good morning. >> good morning, trace. the news about effective vaccines and antibody drugs can't come fast enough as the nation braces for what is predicted to be a new holiday wave of covid cases despite the dire warnings and all the restrictions put in place to keep people safe. the news you mentioned there at the top today a major announcement from astrazeneca that says its late stage trial shows high-level results from clinical trials in the u.k. and brazil. that coming after the federal drug administration set a date of december 10 to discuss fisa's request for an emergency use authorization for its vaccine with a near 95% efficacy rate. moderna on track for approval with similar rates of effectiveness for its candidates. if all goes well the fda approvals immunizations could be happening by mid-desilvio piet warnings from health officials not to travel. the thafrption giving week get away is ramping up with tsa reporting 3 million passengers went through airports friday through sunday. the highest three-day total since mid-march as states across the u.s. clamp down with new rules. 34 states have some types of restrictions. three states curfews and 13 state mandatory travel quar an teens and the governor of oregon is telling people to call the cops if restrictions aren't followed. several communities across the state will see new restrictions coming soon possibly as soon as this week says governor cuomo. he will take a microcluster approach with areas of high rates of covid cases instead of doing a statewide or regional shutdown. >> trace: laura engel live on long island. >> sandra: more on the lockdowns happening throughout the country let's bring in byron york from "the washington examiner". you've seen the pictures and videos of lines at airports across the country, two million travelers over the weekend. seems like people are hitting the road. they are going to visit family. but many of these states are trying to put folks on lockdown and stop the spread. a lot of difficult decisions americans face this holiday. good morning. >> right. no doubt about the crowds we're seeing at the airport. i think what we're going to see a new face of lockdowns. which is as you just heard a more microtargeted lockdown strategy. we know president trump says there will absolutely be no national lockdown under him. joe biden has said there would be no national lockdown under him, either. several states have said they were very hesitant to lock down their entire state. so i think what you are going to see is a much smarter policy of trying to go where the virus is worst and enact various policies there. but that are not a one size fits all policy for an entire state or certainly not the entire nation. >> sandra: i can't help but go back to the oregon story that laura brought up. call the cops if you think he see activity that shouldn't be happening. calling on communities to police each other during these times of being thankful. a tough call for soe. what if you see a party of 150 teenagers gathering in the backyard? what do you do? >> well, calling the cops seems a little extreme. we'll probably have a few stories of that. one of the reasons we're seeing curfews is because of that, people -- some local governments are trying to reduce the number of contacts that mostly young people have late in the evening when they go out to bars or house parties or things like that. now, in terms of bars, you can have a curfew. you can shut them down. in terms of house parties, those are at people's individual homes. very hard to police. we'll probably hear stories of a big gathering here or a big gathering there and the controversy in the neighborhood that it causes. >> sandra: so many people college kids come home the wednesday night before thanksgiving and want to see high school friends. put this up on the screen. tsa checkpoint screening. the numbers we're seeing this holiday from november 20th to november 22nd over 3 million tsa checkpoint screenings reported. the highest three-day total going back march 14-16. a spike in travelers there. meanwhile we're learning more about what a joe biden cabinet may look like. joe biden presidency, administration. we now know he is expected to pick antony blinken as his top diplomat. he was a top foreign policy advisor during the 2020 campaign. he has close ties with him that go back nearly 20 years. the papers describing him as a centrist on foreign policy. >> well, they are all democrats, of course, because joe biden is a democrat and he will have a democratic administration. he is described as a centrist. jake sullivan former top clinton aide is going to be the national security advisor. we are supposed to hear this tomorrow. look, there will be a lot of disagreement between the parties about the president biden's foreign pollz. his apparent intent is to spend his first months undoing what president trump did. he wants to get the united states back into the paris climate accord. back into the world health koertion. to renew or restore the iran nuclear deal. remember, robert gates, who was a secretary of defense and cia for president bush and obama. bipartisan once wrote that joe biden had been wrong about every major foreign policy issue for the last 40 years. and anthony blinken was by his side. the idea to divide iraq to three states. fight against isis that was very ineffective. you will see a lot of republican criticism of this new group. however, this is in democratic terms a centrist group for foreign policy. it's when we see the domestic team announced and maybe see conflict between biden and the progressive wing of his party. >> sandra: bernie sanders is warning this. it seems to me pretty clear that progressive views need to be expressed within a biden administration. it would be, for example, very insulting if biden put together a team of rivals. there is some discussion that's what he intends to do. including republicans and conservative democrats and ignored the progressive community. that would be very unfortunate. aoc and others have talked about warnings about his centrist his cabinet seems to be. >> look for treasury and labor. a lot of names yet to be announced. >> sandra: great point. thank you. >> trace: trump campaign is moving forward with legal challenges in key states. filing an appeal in pennsylvania after a federal judge tossed out its lawsuit over the weekend saying the campaign was trying to disenfranchise nearly 7 million voters. growing uncertainty in michigan over today's plans to certify election results there. if the two republicans on the canvassing board don't agree to certify the state could wind up deadlocked. garrett tenney is live in chicago. what's expected to happen with today's vote there? >> trace, there are some indications that at least one of those two republicans may vote against certifying the election results. one of two republicans on the state board of -- someone said he plans to not certify the results. his wife claims the trump campaign cited her accounts challenging the results in michigan which has been dropped. this weekend, though, michigan secretary of state said the role of the state canvassers is very clear and that they are legally obligated to certify the results. >> every county has certified the election results. i fully expect p state board of canvassers to do the same tomorrow. that said there are also lots of protocols in place to address any type of abdication of responsibility. >> if the board does not certify the results it likely only delays the inevitable. it would go to the state court of appeals and state supreme court. they will demand the board fulfill its duty and certify election results. the governor can replace any of the board members if she chooses. if that fails to reach a conclusion it could then fall to the state legislature, the gop-controlled state legislature to make a decision. however, on friday after meeting with president trump at the white house the top two republicans in the legislature released a statement saying we have not yet been made aware of any information that would change the outcome of the election in michigan as legislative leaders we'll follow the law and normal process regarding michigan. the candidates who win the most votes win elections and the electoral votes. joe biden leading by more than 150,000 votes in the unofficial results in michigan. the state board of canvassers expected to meet at 1:00 p.m. this afternoon to certify or not certify the results. we'll keep a close eye on all of this, trace. >> trace: we'll have the news out of that. garrett tenney live in chicago. thank you. >> sandra: climb on the rides in several american cities murders shooting. a flame thrower in new york. what's behind the spike in violence happening across america? >> good morning. i think what you're seeing is people are angry and rightfully so because what we continue to see is executive order after executive order. in this case a hollow executive order that has to do with curfews at night rather than real leadership we need out of the governor and sacramento that we're not getting in california. where is the executive order to reopen schools safely for kids and teachers? where is the order to fix our unemployment department where we have over 500,000 californians who have been put out of their jobs, out of work but yet can't get their unemployment checks? that's what you are seeing in california. people are hurting. and rightfully so. and they're not getting what they need out of this governor. >> trace: you've been harsh on the governor and tweeted this saying his kids can learn in person talking about his kids going to a private school but yours can't. he can celebrate birthday parties but