presentation to the senate this afternoon, what should we expect? >> that's about to happen in a couple hours. they will detail their hand recount shows booids had a larger lead than maricopa canvas, results that trump supporters may not like to hear. and also sewing doubt in this room behind me. you see people lined up prepared to go in. we see a lot of people gathered across the street and in the plaza, signs that say trump won, stop the steal. this is a group that has their heart set on somehow insisting still that trump won, even though the draft report we got last night with a handpicked group to audit ballots shows that's not the case. we also are hearing from the report that they're raising potential issues that could effect tens of thoughts of ballots, with not a lot of substantial report that they had an issue. you have responses from the county elections officials and board of supervisors, including the chairman, jack sellers. he says as we have done before, we will correct errors and misrepresentations about processes they don't understand. i hope they're holding on to the anger the past ten months will see the truth and put their energy into supporting the democratic process instead of trying to tear it down. in the seats that are set up behind me we can see signs on the folding chairs saying they're reserved for the audit workers. they worked with cyber ninjas, group hired by the arizona state senate republican led senate and the cyber ninja ceo has been known to spread misinformation about election conspiracies supporting the big lie, and during the process of five months, wave seen strange things, workers using uv lights on ballots, looking for bamboo fibers and the processes, methods continuing to change. that's one point the maricopa county makes an issue of that makes this audit questionable because of the constantly changing methods, no bipartisan oversight and other issues. >> lot of energy from the crowd behind you. votes than we previously knew. are you surprised by the results? >> how about that, alisyn, crazy thing hand. i was in the downtown streets, bill murray came up and said hey, big news, joe biden won arizona. i said yeah, we knew that, you know, you told me that yesterday and the day before and over and over and over. that's how it works around here. these guys, you know, we have a combination of some grifters at the top, professional grifters, cyber ninjas milking this for money, now going to other states to try to milk it. you have people with devious motives, some republicans that raemz they can't win any other way other than rig the election. so they cast doubt on the electoral process, and that's the excuse why we need to change statutes, have new statutes to suppress the vote in certain areas. then you have dummies that don't know anything and will swallow anything apparently. >> speaking of grifters at the top, why didn't the sham audit say that donald trump won? why didn't they claim they found boxes of ballots in a river or something? >> yeah, i know. i kind of expected something goofy like that, maybe that crazy time carnival, found a couple of boxes of ballots or something over there with the carnies. the problem was first, they were 100% incompetent. let's be clear on that. the reason we know joe biden won is we had the right people counting ballots in the first place, and the second place and third place. people that knew what they were doing, and that were objective. not these cyber ninjas that nobody heard of before, no idea what they're doing. i think ultimately they knew that even they couldn't rig the actual numbers and so they were stuck with that. so now in order to fulfill their duties, i'm sure they'll cast doubt, what about this, a bunch of mumbo jumbo that none of us can understand and is debunked by experts. that's what i see, and then they move on to the next state. again, make money and cast doubt on the election and hope the united states doesn't do what it should, pass a voter suppression act that will protect all of us from these guys trying to rig the system. >> i want to get to what's next in a minute. first, have you spoken to any of your old republican friends, are they embarrassed they wasted half a million dollars in taxpayer funds thus far and counting? >> yeah, well, my old republican friends didn't support this in the first place, have been embarrassed from day one. a lot of people that see this, i always said arizona, you know, i am a native to arizona. we have these patterns. we do great things, then we do ridiculous things, have great leaders like the mccains, bill waters, and then some of the biggest idiots ever elected. we need more mediocrity out of arizona, that would be nice if we could do that. they were already embarrassed by all this and i think the embarrassment goes on. >> what happens next in arizona, is this now over? can we all agree that joe biden won arizona? >> i think so. i think they're going to have to agree to that. i see that the former president from mar-a-lago called upon the arizona attorney general to do an investigation, of what i don't know. he is running for office. we'll see how he responds. they could continue to drag it out and cast doubt for the purpose of trying to rig elections going forward. i think now even these guys say look, joe biden won. i don't know who is left to say that he didn't. he did. get over it, move on. >> i tell you who is left, pennsylvania, texas, there