justice correspondent evan perez, cnn special correspondent jamie jungle and cnn legal analyst, elliott williams. evan, i want to start with you so, the days went to be thursday. do you know anything more about what that's going to look like what the plan is for him? it's not going to look like any of the others and that's kind of a strange thing to say. the former, president this is his fourth time being arrested and processed as part of an indictment part of answering chain charges. in this case, the sheriff's office in atlanta says they're going to treat him like any other defendant. he's got a lot of different when he turned himself in in new york and certainly in the federal system that then within a mugshot. and this, case they are going to take a mugshot and fingerprints, they're going to do all the things we normally. do >> that's a choice, they don't necessarily have to do. it >> right, they've chosen to do it like they've done others. and, importantly, he's going to be turning himself in at the jail which is the fulton county jail is sort of a very dark place. it's a place that's getting a lot of scrutiny even from the justice department for the conditions under which prisoners are being held there. so, it's not a nice place, and the former president going to be going in, there go through a process on obviously surrounded by secret service, a lot of protection for him, but it's not going to be like the other ones. in this case, the georgia law allows for the release of the mugshot something that hugh so far not had to have have punt. obviously, his fundraising people believe this could be something he could use to his own advantage to try and raise money off of. we'll see whether that is something that really could - work. - >> you said trump would say, it's not a nice place. . we're also kathleen sebelius getting details about this bond agreement the fulton county hard with the trump attorneys. it's interesting to me that there was almost no negotiation over this. what do we know about how the process went down? >> fani willis and a different attorney there wanted them to come into her office and to hash this out today. that is what they did. they saw the lawyers come into the government and sat down at atlanta, and they worked out the details. part of it in this 20,000 dollar bond is, again, this is the first on the former president is actually having to do a casual. on the other ones for personal recognizance and personal surety bonds. this is his argument out to put up money for the georgia system. under the terms of this, it's a lot more extensive than what we've seen in his previous cases, where he's been warned by judges, you can't threaten witnesses, you can only talk to witnesses through your own lawyers. in this case as you pointed out in the document itself, it warrants him about intimidating witnesses and also point out that he cannot threaten or intimidate people using social media, which is something he was doing on the day of his indictment. he warned jeff duncan against showing up and testifying against him which of course he did -- >> they know the defenders are dealing. what elliott, do you think that warning as crystal clear as it's laid out will have any impact on trump's behavior? >> i think it might. the problem is that you come into gray areas every time you talk about speech. what could be what some regard as a threat might be regard as aggressive language. and, i think a judge is going to have, to they'll be back in court at some point because this is just -- i have a hard time seeing a scenario in which the former president gives up his twitter or truth account and does not tweet things about witnesses or so. on now, once that happened, biden is going to have to sort out, is that really a threat to the, step up to the line, divisive over the land, the pointer went have to revoke his bond and women jill? it could certainly happen, it certainly hasn't yet, you have to wait and see. >> can i just say, it's going to happen. he is not capable of restraining himself, and he also knows the court does not want to throw him in jail. this is, you know he understands he can push the envelope like nobody else. >> do you think, jamie, the theatrics of doing it right after the presidential debates, i mean what are his advisers telling him about? i mean those are trump the short term and long term. i can see clearly the short term gain, but the long term impact of that kind of imagery being the next thing that voters see. >> for trump, as we've seen, it always seems he wants to pick up all the oxygen in the room. he will do that on thursday. absolutely maximum effect. that said, let's just say this, we've all been talking for a couple of weeks now about whether or not he would participate in the debate, and everyone including -- political consultant said you know it's actually not such a bad idea for him not to participate when he is this far ahead. that said, we're told there are some trump advisers who really think he should be participating for two reasons, one, heaven forbid someone in that group rises to the top, and he is not there. we know how effective he can be, the second is, if he becomes the nominee, he begins to argue that joe biden should debate him. if he does not show up for the debates, that undercuts that argument. >> a leo and you take on this other, thing the special counsel in a new filing tonight is actually pushing back on trump's request for a 2026 hearing date in that other election interference case. they are accusing trump's lawyers of exaggerating the time it will take to do the document review. are they right? >> they are absolutely right, but that is also incredibly calm and when parties negotiate when