near del rio where the latest flashpoint over illegal immigration is playing out. welcome to "fox news live," i'm mike emmanuel. jeff paul starts us off this hour in texas. good afternoon, jeff. >> reporter: it just doesn't seem to be stopping no matter the day, the time or the weather, that constant stream of migrants here along the southern border just continues. we're just in one spot, and so far today we've seen as many as five different migrant family units crossing the rio grande and sort of the same story, they essentially surrender themselves to texas dps who hand them over to border patrol, take them away for processing. last week we saw a lot of folks from haiti, yesterday mostly venezuela, today cuba and venezuela. so far today oklahomaland security secretary alejandro mayorkas sort of responding to those claims that when people come here, they know they're especially going to eventually be released into the united states. take a listen. >> in 2019 we saw a large number, in 2014, in 2010. this is nothing new. it spans many, many years. it spans different administrations of both parties, and and it speaks to the need for legislative reform. >> reporter: mayorkas wouldn't call the situation a flood of people trying to my grit to the -- migrate to the u.s. he says the biden administration doesn't agree with the building of a wall, and he says the law gives people the opportunity to make a claim for asylum. but texas governor abbott says the biden administration isn't doing enough to secure the border, and he says texas is having to use its resources like state troopers and rangers to try and stop the flow of migrants. >> the people in south texas, they're angry about the biden administration for ignoring them. the biden administration cares far more about people who are not in this country than he does of the people, american citizens who live in this country. >> reporter: now, another migrant caravan could be just around the corner. sources here on the ground in texas say authorities are tracking a group of maybe as many as 20,000 people who just crossed over the southern border of mexico. they're heading north right now and could arrive here along the texas -- along the u.s./mexico border within the next month. mike? mike: no let-up in sight. jeff paul live in del rio, texas, many thanks. ♪ mike: big week with on capitol hill as congress works on president biden's massive $3.5 trillion spending plan and plenty more. here's what house speaker nancy pelosi had to say is earlier. >> i'm never bringing a bill to the floor that doesn't have the votes. you have to go when you have the votes in a reasonable time, and is we will. and i do believe they whether do -- mike: for more on what to expect in the house, we are joined by iowa republican congresswoman and member of the house appropriations and budget means, ashley hinson. congresswoman, welcome. >> thanks for having me, mike. mike: how do you assess what speaker pelosi said about the massive spending and tax bill? >> yeah. this budget process has been broken from the very start, mike. we saw that with how they laid out the reconciliation process. they set an artificial target and deadline and said, okay, committees, go forth and try to figure out how to spend this money. now we're hearing, well, let's not talk about the money, let's talk about our values. well, the problem is i value american taxpayers and iowa taxpayers, and they are being completely disrespected in this process. the only thing that's bipartisan about this legislation is the opposition to it. we have one democrat vote against final passage yesterday in the budget with committee. mike: is so it's not just that massive package the democrats want, there's also funding the government beyond september 30th this week, bipartisan infrastructure package and, of course, the debt limit. what are your expectations on those issues this week? >> well, i think speaker pelosi miscalculated when she tried to tie all of these things together. i think she would have had bipartisan support for a continuing resolution to keep our government funded and and keep those essential services going, but when they're pushing forward with a $3.5 trillion bill, that's just irresponsible, it's reckless, it disrespects taxpayers, so they have a lot of work to do. they have a lot of dissension within their own caucus, but i can tell you that republicans are about targeted spending, we're about responsible spending, and we're about respecting taxpayers in this process. mike: you are interested in seeing a measure called the back to work act. what are your goals with that piece of legislation? >> well, i'm interesting this piece of legislation, the back to work act, because what we've seen is a government that wants to pay people to continue to stay home. just a few weeks ago representative alexandria ocasio-cortez introduced a piece of legislation to continue those enhanced unemployment benefits. we don't need these policies to be permanent, we need to focus on getting people back to work, back to health and back to normal. so my bill would basically pump the brakes on aoc's policies that she wants to move forward with. let's figure out what's the issue with the supply chain, the issue with unemployment in this country. we need to get people back to work, and so that's what we're working on, and that's