good morning to viewers here in the united states and around the world. it is friday, october 8th. and if there is one picture to sum up the state of congress, it is this one. democrat joe manchin head in hands, listening incredulously or maybe dispairingly to democratic leader chuck schumer. it's a scene out of washington's latest flirtation with economic calamity that let's just call mr. mcconnell or how i learn to stop worrying and embrace the debt ceiling. some of senate minority leader mcconnell's own republicans accusing him of caving to congress as he delivered the necessary gop votes to raise the country's borrowing limit. so, did he cave? well, in so much as he decided to other vert total economic disaster, the downgrading of america's ripple effects that would have left us in a recession or worse at least until december anyway, yes, he caved. he did what needed to be done. he got 11 republicans to join democrats. was he met with thanks from his democratic counterpart? not even close. >> leader mcconnell and senate republicans insisted they wanted a solution to the debt ceiling, but said democrats must raise it alone by going through a drawn-out convoluted and risky reconciliation process. that was simply unacceptable to my caucus. and yesterday senate republicans finally realized that their obstruction was not going to work. >> so, in case you missed it, that is joe manchin behind leader schumer shaking his head. he agreed with a number of republicans who thought chuck schumer's speech was mean. >> why was it not appropriate? >> i think basically what we have to do is find a pathway forward to make sure we deweaponize. you can't be playing politics. none of us can on both sides. >> so, on the one hand, no complete economic calamity for a few days or months, hopefully. on the other hand, some hurt feelings. bottom line, they got it done. temporarily. this either shows that getting stuff done is possible temporarily, or that even doing the easy things can't be done without rancor performative or otherwise. let's get the late east coast from cnn capitol hill reporter melanie zanona. melanie, chuck schumer has an approach here. republicans, why was this a thing anyway? but this is why did we even see this? >> this was the absolute bare minimum we should point out. republicans didn't even vote for the debt ceiling hike. they just allowed democrats to proceed to this vote and it's only a short-term deal. we still have to deal with this in december. mitch mcconnell's initial reasoning for refusing to cooperate with democrats, he wanted to showcase divisions in the democratic ranks. what we saw yesterday was dissension in the gop ranks. the anger amongst republicans yesterday was palatable. ted cruz said it was a serious mistakes and republicans blinked. lindsey graham said this was a complete capitulation. of course, former president donald trump launched a new round of attacks on mcconnell overall of this. i don't think it bodes well for the next few months when you have chuck schumer trying to r wrangle his ranks together, mcconnell can't control his conference. we are ahead of a messy deadline. >> it seems like mcconnell wasn't going to highlight divisions over something that was so bad for the country. no way would it have been good for republicans. >> no. i think there was a recognition among republicans, mcconnell especially at the end of the day. no one wanted the government to default on its debts. the other thing that was driving mcconnell was concerns about the filibuster. there was some serious conversations inside the democratic caulkcus about changg the senate rules to get around the filibuster to get to the debt ceiling. mcconnell told lawmakers he wanted to relieve some of that pressure on joe manchin and kirsten sinema. let's not test fate and resoft. he reversed course temporarily this week. >> maybe they would use it for something else, perhaps a giant spending so you have moderates and progressives in the democratic caucus who are still trying to figure out what to do on these major spending bills. and senator manchin, this idea of senator manchin and senator sanders getting together in a room is something that the president addressed in pretty colorful fashion. >> that's right, he said, quote, it would be homicide. this is great reporting from our colleague manu raju. like most good jokes, there was some truth to it. joe manchin and bernie sanders have been openly sniping at each other. they are far apart on key policy details. they could be the key to unlocking all of this or the key to it all falling apart. bernie sanders represents the progressive wing. he has a lot of sway. he was able to get them to come along the $3.5 trillion price tag. joe manchin is a swing vote, they think they could come together on this. so far everyone seems to be talking past each other and not with each other. >> i would like to see them in a room together. i really would. melanie, thank you so much. >> they call that a party. a midnight deadline has passed with four donald trump alums defying the subpoenas. he has told them, don't help. he has indicated he will try to exert executive privilege to prevent investigators from gathering evidence on the investigation. whitney wild and jessica dean. whitney, give us the latest on what's not happening. >> well, it's a holding pattern at the moment. there is this question about what is the committee going to do as they try and move forward and figure out how they will try to hold these people accountable and prove that the subpoena has teeth. as you point out, the former president has indicated that he is going to try to expert executive privilege. and the reason we say try, there is a question how elastic executive privilege is as it extends past a presidency. the current thinking is current president joe biden has the authority to say, yes, this is executive privilege or, no, it's not. however, the former president is indicating he is going to at least try. we know that he had tried this in the past. he had indicated that he may try to exert