reckless conspiracy theorist. roger stone and alex jones the late toast receive subpoenas related to the insurrection, and the prosecution rests just moments ago in the ahmaud arbery murder trial. the jury right now has that case, and america waits for an important verdict. we begin though with president biden and a new effort by the white house to lower your pain at the gas pump. the president later today will announce he's releasing 50 million barrels of oil from the nation's strategic stockpile and at the ask of the biden white house a handful of other big economic powers is to tap their reserves in order to bring down gas prices to thanksgiving, christmas and into ain r an election year. the average price for a gallon of gasoline is $3.57, a seven year high. >> president biden is trying to show first and foremost that he is acutely aware of these inflation concerns of americans so he's going to order the department of energy to release, as you said, 50 million barrels of oil from the nation's stockpile. interestingly though also five other nations to do the same, china, great britain, india, japan and south korea, so certainly taking a big global step here to try and make a difference with the global oil prices of the president's top economic adviser explained it like this earlier this morning. >> this is joe biden doing precisely what he said he would do, using every tool at his disposal to help the american consumer get through this period where production isn't quite up to demand. >> so using every tool at his disposal, a political tool certainly, but it's an open question how much this will actually lower gas prices but certainly going into the holiday season and into nicks year's mid-term elections this is a top concern here at the white house. we'll heart president address this this afternoon. no coincidence that this comes just two days before thanksgiving. again, the white house trying to make the case that they are on this inflation worry. john? >> jeff zeleny live from the white house. appreciate you kicking us off. this is being described by the president as the biggest u.s. action ever to try to ease energy costs. let's bring in our cnn global economics analyst. the president wants to show the american people he's trying to do something. explain the significance here. what will the impact be? >> well, you know, the impact is a bit of a band-aid. it will have some impact at the pump, but it's really more a political move. you know, biden is trying to reassure american consumers, hey, before the big holiday travel season, we've got your back. we're going to do whatever we can to lower these oil prices. it's going to be good politics for him at home. it also makes him look good that he was able to build an international coalition around it, but i've got to say, john, i think that we're going to see higher prices for some time because there is a fundamental mismatch between what opec wants and what oil-consuming countries like the u.s. want. we need lower prize now. certainly before the holidays, you know, lower income families spend 20% of their incomes on gas, but opec wants to keep prices high, particularly because it knows we're going into a clean energy transition, and so they want to keep fossile fuels as high as they can for as long as they can. >> you said potentially a band-aid is a description. the president when it comes to whether it's gas prize or other inflationary pressures on the economy doesn't have a lot of direct tools at his disposal, does he? >> well, that's right. oftentimes the president takes the blame and gets the credit for a lot going on in the global economy that he can't really control. oil is a global market. it's set by opec and set by countries like russia which have been hoarding recently. the president is doing everything he can. he's even looking at whether there might be monopoly issues in the u.s. market. he has the ftc chair looking into that. i think he's doing what he can politically. will it make a difference at the pump? >> maybe a small one. if the white house, if they get credit for a small one they would take credit for that. let's brick in studio to share their reporting and insights, lauren fox, olivia knox and tia mitchell of "the american journal and constitution." here's what the president is dealing with, number one, the personal pain that americans are feeling and it's unfair to the president but gas was a lot lower one year ago because of the pandemic. there was no -- demand was way down so the price was way down. the demand is up so compared to last thanksgiving, you look at that and you say, wow, again, not quite fair but politics is not fair to the presidents sometimes but olivier more broadly, biden's handling of inflation. 67% disapprove, 33% approve. two-thirds of the american people think the president is not doing new. again, there's only so much a president can do, but showing you're trying matters. >> sure. it's about emotion as much as movement as one of my mentors used to say. showing that he's trying to do something about something americans feel. we talk about the price of gas at the pump and it's obviously very important because it's something that tens of millions, hundreds of millions experience. don't overlook winter heating oil costs though. the energy crisis that we're facing is much broader than the punchlgs and i wonder, you know, releasing this a few days before thanksgiving, a big driving holiday. that's probably not going to have an impact on the price at pump, but going to the next several months there's a chance that it will have impact on other areas of high energy demand. >> look, again, the movement thing is important. you are trying to do something. this is the mood of the country. saw what people think of inflation and what do