what is prioritized. mike: to the border, what are your assessments of what we're seeing at the border right now? >> yeah. it's an absolute surge of illegal immigrants at the border, and we've been asking questions to secretary mayorkas, which i heard you played some clips from just a few minutes ago. we've been asking questions, why is this happening, what are they doing about the border. we need to get back to policies that actually work at the border. we need to build the wall. we need to make sure that remain in mexico policy is actually enforced. and i heard the secretary's interview as well, and we have a lot of questions about enforcement. they aren't truly enforcing the law, we know that. we know people are being released into this country, and they can't properly track them. we'll continue to hold them accountable for these failed policies under the biden administration because this is a safety and security issue for iowa families and american families. mike: do you get a sense some of your democratic colleagues are getting more frustrated what we're seeing from our southern border? >> well, absolutely. and you've heard texas representatives speaking out about what's happening at the border. i had a chance to go down in april. we had a round table with local sheriffs, for example, and they were republicans and democrats. this is not a partisan issue. they are crying out for help. i look at it as an iowa issue because every state's a border state. interstate 35 comeses straight up into iowa, so the drugs, the human smuggling, all of the cartels that are winning in this situation, we need to put a stop to it, and it's time the biden administration if stops turning a blind eye to this situation at the border. stay tuned. ♪ ♪ mike: memorial service for gabby petito underway on long island this afternoon where loved ones and friends are remembering the 22-year-old woman. we have team coverage. charles watson has the latest on brian laundrie as law enforcement tries to track him down, but let's start with laura ingle on long island where hundreds are gathered for the funeral of gabby petito. hem low are, laura. >> reporter: hi, mike. it has been a busy morning. family, friends and community members have all been streaming into this funeral home you see here behind me to remember the 22-year-old whose disappearance captured the attention of the nation. and if you can see that blue sign behind me with the red heart. it reads blue point. that is her hometown who is collectively mourning her loss told x. we'll take you inside, there's a live stream of what is going on at this memorial service in celebration of life. her father joe and her stepfather jim schmidt just gave eulogies remembering gabby, hoping those here today will walk away remembering the love she had for life. >> gabby is the most amazing person i've ever met. so if you're going to leave here today, i'm asking that you guys be inspired by the way she treated people, all people. love knows no gender. love knows no bounds. >> reporter: it is a hard day for many reasons. as the investigation continues, we have learned that gabby petito's remains have still not been released by the fbi and are currently in wyoming. and while that was a difficult decision for her stepfather jim schmidt who was there during search efforts to leave without her, the family says with the uncertainty, it was important to grieve together as a family and hold a service in her honor. we have the prayer card. it was handed out to attendees, and it has the words from one of gabby's tattoos she had on her arms that reads let it be with the words lift up your hearts and share with me the memories that will always be. and this long island community is a tight one and gathered friday to hold a candlelight vim jill in her home -- vigil in her hometown of blue point. >> we just want to support this family, standing behind this family. >> reporter: and gabby's father joe announcing on his twitter page the gabby petito foundation which the family has announced to help other families who might be in similar situations, bringing them resources to bring their loved ones home. that is set to go live, you can still check it out at gabbyfoundation.org. there are still many more answers this family is looking for to find out where brian laundrie is, of course, her twafl companion who came home in her white ford van september 1st without her. mike: let's hope they get those answers. laura, thanks a lot. friends of brian laundrie says he has the skills to survive off the grid for a long time. charles watson is joins us from north port, florida, with the latest on the search for him. charles, good afternoon. >> reporter: hi, mike. police say the motivation to find brian laundrie is as strong today as it was on their first day of search areas in that massive swamp area. the 25 crowrkz-acre carlton reserve has a lot of challenging obstacles, alligators, muddy land and a lot of water. about 75% of the reserve is submerged. former reality tv star dog the bounty hunter is thousand joining the manhunt for brian. less than 24 hours ago, dog knocked on the front door of the laundrie family home. fox news digital spoke with him moments after that. >> the strongest lead i see is that one of her friends said he had been in the appalachian mountains by himself for a couple months. now, he's