are other states taking a cue from what happened in arizona and are trying to follow arizona's lead. what's your message to them. >> the message is wake up, people. wake up to what's going on here. first, the cyber ninja type people that don't know what they're doing in the first place, they're in it for the money, okay? they're just trying to, it is a grift. there's a lot of grifters we have been exposed to. i was attorney general for years, i dealt with grifters every day. this is how they act. you would think they'd say this didn't work out, we'll go home, feel bad about what happened. no, they're not. they never give up. they move to the next mark. the next marks are states that you named. then you have to look at the real reason they want to do this. it is not to get to, they're not going to show that the election wasn't what we know it was. joe biden won pennsylvania, he won michigan, he won wisconsin, he won arizona. and it is not going to change. what they do in the process is what they've done here in arizona, you've got a group of people, big group of people that have a little doubt now about our elections and electoral system. that's a real shame because in arizona and most places in the united states we do a great job with elections. we should be proud of that. the best person wins. that's what the republican party ought to get back to. ought to get back to we ought to win elections because we have the best ideas and best candidates, get out of the business challenging the democracy, question elections and rig the system. ultimately they're going to pay a price for that, i hope. i will certainly do awll expectation. the chairman says they're, quote, not holding the opinion that they'll cooperate. do you think that's a fair assessment, that there will be a fight from all four, including mark meadows who used to be a member of that body? >> for sure. we know trump will try as a third party. legal claims, victor, are garbage. the executive privilege, the only point they could make, that's held and decided by the current administration, that's for biden's folks to decide, they also said we're not going to claim it. the drama, the reason they're bringing out big guns now is the possibility of a lousy claim, a spurious claim, nevertheless as we saw in the previous administration in both the mueller investigation and the impeachments, it takes time. way too much time for a lousy claim to work its way through federal courts and that's going to be the dynamic. now, the chair said we'll go for criminal contempt. to do that, they need cooperation of department of justice. you might think the department would be cooperative, but they have policy and opinion that we are not going to file criminal contempt charges in this situation against people in the executive branch anyway, including former people. so that's the $64,000 question. will this get gummed up in the courts, even though claims are lousy, and will that strategy which succeeded in the past again prevail. >> just so i'm clear, harry, sounds like you're saying if they refuse to comply, people subpoenaed, it would be a long, drawn out court saga and that's what you predict will happen. >> right and right. there's a disconnect between how long cases take and congressional subpoenas. it ought to be sped up. in short, there are three ways to hold somebody in contempt. if you want to go the criminal route, you need cooperation of doj. if you want to do the route they've normally done, you have to hold them in contempt, then they challenge it in the federal courts and we have that sometimes long torturous route up to the supremes. that's the worry and that's why, by the way, they're bringing out big artillery now. they skipped a lot of middle steps. they're on trump's inner circle because it is wise, if we're going to have the fight, let's have it now. let's not lose another week. let's engage, fight back best we can. >> let's focus on one of the members of the inner circle, steve bannon specifically. there's this portion of the new book from bob woodward, robert costa, talk about bannon's involvement leading up to the insurrection on the 6th. this is a portion of steve bannon's top legislative priorities threatened by his party's infighting are set to go before the house next week. house speaker nancy pelosi promised the bipartisan infrastructure bill would get a vote on monday. we'll see if that happens, but it is not clear what day the $3.5 trillion build better act will be presented. the massive bill is at the heart of a major divide in the party. moderates argue it is too costly, progressives say it is a must in order to get their support for infrastructure. president biden acknowledged the impasse today. >> now we're at this stalemate at the moment and we're going to have to get these two pieces of legislation passed. both need to be passed. and they'll have a profound impact according to not just joe biden but wall street, imf, international organizations. >> my next guest is one of the moderate democrats that met with the president wednesday to try to bridge the gap in their party. congressman mike thompson of california is with me now. congressman, thanks for your time. let me start here. bridging the gap. how broad is it now? how close, how far apart are moderates, progressives on the top number of this reconciliation bill. >> victor, thanks for having me on. i don't see it as disastrous as some are making