covid test within one day of entering the country. the tightened regulations came after the discovery of the omicron variant in south africa. >> now, there is some good news. early findings show that while the new variant may be more transmissible, the cases could be less severe. still, the travel ban for nonu.s. citizens from eight south african countries is in effect. the biden administration is considering lifting that controversial ban. >> hopefully we'll be able to lift that ban within a quite reasonable period of time. i mean, we all feel very badly about the hardship that that might have put upon not only south africa but the other african countries and for that reason in realtime, literally on a daily basis, we're reevaluating that policy. >> cnn aviation correspondent pete muntean is at dulles international airport for us. pete, how is this rollout of this new requirements going? >> well, pastors tell us so far so smooth. these new restrictions went in place at 12:01 a.m., about 15 hours ago, and passengers coming into the u.s. now have to get tested one day before their departure. the cdc puts the example like this, your flight's on a monday, you have to get tested anytime on sunday. it's a one-day role, not a 24-hour rule. you have to show proof of the negative coronavirus test to your airline, not just foreign nationals, also u.s. citizens, regardless of your vaccination status, and the cdc said it wanted this, tightening this time line from what was a three-day requirement to a one-day requirement because of the new concerns over the omicron variant. airlines have been pushing back against new travel restrictions saying they're not all that effective when it comes to containing the virus. passengers tell us so far here at dulles, this has not been all that big of a deal. >> i think it's that they've got all of these variants that are coming out and we don't know what they do, and that's why it's spreading because it's had an opportunity to do this, so they're just being careful. >> it doesn't matter to me, honestly, i'm just like, all right, cool, if that's what you need me to do, i'll do it. i'll do what i need to do to travel. >> it's less than testing because people may have contact with covid, and then you reduce the risk. >> another huge change when it comes to the federal transportation-wide mask mandate, was said to expire january 18th, in only a few weeks. now it's been given a two-month extension, the new expiration date march 18th, 2022. that applies on all forms of public transportation, planes, trains, buses, boats, also here in terminals especially when the numbers are so big, about 2 million people passed through security at america's airports just yesterday, victor and alisyn. >> pet pete muntean at dulles. l let's bring in leana wen, pete's at the airport, i've got a question about cruises because we now know there were 17 confirmed cases on a norwegian cruise ship, people who have covid-19 when they left new orleans a week ago, they all tested negative. stopped in belize and brazil, and now back in new orleans. explain how that can happen. >> well, and i should also say that this particular cruise line has one of the strictest requirements because everyone is required to be vaccinated, and they also have to be tested prior to being on the cruise, so you can imagine if this happened with this particular cruise line, what about the others that don't require vaccination as an example. in this case, it's possible that people may have picked up covid sometime during their trip, and then because they're in such close quarters on the cruise line, they are able to transmit to one another. but i am glad that they were able to catch these positive cases prior to docking, and that way, at least those individuals can be isolated and prevented from infecting others. >> basically, dr. wen, what you're saying is if they all tested negative a day before, i don't know if their requirements are three days beforehand getting on this cruise or a day beforehand, but clearly something was a false negative getting on and the infection was either so transitory or was just starting and they didn't realize that they were positive, so i mean, there are holes in this process. >> well, the issue is that the test shows what's going on with you at that one very specific point in time, and so it may not actually have been a false negative. maybe at the time somebody got a test, they actually didn't have covid but in two days time, they picked up covid sometime along their cruise, and now they're testing positive. it's also possible that the test was so early that it didn't pick up. maybe somebody was brewing the virus, but it wasn't enough that it was able to be picked up. there are always going to be these holes, and this is the reason why regular testing, not one set of tests, but ongoing regular testing is so important. >> we were having conversations off camera about this research that 65, small study, that shows that the j&j booster for people who have the mrna, the pfizer vaccine, showed that the slower but more sustained antibody response, and those of us who had pfizer and got the pfizer booster wondered why didn't we know this before we got our shot. at what point do these research, these studies become advice? at what point are we supposed to act on these, dr. wen. >> yeah, it actually may not be too far in the future. this particular study is a really small study, and it hasn't been published yet but at the nih is actually doing mix and match studies. there are already some preliminary data looking at antibody levels but pretty