decision to no longer cooperate with the january 6th committee. the panel released explosive new details in a public meeting last night, including frantic text messages sent to meadows from members of former president trump's inner circle as violence unfolded at the capitol. >> and it is important to know these texts paint a starkly different picture from the public message trump allies have pushed since january 6th in which they have downplayed, glossed over the riots. the tests show unnamed lawmakers, fox news personalities and even donald trump jr. panicked, desperate, pleading with meadows to get trump to tell his supporters to stand down. here's committee vice chairwoman liz cheney. take a listen. >> multiple fox news hosts knew the president needed to act immed immediately. quote, mark, the president needs to tell people in the capitol to go home. this is hurting all of us. he is destroying his legacy, laura ingraham wrote. one of the president's sons texted mr. meadows, quote, he's got to condemn this asap. the capitol police tweet is not enough, donald trump jr. texted. meadows responded, quote, i'm pushing it hard, i agree. these nonprivileged texts are further evidence of president trump's supreme dereliction of duty during those 187 minutes. >> cnn law enforcement correspondent whitney wild joining us now with more. there was a lot in those moments last night, plenty of reaction since. what else did we learn? >> we learned a lot more about what lawmakers were saying to meadows about really the -- basically the whole day. a lot of these text messages surround this idea there were, you know, lawmakers who were interested as we know in overturning the election and by having in one moment, by having former vice president mike pence basically say that, you know, all of these disputed electoral votes wouldn't count, that was one suggestion that meadows fielded and large ly the theme from the former president's son, donald jr. tork the, to the med personalities shows a single thing, meadow was at the nucleus of the white house as this riot unfolded and he was really one of the key players, possibly the only person that this trump inner circle and wider circle believed actually had the ability to sway the president and try to get him to condemn the violence. he was -- he had the ear of the former president, which is why the committee feels so interested in speaking with him. here is a little bit more from the very revelatory hearing last night. >> members of congress, the press, and others wrote to mark meadows as the attack was under way. one text mr. meadows received said, quote, we are under siege here at the capitol. another, quote, they have breached the capitol. and a third, mark, protesters are literally storming the capitol, breaking windows on doors, rushing in. is trump going to say something? >> again, further proof that meadows had the ear of the president and was one of the few people who could compel him to act. it is extraordinary testimony. the next step now is for this to go to the house floor. that could happen as soon as today and then after this very likely passes it will go to the department of justice where it will be up to attorney general merrick garland to decide how to handle this case. >> meadows is at the center and also reveals what the president -- former president did and didn't do that day in terms of trying to stop this. whitney wild, thanks so much. mark meadows, he appeared on sean hannity's show after the january 6th committee's vote. said the leaks of information from the panel were evidence this is all an effort to go after the former president. listen to what he said. >> this is about donald trump and about actually going after him once again, continuing to go after donald trump. there never has been an intent on my part. i tried to share nonprivileged information, but truly the executive privilege that donald trump has claimed is his to wave, not mine to wave, not congress' to wave and that's why we filed the lawsuit. >> joining us now to discuss, laura jarrett, attorney and former federal prosecutor, jennifer rogers. meadows making the case there, you know, i tried to share, i did my thing, but privilege, it is not mine to wave, not congress' to wave, that's why we had to file that lawsuit, a lawsuit that was filed, we were told at the time, was also filed in part because there was this subpoena for phone records. you know, jennifer rogers, does that hold up? this whole claim of the privilege wasn't mine to give up, he was cooperating in the beginning, he handed over thousands of documents. >> he did, and i now think he probably believes that was a strategic mistake. a lot of this has all been about delay, delay, delay. but mark meadows is not steve bannon, right? he doesn't want to blow this whole thing up. he's more of an establishment guy. so he's got to walk the line between staying in the good graces of donald trump, obviously he's hitched his star to that wagon, but also he doesn't want to be referred from criminal contempt. he doesn't want to be charged with criminal contempt. so this dance that he's been doing about giving over some things, trying to hold back other things, that's worked for a while, and now it is really -- it is really the time. is he going to be referred for criminal contempt, he tried to file this lawsuit as i think a last ditch effort to avoid that. but the committee is about to vote. and we'll see if he tries his real last card in his hand, which is going in and invoking the fifth amendment, which i think would stop the criminal contempt, but raises a host of other issues. >> laura jarrett, folks at home might wonder why mark meadows is happy to go on fox news to talk about events that day. but not speak to the committee. it is a point that the committee itself made in their report. mr. meadows has shown his willingness to talk about issues related to the select committee's investigation across a variety of media platforms and anywhere it seems except to the select committee. so how does the executive privilege argument even hold, right, if he's willing to go out there and give his view of things on television stations. >> he knows he