it out to be. as you point out, i was in that meeting in the oval office earlier this week with a group of my colleagues from both the senate and the house and my read was everybody wants to get this done, everyone is looking for solutions. i don't think it is any different than any other major piece of legislation. there's a lot of negotiation that goes on, there's different people that have different priorities, and we're trying to work through all of that. this particular bill is monumental. it is transformational. it is one of the biggest pieces of legislation i ever worked on and will be one of the most important pieces of legislation passed in a long time. >> congressman. >> it will take awhile to get to an end product. >> understood. so what's your ceiling, if 3.5 trillion is too high, what's your ceiling? >> i don't know that i want to state a number. i think we need to recognize that first of all, all of the programs that are in the bill currently are all good, they all help the american people. i think what we're trying to figure out now is which one of them deliver the most bang for the buck the quickest. that will drive the number rather than chasing a number. >> so you say don't chase a number. you tweeted out for people that are trying to understand the meeting you had with the president, read this piece by "the wall street journal." sources inside that meeting said moderates wanted it below 3 trillion. is that an accurate, has to come below 3 trillion, does that represent your position? >> i believe that everybody in that meeting, i don't think a number, as a matter of fact, i know no one stated their number. folks talked about their priorities, folks talked about the need to include provisions that can get put into place and address needs of the american people quickly but there were no numbers that were mentioned. >> so speaker pelosi also said let's not focus on the number, let's focus on the content of the bill. you report it as saying everybody wants this to happen, we've all got priorities. what doesn't make your list, what are you willing to say this has got to come out. i see the smile, you know what i'm trying to get to. if you try to pare the bill down, what should come out? >> victor, i would prefer to state it in a different way. make sure that we do a number of things well. and if we do that and deliver for the american people, i think that this is going to be a great success. >> but congressman, respectfully, that's very vague. what specifically, to say you want to do a number of things and do them well, what specifically. the dollar amount is connected to a program, it is connected to universal pre-k, it is connected to many of the social structure programs that we discussed. which ones have to come out to get you below 3.5 trillion? >> i tell you ones that need to stay in. we need to have universal paid medical leave and we need to have child care. we need to be sure we continue with a tax cut to families, working families with children. child tax credit has been extremely successful. it is helping people right now. we need to make sure the green act, legislation i wrote, renewable energy, that needs to stay in. >> i get that, nobody is arguing over what needs to stay. this isn't a fight of what can we all agree upon, it is about what can we decide can come out to make sure it gets passed. last thing. do you believe speaker pelosi will keep her promise and there will be a vote on monday for the infrastructure bill and if there is not a vote monday, will you still support moving forward on talks on the $3.5 trillion bill? >> i have every confidence we're going to pass both bills. >> will there be a vote on monday is the question? >> i don't know. i don't run the floor. that's the majority leader that runs the floor. i am less concerned as to when we vote and more in a rare move, the cdc director broke with her own advisory committee. nick watt has details. >> the booster shot is free and easily accessible. >> the rollout ramps up today. >> when to start the shot and who will get them is left to the scientists and the doctors. >> for now, only those that got the pfizer vaccine and not all of them. the cdc now recommends these people should get a booster at least six months after the second shot. everyone 65 and up and 50 to 64-year-olds with underlying medical conditions. also, these people may get the booster, 18 to 49-year-olds with underlying medical conditions and adults at increased risk of infection in their occupational or institutional setting. the vaccine advisers did not vote in favor of the last group. >> we may as well say to the white house where homeland security secretary is speaking about the crisis at the border. >> months long standard operating procedures at the border which we have been applying to all migrants encountered at the border during this very challenging time of the covid-19 pandemic. as of this morning there are no longer any migrants in the camp underneath the del rio international bridge. i will walk through what we have done, how we have done it, explain the processes and data you requested. first, i want to make one important point. in the midst of meeting challenges we, our entire nation, saw horrifying images that do not reflect who we are, who we aspire to be, or integrity and values of truly heroic personnel in the department of homeland security. the investigation into what occurred has not yet concluded. we