a trial or anything is going to happen. one party the defendant we need more time, the volume, stacks of boxes we need to go through and the prosecution will set, will push back on. that the judge will find a date somewhere in the middle there, it's going to take time to get to trial, it will not take until 2026 to go to trial. that's some funny business. >> what do you think the doj is looking for here in terms of timeline? >> they set an aggressive time of january, knowing that they are probably not going to get it. but i think, watching that judge on the stand, it is clear that she believes this case needs to go to trial, before the election. she believes that this is an important thing for the public, and certainly for voters. i think they believe that they are in a good place to get this trial by early summer. and then, it puts the onus on some of the other judges to try a maneuver around that. if she has a trial date, then some of the other procedural hearings in the other cases are going to have to take second place. >> i was going to say, it was quite deliberately written, the indictment to be narrow and tight the kind of thing that gets to trial pretty quickly. not like the case in florida that involves classified documents, a number of things that's going to take to get. away >> or the case in georgia. >> that is the perfect segue from what i was going to ask jamie, this week, this moment we are going to see 19 defendants parading into a county jail. what, that is different, and totally substantial ways, not just for trump, before the imagery that is going to be up there for the american public. what this case is all about? >> have you ever had 19? >> i haven't had 19, i've had big trials most the time a bunch of the guys plead out, so you will not see all 19. >> these are the characters that have been in the public sphere for over two years now, they will be walking into a jail. >> it is not just as if donald trump is the only bold faced name in the group. but one thing we have seen, people are complaining about their legal bills. in addition to mark meadows who we sort of wonder what he is doing, is he cooperating in some way. we wonder when these codefendants say, i need help with my legal bills, is that sending a message about be careful? >> there is going to be some separation at some point, it seems like between the former president and his codefendants, and it will come sooner than people realize. >> and it might be what fani needs to get this trace to case to a trial. thank you all very much >> i want to now bring in retired secret service agent ray moore, he was the service agent in charge of the field office in atlanta. thanks for being here can you walk us through what the surrender process will likely look at. will trump arrival at the airport over to the now infamous county jail on thursday. >> well first of all thank you for having, me and if we want to talk about the arrival at the airport it's going to be out of secure location. they will have a severe secure motorcade made. -- georgia state patrol, and they are going to travel in a secure motorcade that has been planned out over the last two weeks. the best route to take, the safest route to take to get him to the jail. >> and you have been in touch with both the agent in charge and the county sheriff who will be handling this, how crucial is that communication between the agents that are working on the protection of trump and the local authorities who are trying to get this process moving forward. >> that communication between those two organizations are vital. the great thing here is, both pat labat and steve beso who's the secret service agent in charge, they have known each other for the last couple of years. they belong to a group called metropole. they are not strangers calling each other, they are colleagues calling each other to make this happen. they are on the same page, about what should happen. with the former president. >> we were discussing the question of whether he will have a mugshot, fingerprinting, all of that. in terms of what happens inside the jail, what do you think is lightly to come out of this process. >> well i believe what will come out will be a mugshot, and he will be fingerprinted. that is what the established protocol for the fulton county sheriff's department is. they have talked about it, they talked about what they are going to do bezos and leblanc, former president trump is going to arrive at the jail, secure location. go up a secure elevator. he will come up on the floor where he will be the only person walking up and down that hallway, along with law enforcement. potentially though v2 secret service agents with him. the agent in charge of his detail, and the sheriff's personnel will be there to process former president trump. it is >> it is a small thing perhaps but trump is likely to walk him wearing a suit and tie, will he be wearing that in his mugshot? >> yes he will, they will not require him to change into any jail garb. that has been negotiated by his attorneys. they are going to come in, allow him to be processed and he will leave as i've read today he's already established a bond, a 200,000 dollar bond. he'll be able to come in, be processed, photographed, fingerprinted and leave. >> you point out that the secret service, obviously are trained to protect the former president in virtually any scenario. this is a different scenario, although they have done it about four times if, you are in the secret service are you prepared for something like this? and i wonder do you think the venue here matters, the state, the location within the state how does that play a role? >> it does play a role but, secret service trains every day to