the kitchen, we normally have seven. this will make it much more difficult to get workers back on the job. we've got 10.5 million job openings, charles. >> i got to tell you, a lot of businesses are actually putting that sign on their door. bear with us, we don't have enough workers. inc. you all very much and thank you all for watching. neil will be back tomorrow but of course remember you can catch me every day at 2:00 p.m. eastern on making money on the fox business network. lots going on, the market is pretty wild these days so you may want to tune in and catch up. in the meantime i will leave you with the "the five" which starts right now. ♪ ♪ >> dana: hello, everyone, i'm dana perino along with katie pavlich, jessica tarlov, joey jones and dan bongino. it's 5:00 in new york city and this is and "the five." the border crisis showing no signs of letting up for president biden, a new group of migrants in southern mexico is waiting, ready to come north to the united states. that as we learn what happened to thousands of migrants were camped out under a bridge in squalid conditions. after clearing
