and you can bring your own device. oh, and all on the most reliable 5g mobile network nationwide. wireless that works for you. it's not just possible. it's happening. good morning, everyone. welcome to "cnn this morning." it is saturday, september 30th. yes, the last day of the month. i'm a.mara walker. >> and the last day of the month going out with a bang. i'm omar jimenez. thank you for spending part of your morning with us. we're watching a lot. we are hours away from a potential government shutdown. lawmakers still can't agree on a deal to fund the government past midnight. the last-ditch efforts are underway to keep that from happening. submerging cars, disrupting mass transit and opting water rescues. we'll show you the damage left behind and where we're tracking more rain this morning. border security has become a major sticking point in the fight over a government funding deal. we're joined by one congressman who is seeing the impacts of the migrant surge firsthand and says the city is in desperate need of help. police make an arrest in the murder of tupac. the new evidence that led to his arrest and the reaction coming from tupac's family. we are on the brink of a government shutdown. today is the last day for congress to pass critical funding bill to keep the government's doors open. with less than 15 hours left on the clog, you can see that, it's not looking like house republicans will be able to do anything to get this done. we will see, because we're learning in the next hour they will have a closed-door meeting hoping to start the process toward a last-minute plan and to sway the hardline holdouts. this is after house speaker kevin mccarthy failed to get yet another stopgap bill passed on the house floor last night. >> so if it cannot come up with a solution and the government does indeed shut down, it will be far and wide reaching. we're talking about the effects. but the biggest impact will be on federal workers. millions of people could be forced to work without pay depending on who is deemed essential. during the last government shutdown, that was a couple years ago in 2018 to 2019, an estimated 420,000 workers worked without pay and 380,000 more were furloughed. while we don't know exactly how many people could stop getting paid this time around, that number could be as high as 2.2 million federal employees. >> so we can only do this with live team coverage from d.c. we have all the best. priscilla alvarez is looking at the white house, but first, let's go to annie brayer from capitol hill. you're learning about plans to get this day going. how do we expect that meeting to play out? >> reporter: it is still unclear how this meeting is going to play out, but one member told me it's going to be more of a temperature check for republican leader sship to see how members are feeling after last night, when the house again failed to pass a short-term spending bill. there were 21 republicans who voted against it just to keep a reference, only four can vote against a bill for it to pass. that gives you a sense of how far the divide is. after the vote failed last night, republicans met behind closed doors and they left still without an agreement. so we'll see in this next hour if any progress has been made since last night. but i can't emphasize enough how frustrated republicans are. take a listen to how some republicans have been talking about it. >> it's a very dangerous tactic to take to say, hey, i want to shut the damn thing down. it lit reallily benefits no one. >> we're the governing majority. this is what we're supposed to do. we're supposed to lead. it's kind of hard to lead when a significant number of people that are on the wrong snap count when you call the play. >> they kill ed the most conservative position we could take and then called themselves the real conservatives. make that make sense. >> reporter: so that's what's going on in the house. meanwhile in the senate, the senate will also be in today taking a procedural vote on their short-term spending bill, but because of how logistics work in the senate, that won't be ready before the clock strikes midnight tonight. the bigger issue with that bill, it includes funding for the war in ukraine, which many republicans in the house do not support. so we'll have to see what comes out of this meeting coming up at 9:30, but this just gives a sense of how uncertain things are on capitol hill right now. >> very uncertain. annie, thank you. now president biden is remaining in d.c. this weekend as the white house prepares for a potential shutdown. priscilla alvarez is at the white house. tell us about how the biden administration is preparing. >> reporter: president biden will be briefed by his staff over the course of the day, as these negotiations are underway on the hill. but it is clear over the course of the last few days that the administration is bracing for a government shutdown. and that means federal agencies sending notices to their workforce telling them of the procedure in the event of a shutdown and also notifying some employees that they will be temporarily furloughed, while others may have to continue to work without pay, being deemed essential. that also has impacts on the