this morning, president biden is hosting a virtual leaders summit for democracy. this features meetings with 100 governments. the goal of the white house is to defend against authoritarianism to promote respect for human rights. two countries not invited, china and russia. both are actively trying to undercut the message of the summit. >> moments ago, china issued something of a threat to the united states, australia, canada and the uk for all their diplomatic boycotts of the beijing winter olympics. they said the countries are using the games for political manipulation and, quote, must pay the price. i will tell you, what that tells me is that the message being sent is working. . >> that's right. >> it is being received. >> it's received. and maybe not well, which was the whole point. . >> exactly. >> joining us to discuss the developments on the january 6th investigation, we have cnn legal analyst and former federal prosecutor elliot williams. it says persecutor. >> a little of column a, a little column b. >> former republican presidential candidate joe walsh. thank you for being with us. bright and early here. let's talk about mark meadows. his legal argument is quite frankly perplexing, right, elliott? he has already turned over documents. and here he is now reversing. what is going on with this lawsuit that he has against the committee? >> one, he's trying not to testify. i think that's pretty clear. number two, trying to avoid getting charged with a crime. because if they end up slapping him with contempt proceeding he can go back and say, look, i have been suing to protect my fourth amendment rights. i have valid privilege claims. your honor, i can't be be guilty of a crime here. that's part of what it is, at the risk of saying he's being insincere. it makes little sense because he has turned the documents over. what he has taken away is his ability to provide context around the documents. he can't say, well, there's some nuance in what the phone records say or the male that you have seems to suggest. it is a weird strategy. . >> can i give option number three here, joe. mark meadows provided this already. some of this stuff is very interesting. the committee is really digging in to this. joe, what he is trying to do now is send a message to daddy. >> trump. >> look, i'm fighting this. i didn't give them a whole bunch of stuff that might be a little bit hairy. >> meadows got way over his skis. i think elliott is right on the legal aspect of this. politically, he's trying to get back in good graces with trump. he wrote a book that i thought he thought would be -- would make him look good in front of donald trump. clearly, trump was upset with that. there are people in the inner circle who believe trump is really upset with meadows. so he's trying to apiece trump again. >> let's talk about something former president obama discussed, jerry manne-- gerrymandering. here's what the former president said. >> the plan is to control state legislativers and congressional delegations before a vote is cast. that's not how democracy is supposed to work. our democracy is essential to who we are. it is what makes america exceptional, and it shouldn't be a partisan issue. >> what do you think about his comments? >> i get it. and i appreciate what he's saying. but if i'm a democrat, look, this is a tool that both parties use. both parties kind of need to use this tool unless both parties agree they're not going to use it. i don't see how one party can stand down and say i'm not going to gerrymander. the whole thing needs to reform, but certainly not what the republicans will do. >> i think coming out against jegerrymandering is like saying water is wet. california, which has this nonpartisan redistricting, if democrats wanted to fight fire with fire, they jerry manned erred the heck out of new york and california. the two biggest where they haven't gone all in. >> i will push back a little bit. they have done it better for a very long time. look in real terms. the swaoepl court made this a lot easier. one, by gutting a portion of the voting rights act which would govern how states change their laws. and two by saying partisan jerry manned erg is something you can get away with. look at north carolina. california is theoretical. this happened in north carolina. they voted for joe biden 48.7% voted for a democratic governor. but now the map of congressional districts is 10 republicans to 4 democrats. you look at that map, and it defies mathematics or logic that 70% to 75% of the seats go to republicans. president obama is right, that is not now the is supposed to work. >> can i just say -- i don't want to give people the impression that i support jerry manne mannedering. they have weapons they can use if they want to. in terms of north carolina being unfair, obviously. people need to understand this isn't going to change. the courts aren't going to radically -- it's not going to become a 7-7 state . it doesn't reflect the percentage of voters. >> it goes to the point, my former political party declared war on democracy. and they're using this jerry manned erg tool. that's one tool. again, i think the democrats need to step up and recognize this unique dangerous moment we're in. >> speaking of your reformer party, you have senator, former senator david perdue in georgia who is