soon we might actually have effectiveness data. for now, what people should know about boosters, if you got the pfizer and moderna, two dose the first time, it doesn't matter which booster you get, j&j is fine, there's no reason to not stick with what you got before. if you got the one dose j&j vaccine as i did, and you are a woman of reproductive age under age of 50, you might consider getting a pfizer or moderna booster instead of a second j&j. >> dr. leana wen, thank you. president biden is confronting two major international issues this week. >> sources tell cnn that u.s. officials are considering a wide set of sanctions on russia, including on members of russia president's vladimir putin's circle. the goal is to deter putin from launching an invasion in ukraine. >> president biden has a video call scheduled with putin tomorrow. the biden administration is also just announcing a diplomatic boycott of the upcoming winter olympics in beijing. no u.s. government officials will attend but u.s. athletes will be able to compete. cnn chief national affairs correspondent jeff zeleny is at the white house for us, david culliver is in shanghai, and frederik pleitgen is in berlin. obviously there are a lot of high stakes issues right now for president biden this week. >> reporter: without question, alisyn, and the conversation tuesday morning here in washington, 10:30 at the white house, u.s. time, that will be the virtual meeting with president biden and russian president vladimir putin. again, it's going to be a frank discussion, talking about economic sanctions. right now we are told that president biden has spent some time today, and will be until the coming hours talking with some european allies, really try to go get on the same page to coordinate economic sanctions that the president will be preparing to speak with vladimir putin tomorrow about this. it's all aimed at the troops e mas massing on the ukraine border. president biden is likely to not accept president biden's call to halt the expansion of nato. of course what he wants from the phone call, but certainly they're saying, look, they're going to try and use diplomatic actions rather than military ones but a high stakes phone call without question, and then separately via the u.s. olympics, of course the diplomatic boycott, the u.s. officials, president, first lady, vice president, or second gentleman, they will not be going. athletes will be competing. it will be significant, and symbolic, not like the 1980 boycott that was very controversial. >> let's take that to david now. how is china responding to this boycott? >> victor, it is mostly symbolic as jeff points out but at the same time it could be incredibly damaging to china. they are not boycotting all together. they support team usa, the athletes will come to the mainland to compete. in doing so, they're going to be here, and potentially have the opportunity to speak on a range of very sensitive issues that have bothered beijing, particularly the human rights issues that have been taking place in xinjiang. calling it genocide, more than a million uyghurs have been detained. we covered family separations, i covered that earlier this year with my team. this is an extremely sensitive issue. one that china says is domestic affairs. keep out of business, this has nothing to do with the u.s., and the u.s. is making a clear point that has something to do with the global community and china's war with that. if you look at 2008, it will be an incredible performance, it goes beyond xinjiang, you have concerns in taiwan, the self-governing democracy, you have covid-19 origins and the mystery surrounding that, and the cover ups that happened early on. there are so many issues that have continued to plague these olympics that china is struggling to move forward and just focus on the sports: it's not going to end up that way, alisyn and victor. >> fred, let's talk about what's going on with russia. president biden has this video call coming up with putin, and what are the possibilities, and, we understand the economic sanctions including putin's own circle. so what does it look like there. >> it could be massive economic sanctions, and i think that's certainly something that the russians understand -- very much understand is in the cards, and it was interesting to hear president biden saying that he's going to make clear to putin that any sort of invasion to ukraine would carry serious consequences with it, and i think the interesting thing about it is the russians have come out and essentially said exactly what they want, right. they have come out and said, yes, they have been amassing their troops near the border area, and they say they want no more nato expansion but specifically, they have said that they don't ever want ukraine to become a member of nato. that is certainly something that they call a red line, too. the biden administration has said all of this talk of red lining is something they don't think is helpful. the nato secretary general has come out and said that the russians will not dictate the terms as to who becomes a nato member, and who doesn't, this is up the aspiring nation which in this case would be ukraine, and then nato itself, and you know, quite frankly, i was also in ukraine recently, and they said the russians do try to invade, there would be very fierce resistance from the ukrainians, 2014, when the russians annexed crimea, and they say they are ready for a fight. president zelensky of ukraine says he believes his forces would be ready but essentially what the russians are saying is that they believe that