>> reporter: john, i don't think we should lose perspective here on how significant it is that the house rules committee has now voted out a contempt referral against not only a former member of congress in mark meadows, but this was someone who was also the white house chief of staff. this is something that you just do not see happen on a regular basis on capitol hill. the rules committee today hearing testimony from both bennie thompson and liz cheney, the chair and vice chair of the january 6th select commit, and he talked about the importance of learning more about these communications that meadows received not only on january 6th but in the days and weeks leading up to the insurrection on capitol hill, that it's not just enough for them to get not even a complete list of all of the communications on that day but to get ought of texts and e-mails and messages and also ask him very specific questions about what he knew about the events of that day. listen to what cheney said about the importance of actually hearing from mark meadows as opposed to getting cherry picked messages that he supplied to the committee voluntarily. >> this brings up another point. mr. meadows' testimony will bear on a key question in front of this committee. did trump through action or inaction corruptly seek to obstruct or impede congress's official proceeding to count electoral votes? >> reporter: so we expect the full house to vote on this measure later this afternoon. it will then go to the department of justice who will decide whether or not to prosecute mark meadows for criminal contempt of congress. of course, john, the big question though is now that the committee has taken this step, will they have any shot at getting this information from mark meadows? it seems very unlikely because now this process will be played out in a courtroom. he still has that opportunity here at the 11th hour to say that he'll come forward and sit and meet with the committee. john, that seems very unlikely at this point. >> ryan nobles, grateful for you kicking us off live. let's bring in the room with me to share their reporting jackie kucinich, seungman kim of "washington post" and our senior legal analyst elliott williams. this is not insignificant, this is a white house chief of staff and former member of congress held in congress saying the committee said he cherry picked. he was going to try to koorp reyes rate and then they realize that had mark meadows did not share all of his texts. interesting to listen to liz cheney, one of the two republicans on the committee, get straight to the point. this is liz cheney reading a text from donald trump jr. to mark meadows. >> one of the president's sons texted mr. m.d. meadows, quote. he's got to condemn this shit asap. the capitol police tweet is not enough. donald trump jr. texted. meadows responded. quote, i'm pushing it hard. i agree. >> so in this digital age, former prosecutor, what else did donald trump jr. text? what else did meadows text in reply to him happened then the testimony what, did the president said when meadows says i'm try, i'm pushing? what did he say? >> and also what communications did donald trump jr. have with his father because those communications wouldn't be protected by privilege, he's not the spouse, not the lawyer or senior white house staff. you notice what they did last night and in their report was focus on places where meadows would not have had a privilege claim, text messages he had with people outside of the white house and they were very, very careful here because if they went after him with a hatchet as opposed to a scalpel it never would have gotten by the department of justice because he does have privilege claims. >> dan golden, an attorney for the democrat in the impeachment hearings, he said meadows was clearly on his way by turning over full documents and then something happened before testimony. the committee subpoenaed his cell phone meta data which would show the date and time of his calls. he stopped cooperating. what's in the phone records and that's a question record as the committee goes forward. number one, if they have the records they can fill in some of the picture so donald trump jr. texted this, meadows texted back or are there additional texts? and the pullback and why meadows said never mind, it's fascinating. >> and another thing that happened is the rollout of meadows' book which details some of the conversations that he had saying everything is privileged. i put this stuff in a book you clearly deemed not. yes. he will turned over all of these pages of documents, but what else is there and there's another argument that he didn't turn over any of this to the archives so there's that piece so some of this could be lost to history and i'm sure you could say better than i could that that's against the law. >> even in the 9,000 e-mails and documents that he did turn over before he stopped cooperating, just look at some of the things that raise concern for the committee already, just in what was turned over even before the news yesterday, you know. up message where he says, hey, don't worry, you know, i'm paraphrasing here but the national guard will be there indicating that they will be there to protect any real -- anybody there the day before this is a pro-trump -- that is there to engage in the pro-trump rally. this also raises a question as well amid scrutiny of why the national guard was not deployed for hours that day as well. they are going to continue to look at, that and you saw just a group with