good morning, everyone. it's friday. we're glad you're with us. it's been quite a week for this country. >> quite a week. it's framing what is going to be ab intense consequential months ahead. >> let's get started with five things to know for this friday, august 4th. sour, defiant, we have new reporting this morning about donald trump's state of mind after he was indicted for the third time in four months. the former president proclaiming his innocence and accusing the special counsel of leading a political persecution. also new overnight, democratic lawmakers want to watch the trial. they want a judge to allow cameras in a federal courtroom. the july jobs report will come out. a key number for the fed. also this morning a reenactment of the parkland high school shooting. as part of a lawsuit against the officer who failed to enter the build whg a gunman killed 17 people. two sailors under arrest and have been indicted for allegedly sending sensitive military information to chinese intelligence officers. and if you're one of the thousands of swiftieses heading to los angeles this weekend, fair warning. politicians are pleading with the pop star to post tpone her shows. "cnn this morning" starts right now. what a day america witnessed yesterday afternoon, what is normally a mundane proceeding, it is not that when it is of a former president. as the former president is waking up this morning after being arraigned yesterday, he' in bedminster. he did plead not guilty for the third time in a courtroom yesterday in just four months on charges st from his efforts to stay in power after he lost the 2020 election. the next hearing just a few weeks from now when a trial date will be set. lawyers indicate they will attempt to delay the trial, push it out so this sets the stage for a chaotic campaign season disrupted by court dates. we have on how trump is feeling and his plolitical positioning. sources tell kaitlan collins the former president was irked that the judge referred to him as mr. president trump rather than his presidential title and he's preparing to use the charges to revisit his election fight. >> we will relitigate every single issue in the 2020 election in the context of this litigation. >> new overnight, kevin mccarthy with a few in defense of trump equating this actions to those f al gore after their election losses. >> you are is actually concession. also overnight, 38 democratic lawmakers appealg a federal judge asking that the trial be televised. the letter reads, given the historic nature of the charges brought forth in these cases, it's hard to imagine a more powerful circumstance for televised proceedings. our team informs the courtroom yesterday. jessica snider has more. >> reporter: former president trump pleading not guilty to all charges as he appeared for his third criminal arraignment in the past four months. this time at the federal courthouse in washington, d.c., right as cross the street from the capitol building trump supporters stormed inside on january 6th. part of a broad effort to stop the certification of the 2020 election. trump sat in his trademark blue suit and red tie as the magistrate judge announced all four charges against him, including conspiracy to defraud the united states and obstruction of an official proceed ing. the maximum penalty on all charges is decades in prison. just 15 feet from donald trump inside the courtroom, special counsel jack smith, the man who is now charged trump with multiple counts in florida and washington. they staired at each other several times before the arraignment began. the most recent, accusing trump of conspireing to overturn the legitimate results of the 2020 election by spreading false claims of election fraud that trump knew were false. >> this is a persecution of a political opponent. >> reporter: trump remained defiant as he travelled in and out of washington after his 30-minute court appearance, flying back to bedminster with a slew of lawyers on board his personal jet. prosecutors did not ask for donald trump to be detained, but his release did come with conditions including not being allowed to communicate with anyone else who is a witness in this case. >> this is the persecution of the person that is leading by very substantial numbers in the republican primary and leading biden by a lot. so if it you can't beat him, you persecute him or prosecute him. >> reporter: prosecutors are pushing for a speedy trial telling the judge they are ready to handover all of the evidence they have collected in their multiyear investigation. trump's lawyers, meanwhile, continue to go on offense. >> president trump is under siege in a way we have never seen before. >> reporter: trump's lawyer accuse ing the special counsel acting politically. >> this is the biden political affair we have seen time and time again. last week hunter biden's plea deal fell through when the judge realized it had blanket immunity. the following day, a superseding indictment against donald trump. >> reporter: trump will not be required to attend the next hearing in the case scheduled for august 28th. that's when the judge could set a trial date. prosecutors here are pushing for a quick trial likely well in advance of next year's presidential election, but trump's team really pushed back saying there is a massive amount of evidence here they need to sift through before they can even begin thinking about a trial date. >> joining us now is legal analyst and former assistant u.s. attorney for the southern district of new york elie honig and new york columnest air lewis. i want to start with the timeline before we dig into the league. august 28th, 2350i6 days after