americans think about the economy? in the middle of the summer 45% thinking the economy is good. now that number has dropped down to 30% thinking the economy is good right now. the president is fighting psychology as much as he's fighting, you know, the math that go through when they go to the grocery store or go to the gas station. >> and i think it also shows the disconnect between regular people at home, and i think if you ask a lot of american businesses, the economy is great. they are making good profits. they are seeing demand coming back, and so that's the disconnect because these businesses want higher prices because it's helping them to recover some of their losses from the pandemic, but that's affecting people at home as they are shopping for thanksgiving dinner and things like that and that's the push and pull so it's hard for the president to do anything because he can try to help people at home but the business community won't like that. >> those are the numbers you remember when you're standing there filling up your tank and you're just watching not a dial anymore but you're watching the numbers go by, and when you're standing in the grocery line and you're watching the numbers go up and up and up and it's hard for the president to make the case and it's dangerous for the president to sound optimistic when people are feeling a punch and look at the numbers, 5.6 million jobs created since joe biden became president, 4.6% unemployment and disposable income is up 2%. there are positive economic indicators out there, but it's very hard for the president or his party to say hey you're fine when people are feeling pain. >> that's the delicate balance of going out and selling something like the infrastructure bill or going out and selling the big safety net bill because you might be able to argue about all the projects coming into your community but people might think to themselves what about my family and the fact when i go to the store milk costs more than did two weeks ago? let's get away to a place where we can finally be free. ♪i've got to break free♪ (vo) plan your getaway with norwegian. sail safe, feel free. >> jury deliberations began 20 minutes ago, 11:53 a.m. in the trial of three men charged with murdering aorbury. 11 members are white and one is black. the 25-year-old unarmed black man was killed back in february 2020. prosecutors say he was jogging, and, yes, he did trespass briefly at a construction site but left without taking or disturbing anything. the defendants argue they had the right to pursue a citizen's arrest and that the shooting was a justified use of force. let's get straight to cnn's ryan young outside the courthouse in brunswick, georgia. now a very important deliberation is under way. >> yeah, absolutely. when you think about all the emotions in this case and how it wraps this entire community. we've been here for over two weeks watching it play out and every time you think the pain has gone down it rises to the top when you think about this. in the end the way the prosecution ended was two phases. both of them ahmaud arbery, one while he was alive and one while he was dad and to watch the people's faces inside that court they were shocked by that second image. it really stood with a lot of people. can you only imagine the pain the family is experiencing by looking at that photo. since that moment in court the people have left court. the defense attorneys and the prosecution in this, and on the way out the defense said they believe their clients are innocent and they believe and trust in the jury, but the parents of ahmaud arbery stepped out of court, and this is what they had to say. >> i do think that we will come back with a guilty verdict. we will get justice for ahmaud. >> thanking god that god showed us all the evidence to convict these men. >> reporter: john, when you think about not only the makeup of this jury, the fact that only one person of color is on that jury, there's a lot of people asking questions about all the references to race. even suddenly in this case, something that stood out yesterday was the talk about ahmaud easy to nails that struck a chord with a lot of people now that the jury is in deliberations. a lot of people in this community and country are watching. john. >> grateful that you're there for us to keep track of it as it plays out. let's discuss this with two former federal prosecutors, jennifer rogers and elliott williams. the prosecutor gets the last rebuttal and this morning she tried to get to the point. these defendants said they had a right it a citizen's arrest and she said no, they do not because she said they had no right or no reason to get in their case and chase after ahmaud arbery. >> how do you analyze this case? >> well, was it a citizen's arrest? you decide, but if they were not conducting a lawful citizen's arrest you do not have to consider -- you still may if you want to, but you don't real very to consider self-defense because if it's not a lawful citizen's arrest then they were the first aggressors and they were committing felonies against mr. arbery and, therefore, they don't get to claim citizen's arrest. this is not a citizen's arrest, state eats argument. >> a key point in the sense that if the jury agrees they had no right to do this, then that also means you're done because if you're not properly conducting a citizen's arrest then they have no right to use force. >> that's right, john. it's really the whole ball game. if the jury decides and there's very strong evidence that this is the case, that they had no right to be going up to him at all, no right to stop him or question him. no right to use their trucks to stop his movement. then, you know, they don't have the right to do any of that which means that when they get into