not just a camper then, he is an outdoorsman. >> reporter: so you have police, dog the bounty hunter and now a local law firm is stepping up to help find brian. that law firm offering up to $20,000 to anyone who can lead authorities to the 23-year-old fugitive. >> people are devastated. so we wanted to help the community find answers and get justice for gabby. >> reporter: and while people are trying to track down brian, others are honoring gabby. here in florida community members unable to travel to new york for her funeral have been adding to making shift memorials and holding vigils, the most recent here last night in knot port where dozens -- north port where dozens gathered to light candles and a butterfly release. we expect search efforts for brian the ramp back up tomorrow, but we can't can't know for sure until we hear from police. mike? mike: charles watson is, thanks a lot. a fatal amtrak dead and dozens injured after an amtrak train derailed in montana. christina coleman joins us live with an update. >> reporter: hi, mike. terrifying moments for passengers on this train. three people were killed and local authorities confirmed well over 50 people were injured. this amtrak train was heading west from chicago to the seattle/portland area when it derailed near joplin, montana, about 30 miles south of the canadian border. approximately 141 passengers and 16 crew members were onboard. eight of the train's ten cars derailed. you can see some of them tilted over and passengers sitting out on the side of the track shaken up by this incident. one passenger reportedly said it felt like extreme turbulent on a train. a statement says in part the company is deeply saddened to learn about the lives lost in this incident and confirming that there were hult -- million billion injuries. emergency crews quickly responded and montana's governor tweeted saying, quote: we are closely monitoring the situation involve ising a derailed passenger train near chester. please join me in praying for all involved and the first responders on the ground. also amtrak says they've got a team at the scene to fully support the ntsb as they investigate the cause of this derailment. mike? mike mike christina coleman, thanks very much. ♪ ♪ mike: so the dhs secretary revealing close to 12,000 haitian migrants are being released into the united states as president biden slams border patrol agents who confronted migrants at the border. you're looking live at our fox flight team in del rio, texas. joining us now to discuss is democratic strategist and former biden campaign is circuit kevin walling and talk radio host tony kaplan. how troubled are you by what we're witnessing at our southern border? >> speak as a democrat, this is a crisis, ooh i'm the first one to admit it. on day one of the biden administration, he released a bill congress to fully fund our immigration services. we need to surge resources to the border. since taking office, over 700,000 migrants have returned to their countries based on the biden administration's tough stance on immigration and securing our border, but certainly we need more resources because it is a crisis point on our southern border. mike: tony, why is it some are more outraged about the treatment of haitian migrants than the other groups? >> i don't think anybody argues that we should really want to fund the board. the problem is we have a leader who doesn't want the border, period. if you're going to say border patrol agents who didding nothing wrong and nobody was whipped, you will pay, that's saying you don't have any faith, you're not backing with up border patrol, and you don't believe in the mission. our issue in america is that we don't have a leadership, we don't have a party that is in power, that wants to go about controlling this. so this is more, mike, than just about this conversation of haitian migrants, and they are not refugees, they are migrants. and this is about the entire conversation of what we want from the border and do we believe in a border in and of itself. and this administration is clearly saying, no, we don't. mike: do you want a final word on this one? >> yeah. we certainly believe in border security, we believe in funding resources. we've taken a tough stance on this crisis at the border, and you're going to see more action in the coming days and weeks, for sure. mike: it is a huge week on capitol hill, some critical funding bills expected to be taken up, of course, the need to raise the debt ceiling limit. tony, what is your assessment? >> well, if we're talking about the $35 trillion infrastructure -- 3.5 trillion infrastructure package, i'm so glad to see that it is slowly but surely imploding. i'm very happy to see what senator sinema and senator manchin are doing on this subject and standing tough. i think the real story here is that biden tried in my beloved indiana, they went on tour to try and sell this package and a host of others. america didn't buy, the midwest didn't buy, the heartland didn't buy. i don't even know if the coasts are buying that this idea of human infrastructure is infrastructure. seems to be going along the line of just another swing and a miss from the administration that doesn't understand that america is not as a radically left as they are. mike: kevin, do you expect speaker pelosi will either need to punt the spending and