shrinking. still in the thousands and there is news that another big surge could be coming to that area. correspondent bill melugin has been on the story from the beginning. he joins us live from del rio along the border again tonight. good evening, bill. >> he bret, good evening to you. yesterday president biden said he was going to get the situation here at the border under control. so the obvious question what's the plan? well, border patrol sources on the ground here in del rio tell me when it comes to this camp, they are now naturally seeing pretty much all family units any women that claim to be pregnant. the idea being they want to get this camp cleared out as fast as possible. >> del rio, texas on wednesday. where border patrol is making progress in its gargantuan task. the number of migrant still there has dropped to 5300 as of wednesday afternoon. that's a significant decrease from a climax of nearly 15,000 on saturday as dhs now confirms they are releasing some haitian migrants into the u.s.: quote individuals who have not immediate repatriated detention placed in on ice facility or released with a legal document, either a notice to appear in court or a notice to report to an ice office for further immigration processing. fox news witnessed some of those releases today as bus loads of haitian migranties dropped off at ngo in del rio and given supplies before moving elsewhere into the u.s. while other haitian migrants have been seen flying out of del rio airport after they were released from federal custody. some of the migrants are being deported. on one reoperate its throwing shoes at the aircraft and injuring ice officers. >> two flights canceled wouldn't they boarded the flight they got violent. put ice officers at great risk. >> today dhs secretary alejandro mayor can you say was asked why for a second day in the row he refused to give congress numbers on how many haitians had been deported. >> congressman, let me share something with you, quite clearly, i work 18 hours a day. okay? so when i return from yesterday's hearing, i actually focused on mission. >> and, bret, what we are hearing from multiple border patrol agents on the ground here in del rio when it comes to the migrants who are being released here they are being let go with what's called an ntr. that is a notice to report. what it means is they are released on their own recognizance with a request from the federal government to please show up to an immigration processing center for an ice facility within the next 60 days. the reasons use atrs than nta, atrs about 20 minutes. nta takes about an hour. they want it done as quickly as possible. back to you. >> bret: bill, are the border agents concerned about reports of other big numbers, thousand and thousands kind of coming that way? >> they absolutely are. they are tracking two main groups right now. one about 20,000 in colombia they are worried might start moving north. then they are also getting intel that migrants are gathering in the mexican city clean-up is directly across from the u.s. city of mcgowan down in the rio grande valley which is typically the hot spot. so many resources stowrged this spot right here could potentially leave other orders areas of the border open. however they are keeping tabs on everything going on. they say they will be ready to responder accordingly. better than what happened here. >> bret: bill melugin live on the border. thanks. the white house is mounting a furious defense of growing criticism even in the mainstream media of the president's border policy. howie kurtz will look at the press pushback. peter doocy tells us what the administration is saying about the border, the budget, the pandemic and the diplomatic fallout with france. >> president biden tried to smooth things over with a french president angry about being cut out of a submarine deal. >> he acknowledged that there could have been greater consultation. >> that call was off camera so were meeting with moderate and progressive democrat to try to save the imperiled multi-trillion-dollar budget and infrastructure packages. >> the president has always been open to negotiations and discussions and knew that he was not going to be alone and able to behave a magic wand and pass a proposal. >> we need to go big. >> officials want people focusing instead on a zoom about covid vaccination. >> nothing is more urgent than all of us working together to defeat covid-19. >> just as urgent to many in border states a humanitarian crisis unfolding in slow motion. >> americans know a train wreck when they see one. >> some critics think they see a whip in these photos even after dhs insisted wrong reins used by officers trying to maintain order it at the border. officers are on leave. dhs is investigating. and the president is upset. >> on the subject of the video footage and the photos, the president was horrified by that just as we all were. >> it's been hard to nail down how many migrants are staying and how many are going this is an issue of not knowing or this is an issue of a lot more people are being released into the u.s. than are being sent out. >> that is certainly thought the issue. >> issues at the border have been going on for most of president biden's term, six months ago he sounded like he wanted to see for himself. >> are you thinking of going to the border? >> at some point i will, yes. >> he still hasn't, ever. >> has president biden ever been to the southern border? >> in his life? >> yes. we cannot find any record of him visiting the border as president, vice president, senator, or even as a concerned citizen. why would that be? >> i can check and see when the last time or when he may have been. >> why doesn't he go down to del rio, texas and see what's going on? >> peter, i think the situation at the border is the