you can. he can dine on a $350 meal during the worst recession in generations but you definitely can't. can you believe this? i can't. clearly a critic of the governor. what would you do differently? you talked about some of the executive orders. but in this pandemic what would you do differently? >> accept the rules you have to follow. secondly what you are seeing is the state as big and diverse as california. asking local leaders at the city or county level to say what are the precautions and the things that you should be doing in your area? and instead we get a one size fits all policy in california that clearly is not working. i spend a lot of day on communicating being safe, making sure you are doing physical distancing, wearing a mask. we have to have a governor that understands that you've got to work with your local counties and if are you going to put out rules you better follow them yourself. >> trace: you talk about one size fits all. i'm curious. some of these sheriffs talking about the curfew from 10:00 p.m. to 6:00 a.m. a lot of the sheriffs in several counties said they won't enforce the curfew. the sheriff in san diego county says he will enforce the curfew. what do you think about that? >> education first approach. the reality is you aren't going to ticket your way out of the coronavirus. that's -- when you get back to the hollow executive orders on curfews that come out of the blue with no science behind it and difficult people in california to understand where it's coming from and why it's happening. i think it's another great example of why this governor is just simply out of touch with what's happening in california >> trace: you talked about running for governor yourself against newsom. how can a moderate republican in california largely controlled by democrats and republicans that are here the end to be a bit further right? how does a candidate like you win? >> look, i'm giving serious consideration. we need new leadership in the governor's office. i'll tell you our demographics in the city of san diego mirror those of the state in terms of party registration. i have been elected for two terms. it is not about results, not rhetoric. one example. as we've seen homelessness skyrocket across the state of california the last several years. san diego county is the only county where homelessness has gone down because i take a very compassionate yet firm approach to getting people off the streets. that's the type of leadership that we need in sacramento. it's not about partisan politics it's about getting results. >> trace: san diego mayor kevin faulconer, thank you. >> sandra: we're minutes away from the opening bell on wall street as we begin a new week. more good news on a coronavirus vaccine expected to lead to a triple digit rally on the open this morning. we're keeping our eye on that plus a biden senior advise o*sh accusing president trump of trying to subvert the democratic system by challenging election results. is that going too far? >> we're open to doing whatever is necessary to make sure that this election happened in the proper way and again every legal vote gets counted. for over 30 years, lexus has been celebrating driveway moments. here's to one more, the lexus december to remember sales event. get 0% financing on all new 2020 and 2021 lexus models. experience amazing at your lexus dealer. >> trace: bottom of the hour. top stories. covid-19 cases surging across the country with over 12 million positive cases now reported since the pandemic began. >> sandra: oregon governor encouraging residents to report anyone violating covid-19 restrictions. >> trace: police arrested a 15-year-old in connection with a mall shooting in a suburb of milwaukee. several other arrests made in the shooting that occurred on friday. the investigation there is ongoing. >> they have two or three legal constitutional paths, one that the courts changed what the legislature did about counting ballots after the end of election day. they also have a winning issue in the supreme court on equal protection that some counties allowed flaw ballots to be cured while others didn't. the other legal theory they have which is a potentially strong one is that the computers fraudulently or by glitches change hundreds of thousands of votes. >> sandra: constitutional law attorney alan dershowitz talked about the lawsuits. let's bring in our panel. sean duffy and fox news contributor and robert wolf. good morning to both of you. both sides here. robert, to you first on alan dershowitz laying out the path for victory to the president as they move forward with lawsuits. >> listen, i'm not a lawyer so i'm not going to challenge dershowitz. i don't think i agree with anything he just said but i'll look at what chris christie said. can't continue to act like something happened that didn't. the republican judge said. not the power of the court to violate the constitution. larry hogan, the chair of the national governor's association saying stop the nonsense. we're acting like an banana republic. take republican's words. >> sandra: here is larry hogan in his own words. >> we used to go supervise elections around the world and the most respected country with respect to elections and now we're beginning to look like we're a banana republic. it's time for them to stop the nonsense. it guess more bizarre every day and i'm embarrassed that more people in the party aren't standing up. >> sandra: sean, do you share in concerns as the trump legal team continues with this? >> i don't. donald trump is following the law. he is following the constitution. he has legal rights and he is exercising them to have the election reviewed. you compare that sandra to what democrats did over the four years of donald trump's presidency. obama-biden deep state had a war on donald trump for four years. you look at what happened in my state of wisconsin. we have voter i.d. laws. democrats in democrat counties used covid to skirt unlawfully those voter i.d. laws and let people vote that never showed an i.d. i think we have a legitimate right to look back at the election. if these legal challenges failed donald trump will be out of the white house on january 20th. no one has to be concerned about that. for democrats to make claims that donald trump doesn't have a right to review the election when they've been messing with him for four long years? give me a break. >> sandra: sean, to what have you seen so far that makes you want to continue to push forward with this fight? >> i look at wisconsin. we had -- contrary to our state law we had clerks curing ballots. they can't do that, right? that's challenge number one in our state. we had people in wisconsin who claim they were indefinitely confined because of covid and sent mail-in ballots and didn't show i.d. that breaks our law. so we have many challenges in our state and even if you go to pennsylvania and michigan, we have republican poll workers who weren't able to see the process per the law and court orders. there is real concerns. it is not even for this election. we have to look to future elections to make sure they're fair and equitable. >> sandra: fair enough. we've heard it from republicans who say the fight should stop at this point but what we've learned so far hopefully there is improvement in the system. here kate beddingfield. >> we're talking about donald trump actively trying to overturn the will of the american people state by state. what we see across the board is courts across the country, governors and secretary of state across the country are rejecting that. >> sandra: she is saying he is seeking to subvert the democratic system with the legal challenges and says biden does not have any concern about these trump lawsuits. has she gone too far, robert? >> i don't think so because the courts, maybe the trump administration is 0 for 35 or 0 for 50. i don't know what the number is. one state has thrown out every hour it feels like. unfortunately i think sean is better than what he is trying to -- he is talking about sidney powell. this election wasn't about a conspiracy theory. president-elect biden won 305 delegates. president trump called it a landslide in 2016. it's still a landslide today and time to have the appropriate transition and i think that it's hurting the country whether it's looking at the moratoriums that should be continued, the facilities that can be continued to make sure we have the right covid delivery process, all these things is what a normal transition of politics plays. this time that will move on. >> sandra: let me get sean to respond to that. but first here is lara trump on all of this. >> we again want the right thing to happen here and so far we have seen the fraud that has been uncovered. you've seen dead people have been voting. people voting in multiple states. the recount in georgia showed suddenly thousands of votes were uncovered. most of which went to donald trump that somehow they missed the first round. we're open to doing whatever is necessary to make sure this election happened in the proper way and every legal vote gets counted. >> sandra: what does it look like the next few days as we head into the holidays? new york is seeing a 95 -- a doubling of shooting victims and in chicago, pat, the goal this year by chicago police was to have fire than 300 homicides. they are now at 700 and it is november. what do you see happening here? what's the common denominator? >> the common denominator, trace, good morning, is actually very simple. until crime becomes illegal again, because a law that's not enforced is not a law. and until that changes, until that equation changes and crime becomes illegal we'll see skyrocketing gun violence straight across all our