blue. california is the first to mandate vaccines for students and staff. let's go to cnn's paulo sandoval. how soon is this mandate in california can take in effect? >> especially for parents. we can see it kick in as early as fall if all the moving pieces are in place here. when it comes to addressing the approval or the emergency authorization on some of these vaccines and younger americans, 11 and under. we could see this new requirement implemented in phases by this fall when and if that happens. we'll see another development here that we are following is merck's new drug that's being described as a game changer if it's authorized for treatment of covid patients, oral medication, it's not a vaccine. it's antiviral that would be administered for some of these patients to take early or after their diagnoses. this is only a game changer but also extremely promising and should it be approved to treat not only fully vaccinated people but also americans who do not want the get vaccinated. but, still when you hear from another doctor, richard besser made it clear this is no substitute for getting a vac vaccine. >> i am excited of a drug going forward fda for consideration. we do need better treatments and oral therapy. it's not a replacement for vaccinations. prevention is the best way to go. when people get covid, we need to provide them with better treatments. >> you have preventions and treatments. vaccines are critical in terms of prevention. this is a snapshot at where the country is sitting now. these are just americans 18 and up eligible for the vaccine. you can see over three yaquarte at least receiving one shot. these are american adults 18 and above, they hope many of those people that got their first dose to come back and get their second one. all throughout the country we heard from governors that are sharing reports and numbers that show they are monitoring a decrease in dose statistics. very promising here and something to look out for in the come weeks. advisory committee will be meeting in less than two weeks and tackling a host of different questions here. one of them is the pfizer vaccine for children ages 5 through 11 d and then in a coup of weeks, moderna and johnson & johnson boosters. and also mix-and match booster approach. we are talking about some of those who received one vaccine and would perhaps consider another vaccine to boost their protection, these are all big questions that still needs to be answered. it tells us you don't have to be a parent to have an interest of what's hamming among these advisory committee members in the coming weeks. >> certainly a lot of questions on those issues. and no question about it. paulo sandoval, thank you so much for that. joining me now is dr. schachter, a doctor at the division of infectious diseases. dr. schachter, great to see you. the number of people dying in the u.s. and hiv and aids in the u.s., these numbers are staggering. >> there are more deaths due to covid than there were in the same 1918 and 1919 influenza outbreak. i think it's very important that we continue to work hard to try to curtail this outbreak even more. it's very encouraging that cases are plateauing and going down. but, it's not the same in every state. the state of high vaccination rates are doing much better than the states with lower vaccination rates. there are still a lot of room for improvement and as paulo says there are a lot of things in the works that i think will develop within the next month that'll really bolster vaccinations for children and mix and match boosters for adults and also merck which will help us on the prevention side. prevention best. the antibodies that we use now has to be used in injections. here we can have people pick up these pills in their local pharmacies. it's much more widely distributed but they're not effective at their best, they're 50% in preventing the disease. that's an advance. vaccination is even better. >> this is not a replacement for the vaccine, right? i can see some people's eyes lighting up with talk of this pill that's being described as a game changer but it's still better to not get covid to begin with. >> of course. benjamin franklin told us that. prevention is worth a pound of cure. much better to prevent the disease than to have to treat it and remember. treatment is never perfect. they're always limitations. >> big news in california, it will be the first state in the nation to require covid-19 vaccines for students k through 12 to attend schools in person. the mandate will be phased in as the vaccines gain federal approval for these different age groups. do you this i nk other states a going to follow? schools require vaccines to begin with. this is not a revolution concept. >> oh no, the requirement of vaccines have been with us for decades and decades to attend daycare and schools and colleges. if you are in the military, we in healthcare, there are a lot of areas of society where vaccines are required. this, i think however is a very large step forward. a very large state saying yes, all the children in the appropriate age groups must then receive the vaccine. that's a giant step forward and frankly has come sooner than i anticipated. >> dr. shaffner, podcast rogan, i hate to put it out there but i feel that we put it out there to help you fact check it. >> did you get a booster? >> you mentioned that before we started talking and i had not thought about it before. when i watched it on tv, him getting his shot and his mask on. all i can think of is just a performance. the next step of performance art is not giving him al booster but giving him al shot. i think they're going to give him a booster shot. the last thing they would do it is give it to him live on television. what if he dies or blacks out. people have had very bad reactions in the moment for whatever the reasons. >> these gentlemen are suggesting that the white house faked biden's booster. what do you think? >> well, i think it's completely incorrect. there were so much confidence in the vaccine that the president himself showed the country that getting a booster is safe and he voucher for its effectiveness and all of us in science stands behind him. this is an effective and appropriate thing to do for those indicated to get a booster at the present time. of course, this is a matter because moderna and pfizer have their data in the fda and will be soon in order to get their boosters approved. >> what's next? >> don't worry, just be honest. >> i scratched his face. he grabbed my face like this. >> he slapped you in the face or what? >> he grabbed me. i have a cut right