the trump is going to participate in that. what people flew, how fast we should or could be seeing things play out. >> this is such an important decision. i would argue the timeline is the big question. can we get this in. parties are going to go in front of the judge. yesterday they were in front of a magistrate judge. she will then set at least the beginning of a timeline, sometimes in that scenario, a judge will say i'm going to go to the end and set a trial date and work backwards. let's set some intermediate dates and hold off and set a date at some time in the future. i think this judge is going to set a trial date. i think she's given the signals. she wants to get this in will ever the election. easier said than done. 2024 looking ahead, march and april are already occupied by the hush money case. may into june and july are alreadoccupyied by jack smith's other case. so i'm not sure if she's going to be able to fit in -- she can't do iafr that. if you try to do it before that, that's really, really quick. that does not give trump's team much time at all to prepare. it's a tough spot. the other two dates can move. these trial dates come and go. they can move to accommodate each other. >> a lot people this morning saying they want it televised. talking about what neil wrote in "the washington post" saying it should be televised. he writes, your most important to let americans see what happened in the courtroom and assure them that justice is being done. how can you argue with that? i'll ask you if they can do it legally in a minute. >> it's a noble sentiment, and certainly as a member of the media -- look, what it leads to is grand standing. that's always been the fear. that's why they haven't allowed cameras new. we know trial lawyers. no disrespect. >> i'm the daughter of a trial lawyer. i love trial lawyers. >> you put them in front of a camera and they start to perform. as they should. you're supposed to take advantage of every opportunity, and they certainly would. it would change the character of it. if they want a solemn, dig dignified, swift resolution to this, cameras would work against it. despite all of that, i'm hoping they do do it. twe need to hear this. if as we heard before, the former president's lawyer wants to relitigate all of this, you sure you want to do that? fine, let's go through it all over again. whatever it takes to get people up to speed and acquaint ed wit the facts of this is probably a good thing. we saw with some of the numbers, there were a lot of people that tuned in and want to get information. >> i have breaking news. yes, trial lawyers grand stand without cameras in the courtroom. yes, trial lawyers -- i may have done that at times, even without cameras in the courtroom. defense lawyers really -- you know they are going to cry automatically because it's their thing. so i don't really buy this idea that the cameras will undermine the decorum. we have recent examples. the trial of derek chauvin, they allowed cameras in the courtroom. that was a fair, dignified proceeding. it gave the american public confidence that justice was done. we saw the trial of kyle rittenhouse people didn't like the result, but they were conducted fairly. same thing with the trial in the killing of ahmaud arkansas but ri. all three of those we got to watch it and gave the american people confidence in the proceedings and the outcomes. >> just the judge can decide? >> it's a little complicate d. there's a federal rule of criminal procedure that says no cameras in the courtroom. but that can be changed. the federal courts can do what they want in this respect. it starts with the judicial conference, which chief justice roberts is in charge of. but they can start the ball rolling by saying i would leak to have cameras in this courtroom. >> i want to ask about something you said in terms of the relitigation of the election claims. they went 0 for 6 in their court cases. have at it. it would probably be valuable for the country. that's clear ly a strategy. there's a piece talking about how trump's lawyers are focused on talking about it. why? >> one of their defenses, we don't know what they are going to pick, but one of them that they already telegraphed is this notion of it was awful but lawful. you may not like my politics or style or like what my lawyer rudy giuliani and some of my other attorneys do, and yes, we are strong arming people, we are lying to the public. it's pretty awful. politics can be awful, but we didn't cross the line. if that's going to be the case, i think they are going to put it out there. i think the public, a certain segment of the public will recoil from it. it makes you wonder if you really want to do that at top volume. that's what the former president has done. certainly at all his rallies, do you want to do that in a courtroom or in front of a jury. we'll find out. >> not to be skeptical, if you're going to try to subpoena people and do all this, it's less about the fact you think you have something there but you want to push this past the election because it's get out of jail free card. >> if that's their strategy, good luck. nobody has been able to do that. but yes, i think this is part of their plan to say, this is going to take months and months. we're going toof to investigate all seven months. but judges are going to give very broad range over what their defenses can be. but judges can say, no, i don't recognize that as a valid defense or allowing this. i don't want this to become a circus. that's going to be a huge decision. is she going sdplr a startling claim here. born out by video evidence showing this to be this surface drone approaching what