tax package until next month, or does she count the votes and realize it needs to be scaled back to win over some of those moderate democrats? >> yeah, mike, it's a good question, and you've covered congress for a long time. i don't think we've ever seen a week like this with so many things happening, with the c.r., the build back better agenda and, obviously, the bipartisan infrastructure package. nancy pelosi is a master lawmaker, i would never count her out. this is probably some of the final actions she will have in the leadup to the hid terms, so i'm of the adage, you know, if we don't hang together, we'll hang separately. obviously, the midterms are coming up fast, 408 days away, and we need to, you know, american people would like the democrats to take action and pass all these things. they're very popular9 with the american people, 66% of americans support the build back better agenda including 39% of republicans, taxing the rich and corporations to pay their fair share. i think she gets this done in the next two weeks. mike: tony, any thoughts along the way of this week with votes? >> the bumps along the way is you can push this infrastructure, but human infrastructure is not infrastructure. green new deal policies are not infrastructure. curbing cryptocurrency is not infrastructure. if we want to discuss this as infrastructure, we would, and even the $1.2 trillion won't go through because speaker pelosi and senator sanders have said if it's not together, these two things won't happen. they wanted to force something through without america's buy-in, and america said, no, thank you. and i only hope that's the way (cheers) mike: a huge week ahead on capitol hil as democrats push forward with president biden's massive tax tax spending plan. last night a rare weekend meeting, the house budget committee passed the $3.5 trillion package sending the bill to the house floor. lucas tomlinson live from the white house with the very latest. hey, lucas. >> reporter: good afternoon, mike. house speaker nancy pelosi says she wants to pass not only the $1 trillion infrastructure bill, but that massive $3.5 trillion social spending bill, the largest in history. >> i'm never bringing a bill to the floor that doesn't have the votes. and i think anytime you put in an arbitrary date, well, remember when the republicans said they were going to overturn the affordable care act on the anniversary of the affordable care act? i knew right then and there they were doomed. >> reporter: pelosi said this will be an intense time on capitol hill. president biden says to pay for these massive spending plans, he's going to tax the well and corporate america. the house budget committee met yesterday in a rare saturday session to okay the bill, 2400 pages long. that's twice as long as the bible, mike. democrats have to figure out how to pass it and ram it through the senate. republicans say this is not a bipartisan endeavor. republicans worry inflation's going to get a lot worse. >> it's a debt bomb, an inflation bomb that is going to go off, and we're already seeing it. and i think that, you know, it'll all be sorted out in 2022 and hopefully give us the chance to have the reins again. >> reporter: fiscal year ends on thursday. without a stopgap measure, congress could be working some weekends, not just you and me, mike. mike: lucas tomlinson on the north lawn, thanks very much. joining us now is texas democratic congressman and hebb of the house financial services committee, al green. congressman, welcome. >> thank you, mike. it's an honor to be on with you. mike: here's your colleague, ashley hinson, from earlier this hour. >> it's irresponsible, it's reckless, it disrespects taxpayers so they have a lot of dissension within their own caucus. i can el you that republicans are about targeted spending, responsible spending. mike: how do you respond, sir, and do you believe democrats will have the votes to pass that $3.5 trillion spending plan this week? >> i think that we'll pass the two deals in tandem. that's been our approach all along, and i don't think we'll deviate there that plan. i also believe this while we hear persons make commentary, this is a process. this is the way it works, and i'm not in any way moved by what people say about being responsible, irresponsible. over the years when we've tried to do great things, we've always heard this argument when we've tried to pass social security. we heard the argument for medicare, medicaid. sos this is typical of what is said. but at the end, we have a seminal piece of legislation that will have a great impact on the outyears in this country. mike: what about the fiscal matters, government funding extension beyond september 30th, the debt ceiling, do you expect those to get through this week, sir? >> well, my hope is that they will. we hope to have a c.r. that we'll take up then to december the 3rd, and we hope to extend the -- suspend the debt ceiling until december 2022. i think we can do these things. we have to be optimistic in this business, mike. if you're not optimistic, you'll probably sort of languish away, so i'm quite optimistic. i respect my colleagues who differ with me. i'm a compromise guy. i've lived 74 years, and i've learned i can't always have my way, is so i'm willing to work with my colleague, especially the lady that was on earlier. i'm most