the scuffle with him they don't have the right of zeh defense to shoot him. this was a key issue and the prosecutor did a good job of not only marshalling the effort. she's been workman-like the entire time but upping the ante with respect to the emotion and arguing the jury now that they should do the right thing, that it is the right thing to find the defendants guilty, not only because of the facts and the law, but you convey this through your tone and your demeanor during closings that it's the right thing to do for them individually as jurors, and that's an important thing for the prosecutor to do, so i was happy to see her do that today. >> elliott. it's chess, i don't want to oversimplify a gay and as the prosecutor listens to the defense closing arguments and made her rebuttal this morning. did she make an effective rebuttal? >> she did. the judge gave her quite a gift by stopping the trial last night, letting the jurors go home and have dinner. she could have let the prosecutor go through and finished that night and what show would have given the prosecutor a tired jury, and now they have fresh folks who have come back from breakfast hearing the last thing of the prosecutor's argument. you never know what a jury is going to do. i've had my heartbroken by juries before, but it was effective arguing. >> but if you go back to yesterday to one of the defense lawyers and her summation, this is a racist dog whist. i don't know of any other term for it, but then it makes you ask, you know, why? why would an accomplished attorney, people in the area say she's a good attorney, why would she bring race in like this? >> turning ahmaud arbery into a victim after the choices that he made does not reflect the reality of what brought ahmaud arbery to satilla shores in his khaki shorts, with no socks to cover his long dirty toenails. >> jennifer rogers to you first, that's a line from the autopsy report, when they conduct the autopsy, ahmaud arbery had dirty toenails. ahmaud arbery was wearing running shoes when he was arrested. that context missing there and a whole lot more. is it anything but, help me out, as an accomplished attorney, is that anything but trying to play some racial factor in the jury? >> well, it's very risk is what it is, john, because you really risk alienating the jury here. first of all, saying that he's not a victim here. are you kidding me in the man is dead? he was gunned down. of course he's the victim here. the other lawyers i thought did a better job of saying, listen, there was a tragedy that happened. our clients are not guilty but it really is a tragic event this. woman just really went over the. i think it was a poor mistake strategically. >> elliott, do you agree with that in that if you listen to a lot of commentary there were a lot of trial attorneysration the question, do they have some research on the jury? did they scrub the social media of one or two. you only need one juror who refuses to go guilty. >> john, you started this with a rhetorical question of why would she even make that question in the first place. why would they strike almost all the black jurors because it works and you can get a legal argument for saying that it's lawful. what they did was get rid of most of the black jurors and then provide a basis for saying that -- that they had a reason for getting rid of them, so it is -- it's an ugly argument, but they can get away with it within the bounds of law. the other thing about the toenails thing that's sort of lost in this is that none of the defendants would have sewn the feet so it's an entirely irrelevant point. it's a point from the autopsy, nog not something that they would seen. yes, it's a dog whistle and really a shameful point. >> grateful for your help. we will come back to you as we walk through the deliberations. brand new subpoenas in the january 6th investigation, including two of donald trump's biggest and loudest defenders. where things stand in the investigation. that's next. what's strong with me? >> yeah. our panel is back with us. elliott williams, i'll going to you first as an attorney. investigations involve criminals or bad actors and criminals and bad actors lie, and alex jones is just a renowned conspiracy theorist and liar. roger stone goes back to the richard nixon days, liar, but they are important to the investigation because they are involved with the organizers, involved with people coming, so how do you launch an investigation when you know the person across the table is going to refuse to cooperate or what they probably tell you is a lie? >> this is the big challenge because you can make people do a lot of things but you can't make them talk. you can make them pay money, lock them up in jail and can't make them testify if they have a strong will. that's just a fact. i would assume that the committee has information around all of them to support the things that they are saying, but at the end of the day you may not get their testimony so we'll see what happens. fortunately these individuals don't have any kind of personal privilege or executive privilege to protect them and it's just a question of, you know, are they going to go after them with criminal contempt citations or whatever else. >> let's take, for example, roger stone. longtime trump ally. a lot of involvement back in the mueller report days. this is a pretty common refrain from people close to trump. i have nothing to hide, did nothing wrong but i still won't cooperate. >> i'm not worried about it because i know nothing whatsoever about it. i was not on the ellipse. i did not march to the cap to. i was not at the capitol. i know nothing whatsoever. on the other hand, as one who was framed for lying to congress i would probably assert my fifth amendment right and decline to be