looks like the ship. now they say that 100 russian personnel were on board when, indeed, just short a half a metric ton of tnt struck that ship. that's an absolutely devastating blast if that did occur. and where this happened, possibly more important, a black sea port that is one of those places russia would have thought was frankly unasasailable. it was out of reach. but ingenious technology here, it appears, attacking a boat with a large number of personnel on it and another dent in russias's sense. we have seen the bruj that leads the peninsula also hit by a ukrainian drone. now this. and again, i think a reminder as ukraine's president volodymyr zelenskyy said a few days ago that the war is returning to russian territory. it's still raging here in ukraine with multiple dead most days, but things like this just a sign this is simply not going away. >> nick paton walsh for us, thank you. also two sailors have been arrested and accused of sending sensitive military information to chinese intelligence off officers. the justice department announced charges against the service members yesterday. one man is facing espionage charges. the other accused of accepting bribes. our reporter is live from the pentagon. when you hear that, the question is what's the evidence that prosecutors have? what are they saying? >> reporter: yeah, these are really remarkable charges. notably, they are actually separate cases, but the government chose to unveil them at the same time yesterday to emp fa size how far china is willing to go to try to get military secrets from service members. prosecutors are sayingwo.s. navy sailors engaged in relationships with chinese intelligence officers over the course of a year and another case two years, in which these sailors provided very sensitive information to these chinese intelligence officers. one of these sailors, he worked at naval base and was a machinist, an engineer responsible for repairing things on navy ships, include ing the x. he provided photos and videos, as well as the layout of these intelligence officer beginning in february of022 and actually received thousands of dollars in return for that information. notably, he was also trying to obtain u.s. citizenship through this period, and the officer actually congratulated him in may of 2022 for obtaining u.s. citizenship, all the while prosecutors say he was providing this very sensitive and classified military information to this chinese officer. in the second case, he actually work ed at naval base ventura county and was responsible for fixing electrical equipment at u.s. military installations around the world. accordintorosecutors, he entered into a relationship with someone who was posing as kind of an investor, but in reality, that person was a chinese intelligence officer. he was allegedly providing him with very sensitive plans about u.s. training exercises in the endo pacific, as well as information about a u.s. radar system in okinawa, japan. so very serious charges here. of course, it also comes as the u.s. military is still reeling from the espionage charges against another u.s. service member who was accused of leaking information online, classified information online earlier this year. so at least the third instance this year of u.s. service members allegedly mishandling classified information. >> i have to ask you about some reporting i have been fixated on. i don't think there's much, if any, press tent for this. it feels like confrontation, right? either. >> my frustration with this argument is probably palpable to all of you at this point. i believe there were actual defenses, as we have talked about repeatedly with trump lawyers there. the one with no basis or tied to the actual indictment itself is a little bit off putting. is kevin mccarthy right. is there an apples to apples comparative to al gore and hillary clinton. >> no, of course, not. politicians are entitled to say wavr they want. it's the actions that are what resulted in this indictment. you can say anything you want, but it's when you take actions that cross the line and puts you into legal jeopardy. that's what this case is about. it's not because donald trump kept saying at rallies he thinks he won the election or thinks the election was stolen. he can say that every day. the indictment makes that clear in the first paragraph. what he cannot do is sick his lawyers on a bunch of state officials and start intimidating them and challenging facts that he already knows are not true. and to the extent that he did all of those things, that's why he got arrested. >> this is what we were going back and forth with one of john eastman's lawyers. they keep saying it's okay he changed his mind and he was being a good lawyer. there's a line. you can lawyer what you can't do is pursue things in a crime. that's the difference. but i don't think it's being distinguished for a lot of folks. i don't think many people are being fairly served by these arguments that are con freighting criminalizing acts and speech. what is not what this indictment does. kevin mccarthy's comments nicely highlight the difference between what is and is not criminal. speech is not criminal. you can complain. you can lie. it says that in the indictment. you can say whatever you want. but when it crosses the line into conduct, into let's round up 16 people from the state of michigan, have them claim they are the electors and sign a form and send those forms into the archives and the senate and the secretary of state, then you have crossed the line from speech into conduct. so i don't think this is what kevin mccarthy was trying to do. but if you want to -- he get it is wrong