the ukrainians have recently been belligerent. they say they want assurances that there's not going to be nato expansion, and ukraine will not become a member of nato. the ukrainians say none of that is thu. they have not been belligerent, and point to build ups of russians near the border of ukraine and of course something that's very dangerous as well. alisyn. >> i'll take it. a lot on the line, frederik pleitgen in berlin. david culliver in shanghai. why school officials did not search an allege gunman's backpack or locker at that school in michigan. we'll have the latest on the shooting, and talk live with the lawyer who represented the victim's families of the parkland school shooting. attorney general merrick garland filed a lawsuit against texas over redistricting saying it violates voter rights. we have that ahead. it's the season of smiling. and at aspen dental, we make it easy to gift yourself the smile you deserve. new patients, start today with a full exam and x-rays, with no obligation. if you don't have insurance, it's free. plus everyone saves 20% on their treatment plan with flexible payment solutions for every budget. we're here making smiles shine bright so you can start the new year feelin' alright. call 1-800-aspendental or book today at aspendental.com ♪ ♪ ♪ (sha bop sha bop) ♪ ♪ are the stars out tonight? at morgan stanley, a global collective of thought leaders offers investors a broader view. ♪ we see companies protecting the bottom line by putting people first. we see a bright future, still hungry for the ingenuity of those ready for the next challenge. today, we are translating decades of experience into strategies for the road ahead. we are morgan stanley. we have some breaking news in from the justice department. it is now suing texas over its newly drawn legislative map. >> attorney general merrick garland just filed a lawsuit alleging the texas redistricting plan violates the voting rights act. cnn justice correspondent evan perez joins us now from the justice department, evan, what's the basis of this lawsuit. >> the basis is that the legislative maps, the maps for both house and the legislative elections violates section 2 of the voting rights act. the attorney general says that based on the population growth in the last ten years in texas, the new maps do not reflect what should be the increased voting power of latino residents in texas. take a listen to what he said at the press conference just a little while ago. >> complaint filed today alleges that texas has violated section 2 by creating redistricting plans that deny or abridge the rights of latino and black voters to vote on account of their race, color or membership in a language minority group. >> and according to the lawsuit, texas added about 4 million people in the last ten years according to the census. 95% of that population growth came from latino voters or latinos in texas. texas got two congressional districts as a result of that, and both of those districts were drawn with majority white voters, according to the justice department and that's the reason why this is now the second lawsuit that has been brought against texas for voting rights issues. alisyn and victor. >> evan perez, thank you for the breaking news. republican on republican show down is shaping up in georgia. former gop senator david perdue just announcing today that he is running for governor. >> unfortunately today we are divided and brian kemp and brad are to blame. i like brian. this isn't personal. it's simple. he has failed all of us and cannot win in november. let me be very clear, over my dead body will we ever give stacey abrams control of our elections again. >> okay. donald trump has been encouraging perdue to challenge -- i didn't expect him to invoke his dead body, sitting governor brian kemp, and this not only sets up a primary battle royal between perdue, and kemp but sets the stage for what will be a nationally watched race against the likely democratic contender, stacey abrams, let's bring in patricia murphy, what a time to be a political reporter in georgia. >> you're welcome. >> thank you, what a time to be alive. >> yes, indeed. let's start here with the latest development, the statement from former president trump where he says good things about david perdue. does not go as far as endorsing him because there are other trumpy candidates in the primary. why do you think he stopped short? >> you know, we done know why donald trump does the things he d does but we certainly do look for signals about donald trump about anything he's doing that affects politics in georgia because he is such a gigantic force in republican politics in state even though he's not here. we are expecting an endorsement from donald trump. there is another trump republican in the primary rates, but he's not nearly as strong as david perdue, and donald trump made it very well known, including to david perdue that he wanted a stronger candidate in this race than vernon jones, a former state representative, a former democrat, by the way, so david perdue got in the race at the request and suggestion of donald trump, and we expect him to have that support, and that is going to be crucial in this race going forward. >> so do you have a sense of how republicans in georgia are feeling? do they still like brian kemp? do they believe, as donald trump is trying to shirk responsibility for his role in losing the senate seats there, do they hold brian kemp responsible? do they like david perdue? >> i think you're going to get different answers from different republicans. republican voters here are