services that the federal government provides. for example, the small business administration will stop processing business loans for small businesses. there will be delays and disaster recovery projects. millions of women and children will go without food assistance. and as you mentioned at the top, millions of federal workers, as well as active duty troops, will not get paid. and that is a concern because it does hit their pockets. i have been talking to administration officials over the course of the week and they remain concerned about a is shutdown not only because of the work they do, but also because it's unclear if this happens, how long it will would go. to give you a call sense of what this means, at the white house, personnel also received notice this week about their instructions in the event of a shutdown. and in come cases, senior aids will have to learn the jobs of the senior aids who lwill be furloughed. there are impacts on the american people as well as across the federal government. here at the white house as well as frederal agencies, they are bracing for this to happen, although all are trying to signal or at least hope there could be a deal that would avert this. >> priscilla alvarez, thank you so much. from air travel to security, a government shutdown could affect a lot of american in a lot of different ways, including impacting the economy. so we have economic analysts with us now. so we have talked on this show about how this shutdown could work politically, how it could affect air travel and everyday people. how could this affect the economy? >> the effects would be really broad base d. we have just heard a little bit about how it would affect workers in the government. talking about air trafficful krollers and essential workers. but a government shutdown ripples into the private sector. goldman sachs witput out a repo talking about the effects of which they last for a few weeks. it could have a significant effect we're at a point. and at this point, most economists there's a 90 chance it's going to happen. the political opinions here have become more ebb trenched. we saw a situation with the clinton administration, where republicans came in and tried to force the administration to take conservative fiscal positions. i think this is going to last awhile. the press has been doubling down on their own positions recently. you see them walking a picket line with workers. so i do think it's going to have an impact. and it's unfortunate for the american people. >> to your last point there, there was a time when one would think keeping the government open is a given or at the very least something that would be routine procedure. you cited previous administrations, but how did we get here to where we are right now. >> great question. basically, both parties have become more polarized. i would say the republican party in general has become extremely polarized you're seeing kevin mccarthy get pulled to the right here by certain trump sup supporters. you're seeing republicans double down at a time where there's some politicking around a the elections. i hate to say it, but maybe. ing the economy to not look quite as good as it does now. i wonder if that's not behind some of this. we are at a point in time where historically, there's never been less overlap between the pa parties. so it really does make it hard. >> there's some key economic stake holders that are concerned at the macrolevel. this could have an impact on the u.s. credit rating. moodies, one of the three major agencies, said this would be a credit negative for the u.s., but specifically, they wrote, it would dem strait the significant constraints that political polarization has put on fiscal policymaking at the a time of declining fiscal strength. do you agree with that a assessment? what is the broader lens here outside of the current political fighting that we're seeing? >> yeah, well, for starters, i absolutely agree. it's a hard thing to quantify. what is a credit rating for anyone. it's about trust. . it's the basics. and we have to remember as americans that our economic security is in large part about how the rest of the world and our creditors view us. and i will say that as we have begun to see over the last few years these rolling shutdowns, you're seeing fewer foreign creditors wanting to buy u.s. treasury bills. not a huge deal yet, but you're seeing incrementally a little bit of a pullback from the international community from really believing in the u.s. as an economic power house. this kind of thing just slowly, slowly chips away at the power of the dollar, the power of the u.s. economy and the power of america on the global stage. >> that's at the macrolevel. those are things that affect at the microas well. and you talked about very much depends on how much, how long this particular shutdown, if we get there, is. what are the differences that people are actually going to feel in their wallets if it's a two-day shutdown versus up to what the record was 35 days potentially? >> yeah, so a two-day shutdown, you're not going to feel it in your wallet. you may not even feel it at the macrolevel in global credit markets, but a few weeks, particularly with the very ugly politics