privilege over the department of justice officials who were testifying in a lit of other committees. in the end, he didn't intervene. that is the theory right now. we have been trying to nail down his legal strategy. at this point, that seems to be the legal strategy. here's the exact quote from the statement we got yesterday. executive privilege will be defended not just on behalf of president trump and his administration but also on behalf of the office of the president of the united states and the future of our nation. at this point, we have no indication that anybody is actually going to comply with the subpoena. however, i think it's important to point out that the october 7th deadline was a document deadline. this will become a much bigger deal once people start playing off depositions. and there is a big question what papers are actually available to pass along on the committee. so all of these questions remain to be seen. >> so much information to get-together here. jessica, you have republicans responding to this damning senate report that outlines trump's effort to overturn the election by trying to rewrite history. tell us what they're saying. >> right. so i talked to a number of senate republicans who sit on the judiciary committee yesterday, checking to see if they read the report. this was an eight-month sweeping report released by democrats on that committee that outlined a number, very long, hundreds of pages long, but top lines that trump asked the doj to overturn the election some nine times. his chief of staff, mark meadows, had gone to a doj lawyer and asked him to investigate fraud claims. things that are outlined in detail in hundreds of pages of this report. so when i asked senate republicans about this report, had they read it, none of them had read it that i spoke to. to be fair, everyone was focused very much on the debt ceiling on the hill yesterday. but none of them had read it. senator cruz and holly told me they wanted to. but no one wanted to comment because they hadn't read it. you've been on the hill. that's what we get told about it if they haven't read about it. senator tillis did participate in one of the hearings. it's worth noting the republicans on the judiciary committee put out their own report on this, which was the exact -- found the exact opposite pretty much. but i'll let you hear chuck grassley. take a listen. he's the ranking member on the senate judiciary committee. take a listen. >> there trump had everybody in the white house to discuss it and unanimously, except for one, they said you shouldn't do what the one lawyer said he thought the president ought to do. the president rejected it. the president did the right thing. how does that create any sort of problem? in fact, if he had made another decision, you would have had a problem. >> so, you know, you listen to that and you hear we're just getting totally different takeaways from this report. again, worth noting the republicans putting out their own report. and we talked to senator tillis about wmaybe they were so different in their takeaways. he said when he was sitting in on one of the hearings people were talking over each other. he thinks those are reflected in the two different reports. >> yes, indeed. thank you for your reporting. >> joining us now washington correspondent for the "new york times", maggie haberman and cnn legal analyst and former person counsel for president trump's first impeachment trial, norm eisen. first, a legal matter, norm. donald trump isn't president i did -- anymore. he can't hear me. there is criminal referral for contempt. maggie, let me ask you how this is asking inside trump world. the former president issued this demand that his four former employees, although steve bannon wasn't working in the white house, not cooperate. how is this being coordinated? . >> so trump's lawyer wrote a letter that was sent to these witnesses saying that to the extent permitted by law, don't cooperate with the subpoena in terms of documents and in terms of testimony and invoke any immunities that you might have. it's a very, very broad statement. the letter argues that the commission itself is making an overly broad inquiry. it is the kind of letter you would see and we did see, frankly, when trump was in the white house. he is now trying to invoke executive privilege, which is really up to the sitting president. and i realize you will address that in a second. but we don't know how that is going to work. in terms of trump's world, they want to treat it as illegitimate. this is a way of doing it. but we are heading into yet another, in the trump era, unprecedented moment of potentially blowing off subpoenas and treating them as if they're not real. we will see what democrats do in response. >> i want to cover both of those now counselor norm eisen. through the miracle of television, he can hear me now. as maggie noted, donald trump isn't president i didmore. and steve bannon wasn't even a government employee at the time in question. >> thank you for having me. hi, maggie. there is some hangover executive privilege effect, john, for an ex-president. the courts have recognized that the current president should, for example, consult the ex president. but the ultimate decision, the courts have said, the big case is nixon versus the general services administration, that these privileges belong to the country. the country only has one president at a time. that's donald trump. that was donald trump. now it's joe biden. joe biden makes these decisions. so this is a borderline, frivolous instruction to these men. and i think the critical thing is don't let donald trump run out the clock. the courts, if this ends up in court, the courts need to move quickly, john. >> well, what about contempt? what about a referral to the justice department, as chairman thompson of the january 6th committee said he will do, if he refers to thot justice department for criminal content charge, what should merrick garland do? >> there are three avenues. one is that trump or these four recipients of the subpoenas