major cities. it is a very convenient narrative to lay the blame on the doorstep of covid. granted, covid is a contributing factor, no doubt about it. but riots for fun and profit. a desecrated police department in both morale and operationally and a a completely destructive and destructed rule of law relative to the adherence to it are the main drivers here. covid was a first cousin. >> trace: the police union talking about the political climate. the city council took away the ability of nypd to make arrests. we have cops right now hesitant to grab anybody simply out of fear that if it goes bad, we may get ourselves arrested. so there really is this hesitancy on behalf of police officers around the country, not just in new york. to really get involved unless they find themselves on the firing line. >> absolutely. and that's the diminishment and demeaning of the police morale. the reality is a brand-new term has come to light. called de-arresting. someone is lawfully placed under arrest for probable cause and de-arrest because police commanders under pressure from the media and politicians are saying certain crimes are no longer illegal. people get a free pass. so how does that affect it all? >> we've got good news on a couple of fronts here. as you mentioned, sandra, good news on the vaccine front. astrazeneca has good news. we received more good news from the service sector, it's expanding nicely and we also have good news from the manufacturing sector of the economy, expanding very nicely, thank you. that's why the dow industrials are up close to 300 points at this stage. you are getting right there at 29,554. as you say, sandra, wow. stock prices across the board are very close to all-time record highs. >> sandra: this is not the first good news we've received on vaccine trials. it seems like all the drug companies are getting closer, stuart, that's feeding into the market rally. almost 30,000 on the dow. stuart, this time of year normally we look at retail sales, right, heading to black friday, how the consumer will be spending. are we getting any indication of that? obviously a lot is covid news dependent, how good people are feeling about the economy. >> we're getting indications that this year is going to be a sensational year for online selling. when you look at the earnings reports of the big retailers, you look first of all these days at their on-line operation like wal-mart. they've done remarkably well. virtually doubling the amount of product that they're selling online. same story with target doing very, very well with online. then the gorilla, amazon, expecting a gigantic gains in sales this holiday period to the point where there is some real concern that they won't be able to get all the packages delivered at the right time. so that's a nice concern to have but it shows that the demand for the online people is just going through the roof. that, of course, is because of the pandemic. you are stuck at home. you don't want to go to the mall or store. you order online. that's how it works this year, sandra. >> sandra: i don't want our presents to get lost in the mail. have you done your christmas shopping yet? >> sandra, 2020 has been tough for the restaurant industry throughout the nation and we're hanging on in colorado by a thread. the restaurant industry is the biggest priefsh ot sector job creator and we're hanging on by a thread. >> sandra: you are quoted by this article. last call for restaurants and bars? i see what is happening to restaurants like yours across the country and wonder can you come back from this? how bad has it gotten? and once things do get better, we're reporting on another vaccine this morning. should things improve, are you going to be able to come back online as far as opening your restaurant doors in the capacity that you were back in february? >> well, that's a great question. right now i don't want to be super dark on this monday morning but our industry across the country will not be able to come back if there is not a package soon. there is the restaurant pack they have in the senate. our industry is hit like no other. the studies show me might lose 80% of all independent restaurants by the turn of the year because each week -- every two weeks is a payroll cycles and we lose restaurants every couple weeks. we can't do that. our industry is the cornerstone species to the whole u.s. economic system. you take 11 million restaurant jobs out of the equation, it will be really dark. >> sandra: bobby, as i talk to you and you talk about 11 million people affected and still out of work. in the restaurant industry for that you double the number of people affected as far as families and spouses and loved ones that they might be taking care of. so you are clearly sending a message to congress that they can step up and help keep restaurants like yours alive. what is the message? >> sandra, thank you. the message is to nancy pelosi and mitch mcconnell and president trump we need help and we need it now. we can't wait until the new year. our industry is hanging on by a thread. we need the restaurant backpack. there is a lever to be pulled to stabilize this major part of the u.s. economy. i want to be able to give leadership 2020 vision into the future if they don't react quickly. we will lose millions of jobs just evaporate overnight. >> sandra: i know you try to keep people on your payroll. days away from thanksgiving. people are looking to christmas and the holidays. a tough time. that level of uncertainty holds people back. what would you say is the big picture impact all of this is having on the u.s. economy? >> i think you will start in the next couple weeks because across the country we are seeing layoffs in the restaurant business. it will start this week because of the raging of covid and the fact of the matter is we need a package to stabilize this industry or we'll see millions of jobs. for every restaurant that closes it affects fishermen, farmers, delivery truck drives and you will see it whip saw through the economy. >> sandra: you are talking about new restrictions in denver. level red restrictions. no more indoor dining. it is cold there. when you get these notice you have tens of thousands of dollars of food that goes bad in your restaurant. it is an unbelievable burden on you. how is that new restriction, how will you weather that storm with snowfall in denver. >> outdoor dining is not a viable option in the winter for many of us. we had a beautiful summer but without outside dining it does not pencil out. i just have to be brutally honest. >> sandra: we know you are looking for a path forward for your employees and restaurants to remain open. unbelievable fight you take on with a lot of other restaurant owners and chefs across the nation. our heart goes out to you around the holidays as you fight that fight. thank you for joining us, bobby. >> sandra, thank you very much. thank you. >> trace: the kansas city chiefs hitting the jackpot in las vegas. mahomes threw the game-winning touchdown giving the chiefs the win over their arch rivals the las vegas raiders 35-31. the colts and packers go into overtime in indianapolis after a green bay turnover. colts rookie blankenship hits the game-winning field goal. indianapolis won that one. how about them cowboys? >> their economy is on the brink with the number of unemployed six months or more quad rupe ld during the pandemic. but the governor friday ordered a two-week freeze on indoor and outdoor gatherings to no more than six people from no more than two households. if you witness violators or know of any relatives who plan on it the governor says call police say it is no different than a loud party down the street. call law enforcement. some people in oregon think that freeze goes too far. >> we were starting to get back on our feet and oh, you know, take our legs out from under us again. >> violators face 30 days in jail or $1200 fine or both. some consider it ironic considering the governor had a hands-off approach to the 100 days of protests during the pandemic. >> trace: of course, los angeles county they're shutting down outdoor dining for restaurants this week again. william la jeunesse live in l.a. thank you. >> sandra: okay. south florida official forcing a bar to shut down after it was packed with crowds of young people jammed together. most not wearing facemasks. the fort lauderdale had just reopened friday night after being closed for most of the year. the county said the bar will be closed for 24 hours. the owner says it will stay closed until he can open normally. florida's covid cases are up 49% compared to a week ago. >> trace: more than 3 million americans packing airports across the country ahead of thanksgiving despite cdc guidelines to stay home for the holidays. the tsa saying this was the highest three-day total since the pandemic began in march. health experts reminding travelers not to let their guard down. >> if you are going to travel to someone else's home for thanksgiving, then if possible you should spend as much time outdoors when you are together. we should probably keep meals short and spend more time with masks on. and the smaller the gatherings. the beater. >> trace: the weekend figures were only around 42% of the number of passengers who passed through airports at the same time last year. >> closing businesses as we did then but what we're asking every person in ohio to do is to limit your activity, limit your contacts with other people. >> sandra: the ohio governor pleading for people to rally around the new curfew to help the spread of covid-19. in some places like california as we reported a few moments ago protests in response to new lockdown measures are happening. dr. bill