"cnn this morning" starts right now. we begin this morning with breaking news. two more of donald trump's co-defendants have surrenderered at the fulton county can jail as trump prepares to turn himself in for the attempt to overturn the election results. they were arrested and booked in the early morning hours. you'll remember the former chair of the georgia republican party allegedly conveneed fake el electors to declare trump the winner. kathy was wasn't of the fake electors and also accused of helping trump operatives gain illegal access to voting systems and voter data in the county. >> sources tell cnn that rudy giuliani will be meeting with the fulton county district attorney's office today to work out a bond agreement for his surrender. this is all cast iing a shadow over the first gop presidential debate. trump is skipping it and will be getting ready to turn himself in tomorrow in georgia and be arrested for the fourth time this year. nick valencia is live outside the ful ton county jail. we could see more co-defendants turning themselves in. they have a deadline that's coming up quickly. >> we certainly anticipate to see more activity here. overnight, a flurry of activity as more defendants in the case% began turning themselves in. we're getting a first glimpse at what this process may's look li when the former president does the same on thursday. the deadline rapidly approaching, former president trump's co-defendants are turning themselves in at the fulton county jail in georgia. former gop chair david schaffer and the former chair of the republican party kathiment that have turned themselves in. both are facing charges of meddling in the election, including plot to use fake electors and rudy giuliani is set to meet with the fullton county d.a. today to work out a bond agreement. >> i'm here to vend to an indictment that should never have been brought.cú >> reporter: on tuesday john eastman remaining defiant in the wake of his surrender and booking saying aníc-;krp indict should have never been brought. >> it represents a crossing of the rub con for our countries, implicating the first amendment right tosc petition for redressf grievances. >> reporter: he■ advised on trup to the certification of the 2020 presidential election results. >> do you regret attaching your kxátát to the former president? >> this is how it goes. you negotiate the deal with the' da's office. that's been happening without too many hiccups. then you can surrender any time between now and noon on friday. if they don't, then that leaves fani willis with the option ofs sending the cops out to arrest you with handcuffs and you want to avoid. both sides have an incentive to get these deals done. >> i think what eastman said yesterday is really interesting. we heard the part he said this would be violating my first amendment rights. then he says it targets attorneys for their actions on behalf of their clients. that goes to this same argument, but is it what he's alleged to have done in the indictment just zealous advocacy? prosecutors say it was conduct. >> it all depends who you ask. this is exactly what the battle will be a at trial. the prosecutors allege you went too far. you were not just giving legal advice. >> where is that line? >> this is why this is going to be such ab interesting case because prosecutors allegation is you went beyond lawyering. you sent documents in that were untrue. that you knew were untrue. court but his defense is going to be i was engaged in ;> i don't think he's going to get his arrest and surrender blocked or pushed back. mark meadows and others are going to bring motions for removal, moved over to federal court. but what he's asking the federal court to do is also give me extra time to surrender. i don't think the federal court is going to do that. they are going to hear this motion. that will take weeks months, but i don't think they have any interest in who surrenders when at the county jail. >> but they also knew the deadline was friday when they scheduled the hearing for monday. >> that's a great point. >> one would expect if you were going to intervene, he would have done it before. >> the fact that the federal court scheduled it for after is more indication they are not beginning to get involved in micromanaging. >> i just think it's notable that fani willis sent this e-mail to the attorney saying i have been more than courteous and given you two weeks.cd u$at people would get. >> she's right about that. i was surprised she gave themç< long. >>iq0 can i ask something about something that happened overnight. this is the mar-a-lago documents probe. an i.t. special counsel i haven't seen anythinggi about security cam footage. trump paid for a lawyer. now he has a public defender. what prosecutors are saying is that they believe that his testimony was false then and are looking for new testimony now. what does this tell you? >> this happens all the time. i can't tell you how often anyone comes in. you'd love for them to tell you the truth, but i don't no i anything, i didn't see anything. you know that's not true a lot of times. so you have to take a leaf. sometimes it's changing lawyers. we know donald trump has not just a habit, but a practice of paying for lawyers for people around him. we have seen it from cassidy4m hutchinson to walt nauta. that's not illegal, but it make it is more difficult for these 1.u$e full truth. if you're a prosecutor, you're looking and thinking he's an important witness. he lied to us the first time. can we trust him now? and can we get a jury to trust him. i have had witnesses who died it the first time. circumstances change, and now he's come clean. the question is can you back up what he says. i expect him to be be a witness. >> thank you. we'll see you llater. also it's debate night. eight candidates will make theix pitches tonight to rt voters on the debate stage. the first one is in milwaukee. the contenders are placed on the stage based on their rank in the polls. jessica dean is live with more. what's it going to look like tonight. >> reporter: good morning. we know this is a76p convention event in any sort of primary. but what we also know as just laid out, this is anything but a ye. the front runner won't even be here. and for reasons thatvs you all just discussed, he will be turning himself in tomorrow for the fourth time in a fourth indictment this year. in the meantime, there are eight other candidates that are going to be on the stage in the building behind me that are hoping this is going to be their moment to shine. that they can perhaps break out. and use this moment to be the trump alternative. so far, that's been hard. if you look at national polling, polling in early states, the former president continues to lead by double digits. but the closest runner up in second place in that polling is florida governor ron desantis, who has had several resets of his campaign since he launched it in may. he's looking to steady the chip ship. he's the target of a lot of incoming on the stage tonight. the question is if he can stand up to that and make his case, is this a moment where he can solidify his place with voters. now also there on center stage will be vivek. he has been rising in the polls and becoming a candidate that people who are very hard right in the republican party are looking to. we will see them at the center of the debate stage. the rest of the candidates will span out around them. all eight having to meet both polling and fundraising thresholds to get there on that debate stage. but again, this is just really an x factor. trump continues to loom over the stage. he won't even be there tonight and there are so many questions a about how the candidates will or won't talk about him. will they continue to go after him? what will that dynamic look like? and what will it look like tomorrow morning? >> it would be nice to hear some policy discussion. what a novel idea. donald trump's loom ing arrest is till in the spotlight from the first gop ro!,éév%deba. how hz rivals plan to seize it back tonight. our political experts are here to discuss. we're also getting an intention firsthand look at deadly wildfires that are right now whipping through. just encompassing everything. one of our colleagues in(g it. powerful winds whip flames. >> trying to putx out these raging fires that have] caused massive winds. you can see i'm experiencing right now. their homes. all these homes are at risk. many have beenwr burned. the damamage is extraordinary. mom, c'mon! mia!