who failed to produce documents yesterday, one is that they could go to court. that's unlikely because they will be speeding things up if they do that. that is not under objective. they want to run out the clock. the congress could make a criminal referral to doj. or congress itself could go to court to enforce. one of the differences between civil and criminal, doj goes to court to prosecute if it's criminal. if civil, congress goes to court. there's pluses and minuses to both. congress is undoubtedly wrestling with that. but the imperative is, john, they can't deliberate too long. they need to move quickly so that -- as trump has successfully done in the past, he can't run the clock out. we need to get this information. >> i'm sorry to jump in there. maggie, i want to read two statements because i think they're connected in a certain way. one was from the republicans on the senate judiciary committee. chuck grassley basically saying nothing to see here on the discussions inside the white house where the former president and others in the justice department, clark, were trying to get everyone on board to overthrow the election results, basically. the republicans on the senate judiciary said president trump listened to his advisers, including high level doj counsel and followed their recommendations. chuck grassley said he did the right thing. how does that create a problem. now i want to read something from josh mandel, republican candidate for ohio. great breakfast this morning with another ohioan who took his daughter to the january 6th rally. it's so important for our kids to see democracy up close and exercise their god given rights. it seems to me you have a judiciary minority, committee head saying nothing to see here about what happened behind the scenes about january 6th. and you have now republicans literally celebrating it, telling people it's something you should take your kids to. what's the impact of this? >> the mandel instagram post is something -- the kind of thing i hadn't seen before. i haven't seen -- even a candidate suggesting that going to the rally -- and, yes, there was a rally before people moved up to the capitol, which then became a riot. suggesting that this was a free speech exercise. it was until suddenly it wasn't, and then it was people breaking the law. grassley statement's is not that trump heeded the counsel of his advisers. he tried to find other advisers to do what he wanted to do because exists advisers were telling hypothetical he couldn't do what he wanted to do. did he literally try to go ahead and install certain people which could have triggered all kinds of responses? yes, it's true he didn't do that. that statement is not an accurate representation on of what took place. >> george conway said is if a mob boss was looking for people to carry out a murder but all the hit men told him they wouldn't do the job. so the president took their advice so there's no problem here is the way to report it. norm, what do you make here? is josh mandel says this is something to be celebrated. what does that tell us about where we've come 10 months later and how the country might process this going forward and the risks ahead? >> john, it tells us that we're in a terribly dangerous moment. what we saw the senate minority do on the judiciary committee yet is turn reality upside-down. the majority report determined that trump went to doj to try to get them to participate in his attack on the election nine times. his chief of staff, mark meadows went repeatedly. so to say that there was no interference there is just an alternate reality. and the danger of it, john, and the mandel statement illustrates this, this detachment from reality, this embrace of trump's big lie, and these assaults on our democracy, are creeping further and further into the republican party. and it just is that maga faction within the republican party is breaking with what we have always understood as the bipartisan american commitment to democracy. fortunately, there are solutions. people are fighting it all across the country in various ways. and i think we're going to see another fight over these subpoenas. that is part of the reason it's so important that the house committee enforce their legitimate demand for information. we can't just roll over for this alternative reality. >> yeah. i guess what i'm suggesting is there is a continuum between what grassley and the republicans are saying and josh mandel are saying. you can see where this is headed. to some extent it is already. norm eisen, maggie we'll be figuring that out. that's if all goes according to plan, following pfizer's request for emergency use authorization for the fda for their vaccine. let's break this all down with the president of the american academy of pediatrics. thank you, dr. viers, for being with us. so many parents have so many pressing questions. but the first one is, why is it so important, in your view, for children to get vaccinated? >> thank you for asking that question. this is a common misconcmisconc. it is thankfully children are at least risk but it can be a serious illness. we have seen 22,000 children hospitalized. almost 6 million children infected. and children can have symptoms such as long covid. and also it can be disruptive to their lives. they can be out of school for several weeks at a time when our kids need to be in school as much as possible >> definitely. let's talk timeline. we know this is different for kids of different ages. but if we're talking timeline, when do you think kids 5 to 11 will start to be vaccinated? >> well, so it's the question everybody wants to know, right. we have to make sure we know that the fda is going to be looking at the data. and this is assuming that all goes as we expect and this is assuming that all looks well. i would imagine by early november we should be able to have the vaccine available for children ages 5 to 11 assuming everything looks good with the data and everything moves forward as expected. >> okay. so that -- if we're talking logistics, people are trying