bennett is former education secretary and fox news contributor and he joins us now. good morning, great to see you. there are so many tough decisions to be made at a local level, on a personal level. then at the state level when you see some of these restrictions. do they go too far or could they serve to help stop the spread? >> i think by and large they're going too far, the ones you've cited here in the report are going too far. hopefully we have the vaccines very soon which means this kind of totalitarian nightmare will be over. thanksgiving is a time we give thanks for things that matter. one of the things that matters to americans, sandra, is freedom. it is in our genes and dna. these kinds of things in california and oregon go right against it. one understands the protests. shutting down the businesses as well. a lot of these places are on the brink as an earlier report you just did pointed out. we cannot do that. we cannot destroy the country. think about the children, too. talking about the schools. think of what we're telling the children here. to be frightened and scared to death and they shouldn't be. so i hope this nightmare ends soon. these governors are going too far. you know, here come the police. put granny in the closet. hide the turkey under the table. we have seven at the table. what's going on here? >> sandra: texas governor abbott weighed in on the lock down's and suggested they don't work. >> we've all learned what works and what does not work. one thing that government does not need to do is to micromanage the lives of everybody. if you lock people down it will put them into confined areas where they can transmit covid just as easily without protocol. lock downs are overvalued. >> sandra: it's similar to what we're talking about in the schools, right? the kids aren't spreading it while in school. they are oef behind plexiglas and wearing masks. you shut down the schools and they gather outside of the school not wearing masks and they're crammed together. >> right. it was the safest places for kids to be. and we see the catholic schools in many of the big cities operate. are catholics immune to the virus? no. they exist for the sake of the children. many public school teachers exist for the sake of the children, too. not the people who run the public schools. not the unions. but you know, governor abbott gave voice to a sentiment earlier i had expressed. the situations is so odd now in oregon if you have too many people at your thanksgiving table you and your turkey and mother will be arrested. but if you gather a group of people to have heroin and cocaine it has been decriminalized, have all you want, not a problem as long as the group is not too big. >> sandra: "the new york times" takes all this on in an opinion piece. how to deal with people who ignore covid safety. let's assume they aren't necessarily going to listen. americans need to start thinking about controlling the pandemic under the assumption people won't necessarily listen. the alternatives are more extreme. lock downs and punitive measures to stop large gatherings. let's take the point on testing. dr. bennett. is it worth pressing the point that you can't get a test everywhere if you want one and is that a failure at the federal level, state level, what is it? you see these lines and you know there is limited capacity in some of these lines. they cap it at 600 a day. then people who want to be tested can't get tested. shouldn't there be testing capacity for everyone at this point? >> yeah, and there will be. it is increasing. there will be vaccine capacity for everybody pretty soon. maybe mid-december it starts. late december and then into the spring. but remember, the testing is of limited value. lots of people test positive and they're in no danger. 99% of the people who test positive won't have a serious problem. americans haven't been defiant in a ridiculous way. they've been americans. remember the flag at the revolution, don't tread on me? they're feeling the heavy tread boots of these governors. they've worn masks. you can't go anywhere in america without seeing people in masks. even people driving in cars everybody is masked. americans will listen and do things. don't mess with their freedom. don't mess with their families, don't mess with thanksgiving. these are the clear messages. and again i think we'll be out of the woods soon because of the warp speed effort. we have three vaccines now coming. i don't know, some of these governors who are inclined toward the heavy hand, i wonder if they feel ambivalent about the deliverance that's on its way for americans? >> sandra: such a beautiful holiday. we hope everybody can enjoy it safely and we can get through this and to your point eventually see a vaccine sometime soon. dr. bennett, great to have you this morning. >> we're having two turkeys. mrs. bennett makes a practice turkey for gravy and the other turkey once the first one checks out. >> sandra: sounds delicious. we go to the bennett house. >> oh, you better not. >> sandra: not allowed this year. maybe next year. >> thank you. >> trace: fox news alert now. two people dead, multiple people hurt after a stabbing at a church in san jose, california last night. dan springer is live for us in seattle and dan, have authorities caught the suspect yet? >> trace: there is a lot of confusion whether a suspect is in custody or not. the mayor of san jose tweeted this morning that a suspect had been arrested but then san jose police tweeted an arrest could not be confirmed. local fox station reported that a 22-year-old man had been arrested but that report was later taken down from its website. we do know that the chaos took place just before 8:00 last night at the grace baptist church in downtown san jose. the church was being used as a homeless shelter to get people out of the cold. there was no service going on at the time. police say multiple people were stabbed. we don't have an exact number yet. two of the victims as you said have died from their injuries. police are still at the scene and say they'll update the story later today. they said they have a crime scene inside the church and also outside the church. more to come on this later. trace. >> trace: back to you as the news break. dan springer live in seattle. dan, thank you. >> sandra: president-elect joe biden wants to crack down on certain types of guns so could a new tax be in the cards for gun owners in this country? but what have you been doing for the last two hours? delegating? oh, good one. move your xfinity services without breaking a sweat. now that's simple, easy, awesome. xfinity makes moving easy. go online to transfer your services in about a minute. get started today. >> i do think it's hard to have universal rules. i don't think we can go that far. in places where they put mitigation procedures in place and community transmission in that particular school district is relatively low, i do think those are safer environments. >> the head of johns hopkins center for health security. more schools go to more virtual learning. experts say the science behind keeping kids out of school is being miscalculated. professor oster joins us now. you right in we're roonging for ways to control community spread shutting down schools is not the answer. other measures focus more on the locations and activities known to have super spreader potential would do much more to curb the pandemic. the theme here is that if infection rates at school were higher than the surrounding community it would be a problem. but they're not as you point out. >> yeah, i think what we're seeing is schools are reflecting their community and most of the patterns make it look like infections are being acquired outside the school and not inside the school. what that means is that if we close schools, we are not likely to lower infection rates in the community so it is a policy misdirection that's costly for kids and families. and doesn't seem to have a lot of public health benefits. >> trace: it is amazing. for the past nine months we've heard politicians say over and over again they're doing nothing but following the science, following the science. now there is some indications that maybe they aren't following the science, they're following the politics. listen to cdc director robert redfield. >> the truth is for kids k-12 one of the safest places they can be from our perspective is to remain in school. it's really important that following the data, making sure we don't make emotional decisions about what to close. >> trace: he is saying the science says kids can go back to school. you look at the teachers unions, national education association, politics, they say nope, kids cannot go back to skoo. it is not safe. your thoughts. >> i think we need to be careful about how we communicate this with people. i think part of the issue we're facing is there has been an aversion of trust between the teachers and parents and school districts and broader governmental forces. i think one of the things that will be necessary to get back to school in addition to controlling community rates with other measures, is to really try to rebuild trust in those groups and tell them this is safe and here is what we're doing to protect you to make sure it's really safe. that seems to be a struggle for all of us. >> trace: it is a struggle and the question is how do you do that? you talk about rebuilding trust here and right now in a lot of school districts and parents around this country the trust factor has broken down. i don't know how you rebuild that but a lot of parents and a lot of teachers are wondering where to start. >> i think one of the things is we now have a little bit of a breather because