at the end when he says it's all thought. trump thought he spoke, put he also took action. that's the distinction. >> again, i would like to note that al gore and hillary clinton conceded. they didn't try to force to overturn votes along with what you're talking about. >> didn't start a riot. >> but that's not when he's charged for. this is not about an insurrection or the attack on the capitol. i want to ask we were talking about this during the break. especially with the grand jury is expected to meet again. that would potentially be the fourth indictment for the former president. the timeline, there's an election. you cannot separate the political from the legal at this point. >> that's exactly right. everybody should be prepared for the reality that the most recent c cases in particular are probably not going to advance very far before most of the relevant votes have been cast. so if super tuesday is going to happen in early march of next year, there's almost no way any of these cases will be reinvolved. certainly not past conviction and possible appeal. so we're going to basically do the nominations, the republicans are, without knowing what the real outcome of these cases are. the average case takes about 18 months. and under the best case sc scenario, that's well past the election next year. so at a minimum, early voting will be happening in the general election before the best scenarios any one of these cases is resolved. >> kind of interesting because of how many republicans we're showing don't believe biden legitimately won the election. but there's this new reuters poll that's interesting. 45% of republican voters that they surveyed said they would not vote for trump if convicted. to that great point, we all know the outcome of this. >> let's not forget appeals. because even if we manage to get in one or two of these trials, if it's not guilty, there's no appeal. prosecutor cans not appeal. but if there's a conviction. >> great movie. you don't remember the movie? >> you want a pop culture moment. >> there's a movie about pros prosecutors being not able to appeal? >> "double jeopardy." >> no matter what, these appeals will still be pending when we get into the election season. so even if donald trump is convicted, people who support him will have every right to say this is not final yet. we still have several layers of appeal to go. that will still be pending at the time of the election. >> trump's attorney was talking about we think we'll be successful if we need to be on appeal. they feel more yesterday. a judge officially sentenced him to death. that's the verdict the jury came down it with. it came a day after a jury decided on the death penalty for the man accused of murdering 11 people at the tree of life synagogue about five years a ago. it was the deadliest anti-semitic attack in u.s. history. danny freeman reports. >> reporter: catharsis in the courtroom as one by one family members and loved ones, survivors of the pittsburgh synagogue shooting finally got the chance to freely address the shooter in open court. your sick, vile actions have totally erased you from humanity and society forever, said mark simon. i am in principle oppose d to te death penalty, said arab buy who survived the attack, but this shooter has challenged my ability to maintain that view. in my opinion, he's forfeited the privilege of living. with witness after witness, defendant bowers sat motionless taking notes, no longer in his trial sweater, now in a red inmate jump suit. i can only wish mr. bowers would look at me while i'm talking instead of scribbling on his page, said dan, after surviving being shot. throughout the pain of the week, defiance and hope did emerge. a 97-year-old mother was killed in the attack. but andrea survived. she told cnn in an exclusive interview, her mom rose has looked over her. >> we had a near death experience. i think that changes you and you just see l. it's been hard without my mother, but i know she would with want me to live on and take care of my family. and that's what we'll do. we spend family time together. we talk about my mother, we share memories, we laugh about my mother. she was pretty funny. and. >> back in court, her brother and rose's son spoke directly to the shooter. the synagogue you defiled will be rebuilt, and the joy you took away will be reclaimed. my children will have their weddings there, and their children will have their bat mitt vas there, and we will continue to add to our family long after you have gone. robert bowers was formally sentenced to death, plus 37 life sentences and 20 years each for 4 additional counts. >> danny free minnesota, so important to mare from those survivors. thank you very much. today ballistics experts are set to fire off gunshots in florida during a reenactment of the marjory stoneman douglas school massacre. it's part of a lawsuit families of victims have brought against the school resource officer, who waited outside the build ing whn the shooting happened for 40 minutes while the gunman was inside. the shooter took 14 students and 3 staff members. he couldn't tell where the shots were coming from because they were echoing. carlos suarez is live for us. why did they want this reaena actment? >> reporter: they believe it will show there's no way the school resource officer couldn't tell where exactly the gunfire was coming from the day of the shooting. back in june, a jury found peterson not guilty for his inaction the day of the shooting after his attorneys successfully argued that peterson took cover outside of the 1200 building for more than 40 minutes. he never went inside of the building because he thought there