very much aligned with donald trump. the energy in the republican bates is with donald trump, and so as a result, you have a majority of republican voters here who don't believe that the last election was fair and square. they're looking for somebody to blame. and many of them do blame brian kemp for that instead of donald trump or david perdue who were both on the ballot. so the energy is with that argument, and the race, and so we're going to have to see where those voters end up for republicans in power, elected republicans, they do not want to have this conversation. they don't want to pick between the sitting governor and president trump. that is a really difficult position for them to be in. but it's where they find themselves today. >> steve bannon has weighed in for what that's worth. he says that david perdue is or should be the last person who is challenging brian kemp for governor. he says there's no difference between the two: bannon called perdue a classic country club type republican. perdue won his primary in 2014 against jack kingston by fewer than two points. i think it's like 1.8%. so perdue clearly has some people to convince in the republican party. >> well, i think all the convincing he needs is going to be from donald trump. the primary that he ran in the first time, he had never been elected in the state of georgia. he had lived out of the state for a long time, even though he grew up here and was born here, so i think it would be a really different primary this time around. he did not get a strong challenger when he was running for senate because he was perceived as being really strong among the republican base, and so the challenge that he ran into of course was in the general election, and then he could easily have that exact same problem if he were to get through a primary. with brian kemp, he would still have the same problem he had in 2020 with the general electorate, here in georgia, which is changing very quickly, becoming much more diverse, a lot of younger voters have registered since last time he was on the ballot, even ten months ago. it's a race that has no center of gravity right now. it feels up in the air, and we're going to have to see some polling, talk to voters, and see where they're going to end up on that. and that leads us to the stacey abrams factor. i this year was surprised to hear david perdue say over my dead body. i mean, what's that language? i feel like we're bracing for something to get very ugly. >> i think it will immediately get very ugly. i wasn't surprised to hear him say that at all, actually, because republicans want to be running against stacey abrams, while she is beloved by democrats in the state, she's a polarizing figure in republicans. republicans find her to be a unifying force. if they had one thing to unify, it would be to run against stacy abrams, but they're not in the fight because we have this primary battle happening. we're going to hear all of the republicans, anyone running for lieutenant governor, state senator, sheriff, everyone's going to be running against stacey abrams on the republican side but she's just as galvanizing on the democratic side, and she has registered literally 1.3 million voters since the last time she was up on the ballot. her group fair fight action, the new georgia project, all of these groups have done an enormous registration based on the model she put in place, along with a lot of black activists in the state. it's a very different electorate, a different race, and a totally different dynamic than the last time stacey abrams, and brian kemp faced each other. >> what a time to be alive. patricia murphy. thank you very much. >> thank you. the late senator bob dole will lie in state at the capitol rot rotunda this thursday. dole died sunday at the age of 98. he announced in february that he was being treated for advanced lung cancer. >> flags at the white house are at half staff today, and we're expect to go learn more about funeral plans, and we will bring those to you as soon as we get them. >> well, firstly, thank you very much for inviting me. and secondly, to answer your question, they could have and i submit should have done a mheck of a lot more than they did. firstly, while police officers on the street have a requirement to meet probable cause to search someone without a warrant, school officials have a much lower standard. they only require a reasonable suspicion. but plainly that existed here, so the first thing i would submit that they should have done is search the child's person and the child's background. next, i think a full and proper threat assessment was incumbent on them to perform, and that type of threat assessment requires more than just your typical guidance counselor personnel that you have embedded in the schools. we're talking people that have expertise in psychological and psychiatric assessments, whether that's within the school system or contracted for entity, third party. but those are the basics. checking social media, you know, we're talking -- 2021, this is more than two decades since the tragedy at columbine. the presumption shouldn't be that, oh, gee, this can't happen in our school. it should be quite the contrary. the presumption should be we need to make sure with as much certainty as humanly possible that it isn't going to happen in our school. >> yeah. >> and that means keeping the other children in the student body safe, the administrators and the teachers in that school safe. and there's no way to do that without doing those specific requirements to which i just alluded. >> david, you, as we