unfortunately between thanksgiving and christmas a lot of places will close and re-evaluate. i think we should be looking to january and thinking about what will it take is it masking poand communicating we're collecting the data and making sure it's safe and here are the things we'll do to open in january so kids can be in school from january to april when hopefully the vaccine will address a lot of issues. this month is an opportunity to try to get some stuff in place and try to rebuild some of this trust that has eroded with all the back and forth. >> trace: the governors of new york, and other states released a statement saying there is also growing evidence that the more time children spend outside of school increases the risk of mental health harm and affects their ability to truly learn. what are you finding about these other side effects that kids are experiencing because they're not in-person learning? >> i think you're increasingly seeing first the loss of learning. we see that over summer in a normal year. now we're seeing the summer melt continue through the fall and seeing lots of ill literacy in lower income communities and students of color and it is really concerning. we're exacerbating the inequality. for all kids there have been increases in mental health costs. people in emergency departments we're seeing a little covid in kids but a lot of kids coming in with really serious mental health issues. we need to confront that possibility that actually there are real costs to having kids out of school. it is not just learning. although it is learning. it is also all these other things. so there are reasons to have kids in school, which is why we need to figure out how we can do that safely in a way that makes everybody comfortable, all the stakeholders. >> trace: across the country it is becoming issue one. emily oster. thank you for joining us. >> sandra: thank you, trace. new york governor cuomo getting an award for his handling of the early days of the pandemic. does he deserve it? we'll get that ahead. the two senate runoff races in georgia attracting nationwide attention, activists calling on democrats to take big action to flip those seats. >> what's happening in georgia, everybody should be paying attention. to watch the democrats publicly say they want to cheat. they want to move into the state just to vote to determine an outcome, that should not be allowed. >> bottom of the hour. gun violence in chicago over the weekend leaves five people dead and 47 people shot. authorities say gun violence in the windy city is up 50% compared to 2019. >> sandra: astrazeneca and oxford university say their coronavirus vaccine is up to 90% effective. researchers also say there were no hospitalizations or severe cases in anyone who had the vaccine during the trials. >> trace: coming up tomorrow we're expecting to hear who some of president-elect joe biden's first cabinet picks are. another sign from the president-elect he is moving forward with the transition even as our sitting president, donald trump, refuses to concede. >> sandra: new york governor andrew cuomo is going to get an emmy award for his leadership in the early days of the coronavirus crisis by quote effective use of television during the pandemic. in his daily briefings he was seen by some as a comforting voice in uncertain times. many others have serious objections to how cuomo handled the crisis saying some of his decisions cost lives. our own janice dean lost both of her in-laws in the virus after the covid-19 patients released from hospitals went into long-term care. a difficult week for your family. thanksgiving without your in-laws. what is your message this morning as you learn about this award the governor will be receiving? >> i didn't think that the governor could make me more surprised after his leadership book, of course, was released over a month ago and he has been on a self-congratulations tour to all of the television and radio stations talking about his leadership and how he flattened the curve here in new york city as cases riseed. my in-laws were on the curve he flattened. so it is jaw dropping, insulting, sickening to see him accept an award for his leadership that we don't have answers to when it comes to the coronavirus patients going into nursing homes for 46 days because of his executive order. >> sandra: we were showing beautiful loving pictures of your parents-in-law. they had a beautiful relationship and lives ended too soon. here is bruce praisener. the 111 daily briefings worked well because he created television shows with plot lines and stories of success and failure. people around the world tuned in to find out what was going on and new york tough became a symbol of the determination to fight back. i'll let you respond to that, janice, by first asking you as you've been on this journey trying to speak up for your in-laws but also others who lost loved ones due to this, have you gotten any response from governor cuomo at all? >> no. i did get a response from his office in an interview that i did on friday and his office asked when my husband's parents died, the exact dates and what nursing homes they were in. that's the only responsive owe ever gotten and to me that's a question of prove it to us that your husband's parents died. how insulting. now, i have never received word from the governor or any condolences from his office or an administration. that goes for the thousands of other families that are going through thanksgiving now without their loved ones thanks in part to the governor's leadership. i don't know if i would take a phone call from him right now to be honest with you, sandra. >> sandra: janice, you were expected to testify. i know that you were expected to testify specifically on the investigation into his handling of the nursing home policy. then you were prevented from doing so. what happened? >> i was invited. i was supposed to be part of one of two of their hearings in august in albany. and i heard on a friday that i was disinvited because they were uncomfortable with my testimony. i later spoke to some gop leaders via zoom but it wasn't the same as getting my testimony written up and put into the law. we're still trying to get an independent bipartisan investigation into his covid pandemic response and putting covid patients into nursing homes and we still don't have the exact total number of deaths from seniors that got coronavirus in their elder care facilities but died in the hospital like my mother-in-law. >> sandra: i know you are quoted this morning saying if even one person hears about this story because i've spoken up, then it is worth talking about it. that's a very powerful thing. your voice is a very powerful thing especially for families who suffered from this who don't have the microphone and the outlet that you do, janice. final thoughts on this thanksgiving week. it will look and feel a lot different for your family. message to others who may have lost loved ones during this pandemic. >> i have heard from so many families that are suffering this holiday season because they don't have their loved ones. please know that i am speaking on behalf of you and this is not political, by the way. i have never been a political person. the only reason i'm speaking out is because we aren't getting those answers and the media the needs to hold this governor accountable instead of giving him awards. >> sandra: janice, our heart is with you and your family. thank you for joining us this morning. very important message. thank you. >> thank you, sandra. >> sandra: best to you. >> trace: could a new tax be in the future for gun owners nationwide? president-elect joe biden proposing a plan to help contain gun violence in america including a $200 tax on gun owners who don't take part in a buy back program or register their weapons under the national firearms act. hillary vaughn is live in wilmington, delaware. how would this plan align with biden's promise of no new taxes for anyone making less than $400,000 a year? >> well trace, the conservative group americans for tax reform says it is a contradiction. the mandatory fee that gun owners have to pay under this plan in order to keep their gun basically is a tax and it would affect millions of americans. gun owners who have semi automatic rifles are facing two options under a biden administration, according to his gun safety plan those options are quote, sell the weapons to the federal government or register them under the national firearms act. gun owners who don't want to ditch their firearms have to fill out a 13 page application form. submit fingerprints, a photo of themselves and pay $200. semi automatic rifles including ar-15, 20 million rifles in the u.s. would qualify under this new rule. cost up to $34 billion nationwide for gun owners overall. biden's policies are not just cracking down on gun owners but gun retailers, too. the firearm industry trade association warning this. the biden campaign stated he would use the atf as an anvil to punish retailers for even minor clerical errors threatening to revoke licenses and put them out of business. biden's policy also applies to high capacity magazines, too. the way they define that is any magazine that has more than 10 rounds. so here is the kicker, trace, if you have an ar-15 and four so-called high capacity magazines you would be required to individually registered all of those putting the tally at $1,000 for the fee for gun owners just to keep their guns and their magazines. trace. >> trace: we'll talk to somebody later on who is fighting the biden plan. hillary vaughn live in wilmington, delaware. thank you. >> sandra: teenager is in custody after the friday shooting that left eight