was more than one gunman and because he couldn't tell exactly where the shooting was taking place. now before this reenactment takes place, they are going to get a tour of the 1200 building. they are going to get a look at the three floors where this shooting took police. the classroom, the hallways, where these 17 students and staff members were killed back in 2018, and 17 others were wounded. now just last week, some of the parkland families were up in washington, d.c. and they were lob big some of these very same lawmakers for a school safety legislation as well as more funding for mental health services as well as school resource officers. here now is max shakter, his son was one of the victims killed. he talked to us yesterday about the importance of today's congressional visit as well as the reenactment. >> if we don't use this building to teach others and to educate and use it to prevent the next tragedy, it's all for not. every member of congress before they put their hand on the bible, every school the capitol building trump supporters stormed inside on january 6th. part of a broad effort to stop the certification of the 2020 election. trump sat in his trademark blue suit and red tie as the magistrate judge announced all four charges against him, including conspiracy to defraud the united states and obstruction of an official proceed ing. the maximum penalty on all charges is decades in prison. just 15 feet from donald trump inside the courtroom, special counsel jack smith, the man who is now charged trump with multiple counts in florida and washington. they staired at each other several times before the arraignment began. the most recent, accusing trump of conspireing to overturn the legitimate results of the 2020 election by spreading false claims of election fraud that trump knew were false. >> this is a persecution of a political opponent. >> reporter: trump remained defiant as he travelled in and out of washington after his 30-minute court appearance, flying back to bedminster with a slew of lawyers on board his personal jet. prosecutors did not ask for donald trump to be detained, but his release did come with conditions including not being allowed to communicate with anyone else who is a witness in this case. >> this is the persecution of the person that is leading by very substantial numbers in the republican primary and leading biden by a lot. so if it you can't beat him, you persecute him or prosecute him. >> reporter: prosecutors are pushing for a speedy trial telling the judge they are ready to handover all of the evidence they have collected in their multiyear investigation. trump's lawyers, meanwhile, continue to go on offense. >> president trump is under siege in a way we have never seen before. >> reporter: trump's lawyer accuse ing the special counsel acting politically. >> this is the biden political affair we have seen time and time again. last week hunter biden's plea deal fell through when the judge realized it had blanket immunity. the following day, a superseding indictment against donald trump. >> reporter: trump will not be required to attend the next hearing in the case scheduled for august 28th. that's when the judge could set a trial date. prosecutors here are pushing for a quick trial likely well in advance of next year's presidential election, but trump's team really pushed back saying there is a massive amount of evidence here they need to sift through before they can even begin thinking about a trial date. >> joining us now is legal analyst and former assistant u.s. attorney for the southern district of new york elie honig and new york columnest air lewis. i want to start with the timeline before we dig into the league. august 28th, 2350i6 days after the trump is going to participate in that. what people flew, how fast we should or could be seeing things play out. >> this is such an important decision. i would argue the timeline is the big question. can we get this in. parties are going to go in front of the judge. yesterday they were in front of a magistrate judge. she will then set at least the beginning of a timeline, sometimes in that scenario, a judge will say i'm going to go to the end and set a trial date and work backwards. let's set some intermediate dates and hold off and set a date at some time in the future. i think this judge is going to set a trial date. i think she's given the signals. she wants to get this in will ever the election. easier said than done. 2024 looking ahead, march and april are already occupied by the hush money case. may into june and july are alreadoccupyied by jack smith's other case. so i'm not sure if she's going to be able to fit in -- she can't do iafr that. if you try to do it before that, that's really, really quick. that does not give trump's team much time at all to prepare. it's a tough spot. the other two dates can move. these trial dates come and go. they can move to accommodate each other. >> a lot people this morning saying they want it televised. talking about what neil wrote in "the washington post" saying it should be televised. he writes, your most important to let americans see what happened in the courtroom and assure them that justice is being done. how can you argue with that? i'll ask you if they can do it legally in a minute. >> it's a noble sentiment, and certainly as a member of the media -- look, what it leads to is grand standing. that's always been the fear. that's why they haven't allowed cameras new. we know trial lawyers. no disrespect. >> i'm the daughter of a trial lawyer. i love trial lawyers. >> you put them in front of a camera and they start to perform. as they should. you're supposed