protect the president, or the former president, wherever they go. same type of security umbrella, or bubble wherever they go. including state and local enforcement. it will not be a big departure from how they do their job. the biggest departure is in this case where they do their job. >> ray more, thank you for all those valuable insights, we appreciate it. >> you are welcome and thank you. >> coming up next for us imagine for a minute what it is like to run against donald trump. you cannot go to him to get him on the debate stage, and you can't take him on the debate by without turning off the voters you need the most. and he may steal the spotlight by turning himself in, in a criminal trial the day after the debate. how do you win? >> well, it is going to mean that we are going to be entertained at the fact that you're going to have a number of people who are going to sit there on the debate stage, trying to attack other people up there on the debate stage who may be pulling at one or 2% so that they can show the audience that they are tough, without actually doing the tough thing and going after the front runner. it is going to be crazy to watch. but you will see the differentiation between, it'll be a big question of where does mike pence go, for instance. now you'll see somebody like chris christie, who certainly is not going to ignore donald trump, and then you'll see somebody like ron desantis who is already kind of pretending like he's going to be the guy that everybody is paying attention to. i think what it means, in the long, look every one of these folks think they can't speak out and they don't speak out. , but it is they're not speaking out, and they're defending of donald trump after each of the indictments, it's the reason why he is gaining in popularity. because the people of the republican base trust are standing up in front of him and saying, not only did donald trump not do anything wrong, he is being attacked by the doj and he was the greatest president ever. so why would you ever expected to pick up anybody else's votes? >> do you think the fact that trump is not on the debate stage, will they even defend him for that, or will it try to do what ron desantis has done in the last couple of days, which is to say trump is more or less hiding from his competitors here? >> i have to separate, i believe it is seven people on the debate stage, but you have to separate asa hutchinson and chris christie from the rest. isa hutchinson and chris christie are going to do what is necessary by defending things like, i don't know, the constitution, by saying things like the truth and speaking that truth to power. whether or not that is enough, they are probably at three or 4%. i'm not sure that it's going to catapult them. but, the rest of them are going to do what they have been doing the entire campaign, is not make donald trump that, if you can't stand up to donald trump and somebody who abused the constitution, somebody who has 70 plus felonies and indictments, are you gonna stand up on the world stage leaders who have some kind of -- towards the united states of america. are you gonna stand up for the american people? that is the argument to make against the rest of them. i don't think that that is going to be very interesting, i think donald trump is going to loom large and donald trump may not even, being there, when this debate. >> we may be right about that last point, but it may very well be interesting to see whether the other candidates can create some kind of moment for themselves in his absence. adam, on the other side, trump is trying to create counter programming here with this tucker carlson interview. he's already pre-taped many, many days in advance. it is like a lifetime in a political world to do it that far enough it ahead. do you expect that to actually work? to truly steal the oxygen from this debate as a form of destruction here? >> no, so that is not going to do it. to tucker carlson, even though we all still know his name, every time he is put something out it has gone over very quietly. we get a little chatter on twitter, but people don't pay attention to tucker carlson anymore. when he lost his position at fox news he lost his megaphone. he was, yesterday, i did see being a traitor to the united states and talking about how all these powerful dictators were, but we're not talking much about it because people don't care about tucker carlson anymore. so, i don't think that this is going to be the thing that overshadows of the debate and get donald trump's special attention, or will make him feel good because tucker will continuously kiss up to him and donald trump loves that. but, what we'll do, that is the arrest on thursday. it is, no matter what we talk about on thursday, all the oxygen is going to be sucked out and we're going to be talking about donald trump's arrest on thursday, yet again, and his bail yet again and his felonies yet again and, yet again, we're going to watch a lot of these candidates for president not have the courage to tell the base the truth and then wonder why donald trump is still in the lead. >> i want to play for you what republican senator bill cassidy said the sunday on state of the union, listen. >> i think joe biden needs to be replaced but i think don't think americans will vote for someone who has been convicted. >> do you think he's right about that? >> i don't think so, he actually has the lead in the race, he has the ability to drive all of the attention towards him anytime he wants by just saying something or doing an interview. so i think his main goal here is to deny's opponents any oxygen and to block out the sun on their candidacies. at the same time letting them fight amongst each