that can come during those two weeks, at a time when the markets are already kind of ready for a correction, i think that could have a significant impact. goldman sachs is saying with every week of the shutdown, you're looking at a .2% shave shave off from the private sector economy. so that adds up at a time when we maybe looking at a downturn any way. >> we'll see what happens, but again at this point, all indicators, unless there's a huge breakthrough over the next 24 hours, we will be shut down by this time tomorrow. we never lose faith. thank you so much. still to come, under 16 hours from a government shutdown, but the fallout will be felt far from washington, as we have been discussing all morning. how the shutdown could impact security at the border. also, more tributes pouring in for senator dianne feinstein. a look at her trail blazing career. and a state of emergency in new york city after torrential rains flood the city. torrential rain in new york city has caused flash flooding, road closures and disrupted subway service. >> the pictures are incredible. the rainfall considered dangerous and life threatening surpassed a month's worth in just three hours friday. cnn's gary tuckman has more. >> reporter: life-threatening flash flooding in america's largest city creating large-scale problems. many houses and apartments inundated, particularly in the new york city burro of brooklyn. one brooklyn man said when he woke up at 8:00 a.m., the water was at his knees. >> within i guess about ten minutes, it was waist high. >> reporter: this was the scene at one of the city's largest parks, prospect park in brooklyn. >> how am i supposed to get across this? are you serious? >> reporter: cars, trucks, driving through flood waters. >> oh, my goodness. the huge new york city subway system impacted with raging rapids pour ing downstairs of te station in brooklyn. flooding some of the tunnels and causing signal issues, delaying some of the 36 subway lines and getting to airports, a huge challenge for many. on the grand central parkway on the way to laguardia, flooded roadways. new york city mayor warning people earlier in the day to stay in place wlrp they were at home, works or schools, which were open. >> i'm issuing a state of emergency for new york city, based on the weather conditions and what to say to all new yorkers, this is time for heightened alertness and extreme caution. >> reporter: a state of emergency was declared in long island and the hudson valley. >> this is unbelievable. i have never seen this situation happening. this is crazy. >> reporter: across the state line, a state of emergency declared in new jersey. in fairfield, about 25 miles west of manhattan, a man driving through flood waters is rescued by a fairfield police officer. the driver is fine. this flooding, high ly unusual. but because it's new york city, many people went on with their normal lives the best they could, like this man on his delivery bicycle. >> i thought it was 3 inches of water. i'm soaked. i have a disease now. >> reporter: gary tuckman, cnn, new york. >> it's a lot of water. and people are going to figure out a way to move forward. either way. that's way too much water at once. >> the weather is expected to clear up as the storm system moves further east. >> but this morning, it's still raining in some parts of new york and new jersey. meteorologist allison chin car char is joining us with the littest. >> it doesn't look like this anymore, but we have more rain coming down. this was scenes yesterday. this is one of many roads likely looked like this with at least several inches of water making it very difficult for people to drive. you have some heavier rain bands starting to settle back in. most of these areas it's light rain at this particular point in time. but placess like massachusetts, rhode island, connecticut, even new york still getting some of the moderate rain bands from time to time. and that's going to be the case as we go through the morning hours. we have flood warnings and flood advisories still in effect for a few areas here. not necessarily in anticipation of the remainder of the rain that's expected today, but because we have so much yesterday, it takes time for that water to go away to recede. we had a lot of it. jfk breaking a record over 8 inches. valley stream, topping out at over 9 inches in several other locations. connecticut, surrounding areas, picking up at least 6 inches of rain. so here's a look going forward for the rest of the day, light to mod the rat rain showers off and on throughout the morning. most of these areas finally seeing an end to the rain into the afternoon hours. and finally on sunday, a nice day with sunshine to start to finish. it's been awhile since we had those. one thing to note is we are still anticipating ab extra inch of rain. that may not sound like much, but on top of 5 or 6 inches, that can exacerbate the ongoing flooding. >> obviously, not what people there want to see, but thank you. there may soon be fewer resources for communities dealing with the surge of i migrants at the border. come ing up, we're going to tal with one texas lawmaker who says talk from politicians. it's time for action. the power goes