to take advantage of every opportunity, and they certainly would. it would change the character of it. if they want a solemn, dig dignified, swift resolution to this, cameras would work against it. despite all of that, i'm hoping they do do it. twe need to hear this. if as we heard before, the former president's lawyer wants to relitigate all of this, you sure you want to do that? fine, let's go through it all over again. whatever it takes to get people up to speed and acquaint ed wit the facts of this is probably a good thing. we saw with some of the numbers, there were a lot of people that tuned in and want to get information. >> i have breaking news. yes, trial lawyers grand stand without cameras in the courtroom. yes, trial lawyers -- i may have done that at times, even without cameras in the courtroom. defense lawyers really -- you know they are going to cry automatically because it's their thing. so i don't really buy this idea that the cameras will undermine the decorum. we have recent examples. the trial of derek chauvin, they allowed cameras in the courtroom. that was a fair, dignified proceeding. it gave the american public confidence that justice was done. we saw the trial of kyle rittenhouse people didn't like the result, but they were conducted fairly. same thing with the trial in the killing of ahmaud arkansas but ri. all three of those we got to watch it and gave the american people confidence in the proceedings and the outcomes. >> just the judge can decide? >> it's a little complicate d. there's a federal rule of criminal procedure that says no cameras in the courtroom. but that can be changed. the federal courts can do what they want in this respect. it starts with the judicial conference, which chief justice roberts is in charge of. but they can start the ball rolling by saying i would leak to have cameras in this courtroom. >> i want to ask about something you said in terms of the relitigation of the election claims. they went 0 for 6 in their court cases. have at it. it would probably be valuable for the country. that's clear ly a strategy. there's a piece talking about how trump's lawyers are focused on talking about it. why? >> one of their defenses, we don't know what they are going to pick, but one of them that they already telegraphed is this notion of it was awful but lawful. you may not like my politics or style or like what my lawyer rudy giuliani and some of my other attorneys do, and yes, we are strong arming people, we are lying to the public. it's pretty awful. politics can be awful, but we didn't cross the line. if that's going to be the case, i think they are going to put it out there. i think the public, a certain segment of the public will recoil from it. it makes you wonder if you really want to do that at top volume. that's what the former president has done. certainly at all his rallies, do you want to do that in a courtroom or in front of a jury. we'll find out. >> not to be skeptical, if you're going to try to subpoena people and do all this, it's less about the fact you think you have something there but you want to push this past the election because it's get out of jail free card. >> if that's their strategy, good luck. nobody has been able to do that. but yes, i think this is part of their plan to say, this is going to take months and months. we're going toof to investigate all seven months. but judges are going to give very broad range over what their defenses can be. but judges can say, no, i don't recognize that as a valid defense or allowing this. i don't want this to become a circus. that's going to be a huge decision. is she going sdplr a startling claim here. born out by video evidence showing this to be this surface drone approaching what looks like the ship. now they say that 100 russian personnel were on board when, indeed, just short a half a metric ton of tnt struck that ship. that's an absolutely devastating blast if that did occur. and where this happened, possibly more important, a black sea port that is one of those places russia would have thought was frankly unasasailable. it was out of reach. but ingenious technology here, it appears, attacking a boat with a large number of personnel on it and another dent in russias's sense. we have seen the bruj that leads the peninsula also hit by a ukrainian drone. now this. and again, i think a reminder as ukraine's president volodymyr zelenskyy said a few days ago that the war is returning to russian territory. it's still raging here in ukraine with multiple dead most days, but things like this just a sign this is simply not going away. >> nick paton walsh for us, thank you. also two sailors have been arrested and accused of sending sensitive military information to chinese intelligence off officers. the justice department announced charges against the service members yesterday. one man is facing espionage charges. the other accused of accepting bribes. our reporter is live from the pentagon. when you hear that, the question is what's the evidence that prosecutors have? what are they saying? >> reporter: yeah, these are really remarkable charges. notably, they are actually separate cases, but the government chose to unveil them at the same time yesterday to emp fa size how far china is willing to go to try to get military secrets from service members. prosecutors are sayingwo.s. navy sailors engaged in relationships with chinese intelligence officers over the course of a year and another case two years, in which these sailors provided very sensitive information to these chinese intelligence officers. one of these sailors, he worked at naval base and was a machinist, an engineer responsible for