has a friendly audience there. he knows won't be asked about the text messages as he wasn't asked about the text messages last night despite hannity having been one of the people who sent him those text messages. the problem for meadows as jennifer so aptly pointed out here, you do not get to use executive privilege as both a sword and a shield. and in other words, he doesn't get to selectively pick out the text messages, give them over to the committee and then not show up and answer their questions. he can show up and say i decline to answer that on the basis of my fifth amendment, i decline to answer that question on the basis of executive privilege. he has to actually show up and hasn't and he thumbed his nose at the committee, he hasn't done any of that. that's why this is being referred for prosecution to the justice department. >> you know, liz cheney raised the question of -- i'm looking at my notes here about whether there was obstruction here. she was saying, she said i'll quote here, did the president through action or inaction corruptly seek to obstruct or impede congress' proceedings, saying that meadows' testimony is necessary because they need to understand that, to inform their judgment. none of these words, right, are chosen without very careful consideration. is that, you think, going to have the effect that the committee would like? >> well, it is interesting, erica, because, you know, she is really referring to words that are part of a statute. and just yesterday a judge ruled in the case of two insurrectionists that they could be charged with corruptly interfering with an official proceedings. and so everyone thought that means that ultimately if they get the proof that former president trump could be charged with corruptly interfering with an official proceeding, even if he himself didn't know about or anticipate or cause the violence. so it is really -- it is definitely a deliberate choice of words and, yes, congress needs to look into all of this. there is a legislative purpose here. but there is also a potential law enforcement purpose here. is doj going to pursue a criminal case that might get up to president trump and this ruling from the judge yesterday saying that it was good in the case of two insurrectionists may mean they have a stronger basis to do so. >> beyond family members, fox news hosts, communicating with white house in the midst of january 6th, you had lawmakers doing so, this also coming out of the report. one of the text messages read, mark, as in mark meadows, protesters are storming the capitol, breaking down windows and doors, rushing in, is trump going to say something? another one texted we're all helpless. here what committee members had to say about lawmakers and these texts yesterday. have a listen. >> does the committee intend to subpoena the lawmakers and compel them to testify publicly? do you think americans deserve to know who those individuals are? >> let me just say that we are going to follow the facts wherever they lead. and ultimately the american people will learn everything that we find out. >> where does that go from here? will we learn who the lawmakers are? >> sure. i'm sure we'll learn by the end of the day. some of this has only come out through the great reporting of our teams and others who have sort of filled in the missing gaps here of what we know. but right now we have a very damning portrait, but a one way portrait. we have all these lawmakers with desperate pleas trying to get mark meadows to get his boss to do something, if anything, but we also see sort of this disturbing picture, one of the text messages from an unnamed lawmaker, unnamed right now, apologizing to mark meadows the day after this violent coup saying sorry we weren't able to flip the election in your favor. that's the talk of conspiracy. that's one of the more troubling text messages that we'll have to figure out what was the context of that, who sent it, what did mark meadows know before he even received that. you would think there was some predicate conversation there. >> here is that text message, by the way, laura, you refer to, the lawmaker said yesterday was a terrible day, we tried everything we could in our objections to the six states. i'm sorry nothing worked. to laura's point, whether legally it is a conspiracy it speaks to coordination there. >> yeah. it certainly does. while those are unnamed lawmakers at this point, one would think those lawmakers know who they are, wondering how they're feeling about the texts this morning. great to have you both here this morning. thank you. >> thank you, guys. one thing sean hannity did not address, a number of things, one thing he didn't address when interviewing mark meadows last night were his own text messages to the former white house chief of staff asking for former president trump to call off the rioters. so what role did fox play in all of this? newly revealed text messages to former white house chief of staff mark meadows in the very midst of the violence of the capitol insurrection. among them, brian kill meade saying please get him, trump on tv, destroying everything you accomplished. >> this one from sean hannity, can he make a statement, ask people to leave the capitol? joining us now, john avlon and brian stelter. just to remind people, these are the panicked text messages that were apparently happening in private. just reminder er of what was happening publicly and what the statements were on fox. take a look. >> the uniforms that you saw in some of these crowd shots, have you ever seen them wearing it as chris said those knee pads and the -- all the pads on their elbows? i just -- i've been to a lot of these rallies. you both have covered them. i have never seen that before. ever. >> everyone knew going in today this crowd was going to be massive. they knew there were hundreds of thousands of people that came to town. we also knew that there is always bad actors that will infiltrate large crowds. >> brian, look, i know you've been following this for a long time, you wrote about it in some respects in your book. but these messages, they reveal two things, not only what is happening in private, behind