result of a broken system. >> and i just checked my email while that tape was playing. we still have not heard back about any past biden trips to the border. we also still haven't heard back about any haitian migrants in texas have been september away and how many have been released into the united states. officials promised us that information by this afternoon still nothing, bret. >> bret: peter doocy lyon the north lawn, thank you. the manhunt continues tonight for the boyfriend of a woman who disappeared during a cross-country trip and whose body was discovered and confirmed in wyoming. pressure is increasing on authorities to find brian laundrie. r., who they describe a as a person of interest in the death of gabby petino. jonathan serrie report tonight from north port, florida. >> 60 officers from eight law enforcement agencies searched the rugged and swampy carlton reserve. >> and they are hungry to find brian laundrie. >> authorities say dive teams and sonar systems are being used to search large bodies of water and confirm cadaver dogs have been in use throughout the entire effort which began saturday. meanwhile, social media continue to provide leads on brian's steps before he disappeared. >> these internet absolutes and armchair detectives have come out in numbers. the amount of information that they're able to pull has really been incredible and really help leading the investigation. >> i saw brian laundrie. >> a tiktok user says she pointed the fbi to the wyoming camp site where authorities found the body of brian's girlfriend gabby petino on sunday. jessica schultz says she remembers seeing brian in the couple's white camper van on august 26th. >> i'm 100 percent certain it was just him. there was no gabby. >> police say brian returned alone to his parents' florida home on september 1st, 10 days before gabby was reported missing. brian's parents say their son left the house on september 14th and reported him missing on the 17th. a neighbor says brian acted normally during his time at home, quote: he mowed the lawn, him and his mother went for a bicycle ride around the block. i mean, everything was just normal life once he came back. it seemed like nothing bothered him. shocked and saddened by gabby's death, residents of her adoptive town of north port, florida and native long island, new york have decorated informal memorials with ribbons and flowers. >> i can feel what the parents feel because i lost a daughter five years ago, so i know what they feel like. >> everyone says it's a close knit, you know, community and come out and pay our respects. >> and gabby's death has been ruled a homicide but the coroner says it could take days or even weeks to determine the exact cause. meanwhile, two tourists tell fox news that they saw brian argue aggressively with female staff at a restaurant in jackson hole, wyoming. that was on august 27. they say gabby even apologized for her boyfriend's behavior. bret? >> bret: jonathan serrie in florida. jonathan, thank you. stocks were back up today. the dow surged 338. the s&p 500 rose 41. the nasdaq jumped 150. democrats here in washington appear to be in crisis mode early today. the deep dive over the funding for israel's iron dome defense system plunged them into political quick sand as deadlines debt ceiling and possible shutdown. there has been some movement. congressional correspondent chad pergram has the latest tonight from capitol hill. >> israel's scores it money for iron dome after all. house leader steny hoyer says it comes in a stand alone bill later this week. democratic leaders had tucked a billion dollars to reload israel's missile defense system inside a bill to fund the government and suspend the debt ceiling. >> iron dome saved lives and property. and held israel secure. >> republican lawmakers back the plan. >> we should not be turning our backs on our steadfast ally at a time when they continue to face dangerous threats from terrorists. >> but progressives threaten to shut down the government if democrats left the iron dome provision in. the revolt underscores the chasm between democrats over israel and how the democratic leadership kowtows to liberals. >> it's clear that the leadership of the democratic party right now is moving to the tune of the threats of the left. and it's hurting us internationally. >> the g.o.p. forced to vote to try to restock israel's system but democrats rejected the effort describing it as a gotcha vote. democrats who support israel blasted the g.o.p. for its tactics. >> i will say today the republicans are making the same thing i said to them last year and the year before. they need to stop politicizing israel. >>the g.o.p. wouldn't support the government funding bill regardless of whether iron dome money was in or out. that's because the g.o.p. opposes another provision in the bill suspending the debt ceiling. republicans say democrats are on their own with the debt limit because of their $3.5 trillion social spending bender. >> if washington democrats want to jam through trillions of dollars in reckless spending all by themselves. they can raise the debt limit all by themselves. >> there is increasing concern about how hitting the debt ceiling could spark a recession. >> liberals may have won on iron dome but democrats could cut the $3.5 trillion bill to please moderates. house speaker nancy pelosi says that bill is in good shape. bret? whether you're winning, or just doing your best. when you're on the lanes, they're right behind you. reunite with your team. go bowling. ♪ >> bret: florida's newly appointed surgeon general has signed new rules allowing parents to decide whether their children should quarantine or stay in school after being exposed to someone who has tested positive for covid-19. the guidelines eliminate previous rules requiring