people injured at a mall in wisconsin. how police say he was able to avoid arrest that day. more protests breaking out across california over a state curfew imposed in most counties there. some sheriffs say they will not enforce it. fresno county sheriff margaret mimms is one of those and joins us next. >> the governor's ruling by fiat. we won't allow that anymore. we are going to stand up and we are going to make a point. u shoa first. there's no money down, it's the best vehicle that a person who served in the military or is serving today has today to have a new home. if we can possibly get that veteran in a home we're going to do it at newday usa. why would you rent today when you can buy your own home and participate in the american dream? >> well this is consistent with the actions or non-actions we've taken since the beginning. i don't believe this is a law enforcement issue. we are so busy enforcing and keeping our citizens safe by arresting robbers and child molesters and home burglars. making criminals out of normally law abiding citizens doesn't make sense. >> trace: we talked about the crime stats in california that have gone way up. you won't criticize some of your colleagues. we should point out the san diego county sheriff says he will enforce the curfew. the los angeles county sheriff said the following. he is going to enforce it. we have a lot of options and pretty much on the voluntary compliance side. we get most of our success. if we start scratching paper meaning writing tickets there are consequences that need to follow from that and we don't want to get to that point. not to criticize your colleagues but what do you think of the various strategies being implemented across the state? >> well, i trust californians and most are doing the right thing when it makes common sense. so for instance when the governor talks about this curfew between 10:00 at night until 5:00 in the morning it's a head scratcher. is this virus so smart it won't infect people if they aren't in their homes by 9:59? we all make our own decisions what is best for our communities and in fact our local district attorney said she won't file charges or prosecute if they are brought to her. so it's consistent in our county with our joint efforts in keeping our citizens safe and trusting our people to do the right thing. >> trace: you talk about is the virus smart enough it doesn't attack people between 10:00 and 6:00 in the morning? a lot of people, a lot of businesses we talk to especially restaurants and gyms and hair salons that seem to be low hanging fruit. los angeles county is shutting down outdoor dining again this week. what do you make of these various things when you talk to the scientists sheriff and say we do not know where the vast majority of these infections, where people are catching these and yet some of the same businesses, some of the same curfews are targeting people again and again. your thoughts. >> our businesses, many of them are not going to survive this. when you look at big box stores and their profits and how they've gone up during this pandemic and we are losing our local businesses. that means local jobs. it is again i'll call it a head scratcher. i believe people will voluntarily comply when things make sense to them. however, this local curfew between those hours doesn't make sense. again, we need to really put our trust in people to do the right thing and most people in our local communities are. you hardly go anywhere where you don't see people wearing a mask these days. and i'm just encouraging our local communities when you are in a crowd and being exposed to other people. wear a mask, wash your hands and social distance. some of these restrictions and government control procedures are just not making sense to me. >> trace: and you mentioned head scratcher a couple of times. the man in charge of the head scratchers is the governor of california who said this. watch. >> daily cases in the state of california have doubled just in the last 10 days. this is simply the fastest increase california has seen since the beginning of this pandemic. >> trace: it is certainly getting worse, sheriff. is there a point in this where you think maybe you might take the governor's side on some of these different crackdowns? >> the message is that again we're seeing journalism become activism. tom friedman, a columnist like i am at "new york times." he goes on cnn on national television on cuomo's show and implores people to pick up and move to georgia solely to vote in that runoff on january 5. the problem is that's a felony. you can't move to a state just to vote and then leave right afterwards. that's what the georgia secretary of state says. you also have eric lev its of "new york magazine" says these runoffs will decide who controls the senate and if you have the means and fervor to make a temporary move to georgia. he deleted that tweet. it is a felony if you do that. we have this situation here where you have a huge contest, right? it is basically like this phone is your firewall between the house and the radical side of it and president biden in terms of legislation. if you have republican senate none of the legislation that some people in the house want to pass like abolishing ice or filibuster or electoral college. expanding the senate or supreme court or reallocating police funds or ending fracking. all those things never get to joe biden if there is a republican-controlled senate. kamala harris is is the deciding vote if these two win. we can't have people in the business telling people to commit a felony by moving to georgia. >> sandra: here is doug collins on sunday morning futures, listen. >> georgians need to realize the reason the democrats outside money is flooding into georgia now they want to fundamentally to take away the investigative powers of ron johnson and lindsey graham and others into the things we know have been happening. >> sandra: right in line with your message, right? the roads, rails and skies ahead of the holiday. welcome back to "america's newsroom," i'm sandra smith. good morning. >> trace: hello, i'm trace gallagher. aaa predicting 50 million people traveling this thanksgiving. the tsa screening 1 millionaire line passengers just yesterday. the highest single day screening since march. air travel expected to be down by more than half from last year. still some people are flying despite all the warnings about a surge in covid-19 cases. >> i think there are a few people still wearing masks incorrectly on the plane and stuff like that but for the most part everyone seems to be on board. >> it is not going to stop us. we're very family oriented and very close so me and my sisters, i don't care as long as ?oebd has covid wear your mask and wash your hands and everybody don't hug and kiss. >> sandra: in addition a study bioowe state university's med school found half of people say they'll get together with less than 10 people. jeff flock is probably a busy airport on this monday morning. jeff, good morning. >> you would think so, sandra, based on what happened over the weekend. not so much as you see now. if we go inside some people may not wear masks. if you want to go in an airport you have to put a mask on. as you can see right now not tremendously busy. as you reported look at the numbers over the weekend. it was the busiest weekend and busiest day since the pandemic started. in perspective it is less than half the normal number. it was 2.3 million on that sunday last year so there you go. but a lot of travel despite the cdc warnings. they are saying tragedy. they are recommending if we put up what the cdc has to say about this. they recommend against travel at thanksgiving. one of your family members could be hospitalized or severely ill and die. that's pretty dire. now i think it's helpful to look at maybe one specific market like, for example, new york. a good market to look at. clearly travel will be down this thanksgiving by about 55% if you look at the numbers. 1.5 million last year, less than half that this year. but there are places where travel from new york this year is actually going to be up. those are largely vacation destinations like the dominican republic, cancun in mexico and domestic vacation locations as well like key west, myrtle beach and nantucket. people will be traveling. it is a cost/benefit analysis. i travel every week from where i live to where i work sometimes. i took some pictures yesterday of midway airport. i often go through midway. southwest guarantees that middle seat open. they will until december. so you know, you have to weigh the pluses and minuses. you wear your mask, take the precautions and maybe you can get to see some friends or family over thanksgiving. >> sandra: very interesting. chicago's o'hare airport is one of the busiest airports in the nation. it looks quiet on monday morning ahead of the holiday. but jeff, you know i've spent a lot of time there, too, and it is beautiful at christmastime. decorations put up in the main terminal are worth seeing paying a visit to the airport just to see them. >> they call it the home alone terminal. the american terminal where the home alone classic shot from home alone and the decorations are there. not as many people seeing them. >> sandra: happy holidays. >> trace: the hypocrisy kam strikes again. this time new jersey governor phil murphy at a restaurant with his family wearing no mask. posted on social media showing his outdoor meal after the deck congratulate urged folks in his state to keep their family gatherings small for thanksgiving to help the spread of covid-19. it is very reminiscent of the scene that played out in california where democratic governor gov-in newsom was caught