the scenes, but they also revealed just how chummy, right, these hosts were with the former president and his administration. >> right. and not just trying to communicate to the president through the tv, we knew they did that for four years, but also behind the scenes in private. and yet they're texting meadows, they're not getting replies, they're not getting what they're calling for. president -- donald trump is sitting watching tv enjoying the sights. even sean hannity and laura ingraham couldn't stop him from letting the riot go on. so in some ways it shows the power of fox and the feebleness of these stars at the same time and bit end of the day, they're also pushing falsified narratives, they're pushing riot denialism within the same day. this is deeply revealing and deeply damning for fox news. now, it is important to know their viewers are not hearing about it. this is not being covered on fox, it is not being acknowledged by hannity or ingraham. i haven't heard back from fox's pr people when we asked for comment about this. this is embarrassing and yet they're going to try to pretent none of this has been revealed. >> to erica's point, about chumminess here, it is remarkable. laura ingraham's text this is hurting all of us. in effect putting fox in the same bucket with the white house. he is destroying his legacy. britain kilmeade, destroying everything you have accomplished. it is like they're on the same team, right? john avlon, have we had that kind of relationship between an administration so directly with very prominent members of a network? it is almost indistinguishable. >> not even a little bit. and i think this goes well beyond chumminess. this is fox news functioning as basically as an adjunct of the trump administration. when laura ingraham, this text, this is bad for all of us, she's not talking about all of us as in the american people, our country, our democracy. she is talking about it is bad for us, in the trump water carriers and right wing talk tv. it is bad for us on team trump. that's how deep -- they have been used to functioning as advisers to the administration, which itself is unprecedented. but she is saying that trump's refusal to denounce this will hurt all of us. and then hours later, as brian says, they default to lies. hours later they start whitewashing and pedaling a fiction, lying to their viewers this was some kind of false flag operation, when in real time they knew the truth. this was being done by trump supporters and only trump could stop it in their eyes. >> and there is plenty of lying by omission. there has been a full on omission since this first came out last night. what we don't know were those unnamed lawmakers, we don't know who they are brian. i'm curious your thoughts on once those names come out, because they will, do you think that will prompt any coverage? >> that's interesting. is this going to become a situation where everybody -- every man for himself, every woman for themselves where they all -- i would be surprised by that. there has been such a strong denialism streak for the past year. it started the night of january 6th. it continued ever since. it has become more intense in the past couple of months this attempt to deny the reality of the riot, the hearings are not covered on right wing tv, they don't have reporters at the courthouse the way cnn does keeping track of the prosecution. they don't have reporters keeping track like abc and the new york times. they're pretending like it didn't happen. can this committee shake the fox base out of those fictions? is that possible? is the country too far split and the fox base will never hear the truth? i think we might be at the point where it is the latter. >> yeah. listen, remember, no one, john avlon, went to trump's departure, right? no one wanted to show up there, right? now folks are flocking to mar-a-lago. they need his endorsement. is the fact, the sad fact that for a portion of this country, the january 6th has been rewritten already? soviet style? >> fox has been engaged in the soviet-style rewriting of january 6th from almost the evening of the attack, despite their anchors knowing better as we have seen. it metastasized even further with the false flag narrative documentaries which prompted some anchors who still retain a shred of journalistic integrity to leave the network. this is denial as a business strategy. but in the jump ball for our democracy, what we are talking about, the fact that the republican party has rallied around this disgraced ex-president, as more and more information comes out clearly showing that there was an attempted coup, quarterbacked by the white house, on his watch, by his wishes, is sign of incredible sickness in that political party. and anyone who goes along with it is absolutely complicit at this point. and there will only be -- there has to be legal accountability for it to breakthrough this. this is not a narrative war at this point. there has to be legal accountability to really change the trajectory. >> and that we haven't seen. at least for the ring leaders, right? - san francisco can have criminal justice reform and public safety. but district attorney chesa boudin is failing on both. - the safety of san francisco is dependent upon chesa being recalled as soon as possible. - i didn't support the newsom recall but this is different. - chesa takes a very radical perspective and approach to criminal justice reform, which is having a negative impact on communities of color. - i never in a million years thought that my son, let alone any six-year-old, would be gunned down in the streets of san francisco and not get any justice. - chesa's failure has resulted in increase in crime against asian americans. - the da's office is in complete turmoil at this point. - for chesa boudin to intervene in so many cases is both bad management and dangerous for the city of san francisco. - we are for criminal justice reform. chesa's not it. recall chesa boudin now. this morning, there is new data on the effectiveness of vaccines specifically against the omicron variant. a new study from south africa suggests that two doses of the pfizer vaccine are only about 