students to quarantine for at least four days off campus if they have been exposed. now, students can continue to go to campus provided they show no symptoms. pentagon press secretary says military service members who refuse to be vaccinated against covid-19 could face disciplinary action; however, john kirby says that action does not have to rise to the level of a discharge. kirby says more than 90% of the 1.3 million active duty military members have already received at least one dose. he says the defense secretary expects commanders to do everything they can to inform and educate service members. new jersey democratic senator cory booker says bipartisan talks over police reform have fallen apart. president biden says he is looking into further executive actions he can take on that matter. the naacp says law enforcement unions and partisan politicians are standing on the wrong side of history. meantime south carolina republican senator tim scott who was negotiating says democrats squandered a crucial opportunity to implement meaningful reform. the military officers of the u.s. and russia talked today for six hours in finland. the session with joint chiefs chairman general mark milley combings as the u.s. tries to secure basing rights and other counter-terrorism support in countries bordering afghanistan. russia has warned any deployment of american troops in countries neighboring afghanistan is unacceptable. >> take a look at life for women inside afghanistan. as the taliban consolidates its power there the most recent ministerial announcements in kabul once again included no women. this occurs as the taliban fights both a public relations battle and a military one on the ground. correspondent trey yingst is there. he has the latest tonight from the afghan capital. >> right now we are with the taliban unit inside the afghan capital of kabul. they are patrolling the streets not only for criminals but also isis-k fighters. isis has launched a number of attacks against the taliban in recent days killing dozens of their fighters. two taliban fighters and three civilians killed in a shooting attack today in the city of jalalabad of as the security of afghanistan continues to deteriorate. taliban ramping up patrols. >> he people who fire at us. no problem for us because we are defending our own soil and our religion. >> but the group is implementing a tribal interpretation of islam further disenfranchising women in afghanistan not allowing them to participate in society. this week the taliban announced new prime minister minister roles and declined to appoint any women. women working in municipality positions must now give up their roles to men unless no man is available to fill the job. in a true orwellian twist the taliban has renamed the ministry of women's affairs to the ministry of vice and virtue. not surprisingly there are no women serving in top positions here. >> the changes drew a small number of women to protest over the weekend in the afghan capital as women fear what comes next. >> for the future we are afraid. we don't know how to live under the taliban regime. how can our children grow up in this society in this community? >> bret: fun to watch. mike, thanks, one of the losses for the president in recent days and weeks the mainstream media. the honeymoon looks like it's over. what had been a very favorable approval has turned in recent days to frustration and criticism. we get examples tonight from fox news media analyst and host of fox news media buzz howard kurtz. >> hey in two months i will be able to say the next president's name out loud joe biden. >> "the view" is no longer celebrating president biden as television screens are flooded with images of haitian migrants being mistreated in a texas border town. >> the way people are being treated on that to me is absolutely more disturbing. >> so disappointed in the biden administration today. so very disappointed. >> also more skepticism at msnbc. >> how about the message from our vice president. where is she? she was supposed to be in charge of all of these migration issues. >> from the border crisis to the afghanistan disaster from covid booster delays to democratic infighting over big spending bills, joe biden is now drawings the most negative coverage of his presidency. >> i think he has got a pretty big credibility crisis on his hands. >> and interviews with press secretary jen psaki are turning tougher. >> we are still getting hammered for how the withdrawal from afghanistan happened. what are we doing to justify or explain what appears to be very bad behavior on our part now? >> we don't see it that way. >> if we had an honest press, this country would be even greater. >> while biden isn't facing the outright journalistic hostility that define donald trump's tenure on both sides, the press is now questioning his basic competence. as for access, white house reporters were furious when biden met boris johnson, british journalists getting two questions and they got none. >> got to go. >> thank you. it's not unusual for presidents to draw tougher media scrutiny as problems pile up and this president's political fortune could say rebound. what's clear is that the media are no longer giving joe biden the benefit of the doubt. bret? howie, thanks. facebook is being sued tonight over alleged efforts to try to shield its ceo from government scrutiny. also tonight, facebook's oversight board says it will review its just revealed policy of giving high profile users preferential treatment. fox business correspondent jackie is in new york tonight with details. good evening, jackie. >> good evening to you, bret. that's right. after initially pushing back on the "wall street journal" report about white listing certain users facebook's oversight board will review crosscheck system now even