out and we still have wifi to do our homework. and that's a good thing? it's true. plus, when you buy your first line of mobile, you get a second line free. there are no term contracts or line activation fees. and you can bring your own device. oh, and all on the most reliable 5g mobile network nationwide. wireless that works for you. it's not just possible. it's happening. here's a live look at capitol hill, where lawmakers will be working today to try to hammer out a deal. so far, they have been unable to come up with a plan that both can can agree to. we're specifically talking about house republicans. so barring an 11th hour deal, government funding will expire at midnight. that will trigger an avalanche of impacts across the country that will affect all of us. 2.2 million federal workers and 1 million active duty military personnel will either be furloughed or forced to work without pay. we can see major impacts at the nation's airports because of the tsa worker and air traffic controller shortages. that's important to note that both of those jobs are considered essential. so those workers will be expected to show up, even though they are not getting paid, leading to concerns that workers will simply call in sick and refuse to show up, just like they did in the last shutdown. also, most national parks will close. the fda says food safety inspections could be disrupted. transportation and infrastructure projects in cities across the country could be put on hold. and wic funding, that's the program that provides food and nutrition benefits for women and infantd children, could immediately be at risk. according to the biden administration, 7 million pregnant moms, new mothers and their children rely on wic benefits every single day. now one thing that will not be affected by a government shutdown, lawmakers' paychecks. they will continue to get paid, even as millions of federal workers do not and critical services that impact every single person in this country come to a halt. the number of migrants arriving at the u.s./mexico border increased to approximately 8,000 per day this week,. the 19,000 agents at the border are considered essential will and will consider work ing without being paid. that includes detaining new migrants. but border communities will be cut off from additional federal funds to handle the influx of joining me is texas representative eddie morales. good to see you. for people that don't know, your district includes eagle pass, almost 800 miles of border. while i know you're not necessarily involved with the federal border negotiations that are a part of this shutdown back and forth, if the government were to shutdown, what type of impact do you expect to have on your border? >> well, good morning, omar. thank you for the opportunity. we really don't think we're going to see it as you mentioned, law enforcement and border patrol will be out there. we have a heavy presence of dps, state law enforcement officers that are assisting with this migrant surge. so with we also have local law enforcement at eatgle pass polie department and the eagle pass firefighters and ems crews. so we have addressed that. we have had communications with cities administration, and we think that we will be okay for the short while, but obviously, funding is a key issue. we keep incurring daily costs associated with the migrant surge. >> obviously, there's a huge difference between what could potentially be a 2-day shutdown or one that extends further thn that. you were quoted in an article saying we have had these delegations of congressman take pictures by the boat ramp or the border patrol boats, and then they go back and do absolutely nothing. do you feel the federal government has done enough here? >> no, sir. and more than anything, even our audience and all americans in texas expect more from our leadership in congress and i think they have felt this. in the last 30 years, they have failed to pass effective policies to address the situation. we wouldn't have to be here if they had done their job. it's unfortunate that many of them are headed towards a shutdown without any problems. they are still willing to take compensation while this shutdown is taking place. we're bigger and better and americans and texas expect more from their public servants. >> and while you are a public servant at the state level in texas, do you have a solution as someone who has so much border in your actual district? do you have a solution that you think can work or help? >> i do. were trying to propose a bipartisan effort to make sure we pass the texas secure our border processing and jobs plan here at the state level. backing up a little bit. when the surge first started taking place, the mayor conducted an audit of all these migrants as they were heading in. and each one of them had 2 to $5,000 in their pockets because they know that's how much they have to pay to get them across. and so we have created an industry for the smugglers. and the state of texas needs to take that by the horns and actually initiate this processing and jobs bplan, wher we'd make certain conditions and from these migrants. we need to stop using our rivers to get them across. the program is all wrong. we