amenable to working with her. mike: do democrats feel pressure realizing much of president biden's domestic agenda is on the line this week in. >> i think that each thing that we do is important to us. this is important, but believe it or not, next week and after we do this, there'll be something else that will be important. my life is full of important things that have to be done right away, and the things that we have to do that are urgent, we'll do them as quickly as we can. and it's possible it takes a little bit longer, but we'll get it all done. i think we are at a point in our history, unfortunately, mike, where we're sort of evenly split this terms of the parties. and when you're evenly split like this, there's always going to be the opportunity to work together or one side having to go alone. i don't want to go alone. i'd like to have bipartisanship. but if we can't, then we have to do something. this is not one of those circumstances where you do something even if it's wrong. we're going to do the right thing because of the great opportunities before us. mike: to the border. you represent the great state of texas. what are you hearing from your constituents about the scene we are seeing playing out at our southern border? >> well, greatly disappointed about the situation with the persons on the horses, the agents on the horses. i think that it is not indicative of all of the members of the corps, only of the persons who were on the horses and who were swim with dating persons on -- intimidating persons on horses. i think the my colleagues would just walk in my shoes for one moment, or the shoes of an african-american who knows what happened on bloody sunday when we had these horses there and john lewis was beaten at the edmund pettis bridge. john lewis told me he thought he was going to die on that bridge. and what happened early in this country when we had persons who were slaves who were trying as best as they could to make a life for themselves, and they were whipped and tethered to horses and then, of course, the images you've been showing. my point is this, i see something that others don't see. i'm a son of of the segregated south. the rights of the constitution recognized for me, my friends and neighbors denied. so if you look at it from my perspective, you find that very onerous, what we saw, and we never want to see what we saw repeated. because when it's repeated, it gives you reason to believe that we may be moving back in time, and we're not going to go back. i don't think america wants to go back. we want to move forward together. mike: certainly the folks in haiti have been through a lot of suffering, natural disasters, turmoil in terms of their political system, but do you ever ask yourself, how the heck to they get to our southern border? >> well, i have some knowledge. they, obviously, traverse the gulf of mexico, but they've been living in countries south of the border for many years, and a good many of them, the we send them back to haiti, they'll go back to a country they haven't been to in over a decade. we give them $50-100 and a phone and some food x. as you know, we have temporary protective status in place for haitians who were here prior to earthquake, and we're not sending them back because we've concluded that it's just not safe to do so. there are gangs, the country had the president assassinated, so with these things happening, we've decided we're going to give temporary protected status to haitians. well, now these persons coming across the border, i don't think we can just decide that, well, because they came a little bit later, that it's okay to send them to a country where we're not sending other persons to. you can see the contradiction. so so i'm one of the persons who believes that we should give some consideration. after all, the haitians have helped us through the years. thank you. mike: congressman al green of the great state of texas, thank you so much for your time, or sir. >> thank you, sir. greatly appreciate it. ♪ mike: -- uncertainty on the ground in afghanistan with the taliban in control. our trey yingst is in kabul with the latest. trey, what's it like there? >> reporter: well, mike, good afternoon. there are a lot of questions about what comes next for afghanistan. now, the mayor of kabul remains hopeful, but the clock is ticking to find an economic solution for the afghan people. >> we want to create pockets of hope, stability and forward looking, cultural, uplifting. >> reporter: the mayor of kabul is a former u.s. citizen and united airlines pilot, and thousand he's one of the last afghan government officials still serving under taliban rule. >> i have a responsibility, and i've been, i've been given the responsibility to do something. and if i just leave like others, what have i achieved? >> well, it sure sounds that way. i mean, their a family has been described as a dynasty. they have a longstanding history of being a prominent family of attorneys. so perhaps they thought they were untouchable, but i gotta tell you something, mike, they certainly are touchable. i don't know if i've ever seen a life unravel faster than alex murdaugh's right now. i mean, if we look at, first, his wife and and son are mysterious yously murdered, his law firm kicks him out, they take his bar license, he attempts to kill himself, and now he's in rehab