to plan holiday travel, right. so for kids that age, maybe it's christmas. maybe it's not thanksgiving. i have a 5-year-old. i also have a 3-year-old. so i'm looking at christmas and saying maybe not christmas. maybe we're in the new year for the 3-year-old. is that right? somewhere around the new year, after the holidays, or kids, what, 2 to 4, would you think? >> in absolutely. and i think you're exactly right. it takes time for everything to kick in. it is a two-dose series. they need to be given three weeks apart. when you're thinking about early to mid-november, that's when the vaccine series can start. and so you do need a little bit of extra time before children have full immunity. yeah, i think what we are hearing from the manufacturers is that they're hoping that the data for the even younger kids will be available perhaps in the late winter, late this year, early next year. but of course this is one of these things. we have to follow the data. we have to take it step by step. but so far everything has been going according to plan. so far things have been going as we expect. so hopefully that will continue to be the case >> if that continues, babies, toddlers in the spring, which would be amazing. then once children are vaccinated, is that essentially the end of the pandemic, in your view? >> well, this i think gives the picture of who is doing it. he is down among democrats, down among republicans, and down among independents. among democrats, down 10. among republicans, down 12. among independent, he is down 19 points. he was in positive territory august 1st at plus 3. he is now minus 16 points net approval rating with independents. it's the folks in the center of the electorate who are driving this. >> they have moved a lot and moved pretty quickly. why are independents important for joe biden. >> they are the reason he won in the 2021 election. this is comparing it to hillary clinton's 2016 margin. joe biden won by 13 points. hillary clinton lost by four. now that he is under water, a very bad sign. >> what are they seeing or not seeing? >> i think this right here, how much has biden accomplished in office so far? in late april, look at this, 51%, fair majority but a majority nonetheless saying he accomplished a great or fair deal. look at late august. down to 40%. the clear majority saying look at this. 58% say he accomplished only some or very little. they don't think joe biden has gotten in office and done very much. . >> vaccinations, a real push for the administration, they got a lot of people vaccinated. with delta, people not feeling as good with that. that may be driving that. another thing they could do to help turn this around? janet yellen spoke with erin burnett ahead of last night's vote. >> good morning, john and brianna. i spoke with treasury secretary janet yellen on a key day for the debt ceiling negotiations. you know what's interesting, we talked about that, as well as biden's massive spending plan, and how to pay for it. take a listen. . >> december 3rd, it's a short time relative to the debt ceiling. so the uncertainty remains longer term. i think it is damaging to confidence of consumers of investors. of course everyone including me breathed a sigh of relief that we were able to reach an agreement that gets us to december 3rd. we were staring at october 18th as a time when we would, you know, run out of extraordinary measures and cash would be running down. it's important that we have met that deadline. >> so ultimately the debt ceiling exists to curb future spending, right? even though obviously raising the debt ceiling enables you to pay bills that come from past spending agreements. >> that's right. you have been categorical that you support eliminating the debt ceiling. do you see any chance that this happens? >> i think it's become increasingly damaging to america to have a debt ceiling. it's led to a series of politically dangerous conflicts that have caused americans and global markets to question whether or not america is serious about paying its bills. it's flirting with a self-inflicted crisis. and it really involves the government giving to their treasury secretary and conflicting sets of instructions. >> both parties see spending on their priorities as just and as revenge against the oppose party's ra transgressions. why does everyone see this as a political thing when it isn't? it is an economic reality. >> well, look, i think you shouldn't assume at all deficits are bad. we have incurred deficits to -- this was true in the trump administration, the c.a.r.e.s. act, the consolidated appropriations act, the rescue plan under biden. this was deficit spending that -- look how wealthy the u.s. economy is doing in recovering from a devastating pandemic. now, president biden wants to do more. he has proposed a build back better plan that has been translated into an infrastructure bill that has cleared the senate and is sitting in the house. a reconciliation process that will attend to proposals to do education, child care, paid leave, environmental investments. and all of that is paid for. that's not deficit spending. that's a package where revenues will be raised that will fully cover the cost of that spending. so, you know, people can have different opinions about the value of the package and whether they support it. i am strongly in support because i think it's what this economy needs to be more productive. >> it was a rare and wide-ranging interview with the treasury secretary. you know, but what's so interesting about this, guys, while congress obviously stopped the u.s. from defaulting this month, it's clear we will be right back here in just a few weeks. and the treasury secretary finds that incredibly frustrating because it takes such a toll on the economy and the confidence the people around the world have in the united states. john and brianna, back to you. >> erin, thank you. yes. very unfortunate deja vu. if the senate struck a deal to divert potential economic disaster at least for a little while, why was senator manchin shaking his head?