trying to unseat governor brian kemp as governor. >> yes. . . >> and he has now bought into the big lie publicly. he has said that he would have not certified the votes in georgia that obviously gave georgia to joe biden. i wonder -- he's had time, joe, to think about this. this is where he's come down. >> he wants to win. he wants to win. and it's about daddy. it's about trump. guys, it's about the base. the base of the republican party has embraced this big lie. perdue knows if he's going to win in georgia, he has to wrap his arms around it every single day. it's sad, pathetic, wrong. that's where they are. >> and kemp's eventualvulnerabl. >> the big lie may have depressed the vote in 2020 but actually doesn't look like it's doing that this time, particularly among republicans. make the case to the american people that there is a toxin taking hold in american politics. actually not that is destroying the system but seeming to win. it has become an increasing litmus test for the party to enter the post-truth world. be honest with the american people and tell them the other side is lying and demagoguing the issue. we're past reality. >> democrats have to outvote them. plain and simple outvote them. >> it's a big problematic circle, which is that, yes, democrats ought to flex more political muscle. but they can't at least with respect to congress if they are losing their seat at a greater rate than republicans are. . >> a vote in the senate last night we saw against the policy of the biden administration, which is that employers have to -- their employees have to be vaccinated or have weekly testing, employers who have more than 100 employees. two democrats joined republicans here. what do you make of this? some places are. you see mask requirements in parts of the united states. you also do see vaccine requirements, be vaccine passport requirements in some places. for example, in new york city and los angeles county and in new orleans you see requirements that you have to have a vaccine to get into restaurants or other kind of similar venues. it's interesting that the uk has taken this big step. we will see if any locations follow suit. brianna, john. . >> hard to imagine a broad approach this way, though. elizabeth, thank you. >> so secret federal documents uncovered by buzzfeed news reveal crucial information about why the first cdc covid test failed in the early days of the pandemic and what it meant for the deadly spread in the united states. science reporter is dan bergano. heck of a story. thank you so much for joining us. in summation, it was a mess. i mean, it was a mess. and you had one lab and other labs that were just overburdened by the scope of the coronavirus challenge. >> that's right. what we got with these documents, which we were quite surprised the government gave to us unredacted and complete, peered into the burden of the labs that suddenly had the whole weight of the world on them. >> specifically, dan, you found there was a lot of blame to go around. it wasn't just this one smaller lab which had a lot of fingers pointed at it for a long time that went set up to handle it and whose standards weren't as strict as they should have been. >> right. so there was government dysfunction there. these labs have been neglected for decades. so they were sort of set up to fail. there was misaimed blame where the lab was given the shaft here. it was you did the wrong thing. and it looks like a bunch of other labs were making mistakes. but the thing was this calamity of this test not working out was magnified by the fact we didn't have a strategy at all. about the one test went bad, we were out of luck. where are all the tests? we were counting on this one. the more thinking about where else do you get a test? is. >> the other interesting thing you find, it's not like other tests that weren't working in other places in the world. >> right. >> so why didn't the u.s. say, hey, look at this. it's working. >> there that's a great question. there was just a lot of overconfidence there. oh, yeah, we had tests before. this one is going to work. and why didn't the leadership at cdc and hhs, and the trump administration say, you know, maybe we should look at these other tests and have them in our back pocket in case this doesn't work out. that's a question that hasn't really been answered. >> dan, what's interesting, you did some great investigative reporting. once you got the documents, hhs tried to claw them back. you're like, oh, that must mean we do have something good here. why should we care now? your customers. a navy s.e.a.l. has died following a tragic training accident. we have now learned it is the commander of s.e.a.l. team 8, brian bougeous. cnn's oren liebermann is joining us from the pentagon. this is so sad for this community and for the u.s. military. this is one of the top leaders among the s.e.a.l.s. >> reporter: absolutely. 