repairing things on navy ships, include ing the x. he provided photos and videos, as well as the layout of these intelligence officer beginning in february of022 and actually received thousands of dollars in return for that information. notably, he was also trying to obtain u.s. citizenship through this period, and the officer actually congratulated him in may of 2022 for obtaining u.s. citizenship, all the while prosecutors say he was providing this very sensitive and classified military information to this chinese officer. in the second case, he actually work ed at naval base ventura county and was responsible for fixing electrical equipment at u.s. military installations around the world. accordintorosecutors, he entered into a relationship with someone who was posing as kind of an investor, but in reality, that person was a chinese intelligence officer. he was allegedly providing him with very sensitive plans about u.s. training exercises in the endo pacific, as well as information about a u.s. radar system in okinawa, japan. so very serious charges here. of course, it also comes as the u.s. military is still reeling from the espionage charges against another u.s. service member who was accused of leaking information online, classified information online earlier this year. so at least the third instance this year of u.s. service members allegedly mishandling classified information. >> i have to ask you about some reporting i have been fixated on. i don't think there's much, if any, press tent for this. it feels like confrontation, right? one with no basis or tied to the actual indictment itself is a little bit off putting. is kevin mccarthy right. is there an apples to apples comparative to al gore and hillary clinton. >> no, of course, not. politicians are entitled to say wavr they want. it's the actions that are what resulted in this indictment. you can say anything you want, but it's when you take actions that cross the line and puts you into legal jeopardy. that's what this case is about. it's not because donald trump kept saying at rallies he thinks he won the election or thinks the election was stolen. he can say that every day. the indictment makes that clear in the first paragraph. what he cannot do is sick his lawyers on a bunch of state officials and start intimidating them and challenging facts that he already knows are not true. and to the extent that he did all of those things, that's why he got arrested. >> this is what we were going back and forth with one of john eastman's lawyers. they keep saying it's okay he changed his mind and he was being a good lawyer. there's a line. you can lawyer what you can't do is pursue things in a crime. that's the difference. but i don't think it's being distinguished for a lot of folks. i don't think many people are being fairly served by these arguments that are con freighting criminalizing acts and speech. what is not what this indictment does. kevin mccarthy's comments nicely highlight the difference between what is and is not criminal. speech is not criminal. you can complain. you can lie. it says that in the indictment. you can say whatever you want. but when it crosses the line into conduct, into let's round up 16 people from the state of michigan, have them claim they are the electors and sign a form and send those forms into the archives and the senate and the secretary of state, then you have crossed the line from speech into conduct. so i don't think this is what kevin mccarthy was trying to do. but if you want to -- he get it is wrong at the end when he says it's all thought. trump thought he spoke, put he also took action. that's the distinction. >> again, i would like to note that al gore and hillary clinton conceded. they didn't try to force to overturn votes along with what you're talking about. >> didn't start a riot. >> but that's not when he's charged for. this is not about an insurrection or the attack on the capitol. i want to ask we were talking about this during the break. especially with the grand jury is expected to meet again. that would potentially be the fourth indictment for the former president. the timeline, there's an election. you cannot separate the political from the legal at this point. >> that's exactly right. everybody should be prepared for the reality that the most recent c cases in particular are probably not going to advance very far before most of the relevant votes have been cast. so if super tuesday is going to happen in early march of next year, there's almost no way any of these cases will be reinvolved. certainly not past conviction and possible appeal. so we're going to basically do the nominations, the republicans are, without knowing what the real outcome of these cases are. the average case takes about 18 months. and under the best case sc scenario, that's well past the election next year. so at a minimum, early voting will be happening in the general election before the best scenarios any one of these cases is resolved. >> kind of interesting because of how many republicans we're showing don't believe biden legitimately won the election. but there's this new reuters poll that's interesting. 