said, represented the families of the parkland victims. broward county reached a $25 million settlement with 52 victims of that shooting. the parents of those students who were not killed, were not injured, who were in the building that day, and we've seen the videos of them, kind of bury themselves in rooms and climbing out of windows, the breadth of a civil case that they have against the county, against the school district, against this district? >> are we talking michigan, victor? >> yes, michigan. >> well, michigan, from my research into the matter is a far different animal than florida, and not for the good, frankly, for these victims. specifically michigan has a more comprehen comprehensive sovereign and governmental immunity law. and that law prohibits the bringing of a claim or lawsuit against the entity, like in this instance, the school or school district. there's, from my read, complete immunity there. the only option that is available for the victims of this horrific tragedy that i'll digress to note is becoming all together all too common place in america, you know, where injured and killed students outpace the injured and killed soldiers abroad, but i know that's a topic for another day, but the victims here have, from my read, only the option to bring a claim against the individual school actors like the guidance counselors, and only if they can prove that those actors acted with gross negligence and not simply simple negligence. >> david, i think your point actually does bear repeating. you're saying that more school children are killed in america every year than our military personnel overseas? >> that's my understanding from reading the data, yes. >> i mean, that is just such an indictment, obviously, of something that is going horribly, horribly wrong. what i hear you saying is the school is immune, basically the soo school and their choices, they could have legally searched his backpack, even though it's his possession, the school could have searched his backpack. >> could have and should have with a mere reasonable suspicion, which was manifested, and i would defer to michigan counsel on these issues of civil practice, and the like, i'm pretty confident that i am correct that that is the case in civil law regarding the immunity that the school and the district have and the mineral opening that would be existing for civil practitioners to sue only those guidance counselors, and of course i hasten to add that the parents themselves are subject to liability. there is a clear standard in the law that you have to secure loaded firearms in a location that they're not accessible to children, especially minors, so that they don't use them inappropriately and like was obviously done here. >> right. that's a low bar just asking the parents to do just that, which according to prosecutors these parents didn't. david bril, thank you. >> my pleasure, and again, thank you and my sincerist condolences to affected by that tragedy. i get tired of saying it, but it doesn't make it any less true. >> us too. thank you, david. meanwhile, former empire actor jussie smollett takes the stand to defense himself in his criminal trial for allegedly lying to police that he was the victim of a hate crime. we'll tell you what he said next. football, is a game of inches. but it's also a game, of information. because the nfl is connected. and at any moment, the fate of the season can come down to this. billions of secure connections, per second. when the game is on the line and the game is always on the line touchdown! the nfl relies on cisco. superpowers from a spider bite? -i'm so good! ♪ this is what healthier looks like. ♪ former "empire" actor, jussie smollett is on the stand right now testifying in his own defense. smollett is charged with six counts of disorderly conduct for allegedly falsely reporting to police that he was the victim of a racist and anti-gay hate crime in chicago in january of 2019. last week two brothers told the jury that smollett paid them to carry out the attack. this was his attempt to get media attention. >> cnn's omar jimenez is in chicago for us. how is jussie smollett explaining all of this? >> reporter: well, victor, and alisyn, a lot of the testimony today has centered on jussie smollett's relationship with these brothers. bola, or bond as jussie smollett called him was someone he said was a friend, but ola was someone he said he couldn't trust, someone that creeped him out, someone that they didn't speak to each other when they went out at times, and so that was how he framed the relationship with bola, basically someone he knew through proxy. the testimony also got into details about drugs that jussie smollett said bola , along witha sexual relationship began to forge. specifically, the reason that's important is because one of the defense theories is that homophobia from the brother ola, they say was part of a motivating factor in what they say was a real attack. they forged further into that part of testimony to the point where smollett testified when all three of them were out at one point, bola and smollett felt they had to sneak away from the actual encounter. so this testimony is ongoing right now. but this is expected to be the last full day of proceedings with the judge saying he's 100% certain it will be in the jury's hands by tomorrow. victor, alisyn. >> thank you. well, the justice department is officially closing its investigation into the murder of 14-year-old emmett till for a second time. >> we'll explain why, next. so i got visible. get unlimited data for as low as $25 a month. no family needed.