33% effective against the variant. remember, the same vaccine that was more than 90% effective against the original covid strain which vaccines were released, we should note exactly one year ago today. on the positive side, that same study found vaccinated people who are infected with omicron are about one-third less likely to end up in the hospital when compared to the original strain of the virus. joining me now to discuss this and many issues, dr. anthony fauci, director of the national institute of allergy and infectious diseases. good to have you back on the program. >> thank you, jim. good to be with you. >> so, first, last week you were on cnn and you said that the nih lab was expecting to have results early next week, that is this week on vaccine efficacy against omicron. is there new data and what does it show? >> well, you know, we're going to be talking about it tomorrow. but it is mostly confirms what you have been hearing that have come from south africa as well as the uk. the data you showed up on the screen, jim, is correct. what happens is that if you get two doses of a pfizer or a moderna, the protection against infection itself is dramatically down. however, what is the somewhat encouraging news is that the protection against hospitalization and severe disease, although it goes down to around 70% from around 93%, when you get boosted, it brings it back up to the level of pretty good protection, which is a very strong argument for people getting their boosters. so omicron is going to be a challenge because it spreads very rapidly and the vaccines that we use, the regular two-dose mrna, don't do very well against infection itself. but particularly if you get the boost, it is pretty good. >> should we then be looking at this really as a three-shot vaccine when it comes to pfizer? that that boost is not just an advantage, but might be a requirement? >> well, again, there is a difference there, jim. it is a sensitive issue because of the legal issues about what is going to be a requirement that is now under litigation. the situation is there is no doubt we can say that optimal protection when you deal with an mrna is with three doses. there is no doubt about that. both for the durability of the protection and as well as the protection against the omicron variant. so there is little doubt about that among those of us who work in this field. >> we are seeing, though, an organization like the nfl basically move forward to now require that third shot. the thing is many companies, private companies as well as federal government agencies, they look to the federal government. should the federal government be leading on this in terms of requiring boosters? >> well, again, there is a difference, it is a subtle difference, jim, between requirement and optimal. i can tell any organization that asks me what is the optimal to protect ourselfs? be it your athletes or be it the people in -- there is no doubt that the optimal protection is going to be with three doses of an mrna. >> understood. okay. let's move on to another treatment, which is showing progress and promise and that is covid pill. this morning, pfizer released updated results for its covid-19 pill. it shows cut the risk of hospitalization or death by 89% when given to high risk adults, though, within a few days of the first symptoms. i don't want to suggest this is a substitute for vaccines, you've been clear about that, folks should get vaccinated. but for the folks who are not getting vaccinated. about a quarter of the country at this point. for those people is this pill potentially a life saver? >> well, the pill is potentially a life saver for everyone, jim, vaccinated and unvaccinated people. even vaccinated people who are in a higher risk group, the elderly, those with underlying conditions, can have serious disease leading to hospitalization. the good news about this morning, i was on the phone with the chief -- the scientific officer of the company, just literally a couple of hours ago, the good news about that is that the preliminary data showed about an 89% protection from hospitalization or death have given within the first three days of symptoms. now that the complete full final data center is in is just as good if not better. that's really good news. it is holding off under larger numbers of people. they're going to be submitting that to the fda and hopefully we'll get action on that soon. >> it is has been a year to the day since vaccines first came out. but it is also well more than a year into this pandemic. and we were looking at the death toll and the first nine months of the pandemic from february -- from the first death on february 29th, 2020, to nine months later, 269,000 deaths, a little bit more. in the last nine months, very close to that, 255,000. and those are nine months in which the vaccine, highly effective vaccine has been available and free and distributed around the country. why hasn't it gotten any better in terms of the overall death toll and does it surprise you? >> well, it doesn't because there are two things that are converging here, jim. one is we're dealing with delta. we didn't have delta a year ago. we're dealing with a much more formidable virus in every respect. super imposed upon that, if we had optimally implemented a vaccine program, those numbers would have been down. those are -- many of them, not all of them, many of them are unnecessary deaths because we have up to 60 million people in this country who are eligible to be vaccinated who have not gotten vaccinated. we have got to be doing better than that if we want to get this thing over with. >> dr. paul offit, on the fda adviser committee, he was on the show last week. and he made a point which is -- he's not alone in this there is a possibility that omicron takes over delta in this country, more transmissible, but causing less severe illness. and i know it is early in this, so we don't want to get ahead of where the data is. but is that a possible outcome here, that omicron becomes dominant, but there is an advantage in that it is less dangerous? >> reporter: well, jim and erica, they need shelter, they need food and in a lot of cases they're