on camera attending a maskless dinner at a swanky restaurant after he issued guidelines discouraging large get-togethers. >> sandra: back in january around 5 million people traveled from the chinese city of wuhan to celebrate the country's new year unleashing covid-19 to the world. now in the u.s. 50 million americans are sent to travel to celebrate thanksgiving. public health officials fear it could spread the virus further and resentment at the government telling people how to stay safe and made worse by politicians violating their own rules. james freeman is the "wall street journal" editorial board member and fox news contributor. good morning. thanks for being here. we all want to say happy holidays, happy thanksgiving, enjoy our holiday safely. but so many of us are facing these growing restrictions at a time when this virus is still spiking in this country. where does that lead us -- leave us as a nation on this monday morning ahead of thanksgiving? >> i think we have more information now to do the kind of risk analysis, cost benefit analysis jeff was talking about. i think average americans are doing it because so many people in our industry frankly and in government have not done it. we do know now that most people are at little risk of the virus so obviously you want to focus on protecting the vulnerable but i think we're now eight months after a lot of public officials told us we needed to lock down for a few weeks to flatten the curve, i think a lot of people are also asking questions about liberty, even for a vulnerable person. if they have a pre-existing condition, if they are elderly, and they decide they are willing to take the risk because they want to hug their grandchildren on thanksgiving, i think more and more people are saying they ought to have that choice. >> sandra: those on the side of these restrictions have gone too far are the american conservative. the greatest scandal of our lifetime. totalitarian lockdowns. here is congresswoman kim a republican in california on these new restrictions in her state. listen to this. >> i too understand that government's heavy hands is not the right approach to dealing with the pandemic as we take steps to address our public health concerns, we should take into account -- i should say the governor should take into account that people's livelihoods and liberties are at stake as well. >> sandra: we talked to the owner of a restaurant group in colorado. he is out of denver, boulder, they can't serve their meals indoors now. it affects millions of americans, these restrictions. there is no doubt it is a tricky situation, james. why haven't we better figured out how to handle this at this point in the pandemic? what do you think? >> well, i would have hoped by now that we realize that the blunt instrument of lockdowns causes tremendous damage for very uncertain benefits. it is very discouraging seeing new york city locking down schools again when we know children are at little risk. what was often ignored in the original rush to lockdowns last spring was the tremendous economic cost and we've now seen the tremendous non-covid health damage of lockdowns. blue cross-blue shield looking through its claims data and showing really an epidemic of kids not getting immunizations this year for what can be in some cases fatal diseases during those periods of lockdown. we saw a lot of non-covid medical conditions not being addressed during the lockdowns. obviously when we all become poorer that has an impact on our health as well. i think all of those things unfortunately have not often been considered when lockdowns are proposed. now eight months into it we're getting a lot of good news on vaccines but if politicians want to argue that we need to keep locking down for months until the vaccines are available everywhere, i think that will be a tough sell increasingly. >> sandra: it is tough. we like to think we're making the best decisions for us and for our families. we walk into a situation, too many people, too close together, not wearing masks, the right thing to do is turn around. you see politicians like the case of governor newsom in california that causes outrage. he did not walk away from that dinner table conversation sitting closely, too many people not wearing masks. and that's tough for the american people trying to do the right thing. >> well, and we're learning unless it is a surgical mask, professional mask that is perfectly applied, it is really not clear how much good you are doing for public health anyway. you make people more comfortable in many cases when you wear a mask, but those sensible things hand washing, individual choice i think people when they've seen the devastation of lockdowns, they want more of that personal responsibility, personal choice to factor in here. and again eight months since we were told a few weeks of lockdowns would flatten the curve. >> sandra: for now we're told wearing the masks is better than not wearing them when we can't distance. that's what thanksgiving will look like this year, james. appreciate your time. thanks so much. another breakthrough in the fight against covid with astrazeneca say its vaccine is up to 90% effective if trials. the third company to talk about a vaccine. covid-19 surges across the country. >> trace: the trump campaign is appealing a ruling from pennsylvania court which tossed out it's election case today >> the trump campaign filed the appeal on sunday one day after a federal judge dismissed one of their lawsuits in the state which tried to block the certification of votes in pennsylvania and now this judge is essentially accusing the campaign of asking the court to disenfranchise about 7 million voters. in his opinion the judge wrote in part quote one might expect that when seeking such a startling outcome a plaintiff would come armed with compelling legal arguments and factual proof of rampant corruption. that has not happened. so now the campaign is appealing that decision but today is the deadline in pennsylvania for counties to report their certified tallies. this morning the state's republican senator said the writing is on the wall. >> i have fully supported the president's pursuing every plausible strategy, recounts and litigating irregularities but at some point you exhaust those possibilities. i think the president has reached that point in pennsylvania. he appears to have reached that point in georgia, michigan wasn't even close. >> michigan the state's canvassing board meets to certify the results and one of the republicans on the board has suggested he may vote against certification even though the president-elect joe biden defeated president trump in that state by more than 150,000 votes. so watch for that today. and over the weekend a shake-up to the president's legal team. attorney sidney powell is out. the exact reason why has not been given. rudy giuliani simply said in a statement that quote sidney powell is practicing law on her own. she is not a member of the trump legal team. she is also not a lawyer for the president in his personal capacity. but the shake-up likely has something to do with her unsubstantiated claims of a global communist conspiracy to hurt the president. claims that chris christie called over the doesn't work. >> trace: and yet gun sales are through the roof. i want to put the numbers on the screen if i can. through october of this year, right? 16.5 million guns sold. that's 1.6 million more than 2016, a 33% increase as you see there from 2019. first time buyers 7 million weapons. what do you make of these numbers, mark? >> it tells you the american public is voting with their wallets. they know where they want to be when taking access to their rights and they want to make sure they have the afwoilt protect themselves and their loved ones. they are going out in record numbers breaking all previous records with still two months left in the year to go, typically the strongest months for firearm sales. the american public will choose safety for themselves and choose to exercise their rights. >> trace: we see gun numbersing up. the heritage foundation wrote this you always have your sort of usual suspects, your middle age, what people consider like the stereo typical gun owner but you are also seeing very large increases in percentages that are either minorities or women. minorities and women buying a lot more guns and to that you say what, mark? >> this is something we should celebrate. every american who is a law-abiding citizen has the right to exercise their second amendment rights and we should celebrate that as we celebrate anybody else exercising their rights. 