45% of republican voters that they surveyed said they would not vote for trump if convicted. to that great point, we all know the outcome of this. >> let's not forget appeals. because even if we manage to get in one or two of these trials, if it's not guilty, there's no appeal. prosecutor cans not appeal. but if there's a these appeals will still be pending when we get into the election season. so even if donald trump is convicted, people who support him will have every right to say this is not final yet. we still have yesterday. a judge officially sentenced him to death. that's the verdict the jury came down it with. it came a day after a jury decided on the death penalty for the man accused of murdering 11 people at the tree of life synagogue about five years a ago. it was the deadliest anti-semitic attack in u.s. history. danny freeman reports. >> reporter: catharsis in the courtroom as one by one family members and loved ones, survivors of the pittsburgh synagogue shooting finally got the chance to freely address the shooter in open court. your sick, vile actions have totally erased you from humanity and society forever, said mark simon. i am in principle oppose d to te death penalty, said arab buy who survived the attack, but this shooter has challenged my ability to maintain that view. in my opinion, he's forfeited the privilege of living. with witness after witness, defendant bowers sat motionless taking notes, no longer in his trial sweater, now in a red inmate jump suit. i can only wish mr. bowers would look at me while i'm talking instead of scribbling on his page, said dan, after surviving being shot. throughout the pain of the week, defiance and hope did emerge. a 97-year-old mother was killed in the attack. but andrea survived. she told cnn in an exclusive interview, her mom rose has looked over her. >> we had a near death experience. i think that changes you and you just see l. it's been hard without my mother, but i know she would with want me to live on and take care of my family. and that's what we'll do. we spend family time together. we talk about my mother, we share memories, we laugh about my mother. she was pretty funny. and. >> back in court, her brother and rose's son spoke directly to the shooter. the synagogue you defiled will be rebuilt, and the joy you took away will be reclaimed. my children will have their weddings there, and their children will have their bat mitt vas there, and we will continue to add to our family long after you have gone. robert bowers was formally sentenced to death, plus 37 life sentences and 20 years each for 4 additional counts. >> danny free minnesota, so important to mare from those survivors. thank you very much. today ballistics experts are set to fire off gunshots in florida during a reenactment of the marjory stoneman douglas school massacre. it's part of a lawsuit families of victims have brought against the school resource officer, who waited outside the build ing whn the shooting happened for 40 minutes while the gunman was inside. the shooter took 14 students and 3 staff members. he couldn't tell where the shots were coming from because they were echoing. carlos suarez is live for us. why did they want this reaena actment? >> reporter: they believe it will show there's no way the school resource officer couldn't tell where exactly the gunfire was coming from the day of the shooting. back in june, a jury found peterson not guilty for his inaction the day of the shooting after his attorneys successfully argued that peterson took cover outside of the 1200 building for more than 40 minutes. he never went inside of the building because he thought there was more than one gunman and because he couldn't tell exactly where the shooting was taking place. now before this reenactment takes place, they are going to get a tour of the 1200 building. they are going to get a look at the three floors where this shooting took police. the classroom, the hallways, where these 17 students and staff members were killed back in 2018, and 17 others were wounded. now just last week, some of the parkland families were up in washington, d.c. and they were lob big some of these very same lawmakers for a school safety legislation as well as more funding for mental health services as well as school resource officers. here now is max shakter, his son was one of the victims killed. he talked to us yesterday about the importance of today's congressional visit as well as the reenactment. >> if we don't use this building to teach others and to educate and use it to prevent the next tragedy, it's all for not. every member of congress before they put their hand on the bible, every school board member, every sheriff should walk through this building and understand what happens if it you don't prioritize safety above education. you cannot teach dead kids. >> reporter: we're told that the reenactment is going to take place pretty much the entire day. some 140 rounds of live ammunition will be fired off in the 1200 building, and the reenactment will be recorded on video and audio as part of that civil case against scott peterson. as for the building itself, the plan right now is to tear it down piece by piece. we're told that could take several months. >> carlos suarez, thank >> my first thought is that what if all the form pseudocall drugs that all the seniors are taking now, what if it was replaced with all of these plants. plants over pills. >> 75-year-old sue taylor is a brand ambassador here at glass house. she's an unlikely believer and now a messenger for cannabis use for the elderly. >> if you said to me, you're going to be the trusted face of cannabis, you have been smoking too much. >> what was your perception of cannabis? >> i thought it was a drug like cocaine, like crack cocake. that was a stigma. >> but over the last decade, the perceptions, the stigma, and yes the face of cannabis has changed. >> it was before this came out. >> reporter: to this face, a senior, former principal, who opened her own dispensary dedicated to seniors. >> working with the cannabis is like magic. >> you have seen people get rid of their other medications once they start taking cannabis?