getting it. there are complications there. i'll show you what we're looking at here. we talk about the recovery effort, you'll get a multidimensional view of the salvaging and clearance efforts down broadway street here in mayfield. our photojournalist rafael rodriguez will train his camera past the shovels clearing debris there and you have other shovels, forklifts, cranes down the street. you see the operations as they're trying to clear away as much of the rubble as they can. but you also get a sense from this view of just how tough that is going to be and how long it is going to take. it is going it take weeks if not months to clear all this stuff out. we talked about active search and rescue operations. you still got more than 100 people missing throughout this region from this tornado. so in some cases like in scenes you see behind me, not here, but in other places, they have to do stuff like this just to try to get to people who might be trapped under some of the rubble. so it really is very, very dangerous, right now we can update you, 74 people dead, just in kentucky, the age -- the range of age of victims ranges from 2 months to 86 years old. still got more than 100 people missing as we said. and, again, scenes like this gives you an idea of how tough it is a road ahead for them to clear rubble, try to get to people, try to get people to shelters, things like that. it is really just beginning here. >> yeah, tough and long, just beginning as you say. brian, appreciate it. just about 130 miles to the east in bowling green, officials say at least 13 people are unaccounted for. the coroner's office has confirmed the deaths of at least 15 people. >> so many communities affected here. cnn correspondent nick valencia is touring the damage in bowling green. nick, heard a lot about mayfield. tell us about what you're seeing there. >> reporter: grief and despair, jim, as these residents slowly begin to come back to their homes and reflect on what they have been through. this was an ef-3 tornado that ripped through here and days later you're still hearing this eerie sound of fire alarms going off in the homes, what is left of them anyway. this subdivision, block after block, lined with debris of those homes that were wiped away. i was speaking to the police here in bowling green this morning and they say of the 15 people who were killed by this tornado, most of them came from right here in this subdivision. that includes seven small children. the woman who lives here, la tonya webb said she was convinced she was going to die. look at what's left of her home. she was inside as the roof was being ripped away. she said she still doesn't know how she made it out alive. >> i watched some people die that didn't make it. and my question is why? why? i keep saying why? the aftermath, after the tornado was worse. it was so many people crying for help. and i could hear people praying. and i could hear people saying, lord, help us. and i come out without a scratch. >> reporter: she said she was crying tears of joy while talking to us because she has her life still and she knows so many others don't. there is a lot of survivors' guilt here in this community, just because they know looking around how bad it was. there are still 13 people missing here. and today that's going to be the focus for police to go through and clear out this debris, make sure there is no signs of life left behind. jim, erica? >> well, that's the key question here. hope springs eternal from democratic leaders who are optimistic they can push this through before the christmas holiday. senator joe manchin a key roadblock in these discussions. he spoke with the president yesterday over the phone. they had a productive conversation, that was a readout from manchin's office and the white house. yet there's still no promise that senator manchin is making that he will support this bill. instead he has deep concerns that he made clear yesterday that fall under the categories of inflation. that inflation report last week startled him. he said it was a problem for him. he also has concerns about moving too quickly. so whether or not that categorizes moving before christmas as too quickly, we don't know. senator joe manchin is someone that all of his democratic colleagues are watching very closely. you know, it's always a delicate balance. they can't pressure him too much, they have to let him stay at the table with the president. right now all hopes are in the president to try to get him to yes. jim and erica? >> they will be appearing in person, which is different than the other ppeared yesterday in a virtual hearing where prosecutors say they handed over 500 documents to his attorney. we expect the same today from prosecutors in this case to talk about the evidence and discovery that they handed over to they can begin the next steps in this case. we're waiting to see if they face any additional charges. they set off a chain of events after they didn't appear for their arraignment, they weren't able to be arrested when they fled and police had to set off and search for them, there was a manhunt and they were eventually found. we'll wait to see if there are additional charges in that case. interestingly enough, now they have no say in their son's defense. the court yesterday appointed a guardian to represent their son. they have seemingly abandoned him. have had no contact with him. have not seen him or spoken to him. obviously what lies ahead for their case, it's going to be a difficult one for prosecutors after they charge them with four counts of involuntary manslaughter arguing that they gave him the gun as a gift, but also saying that they did nothing to prevent him from unleashing this shooting, this attack. prosecutors saying they knew things were going on and they should have done stuff, that's why they charged them and we'll see them later in court this afternoon. >> four children are dead. sh shimon, thank you very much. very good tuesday morning to you. i'm jim sciutto. >> i'm erica hill. the fate of mark meadows will likely soon be in the hands of the justice department, this following the january 6th committee voting unanimously to recommend that