43 years old, 20-year veteran of the navy. he basically spent his entire adult life, since graduating from the naval academy, in this community. he was a member of the elite s.e.a.l. team 8. he was on fast rope training when they descend from the helicopter to the ground as quickly as possible. it is unclear exactly what went wrong here. the navy says there is an investigation. initial indications say that during this training there was some kind of accident or incident, and he sustained injuries. he was rushed to the hospital over the weekend where he died yesterday. in a statement, his commander, captain weatherby, said brian was as tough as they come, how long leader and committed husband, father, and friend. this is a i great loss to everyone who knew him. he will be greatly missed. he is survived by a wife and five children. residence in london. at a time when social gatherings indoors were banned in london. boris johnson's then press secretary resigned yesterday after a video showing her joking about the alleged party was leaked to the press. johnson said he was infuriated by the video. he did announce an investigation into whether or not a party was held at his own home address. but the main opposition leader says he's been caught red-handed and could save everyone the headache by simply admitting rules were broken. >> reporter: i'm in athens greece. the prime minister has apologized for being maskless in a nightclub over the weekend after coming in contact with a foreign minister who tested positive for covid-19. she said she should have used her own judgment and self-isolated even though she was officially told it wasn't necessary for her to do so. she had received a message on her mobile phone, which she said was a government phone. this message had recommended that she self-isolate. finland actions. >> reporter: this is john allen in rome. pope francis weighed in on the case of a french archbishop forced to resign after a media expose suggested he carried on an affair with an adult woman. the now former archbishop of paris denied there was anything sexual but conceded the relationship was inappropriate. speaking money, pope francis said that the bishop had been the target of malicious gossip in the press and added that the sins of the flesh are not the most serious. now, speaking privately, vatican officials have insisted this was not pope francis signing off on survived the 2018 marjory stoneman douglas shooting in parkland, florida, is speaking out at michigan's oxford high school. sarah learner writes in the "new york times", it's hard to believe after what happened at my school others haven't learned or taken actions to keep their campuses safer from gun violence. how do warning signs still follow through the cracks? how do these pleas for help go unanswered? how can school officials put the owe us on the parents? and how can parents not take responsibility for what led to their son's actions? there is only so much that teachers can do in acting as a line of defense for their students. sarah, thank you so much for being with us. and i think judging by what you wrote and talking to so many parents and survivors of the shootings, the hope is always that you can improve the future. because you can't change the past. and so tell us what it was like watching this happen all over again in michigan despite what we saw in parkland. >> well, thank you for having me on. i appreciate the opportunity to use my voice to continue this conversation. when i heard what was happening in michigan, i was surprised. but at the same time, i wasn't surprised at all. because clearly things have continued down this path over the last almost four years since the shooting at my school. and one would think that we as a country, that lawmakers, cool boards and districts would have acted to make changes so things like this didn't continue to happen. >> we saw the teachers raise warning flags. how do you think they handled this situation? >> i mean, it's hard for me to say completely because i don't teach in that district. but we are taught, as i said in the piece, if you see something, you need to say something. but when we do, and it seemingly falls on deaf ears, you as the classroom teacher have done your due diligence, and it's on those above you to act upon what you feel is suspicious behavior or disturbing writing or pictures. we have this contact day in and day out, so it's easy to see warning signs in their writing. as an english teacher i get to read things a lot of times they don't share because they don't feel safe doing so. but in their writing, they do. it's important that these warnings signs are taken seriously when teachers report them or something like this will continue to happen. >> sarah, you say it's clear to you that school officials at oxford high didn't take this seriously enough. what was the action that was the failure, in your opinion? >> as an outsider, you know, looking at everything kind of in hindsight, it seems like there were fail kwrrs at ures at seve. but because he hadn't done anything, quote, wrong, he was sent back to class. he was looking at ammunition online. that should have been enough. he had drawings and wrote blood everywhere. the parents were called and didn't want to take their student out of school. that should have been enough. it was all of these things that to us as outsiders, you know, you look at this and you're like, are you kidding me? but it wasn't enough to remove him, check his bag and make sure he wasn't going to do something destructive to his school. >> we have learned it was enough to check his bag. that's what is so horrific about all of this. sarah, thank you so much. we are of course always thinking of your school community as you are