other, so by not showing up it really does perfectly suited strategy. >> do you think you'll skip all of them? >> i think what will he make him change that is if he does start to see somebody rise and he starts to see a trend line working in the direction of one of these candidates that he sees as a direct threat. then he's going to show up and show these guys who's the real front runner in this race. >> felipe, debating is a muscle memory for candidates, even candidates like trump. he won't be doing it, and if he becomes the nominee and he's up against joe biden he will really have to work and get up to power their. there will be all these other candidates on the debate stage, they might lose by not being able to take it to trump and show voters that they can. >> yeah, first, we are 48 hours away. i'm not so sure that he is not going to be there. >> you've all people -- >> he's not beyond playing a stand to be the center retention. he also doesn't prepare, so it's not as if he needs to do something that he hasn't been doing along the way. i disagree with kevin a little bit, i actually think he's making a mistake and he is going to regret it because, to some extent, what the others want to do and the republican establishment at large is trying to show people what a party without donald trump looks like. if i were him, i'm not sure that i would allow that visual. obviously, if it is a food fight on wednesday night, that no one looks good. but you know, what some might look better than others. i say they all go in with different goals. people don't realize how hard prep is, kevin our talking before we came, out it is grueling and no one enjoys, it but it is part of the most important thing that they do, especially now, to your point, about cobwebs. except for ron desantis have been debated last year in the context of his reelection pence has not done it since 2020, i don't think kristi is done in seven years, haley in eight years -- >> and some of never done it in a multi candidate field. >> as someone who is moderated a debate with multi fuel on it, it's hard to manage that dynamic on the stage. >> imagine showing up, not preparing to be the moderator. >> something i would not do, by the way. >> kevin, the goal for a lot of the candidates is to make a moment on that stage. it is hard to do it, but the whole thing seems like it might just become very vanilla. is it hard for these candidates to stand out? >> it's hard if you don't have a strategy. i think that is one of the things, we probably agree on, if you're sitting and preparing for, this you're telling a candidate hey, we are going to pick a fight with candidate acts on immigration. we're going to pick a fight with candidate why on foreign policy, and we're going to have it out. and that's going to be the message that we're able to crystallized to the voters and to the message that we can, ideally, take as part of momentum because the interesting thing about debates like this, where you only get these 32nd sound bites, is advising that message so that for the next two days is that is what everybody sees, that one moment that brings to life your candidacy. for a lot of voters, for the first time, they are being introduced to you. >> to that point, it's still work in progress. very few of these candidates have a message that has clearly resonated that they are going to stick with. so you're going to see a bit of experimentation on wednesday. wednesday night could be ugly whether or not he's there or not, but you will see that some of them are gonna come in with a bit more a strategy. i think chris christie in particular will be interesting because he is going to use the lines he is prepared to use it to don trump's, face he's just going to do it to the camera. i also think he could be an m c of the whole thing, saying, folks, imagine this. this is what his presidency would be like. it'll be too busy in court when we are trying to run the country. i think that he could distinguish and self a little bit. >> these other candidates are not gonna come out unscathed, the kids what kristie does is that he will listen to the talking point and call it out in the moment and -- >> he destroyed marco rubio. >> i want to play a flashback for you sleep, this is you playing donald trump in this debate prep with hill who clinton back in 2016. >> first, i admit, i made a mistake and using private email. >> breaking news. >> i made a mistake running against this guy, to. >> >> that's the most trump tie. >> the tie was dragging on the floor. >> how do you prepare a candidate for a moment like that? >> laura, i do think it is fair and i think it is expected. in one sense, it is low because that is not number that is very meaningful to someone of donald trump's wealth. in folding county, georgia, the way they do these bond amounts is they set up by count and donald trump runs all through this complaint, this indictment that the fulton county d a fani willis has put forth. >> the more charges, the higher the bond? >> exactly. the highest amount is actually for the most serious of the charges, the one that unifies the indictment. we talked about it a lot. the rico charge, that is $80,000 in bond and then $10,000 per each of the other charges. it totals up to about $200,000. i think it is fair and reasonable under the circumstances. >> let's compare it to others, because -- in fact john eastman came in earlier today, if we look at the other people who are part of the 19 slate of co-defenders there, intentional state of electors, there you have the codefendant bond agreement and you've got john eastman, 100 grand he is supposed to pay. ken is chesebro 100,000, ray smith and scott hall lower at 50 and ten respectively. why?