need to use it to protect our law enforcement and we can also treat migrants humanely. there's nothing humane about rows and rows crossing through the river. we lost law enforcement personnel as a consequence of that. and the olympian that would be implemented is once they get through customs, there would be emergency management and a tent that would be able to process them for the state residency . we would be able to charge an initial fee knowing from this audit that took place that they have that money, rather than paying and exposing them to the cartel and human smugglers, let's use the dry land to get them across, initiate this processing fee. we were having 1,600 crossings daily. with now have 8,000 crossings taking place a day. this would generate $16 million in over $5 billion to the state of texas. now i understand this plan may draw the ire of the department of justice, but that with the invasion clause that the texas constitution has, we have some teeth in there to be able to say and justify ourselves why we have to take action since congress has failed us over 30 years in passing effective immigration reform policies. we would impose a mite grant income tax and will there would be refees as well. we would make conditions like anything over a class d misdemeanor. >> there are so many factors there. you listed off so many. obviously, it's a steep hill to climb, so you have to get everybody on the the same page as you, but i have no doubt based on the conviction we met, i have no doubt you're going to light a fire in a few of the folks down there in texas. thank you so much. still to come, the government shutdown throwing a wrench in plans to celebrate jimmy carter's 99th birthday. how the carter center is still planning to honor america's holdest-living president. former president carter's 99 bth is tomorrow ux october 1st will be scelebrated todays a th government shutdown loms. the carter center said festivities were set for sunday, but a midnight shutdown could affect the library as well. carter served one ternl as georgia governor before being elected president from 19 7 to 1981. he was a peanut farmer and a navy lieutenant before topoliti. joining us now is director for the presidential library and museum, tony clark. tony, a pleasure to have you on. thank you so much for joining us. i see the festivities, the decorations are all up. tell us more about what is planned for today and will there be any events tomorrow? >> the outpouring of love has been so great that we decided we needed to start early. so last week we sent out birthday books. people could sign. we had a screening of a film on chestnut trees that president carter is in. we had andy young talking about their relationship. so what we ended up doing is expanding it. today we're just going all out. there are buttons like these for people who come here. we've got activities, kids will be making little puppets of president and mrs. carter. there are birthday books, there's cake. and we're having 99 cent admission today in honor of his 99 theth birthday. so there are all kinds of activities both the carter presidential library and the carter center. they are two separate organizations. >> i love how you're making it a family-friendly event. a lot of people are wondering how president carter is doing. we know he and his wife made a rare appearance at last weekend's peanut festival in georgia. can you tell us about that and how he is doing? >> this weekend, they are having a family celebration the family is going to be there to help them celebrate. it will be a quiet scelebration. 99 wonderful years. i think back to a quote that he gave a journalist some time ago where he said i have one life to live and one chance to make it count. and i think we're all that he's made that one life count for something. >> beautiful. and tell us about some of the outpouring of love and the messages and what are people saying? >> there have been messages from all over the world. in fact, people have to come here to the presidential center to see this giant monotort in a circle of flags. it's a mosaic of president carter. each one of the little pictures comes out you see an expression of love and admiration for the work of president and mrs. carter, and the other night when ambassador young was here, he wrote in one of the books, you are a wonder. love and affection, andrew young and caroline. so we're getting all kinds of things. you may have seen there was a concert that peter gabriel had the other day. he had the audience sing happy birthday to president carter. so this has been an incredible outpouring of love for the 39 the. >> it's a great way to describe it. what a blessing. 