brother. yesterday capitol hill police officer william evans was killed in that attack at the capitol prim perimeter the disict slammed a car into a barricade, raises new questions today about security around and will be reopening to the public completely. so what do do ceo of the solutions of former secret service special agent, and former department of homeland security advisor charles this attacker hit that barricade which is, you know, a security measure that was placed there potentially the ward off terrorist attackings. what do you think can be done to reduce or end these type of assaults or is that simply in this day and age not possible? >> yes. thanks eric you know what we saw yesterday with the vehicle ramming the barrier and armed assailant attacking two capitol police officers is just one threat in a multitude of threats that the u.s. capitol receives and encounters on everyday basis some are none, like yesterday as it appears it was unknown. right, this guy is off the radar not on the radar. and any law enforcement agency, and that's where these established permanent security perimeters come into play. so as a result, yesterday, we saw the system working exactly how it should. we saw the vehicle barriers perform the way they should we saw the two police officers perform extensionally well. exactly the way they needed to eliminate a threat very quickly. but as we think about perimeters following the task force report that was requested by speaker pelosi and led by general, this has to be a what deemed reasonable and balanced while still being able to stop what a realistic and common threats that the capitol is beginning to face. >> eric: when you talk about reasonable balance talk about that fencing that was put up after january 6th attack on capitol hill. i mean people say well it wouldn't have happened if fencing was still up others say that fencing was too much but, i mean, any sense of entry where it was there right on the outside the rustle senate office building or down constitution avenue, you know, perpetrators still have access to whatever point that entry is and it could be sensitive. >> yeah. that's right eric. i think this is where strong intelligence programs come into play here, and this is one area that the task force focused on extensionively and that is an intelligence program that is able to pull all of this information together where you do know about a eminent threat and you're able to respond. i think they brought up the specific example of mobile fence right we saw the white house expand the perimeter around the white house during this summer riots where they pushed it out to h street down the constitution just south of the ability to respond to intelligence. collect it, analyze it and then have the maines mechanisms in place to expand accordingly but fencing around capitol right now the president of the national guard these are just not long-term solutions. that are going to be acceptable to either congress or the general public in d.c.. and the capitol police find themselves in a tough situation of building berchg within their department to make sure they have the capable resources to respond to these types of threats. >> and then there's the broader issue this -- this suspect was unknown noah greene 25 years old. not a terrorist attack they suspect his brother -- according to "the washington post" say there's some violent type of argument on thursday night that they family does suspect a potential mental illness depression, a star athlete. but past few years descended into apparently the family says a paranoia deep religiousness and mental issues. how can we protect against or is it possible at all to deal with that and what will authorities be delving into when they look at his background? >> yeah. so ultimately when you don't nobody a threat what we saw yesterday was question saw what is known as the last line of defense perform. right in terms of physical perimeter barriers, and the police officers that, you know, in some situations, they are ultimately going to be eric, the last line of defense for a place like the capitol ultimately capitol police are a protection oriented law enforcement agency. and in some of these instance when is you don't know about them, you just cannot prevent them entirely ahead of time. what they're going to be doing investigatively the bureau will attacked leads and see joint terrorism task force participate to make sure there are no terrorism related it ties to this individual. and they'll start going thoroughly into his background going through social media talking to friends, family, coworkers, and this is not uncommon eric in the washington, d.c. area. where we do experience people suffering from mental health illness, that do travel from far distances away to come to the government because they have some perceived injustice that they feel that a particular element of the u.s. government is committing against them. so it's hard to -- >> yeah. sorry. eric: on that point for we cannily he apparently was a follower of the nation of islam and louie has been avid against vaccines is that something to look at potential influence or any type of factors like that? >> so they absolutely will in terms of an ideology, they're going try to find out did he take this action based on the specific ideology? this was where the terrorism element comes in. right? did he take an action based on the particular religion? or was it the mental health issues that just kind of pushed this over the edge? so that's why, you know, in terms of calling these types of incidents early, i'm not a proponent of that. let's see how this plays out. and we'll get the information ultimately from the investigation on what the motivation was for this individual to carry out this attack. eric: of course, our hearts and our prayers are with the slain police officer william billy evans who is an 18 l-year veteran capitol hill officer evans showed the great courage and bravery of what our law enforcement officers across the country have to face every day. >> absolutely. eric: we should remember >> absolutely. >> what level of force might that be? >> that would be the top tier deadly force. >> why? >> because of the fact that if your knee is on a person's neck that can kill them. >> and that is the head of the minneapolis police department's homicide division on the stand yesterday at the trial of derek chauvin. criticizing the actions of the former officer accused in the murder of mr. george floyd. lieutenant richard zimmerman testifying that kneeling on the neck of someone who was handcuffed lying on his stomach is, quote, totally unnecessary. let's bring in our legal panel now mercedes is a fox news legal analyst and richard st. paul is defense attorney also a member of the republican lawyers association. so lieutenant zimmerman testimony a blow to defense mercedes what were some of the other strengthses in the prosecutors arguments and witness this is week? >> well without question aside from mr. zimmerman it was the bystanders which was gut-wrenching. these testimony that came forward by those individuals, many of them cried on the stand many of them said they stood by helpless that it was clear to them that there floyd was dying underneath the knee of officer chauvin. so it was very painstaking to hear that i'm sure that a lot of jurors sitting there were moved by that testimony. in fact, one of the bystanders wuct even cross examined by the defense they allowed direct testimony to stand as is. so it certainly a powerful blow to the defense, and it really resonates the message being to these jurors, if all of these individuals standing around watching this interaction between the officer and mr. floyd, and they understood how grave circumstances were yet the officer chauvin never stood up, it is like what is prosecutor started in the opening testimony when he said he didn't let up and get up. let up and get up you're going to hear that over and over again. and at one point what he should have gotten let up and get up certainly at the point where mr. floyd was no longer conscience. which is over three minutes to four officer chauvin release his hold on mr. floyd. arthel: richard what was strength in defense and witness this is week? >> so, to start off with lieutenant disem or man defense tried to shed some light on the fight that lieutenant zimmerman head of homicide in minneapolis police that he had not been patrolling on the streets for over 20 years. that is that he had not been a patrol person since 1993. and really that officer chauvin who was a 19-year veteran in 19 years patrol officer mean that they do patrols on street that they assign to l property city that lieutenant zimmerman hadn't had an experience in so long and wasn't familiar with having to arrest somebody, and that his -- followed up investigation so i think that's what defense wanted to highlight is that he is does not know what it is like ton on street and how to deal with people and arrest them and what force is necessary to arrest the individuals. so that was part of what the defense was showing cross-examination of -- >> mercedes i'm sorry so far that seems to be a weak argument when trial resumes on monday when side bears bigger burden to get their desired outcome mercedes ripped give me a short one minute on that one. >> there's a burden of proof rest with the prosecution but you can tell from the opening statement how powerful the testimony is going to be. this whole case is geng to rest on the toxicology report and defense will come forward and has been highlighted in opening that their going to rest heavily on toxicology report and the defense is already said don't focus on the nine minutes and 29 seconds like the prosecution wants you to focus. let's focus on experts and focus on 100,000 pages of evidence that hasn't come in yet. let's focus on these other testimony that's going come in as well. but in the final analysis, the prosecution has a very powerful case. that video alone especially when mr. floyd is no longer conscience, why is officer chauvin still on restraining him with his knee on his neck and that's what that -- devastating blow not sure how they're going to overcome it in the defense. >> richgd let me give you another 30 seconds -- >> sure very quick we have not reached meat of this case the meat solely relies on did officer chauvin put in his knee and george floyd's neck cause his death?
