The school resource officer, who waited outside the build ing whn the shooting happened for 40 minutes while the gunman was inside. the shooter took 14 students and 3 staff members. he couldn t tell where the shots were coming from because they were echoing. carlos suarez is live for us. why did they want this reaena actment? reporter: they believe it will show there s no way the school resource officer couldn t tell where exactly the gunfire was coming from the day of the shooting. back in june, a jury found peterson not guilty for his inaction the day of the shooting after his attorneys successfully argued that peterson took cover outside of the 1200 building for more than 40 minutes. he never went inside of the building because he thought there was more than one gunman and because he couldn t tell exactly where the shooting was

Broward county, florida. verdict, count two, we, the jury find as follows as to the defendant in this case. the defendant is not guilty. former school resource officer scot peterson breaking down tears after being found not guilty for failing to kill the gunman who killed 17 people at marjory stoneman douglas high school in parkland, florida. he faced seven counts of felony child neglect, three counts of culpable negligence and one count of perjuries. prosecutors say he did nothing, taking cover for 45 minutes outside the school before the killer was apprehended. peterson s attorney argued the then-deputy didn t enter the building because he couldn t tell where the shots were coming from and he was found not guilty on all charges. joining us now is scot peterson and his attorney. scot, thank you for joining us. i want you to listen to what some of the parents said. we saw your emotional reaction.

Committing some type of overt crime. he was accused of not doing, of failing to act. the prosecutors here had prosecuted him under a statute that referred to him as a caregiver under florida law, which means that he had a duty to protect those children, the staff that were there at the school that day in parkland. now his attorney actually issued a quote that was very direct but obviously raised a lot of eyebrows saying that his client had no duty to protect the victims. now for his part all along as this prosecution and the investigation was under way, what peterson said is that he didn t react because he couldn t tell where the gunshots were coming from. of course at the end of the day, no one knows what was happening inside his head. i mean, i ve been in situations where, yeah, if you have gunfire particularly bouncing off buildings, you might not be able to direct yourself. but to that location. but what prosecutors said is he didn t even stop to ask the fleeing students what did