interviewed. >> in the trump silo i'm a victim. that's the constant refrain. i'm a victim. they are after me. >> yeah, and i think it's interesting because what they are not saying, you know. the siena is about their involvement in the stop the steal rally prior to the insurrection, and what he's saying is well i didn't march to the capitol and i didn't know anything about what happened at the capitol but that's not what you're asked to talk about and what the january 6th committee is trying to determine is how connected were the two? you know, we know that it started at that the rally and then it turned into something else. connecting the dots, it looks like that's what they are trying to get and that's what the trump allies don't want to talk about. >> and to that very porn point, who was involved works paid for it, what did you know about who was coming? well, alex jones himself made clear he knows a lot. >> we went and paid for it, thank god a donor came in that paid for like 80% because it cost close to half a million dollars for all the equipment and stages and the rest of us. the white house told me three days before we're going to have you lead the march, the secret service before trump finishes, 30 minutes before so we'll lead you to a point, take you out of the front row and lead you to the place where they want you to start the march and trump will tell people go and i'm going to meet you at the capitol. >> well, if -- if that's the truth, which is always an if when it comes to alex jones, but if that's the truth, that's pretty valuable piece of the narrative about how involved was the trump white house, what was the then president's plans? who else was involved? where did this money come from and so on. >> well, you can understand why the committee is really torn. maybe this witness may not be honest, but maybe they have very valuable information. it might be a fight to get that person to testify. you may never get that person to testify or if they come in they may plead the fifth but you can understand exactly why the committee is going after him. i think the other question is how broad is this investigation going to become? the number of subpoenas coming out of this investigation i think is really tremendous, the number of witnesses they have talked to, roughly around 200 at this point. this investigation is massive, and it does kind of have a deadline if democrats don't win the house in the mid-term elections so a lot of work to do, how much time they want to give to legal battles with alex jones is another question. >> you make a key point. you'll run into people especially on the trump side of the equation who say this was ten months ago. just give it up, let it go. new video, department of justice department video, olivier, showing part of what's happening, security gate at the capitol. you see the police behind it and people on the other side trying to get past, whenever i see the misuse of the american flag it drives me nuts. people throwing chairs. you're building facts with a lot of people who, a, don't want to cooperate and, b, with others who have shall we say interesting reputations. >> one of the things you hear from democrats in congress, staff and elected is they want to be able to do this again, that former trump has not backed off the rhetoric that he used for months after the election claiming there would be fraud if he lost and then, of course, ramping that up a lot more afterwards. the de "ms." i've talked to on hill saying no, no, no, we have to do this not only because we're looking at january 6 and because we want to discredit this entirely and the only way to do that is lock down who were the intellectual authors of this insurrection and if we mete out some kind of punishment in court or the court of public opinion. at a plea hearing for one of the defendants adam johnson, photographed carrying speaker nancy pelosi's lectern. al gore had a better case to argue than mr. trump, but he was a man about what happened to him. he accepted it and walked away. hard to argue from that from an esteemed federal jung in washington. yes, new infections are climbing, but, no, we didn't have vaccines last year. up next for us, how to enjoy the holiday and your family safely. ♪ your mother loved this park. ♪ she did. ♪ with xfinity home, you can keep your home and everything in it more protected. i can wrangle all my deliveries. thanks, hoss! and i help walk the dog from wherever. *door unlocks* ♪ ♪ well, i can bust curfew-breakers in an instant. well, you all have xfinity home, with cameras to home security monitored by the pros. *laughs* learn more about home security or get our self-monitored solution starting at just $10 per month. yes, we have the tools this pandemic thanksgiving to do some things that are were just not safe last year, but there are also some new warning signs to consider in your holiday planning. let me show you just a couple of those. number one, the map of covid transmission. red means that your community is high transmix and you see much of the country, especially the northern half of the country, still has very high transmission of the covid pandemic. less so down in the south where the temperatures are warmer and out in california as well and a little smattering up here, but a lot of country, especially the northeast has high transmission in every county and the case count frustratingly going back up. 95,000 new covid infections yesterday. a month ago it was 72,000. seven-day average is up 31% from one month ago. to share your insights and expertise is dr. leana wen. you wrote an excellent column in "the washington post" how to safely get through thanksgiving. when you see the high transmission in many communities and the case count sadly going back up again, walk through what