here, i can feel it. >> police say the evidence all suggested that gabby was the lead gagreser in this situation. >> reporter: rather than charge gabby, both made clear they did not want. officers decided to separate the two for the night. casey jordan says that was a bad idea. >> they have labeled her the primary aggressor. she's distraught and she can't stop crying and she's 20 feet away smirking. there was more that needed to be sorted out. >> reporter: in utah, domestic violent cases, the primary duty is for the officers to protect the victim and enforce the law. >> in no way shape or form that i can perceive what happens here is a little slap fight of fiance who loves each other and wants to be together. >> reporter: two weeks later, brian returned home without his fiance. a day before laundri returned home, his mother cancelled a camping trip reservation for september 1st for two people and made a new win september 5th including a third person. where he is today remains a mystery. >> jim clemente is joining me now. jim, thank you for being with us. this new body cam video that we were just taking a look at, there is a lot of criticisms that the officers may have missed some textbook signs of ab ab abuse. when you watch it, what does it tell you and can we give these officers a hard time when they deal with these situations all the time? >> i don't think we need to give them a hard time. i think we should use it as a learning opportunity. there were signs here, a lot of signs and of course control. she kind of took on all the blame. he put all blame on her. there are definitely places where is he was caught lying and they didn't pick up on it. the fact that he said she yanked the steering wheel. witnesses say he was in the vehicle and locking her out and trying to get her phone and hitting her. all those things add up to me that this is an abusive relationship but he's the g aggressor and she's being controlled by him which is why she didn't want to call out what he had done to her. >> ishe clearly looked distraugt in the video. brian laundri's mother cancelled a reservation made for two people right before brian returned home without gabby, she then made a new reservation for three people and laundri went with them as to the sister's. how important do you think that camping trip going to be in all of this. it sounds strange. >> it does sound strange to me, jim. >> basically, if you know a young lady who lives with you is missing, not missing down the block or arndsound the corner b missing 2,000 miles away. then you decide to go on a camping trip and not knowing and not telling her parents you don't know where she is, that's really suspicious behavior to me and telling me he had no concerns at all about her. >> and what do you make of the fact that brian laundri bought a new phone right after he returned but left it behind. sounds like he's on the run. >> yeah. >> the fact that he bought a new phone and people get burner phones all the time. a phone that's not necessarily attributed to him. he went to at&t to get this phone so it sounds like this is a phone with a plan. he could have taken the similar card out and plug that sim card in any phone and use that phone where ever the hell he is. that maybe what happened here. the fact that the fbi now have the phone does not mean he did not take it with him or leave it in his car at the preserve where his car is found. it opens more and more questions about their behavior. >> so many theories about where he could be. how do you narrow these down? do you have any answers? >> i do. with the time that elapsed and nobody had seen him in a location that they thought he was in. i think he could have made it to the appalachian trial that's 2200 miles of trails through mountains and ravines and there are caves and valleys where he could hide. people spend months there on the camping trail. that's probably the kind of location where he'll be found. he'll eventually have to come forward to get food or water or he'll just be seen by somebody passing by. >> i would assume by this point he has run across if he's still alive and on the run that he has run across another human being. because of the nature of this case and so many people have talked about it, i would have to think somebody has recognized him. what about this search at the carleton nature reserve in florida. was that just a waste of time? >> well, if it rules out him being there, it was a waste of time. that had to be done. it was the last known place he was reportedly seen and he was traveled to. you have to rule it out. it just happens to be a difficult place to search. there is a lot of perils there. the water and the animals and so we don't know if he was there and his demise. if he used that as a diversion tactic like he did leaving where gabby's body was and hitchhiking away from it. it could very well be that mustang was left there because he went in the opposite direction. >> gabby petito's family attorney made a direct plea. >> for the laundrie's silence, t they did not help us find gabby, they're not going to help us find brian. brian, we ask that he turn himself in. >> why would that be? >> are you ready to meet in the middle. >> in let me first of all say to you and the american people what progressives did and have done is to ensure that the agenda of the president of the united states is carried forward. he reenforced that many times in our meeting yesterday that progressiv progressiv progressives reenforced what he committed to the american people which is bill back better. an opportunity to build the economy of people of all the essential workers and medicaid program or affordable housing. that's what we did. in addition, we provided the vote along with democrats to ensure the debt ceiling and to the extent that we did not get call on our bills. and as well, we continue to see that the government operated to what we call a continued resolution. democrats know how to govern, that's what we'll do going forward. we are always open to discussion. we don't like numbers but we like to know about program. if i might, we have priorities, lowering drug costs and affordable housing. it's such a high degree of homeless. people are priced out of housing. we want to make sure we reenforce fighting the climate crisis which is really coming down on us quickly. and so, we want to make sure when we do discuss numbers, we are not talking about a random cut, we can't do that with programs that deals with drug prices and medicaid program on housing. you can't do that when you think about ensuring the program. >> can you get anywhere