more pressure on facebook as another lawsuit filed against the company last year has become public. in this suit, two rhode island pension funds facebook shareholders accuse the company of overpaying the ftc, the federal trade commission, to stop an inquiry into ceo mark zuckerberg. the original fine was 106 million. the payment was $5 billion. what was the extra money for? well, the state says this all goes back to the cambridge analytica data leak from 2015. recall that before the 2016 election political candidates were getting data from cambridge analytica and that data has harvests from millions of people's facebook accounts without their consent. a shareholders first concern is that company funds were being used to ensure that facebook's ceo zuckerberg and the company's coo wouldn't have to be deposed or face personal liability. the second in light of last week's "wall street journal" report is that the company hasn't focused enough on oversight since cambridge analytica. be instead it has enabled him and paid billions of dollars from facebook's corporate coffers to make his problems go away, end quote. facebook not commenting on this. bret? >> i don't know that the -- the format whether it is multiple shorter q and as or a longer formal press conference is at the top of the list of the american public's concern? >> bret: just a taste of the white house's briefing today the questions on a number of different fronts a litigation bit more pointed. the biggest is the border crisis del rio, texas, the haitian immigrants we know some have been released into the u.s. we don't know how many. the dhs has put out a statement saying those who cannot be expelled under title 42, that's the health ruling, and do not have a legal basis to remain, are placed in expedited or full removal proceedings. individuals who have not immediately reoperated are either placed in alternatives to detention. tee it and i in ice facility or released from a legal document either a notice to appear in court or a notice to report to ice office for former immigration processing. the document an individual receives is dependent on facility space and resources available to process. so you can process all of that it's messy. let's bring in our panel katie pavlich news editor at town hall.com. kimberley strassel. charles lane opinion writer for "the washington post." what about how this administration is handling this moment kimberley, especially when it comes to the border? >> i think if you step back, one of the problems that joe biden just has in his presidency is he has yet to pick a spot. he ran as a moderate, right? and if you look out there, the vast majority of americans want a secure border and so that requires him to go and deal with this haitian problem. at the same time, he is trying to cater and has been from the beginning to progressives demanding policies that are mind the reason why we are having these surges and the administration administration are seems not willing to change track on policies. you end up with the hits from both sides and until this president decides how he is going to govern, i don't see how that changes in any other issue as well as either. >> bret: as this is happening, obviously reporters are asking for specifics. specific numbers. lawmakers are asking that, too. here is a comp comp politician of the lack of data. >> the perilous journey is not the one to take. one risks one's life the life of one's loved ones or a mission that will not succeed. >> how many people have been returned? how many people are being detained? how many people have been dispersed to all points around america? >> senator, i would be pleased to provide you with that data. >> i want them now. >> i work 18 hours a day. okay? so when i return from yesterday's hearing, i actually focused on mission. we will get that data both for the senator who posed it yesterday and to you, congressman today. >> bret: we don't have it as 6 yet, chuck. we know from authorities on the ground at the border that they estimate thousands of haitian immigrants have been released into the u.s. on notice to appear and we know how that goes. >> i think it was a little unfair and the usual hearings grandstanding to sort of badger secretary mayorkas for those numbers? but, yes, it would be helpful to know what the figures are? on the other hand, bret, i think it's pretty obvious that's a lot of people. furthermore, it's going to be more people. there are people moving through mexico now hoping to get across the border. although i think if you are against having more of this, you have to at least give the administration credit for doing enough deportations now to deter some people who are thinking about coming. there is some evidence in the reporting that migrants are telling their family members who are on the way that it's not such a good idea. look, the bottom line here is we do not have law and policy in place to deal with the fact that a lot of people want to come to the united states on the one hand and on the other hand, a lot of them don't meet the criteria for asylum. unless and until republicans get it through their head that this isn't just something to exploit for political purposes that something we really need to do and they can work together with democrats, and democrats, on the other hand, get it through their head that no, we can't have open borders, i think we are going to be stuck in situation. >> bret: democrats trying to put in immigration reform or a pathway to budget bill is not the way. katie, obviously they are concerned about border security. tonight msnbc is reporting the biden administration is seeking a private contractor to operate a migrant detention facility at guantanamo bay with a requirement that some of the guards speak spanish and haitian creole. that would