you think are the most important things for families to think about. >> well, first and most importantly, john, i think it's time for us to urge caution once again because we do see the rates climb, and we were hoping to see a decoupling between infection rates and hospitalization, but actually we're seeing a rise in hospitalizations and still a very high death rate as well and so it's important to have caution. the first and most important thing when we're getting together is to make sure that everybody around us is vaccinated. we know that those who are unvaccinated are six times more likely to be infected with covid compared to those who are vaccinated. also having a booster dose further protects you as well. then the second thing is ask what are the medical conditions of most of the people in your household, if everybody is vaccinated and healthy it's safe to remove the mask but if they are immunocompromised, be outdoor, open all the windows or get a rapid test the day of for everyone. that helps to ensure that everyone stays health from covid and safe from covid this thanksgiving. >> i want to walk through some of the other numbers as you go through. get a booster. i've had mine. you've had yours. 36 million americans have had booster shots and 170 million americans are eligible. as you watch the rate of this play out. do you see any questions, is it those people just waiting their turn or do you see any hesitancy or people are saying i got two, i don't need three? >> i think there's been a lot of confused messaging around boosters to the point that a lot of people, including patients that i see, they are not even thinking about boosters as in they have heard about this debate. they are now thinking, well, i'm pretty well protected with two doses. do i really need this third dose, is it just something that's nice to have? the rnc -- i mean, the republican governors association says it will support republican incumbents. trump is at war with all inform those republicans. 7 of the 16 republican governors face challenges from trump-endorsed or inspired candidates including the governor of georgia who donald trump thinks they should help him cheat. this is what is said when it comes to republicans and the sglat sglats. we've got 36 other races over the year. we intend to protect our incumbents and keep red states red. we think our incumbents across the country deserve re-election. >> follow the language. the words donnell j. trump were not use there had at all but they are trying to say please leave us alone. let us run our races the way we think they should be run. >> i write for the newspaper in georgia, and it's not just that president trump is not supporting governor kemp, but if he continues to undermine the integrity of the election it could depress republican turnout, and in a swing state like georgia that doesn't bode well for governor kemp against whoever becomes the democratic nominee, potentially stacey abrams, so i think what the republican governors are saying it's not just we don't want competition, but trump can really hurt hour chances to win in close states. >> especially every day, every day he puts out a statement that repeats the big lie and a whole bunch other things but the foundation of trump is still the big lie about 2020. it's fascinating to watch different -- different republicans with ambition how they respond to the trump factor. some are willing to get in his face. others are more careful about it. let's start with one willing to get in his face. larry hogan is the republican governor of maryland and he cannot run for re-election. he has a favorite and donald trump has a different favorite. i would prefer endorsements from people who didn't lose maryland by 33 points. larry hogan selling donald trump who cares what you say in maryland. >> look at the levels and how they respond. the senate level and gubernatorial level. people are pushing back on donald trump and that is absent basically in house races and it's interesting to see how the dynamics play out in the republican party. if you run in maryland you have to capture a number of democrats and independents and if you're running for a safe house district where trump won by 50 or 60 points you're not going anywhere. you've got to hug him close >> you talk about to win a general election in maryland can you not be a trumpian canned day. maybe you can win a primary. saw the president's candidate in pennsylvania have to drop out of the race and they are looking for a new case there. that's what the republicans are worried about, that the president will get behind people in primaries and the trump voters turn out. >> that's what mitch mcconnell is worried about. >> and here's another example. chris christie was first in line to back donald trump and now has a back in which he says the party has to leave the big lie behind and implicitly leave much of donald trump behind and on fox news he's trying to split the baby, i guess, if that's the right word. >> what you don't like about trump is more personality or backward looking stuff. the policies you liked, correct? >> look, the policies i've support and you know, laura. >> yeah, you did. >> the line of supporting donald trump starts behind me. i was the first elected official in america to endorse him in 2016. prepped him for those debates and prepped name 2020 for the debates, you know, and stood up for him as the chairman of his opioid commission and the chairman of his transition. >> did that work? can that work? i was for him before i was against him. >> and some of these republicans will say i was for him and i was against him a little bit but i could be for him again in 2024. we heard that from secretary raffensperger in georgia so it's really interesting. >> didn't christie on another show?