near the $1.5 trillion that joe manchin mentioned? >> we have the commitment and reality that this will be paid for. and the numbers are way above 1.5. the $3.5 trillion will be paid for. any numbers under will be paid for because of the way we orchestrated the ability to ensure that there will be no debt to the american people. the real question is, i know everyone wants a number. we want programs. if we get the programs, we'll look at how the numbers fall. we hope our friends in the senate are going to call them friends will be as concern as their constituents in west virginia, arizona, that needs child care and affordable housing and pre-k and that needs lower drug costs and we think if they are, two years of free tuition because americans most of high school graduates outstanding. we know they will do more. democrats can govern and just as the president says, it's a great phrase, six minutes, six days or six weeks, we'll get it done. we'll be looking at numbers and programs and we are not going to get the american people down. president biden won't let them down. >> if you don't mind, y'all have been w been working on it for about six months. kirsten sinema put out a statement that she's disappointed. are you worried of depriving the president of a victory by digging in and demanding this much larger spending bill may include many useful and helpful programs by demanding that would be passed first? why not just give president biden a win with the bipartisan infrastructure bill. get it out of the way. >> again, it's a very good question because the field was when we started with the president and even when it was presented to us. it was a couple and it was a group effort. it was the infrastructure bill that all of us want and also build back america. we don't think we are default on any commitment. we are in fact enhancing the president's ability and commitment. what i would like to say is i have not cob dndemned anyone. i applauded all of those who have been engaged. applaud their work. i applaud their work on the investment. it's solid and there. it's not going anywhere. all we need do is to work with the senate to finalize a bill back better. we'll have a pack to serve all of america. it will do many, many things and we'll be good together. >> congresswoman, there are some in your party who's saying the president should have gotten involved sooner. do you agree with that? i know you may not directly answer that question, let me ask you this way, is it time for president biden to get more involved now? is he going to make repeated trips up on capitol hill. should we see the vice president involved in. >> you know a man that's spent much of his life in the united states senate is a friend and not afraid of either house. i know the president has been in meetings around the clock and i would like to sigh seven days a week. i don't have his calendar. i know he's been engaged in conversations, meetings and one-on-one meetings in the oval office. i think he has not sftopped. let me say what will come about the next couple days. everyone will be digging in, making sure we are listening the each other and we got the program that's going to serve the american people. it does not make sense. shallow out, hallow out the bill back better. not having the ability to help people who we have touted during these difficult covid days. the taxi drivers or the uber drivers or assistance, i think we are on solid ground. i know this looks pretty interesting as it relates to national media. legislative work, when we come out, we'll have a civil rights that's a 1965 voting rights that we have medicaid and medicare, we have the housing and urban development where we focus on housing. now, we have to reenforced all of that with a new era 21st century legislation. as you well know, this can't come out with a half baked loaf of bread. you have to have a whole loaf in order for you to enjoy it. we are not in any way stopping the president, we are providing and facilitating for it. i expect the president will be v involved and every member of his team as they have been. we'll all be involved. all of us are listening and talking about it. i am on a budget committee. that's helping to move forward. our speaker is constantly engaged and telling us we need to be out there, dealing with the budget last week and we brought it out. we are ready. now we must look at a number that we did not expect and not saying that we are not going to continue, we are going to continue but we are doing it on programs. we can't do across the board. we can't see to the number until we look at the program and work with all the perks. i would say this to them, let the senate go and get the program or budget done and let us look at that and go forward. >> all right. >> we'll be ready for the president. >> alreadyl right, we'll be wat all those loaves of bread and sausages making. >> congresswoman lee, thank you. >> good to be with you. it's going to get done. >> we'll watch. we'll be right back. before we talk about tax-smart investing, what's new? >> reporter: this is ground zero, we are in front of the supreme court roight now. you can see officers protecting the building outside and counter protesters. more of capitol hill police who out there and out here to separate these two groups. there was no incidents. about a block over east capitol that's where the women's marchers continue. it's all about abortion rights and reproductive rights and the supreme court rules and all of this following texas law banning abortion after six weeks. >> take a listen. i am dressed up as the late ruth bader ginsburg. i am here for everything women have fought for since 1973 when this law was passed giving us the right to choose. i am curious what has changed during that time frame that make our supreme court justices think we have change d our minds abou that. >> i believe that it stand fos r the fact that justice should be blind and without biassed and it's really biassed in the supreme court, extremely biassed. why i am here today och the things that's going on in texas drove me here today. >> reporter: and the supreme court refused to get involved in that texas law. they'll be involved in a mississippi case. that's what all eyes are on. the supreme court will be back on monday on both sides of the courts. i want to make it clear, their strong positions on this controversial issue. jim. >> they're getting creative to get their point across. that was very interesting stuff. >> suzanne, thank you so much for that report, we appreciate it. did youtube ban on covid misinformation comes too late?