be quite a turn for gitmo if that, in fact, happens. and you wonder what the democrat response to that will be. >> file that suggestion if president trump did it and i'm sure the media would have a very different take on that even suggestion of what's going on. the reason why maybe that's happening is because border patrol has told the administration that there is intelligence that interest may be thousands more haitians goings to the border. and when you have an administration that is standing up at press conferences during briefings with reporters and repeatedly telling the american people who are watching that they are not seeing what their eyes can clearly see with camps being set up, with people crossing the river and border patrol agents trying to do their jobs and stop them from coming, they can see what's going on. and, in terms of what is happening on the ground, there is bipartisan agreement in places like texas. you had yesterday governor greg abbott with the mayor who was a democrat in del rio coming together to address this crisis. the democratic mayor of del rio has said joe biden to visit the border. and the bottom line until there is a policy change, rather than words from dhs secretary mayorkas not to come that it's a dangerous journey for you, not to send your families, as long as the biden administration allows family units to stay and for the bar for staying in the united states to be a simple statement of i feared for my life i'm seeking asylum for my country and i was persecuted which is a very low bar, this will continue. this will absolutely continue and will continue to see these horrific humanitarian situations playing out on the border. >> bret: obviously this is being asked about now. it's being talked about now. it wasn't for weeks as this was happening, kimberley. the one thing that was talked about this week more than anything else was this image of the border patrol agents on horseback and using the reins there and there is one particular image that people started saying was whips that they were using. that is not the case. just take a listen to this. >> what the hell are we doing here? what we witnessed takes us back hundreds of years. what we witnessed was worse than what we witnessed to slavery. >> those individuals were placed on administrative leave and will not be interacting with any migrants. we are not going to stand for that kind of inhumane treatment. >> border patrol has had those horse brigades for a while. they have had them for a while. they don't carry whips and they do not carry lassos. what are they supposed to do just stand there and let everybody come in? we are a long way from 2022. >> two schools of thought, the progressive view is that the way to win this election next year is to pass a lot of bills that the polls say are popular and that will fill many of the promises that they made in 2020, including the president biden made and moderates look at it from the point of view of their districts which are a lot closer and say if we embrace that entire agenda, i'm going to lose my seat which is part of losing the house. and the truth of the matter is, bret, with redistricting and the usual trend of a president's first term being unfavorable in house elections. democrats really don't have a great chance to begin with of holding the house. in a way, i agree with kim, what's going to be really interesting to watch is how president biden defines himself, which will affect 2024. is he going to govern with the moderates or is he going to follow the progressives in his party? >> bret: kim, that is a good question because obviously he campaigned as somebody who was going to work across the aisle and be bipartisan but he is governing, at least the legislation that he is advocating for much more like an fdr figure or progressive figure. gore. >> and i would have to say that that is behind these fall and these poll numbers. in one way, you can make the argument that maybe the best thing that could happen to joe biden would indeed be the failure at least of this 3.5 trillion reconciliation bill. yeah, progressives would be angry but it would be a chance for him to re-set get back to that and what he said he was going to govern as, claim that infrastructure bill as a win, as a bipartisan win and start afresh and we will see if that has landed on him whether he want it or not. >> bret: yeah. katie, i mean, the battles don't help the president up on capitol hill when progressives are saying take out the iron dome funding for israel and the replenishing of those missiles. they managed to squeak it back in the bill but the progressives are not happy about that. >> and that will certainly be another issue that they will have to fight over to get what they want. but in terms of the iron dome, it's a bigger question obviously of american foreign policy when you have people like congresswoman ilhan omar on the foreign affairs committee in making those big decisions when the iron dome specifically a system that is defensive to protect christians, jews and muslims in israel from being murdered by iranian backed iraq and iranian rockets. they make this argument that they are standing up for the palestinians, the reality is about the iron dome it allows israel to defend itself against rocket attacks specifically from gaza in recent times and it allows them to have a buffer zone so that they don't have to respond immediately with fighter jets or drones in places like gaza. and so, it not only puts innocent civilians in israel at risk but puts civilians in gaza at risk as well because hamas, of course, uses them as human shields. >> bret: chuck, do you think that the president not answering a lot of questions, lyle any questions in recent days has hurt this white house or they are playing it kind of like the election?