that email about the national guard being there to protect some of the people at a pro-trump rally and you saw that an unnamed lawmaker is messaging him on the day of january 6th saying we're under siege. it's important i think to remember, to remind everyone that especially look, i was there as well, that this was in that time span. those roughly three hours. you had hundreds of people overrunning local law enforcement there and members of congress trapped inside that building pleading, each with members of the defense department and military and calling mark milley at one point as well saying we need help. it does raise questions from the person closest to the president about the delay of the national guard. >> which is critical. so many people say why do you care so much about january 6th? why can't you move on? number one, it was a coup attempt, an attempt to subvert american democracy in the american temple of democracy on a critical day for the democracy and you make a key point that many of the key players are still active and still trying to undermine and trying to rewrite the history of that day. liz cheney went through some of the tweets from trump cabinet officials and some republican members of congress saying this is horrible, this is a siege. many of those same people now say forgot about it. it was a little deal. just a few people got violent including, including, donald trump's friends at fox news. >> mark, the president needs to tell people in the capitol to go home. this is hurting all of us. he is he stroig his legacy, laura ingram wrote. >> there was certainly a lot of violence that day, but it was not a terrorist attack, wasn't 9/11, wasn't the worst thing that ever happened to america, it wasn't an insurrection. >> please, get him on tv. destroying everything you have accomplished, brian kilmeade texted. >> donald trump was not saying go take the capitol, go protest the capitol. he didn't say go take the bike racks and throw them. >> can he make a statement and ask people to leave the capitol, sean hannity urged. >> trump support remembers getting blamed for what happened at the capitol. the vast majority of people who protested did so peacefully. >> the hypocrisy, number one, everything they did violated journalism ethics reaching out to mark meadows, but number two they are not journalists. just the hypocrisy to pretend it didn't happen. on that day it was urgent, on that day the president has to do something and save his legacy and then by that night on tv, not a big deal and to this dole not a big deal. it just tells you again why it's so critical to get to the full truth that have day. >> the hypocrisy and also the creation of this false reality that they are spreading to their millions of viewers who don't believe that this was a violent action perpetrated by pro-trump supporters, and that's why it's so dangerous but you do see even republican lawmakers as time passes from that horrific day at the capitol downplay or negate what happened to their own work promenade des anglais. we do remember kevin mccarthy was critical in the immediate reaction of the insurrection and not so much anymore. you see that dissipate willing and you see the polling with republican voters that feel people should be prosecuted so we need this information out there for historical purposes, for accuracy, but also for just accountability as well which seems to be diminishing by the day. >> and because they failed that derrick the effort now to roll back voting rights and infiltrate election officials, they failed that day so they are work now to find ways we need to do that again. the levers we tried to do that day. mark meadows saying not surprising. >> obviously it's disappointing but not surprising, and let's be clear about this, sean. this is not about me holding me in contempt. it's not even about make the capitol safar. we see that by some of the selective leaks that are going on right now. this is about donald trump. think tried to weaponized text messages selectively leaked to put out a narrative that quite frankly the president didn't act, and can i tell you this is -- the president did act. >> that spin. politely that's spin. but if they selectively put out messages and they cherry picked then mr. meadows demand a public hearing and bring it all, right, right? to what extent were members of congress involved in pre-planning and potentially in the insurrection itself, and we don't know what that particular witness turned over, but it's something that -- that i think the country really needs an answer to so these people can be held accountable. whether that's also in the meadows' texts we don't know, but potentially this could be huge. >> look, it's also worth a reminder here that there was one text that was released yesterday that did have mark meadows exchanging a text with an unnamed rally organizer as well who at the time was saying, hey, this is getting out of hand, right? things are getting a little bit out of control here, so, look, i don't mean to make the connection to the individual we just played. we tonight know which organizer that, is but we do know there was some communication and the question is to what extent, right? hand how far did it go from january 5th to january 6th we have to remind folks, you know, there were events going on that day. some of those folks stayed on, but what they are going to try to find out that connective tissue between communication between the rally organizers on the 5th and the violence that we saw happen on january 