40% are women. the largest increase is african-americans at 58% over 2019 figures. it is something we should celebrate. today's gun owner is looking less like me and more like the rest of america. >> trace: some believe that biden's poll seals will save lives. we can count on biden and harris to address gun violence and save lives via executive action and looked forward to standing behind them every step of the way. that is the spokesperson for every town for gun safety. your thoughts. >> when we look at this policy of him wanting to register all sporting rifles we look at the cdc studied the assault weapons ban. they found in the study there was no appreciable impact on the reduction of crime. we're talking about a crime problem. law abiding citizens who are gun owners are overwhelmingly abiding by the law and not the issue. we have a problem with crime in america, not with law abiding gun owners. >> trace: we have talked much about how crime is going up in major cities across the country. a quote from you. president donald trump vowed to safeguard this right and former vice president joe biden and his running mate senator kamala harris have both embraced confiscation of lawfully-owned firearms as the headliner of the most far reaching gun control agenda presented to the american voter. it seems like a fairly strong statement. do you still stand by that, mark? >> we do stand by that. we have to understand at the beginning of this presidential campaign back in july of 2019 joe biden stood on the debate stage with all the other democratic candidates and said the firearm industry is the enemy. he is talking about me, trace. i'm a 25 year marine corps veteran and served my nation as an oath of service to uphold and defend the constitution and he is calling me and my industry that provides law enforcement the military their firearms, he called us the enemy. all the policies that he has laid out are demonstrating he is doing everything that he will to destroy this industry. >> trace: we are proud of your military service, mark. good to see you. >> sandra: president-elect joe biden his newly named chief of staff ron klain says it is likely that biden will travel to georgia as control of the senate hangs in the balance. matt finn is live in atlanta. can we expect biden to campaign in georgia any time soon for those two democratic candidates? >> good morning. one of the candidates running for senate here in georgia democrat john ossoff was asked directly when president-elect joe biden might travel here to georgia. he said he hasn't heard of any definitive plans. >> i think that georgia fam leels across the political spectrum are rooting for our incoming president-elect for his success, would welcome his visit and to hear his plans in the first 100 days. tackle to virus and get our economy moving again. >> right now in georgia democrats and republicans are trying to convince voters, some likely fatigued to the return to the polls for the two runoff senate races that determine balance of power in the united states senate. warnock hosted a series of meet and greets this weekend. vice president pence campaigned with perdue and loeffler on friday. loeffler is quarantining now. she had conflicting coronavirus tests beginning on friday. and switching to georgia's presidential race georgia just hand counted 5 million ballots as part of its own audit. president-elect biden the winner by about 12,000 votes in georgia. now another recount at the request of president trump's campaign. georgia's audit by hand discovered thousands of ballots were not tallied. one of georgia's election officials said the second recount will now be by machine. >> at this point i'm loath to say nothing can change. what for years, blinken. back in washington and back in the seat of power with a make america great again, america first gop which is less interventionist and less hawkish on the whole. also a hard left that's very against a lot of these interventions and for international law. he stapds for those kinds of things. whether it's invasion in libya, toppling kaud aftery and getting more involved in feeling that joe biden is likely, given his supporters where a lot of the money came from. a lot of backers in wall street stay the course and annoy the left with some of his picks, some of the more wall street guys, the finance men and women. but if he does go down the warren standpoint that's obviously one of his standard bearers of the left. someone before aoc one of the ideas people behind generally think so. i find it difficult to believe it will be taken. basically anywhere with defund the police or other hard left initiatives were on the ballot 2ke78 congratulations lost and republicans made gains despite the president being behind in a lot of those votes. that is a sign of the hard left. i don't think they'll take it and they'll demand what's theirs. at the end of the yesterday yet another strap hanger was shoved onto the tracks by a mentally ill homeless person and even democratic members of the city council are begging and pleading for some sort of intervention by our mayor and governor who oversees the mta. >> trace: we're putting the video up. we should know the person onto the tracks yesterday also came away with some minor injuries but just miraculously again. you are right maureen. it is not just you talking about the mayor, this is coming from the new york city transit interim president and she says quoting here we have a crisis in this city. it absolutely has to be addressed. it has to be addressed and i'm desperate for this mayor and next mayor to take it on. we have got a long way to go. this mayor or the next mayor? that's desperation. if it's not this guy we need the next guy to address this. >> it is so remarkable for new yorkers who are living here through this pandemic to see just how quickly decades of efforts that made this city the safest big city in the world has completely unraveled. that earlier incident from last week, this man who clamored atop of a city bus that was filled with riders and just unleashed a flame thrower, just unleashed open flame into the air. i called it in that column truly our escape from new york moment. the lun ticks are running the city. >> trace: i want to put up the numbers. this is some of the subway system crime this year and as you look at these, look, the numbers look close. keep this in mind. there is only 30% of the ridership so far this year of last year. 1/3 of the people and look at the robberies in 2020. felony assault 249, 289. homicides 6 versus 3. double rate. 1/3 of the people. that is astounding. >> yeah. mta source told the post these crimes, these sorts of attacks have more than doubled since last year and you mentioned the increase in rapes. one of the more horrifying incidents that i mentioned in that column was a woman who was waiting at the 63rd platform, the f train. these are well-traveled -- normally well-traveled stops. 11:30 in the morning on a saturday was nearly raped on the platform in front of other strap hangers. this is the kind of crime you would have to go back to the 70s or 80s to see that brazenness. >> trace: i have to go, maureen. any indication when you wrote your column is anybody giving you feedback about what is being done? are there at least groups being organized to try to get this solved? >> interestingly, trace, the people i've been hearing most from are retired police officers, veterans with 20 plus years on the job and they are just expressing their dismay and their sadness. and they just -- they are crying for again intervention. you know, as one of our city council members said it is not compassionate to ignore the plight of the mentally ill homeless. >> trace: good to see you, thank you. >> sandra: it is an amazing rescue that was caught on tape. here a florida man jumped into a pond, wrestled a gator, opened its jaws and saved his young puppy. it did not even get the cigar he was chomping on wet through all of it. he and his puppy gunner are here to tell us how that all happened. welcome, sir. >> sandra: a 74-year-old man saving his puppy from the jaws of an alligator. richard wilbanks seen wrestling with the reptile in waist deep water and keeping a lit cigar in his mouths. richard and his dog gunner join us now. tell us your story. what an amazing video. >> good morning. we were just out for a sunday morning stroll walking by the edge of the pond. all of a sudden an alligator came out from under the water and grabbed gunner and had him back in the water and swimming off with him. i just jumped in and got ahold of the alligator and drug him up to the bank and pride his jaws open and got gunner out. >> sandra: what i thought was amazing was that this video. it wasn't taken by your wife or family member or friend. it was the florida wildlife federation, you and others in your communication allowed the cameras to go up on the land to document animals and other wildlife and so they went back to look at the video and there you were fighting an alligator. >> that's correct. that's correct. >> sandra: amazing. you are a hero. how are you doing? how did you come out of that? a few scrapes we're told. >> i had a few little puncture wounds on my hand. after i got gunner out of the alligators mouth i had my hands stuck in there. i had to work them out and so, you know, took gunner to the hospital and got a tetanus shots and gunner had to spend a couple days in the hospital. >> sandra: it is a remarkable story. what went through your mind when you heard your dog crying just a puppy, three months old at the time and you thought oh man, i have to go save gunner. what went through your mind? you had to face an alligator. >> well, you know, it all happened so fast that fortunately i didn't have a lot of time to think. i just -- instinct of saving gunner because he is such a wonderful little puppy. i just wasn't going to let that alligator have him. >> sandra: amazing. your wife is quoted in one of the local news articles saying he was covered in blood. what did your wife think about it? >> it was my blood. gunner only had a small puncture wound by water in his lungs. i told her gunner has been attacked by an alligator. we need to rush him to the vet. and so we wrapped him in a towel. he was in shock. we jumped in the vehicle, rushed to the vet and took him in and took care of him and kept him a couple days. >> sandra: remarkable to watch gunner run aware, the cavalier king charles spaniel. amazing man for doing that. go ahead. >> thank you, ma'am. gunner is beautiful. such an amazing dog. >> sandra: can you hold gunner up for us? so sweet. so sweet. it is proof, right, richard, for all of us dog owners we will do just about anything for them. they are our children. >> oh, absolutely. absolutely. >> sandra: good stuff. all right,