99th birthday, with your family. a pleasure to have you. reactions are pouring in from both sides of the political ai aisle. dianne feinstein passed away friday at the age of 90. feinstein was the longest serving and history. with her passing, california governor newsom will have to appoint an interim lawmaker to serve out the rest of the term. the late senator said the legacy is, quote, undenial. >> i became a product of assassination. and the first openly gay public official being kill ed. >> for dianne feinstein, tragedy paved the way for opportunity and a career in poll tucks that would last decades. >> they have been shot and killed. >> it was 1978, san francisco's mayor, along with the town supervisor march veto milk had been shot dead. fast forward to 1984 when feinstein found herself on the short list of vp. that didn't pan out, but washington, d.c. eventually did. >> so help you god. >> i will. >> in 1992, feinstein won a special election and packed her bags for the nation's capitol, becoming the first woman to represent california in the u.s. senate. >> i won among men. i won among wum. what that says is that to me, the fact that i'm a woman is there, but it's incidental. >> incidental perhaps, but hard to ignore, especially given everything she has done. on a long list of firsts, feinstein served as the first woman to sit on the judiciary committee, the first chair of the intelligence committee and the first woman to chair the senate rules and administration committee. >> today there are 25 women serving in this chamber and every one of them they stand on dianne feinstein's shoulders. >> she fought for the issues important to her, like gun control. one of her notable success was pushing through the assault weapons ban in 199. >> there's no second amendment right to bear every type of weapon that you know of. >> she was also a leading voice on legalizing gay marriage and lgbtq rights, and she help ed create the nationwide amber alert system. feinstein had a unique ability to reach across the aisle, where she found a friend in mitch mcconnell. >> we were actual friends. >> feinstein was born in san francisco in 1933 and graduated from stanford university in 1955. >> i want to find out what was on that. >> her high-profile senate career was featured in the film "the report." she was portrayed by ann nets benning, what tackled the use of torture in 9/11. as chair of the senate intelligence committee, feinstein fought with the cia for years over releasing the investigation into the use of enhanced interrogation techniques. in february, she confirmed she would not run for reelection, telling cnn the time has come. she was the longest serving woman in the u.s. senate. >> it's what i meant to do. as long as the old bean holds up. >> her desk now draped in black. dianne feinstein was 90 years old. more than 25 years later, a self-profess ed gang member who has continuously claimed his involvement in the shooting of tupac shakur is officially now charged with murder. >> this development has brought back to life an extensive investigation that had been pretty stagnant. let's turn to brian todd, who is covering the story for us. >> after 27 years of an enduring mystery, an arrest in the 1996 murder of rapper tupac shakur. >> for 27 years the family of tupac has been waiting for justice. i know there's been many people who did not believe the murder of tupac shakur was important to this police department, i'm here to tell you, that was simply not the case. it was not the case back then, and it is not the case today. >> reporter: police on friday arrested 60-year-old duane keith davis. his wife's home in nevada had been searched in july as part of the investigation. davis had long placed hisms at the scene of the crime in downtown las vegas. once telling b.e.t. he was in the front of seat of a white cadillac when shots were fired from the backseat. >> he said the shots came from the back. who shot him? >> it came from the streets. >> reporter: he was shot four times and died six days later. >> he was the shock collar for this group of individuals that committed this crime. he orchestrated the plan that was carried out to commit this crime. >> reporter: he was shot in 1996 after leaving a mike tyson fight at the mgm grand. police say shakur and shug knight had been in a feud with duane davis and a gang he was affiliated. >> the permanents would be steep in terms of life in prison without a possibility of parole, particularly with that gang enhancement, if the prosecutor pursued it. >> reporter: on friday police played footage from inside the mgm grand show whag they say was shkaur punching and kick ing a man who was duane davis' nephew. >> little did anyone know it is this incident here that ultimately would lead to the retaliatory shooting and death of tupac shh cur. >> after the beating, davis devised a plan to retaliate. he obtained a gun and got into a white cadillac with anderson and two other men. police don't say davis was the trigger man, but he passed the gun to someone many the backseat who shot at sha cur and night after they pulled up next to them.kur and night after they pulled up next to them. >> the only living suspect is duane davis. all other three suspects are deceased. >> his stepbrother called duane davis' arrest bittersweet. shakur said the family has been through decades of pain. they have known about davis for years and he's been running his mouth, so why now. shakur said for the family, this isn't over yet. they want to know if there were more accomplices. brian todd, cnn, washington. >> almost 30 years later that comes up. we have been through a lot this hour. we're going to be back in an hour. >> smerconish is up next. see you at 10:00 a.m. eastern. see you then.