6th as well. >> from a legal standpoint again help us. you have a private citizen, rally organizers who says he has texts. you have to see it to believe it but says he has texts with people close to the president, members of congress, turning them over. if he's got both sides of those exchanges, do the other people have any protection? should we look at that as quote, unquote encouraging and better news than having delta on top because it leads to less hospitalizations and death, or what does that mean? >> well, i think it could be a silver lining but at the same time i want to caution people that we really don't know what omicron is going to do in our country. i think in south africa they had 70% of people had previously been infected. they have a much younger population so it may be younger people don't get as sick but we have to see what happens in our country. we have an older population and have many people with co-moeshd conditions such as obesity so as a friend said to meet other day i want to see omicron go through a nursing home and see what happens and if people in nursing homes get infected but not sick that will be a different story and we'll all be happy but i'm still worried if you have a lot of people infected even at 28% risk of severe disease you'll still have a lot of people going to the hospitals and that's what we need to avoid. >> just looking at the cases right now across the country, anybody watching, the darker colors mean a higher rate of cases. sadly, this is now covid winter just a week ahead of us. dr. del rio, the northern part, colder parts of the state. am i going to be standing here a year from now and will there be a new covid vaccine and like a flu shot every year where it gets rejiggered depending on what the variant of the day is? this has been on the table now for month, months, the big picture and then the house passed the plan. it's been back and forth. if he wanted a deal he could hand the president or chuck schumer a piece of paper saying this is ail can vote for, take it or leave it and instead we keep doing it. >> right. he's a man who is clearly not in a hurry to get this done which is such a contrast to the rest of the party. obviously there's no forcing mechanism to get build back better back by the end of the year, no government shutdown and no debt default and senator manchin understanding the leverage that he has is playing to a litany of things to show he's not yet ready to get on board and may not be by the end of the month and as every day goes by it seems less unlikely that this gets done by the end of the year. >> let's listen, let listen. depending on which day you ask senator manchin what's the problem you might get a different answer. >> i've seen the text but i haven't seen the final -- the final bill. you asked me about inflation is real. it's not transitory. it's alarming. it's going up, not down. geopolitical fallout, we've talked about that. i'm concerned with close to 100,000 troops on the russian-ukraine border and also with the continuous flyovers from china taunting taiwan. i'm concerned about paying down debt, too, so whatever we raise i want to make sure there's money going towards paying down debt. >> i get inflation. i get the debt, sure, but how would providing home care or more child care or taking some steps to protect the climate impact 100,000 troops on the russian-ukraine border? >> well, he told me it's not a factor for him, but in talking to a lot of folks who are dealing directly with joe manchin, they recognize the difficult political position he could be in if he moves ahead with this vote. remember, this is, of course, a state that donald trump won by 39 points. this is a state that has trended in the republican direction dramatically and also remember what happened in 2018. he was the lone democrat to vote for breatt kavanaugh and appoin him to the supreme court. he's watching build back better and alex mooney of west virginia says if manchin does something conservative, like opposing build back better. if he supports it he's going to get backlash and it's not also that easy because if he's the decisive vote to tank this bill, his own core supporters will revolt as well which is why all of this could play big, not just for the democratic agenda but also for joe manchin his own hopes. he told me i'm considering running again. he said i'm not ruling it out and he said do your voters want this bill? >> reporter: john, you mentioned the more than 100 still missing. that means there's still a very you are swrent search and rescue situation of operations going on all over the area in mayfield and the surrounding areas hit by this. the series of tornadoes hit the state. governor andy beshear talked a while ago about the one piece of good news that we've gotten in the last several hours. that's when the one in the candle factory outside of mayfield lost eight lives, they now know that everyone has been accounted for, eight people have been listed as missing and the governor did update along with emergency officials earlier saying they have now accounted for everyone. here's what he said a short time ago. >> we certainly hope that a miracle, our prayers were answered and that it's just eight that are ultimately lost there. if you saw it in person, you would believe that's a miracle. >> and our team actually did see that person yesterday, john. that factory was completely leveled. if there was anyone in there then, we wouldn't have believed that anyone would have been pulled out alive. the good us?