facing criminal charges of his own. and this all happened within basically a three month period. so things are not looking good for him. but also things are not looking good for anybody who is suing him civilly because one of the many civil lawsuits currently pending is his own insurance company trying to get declaratory releave that they should not have to -- relief that they should not have to pay out certain claims. that's never a good thing. mike: let's put on the screen the number of investigations into the murdaugh family. murder of paul and if maggie murdaugh, death of steven smith, death of gloria satter feel, obstruction of justice related to that boating accident, insurance fraud, allegedly hiring someone to murder him and misappropriating funds, that is quite a trail to this one family, isn't it? >> that is quite a trail. and i do see one thing, his attorneys are trying to play the sympathy card, if you will, in that they're a blaming a lot of these misdeeds on alless admitted opioid -- alex's opioid addiction. a lot of people can forgive, the law forgives addiction. i understand that, i work in the law. but what i can't forgive is an attorney who's going to steal from if his law firm and most especially steal from his clients. and god forbid he's involved in any way, shape or form in the intentional deaths of the people around him be it his wife, his kid, perhaps his longtime housekeeper. that's inexcusable on any level. mike: sorry. is some of this because the family was in financial trouble? >> well, it seems that they might have been in financial trouble, but the only reason we really know that is because that's alex's plan. was it because he was spending money on opioids? was he just greedy? the one thing we know now is insurance is not going to want to pay anybody anything. so if a civil plaintiff sues himwants any financial gain, they're going to have stand in line to get his assets. so this is just, like i said, unraveling fast. mike: we're up against the clock, but does the national spotlight put pressure if on local authorities and also south carolina officials to really thoroughly investigate all these matters? >> oh, absolutely. and they really need to take a harder look at alex. and i'm sorry, i know this is speculation, but if he were in dire financial straits, how do we know he didn't kill his own wife to get her life insurance? (announcer) go to golo.com to lose weight and get healthier. ♪ mike: doctors announced saturday that sheriff's deputy joshua moyers is not expected to survive. he was shot in the face and back outside jacksonville, florida, on friday. 35-year-old patrick mcdowell allegedly assaulted moyers. the officer had pulled moyers over for driving a stolen vehicle. hundreds of officers now searching for mcdowell. he's believed to be extremely dangerous. deputy moye with yers is 29 years old and soon will be the second deputy lost in the line of duty this year for nassau county, florida. four teenagers have been caught planning a columbine-style attack on a pennsylvania high school for 2024 on the a 25th anniversary of the colorado school massacre. alexandria h to off joins us with more. >> natural born killers, that's how these teens described themselves. in fact, it was the title of the text message thread that a parent found and took to police, foiling a plot to replicate the columbine massacre. two 15-year-olds have been charged as adults, two more as juveniles for their role in a conspiracy to carry out a mass casualty attack on dunmother high school. -- dunmore high school on columbine's 25th anniversary when two student shooters killed 12 class a mates and 1 teacher in colorado -- classmates. this pennsylvania is community is horrified by what could have been. >> i was like, no,ment isn't be real. it's terrible for 15-year-olds to actually plan on murdering people it's just beyond. >> reporter: according to our fox affiliate, the group planned to, quote, shoot up the school and specifically target three faculty members. a search of one home uncovered a stockpile of homemade explosives, plans for making pipe bombs, a list of guns and ammo needed and writings on columbine. on friday the district superintendent released this statement to the community reading in part, quote: please be advised that the administration has been informed that the alleged perpetrators are in custody, and we have been assured that there is no current danger to students and staff. now according to our affiliate, that plotting began back in may, and the parent found out about those text messages and went to police in july. many in the community are concerned with why they didn't find out about this sooner. mike? mike: i covered columbine high school. that stuff is scary. thanks very much. tomorrow john hinckley jr., the man who tried to assassinate ronald reagan, is set to appear many court. his lawyers are seeking to have his restrictions lifted. hinkley's required to turn over computer and account passwords and is banned from contacting any of the reagan family members. hinkley's attorney says he no longer poses a threat. he was released from st. elizabeth's mental hospital here in washington in 2016. hurricane sam is a category 4 storm still far offshore in the atlantic ocean. the storm could bring dangerous conditions later this week. what to expect coming up next. ♪ ♪ mm.