know that those images painfully conjured up the worst elements of the ongoing battle against systemic racism. we have been swift and thorough in our response. first, we immediately contacted the office of inspector general and launched investigation into events captured and disturbing images of horse patrol units. we stopped use of those in the area. the agents involved were assigned to administrative duties and are not interacting with migrants while the investigation is ongoing. i directed the personnel from the cbp office of professional responsibility to be on site in del rio full time to ensure adherence to the policies, training, and values of our department. the highest levels of the cbp office of professional responsibility are leading the investigation which will conclude quickly. the results of the investigation i will make public. the actions taken as a result of what we have seen in those images, the investigation will be compelled, results will be compelled by the facts that are adduced and nothing less. let me be clear. the department won't tolerate mistreatment of a migrant, will not tolerate any violation of values, principles and ethics. now i would like to turn to our operational response. dhs led the mobilization of the whole of government response to address the challenging situation in del rio. dhs immediately worked to address the acute humanitarian needs of the migrants themselves by partnering with federal and nongovernmental agencies and entities. we rapidly deployed basic services like drinking water, food, clothing, portable toilets. i am grateful to the red cross for providing more than 17,000 hygiene kits in the world central kitchen, contributing more than 14,000 meals per day to supplement other food programs. we search medical resources and capacity, including over 150 medical professionals to provide health services to ensure safety of the migrants, employees, and surrounding community. we provide personal protective equipment, including face masks, and climate control tents for vulnerable populations. let me go through operational response. simultaneously with humanitarian response we and department of homeland security implemented a series of operational measures to process migrants consistent with existing laws, policies and procedures, in particular, cbp, customs and border protection searched 600 agents, officers, and dhs volunteer force personnel to the del rio sector to provide operational support. we also, dhs officers and agents conducted 24 hour patrols for general safety as well as to identify anyone who might be in medical distress. i.c.e., the u.s. coast guard, department of defense and department of justice provided transportation support to transfer migrants out of del rio to other border patrol sectors with capacity. working with departments of state in haiti, dhs increased the number of removal flights to haiti commensurate with the country's capacity to receive. importantly, u.s. aid has established a $5.5 million program to provide on the ground assistance to repatriated haitian migrants. nearly 30,000 migrants have been encountered at del rio since september 9, with the highest number at one time reaching approximately 15,000. today, we have no migrants remaining in the camp under the international bridge. migrants continue to be expelled under the cdc's title 42 authority. title 42 is a public health authority and not an immigration policy. it is important to note that title 42 is applicable and is applicable to all irregular migration during the pandemic. it is not specific to haitian nationals or the current situation. some more data. to date, dhs has conducted 17 expulsion flights to haiti with approximately 2,000 individuals. those who were not expelled under title 42 are placed in immigration removal proceedings. let me take a step back and explain the process. there are two exceptions to the applicability of title 42, the public health authority. number one is if an individual has an acute vulnerability such as an urgent medical care and two, if in fact operational capacity is such that we are not able to execute the title 42 authority with the centers for disease control. i should also say there's a convention against torture exception if someone claims torture, which is a distinct legal standard. individuals as i mention with acute vulnerability can be excepted from the title 42:00 a.m. indication. approximately 12,400 will have cases heard by an immigration judge to make determination whether they'll be removed or permitted to remain in the united states. that's a piece of data that's been requested of us. if someone is not subject to title 42 expulsion for the three reasons that i explained, acute vulnerability, operational capacity limitations, or convention against torture exception, then the individual is placed in immigration proceedings. that means they go before an immigration judge in an immigration court. if they make a claim that they have a basis under law to remain in the united states, then the judge will hear and adjudicate that claim. if a judge determines that the claim is not valid, the individual will be removed. an estimated 8,000 migrants have decided to return to mexico voluntarily. and just over 5,000 are being processed by dhs to determine whether they will be expelled or placed in immigration removal proceedings under title 8. we previously articulated publicly, previously expressed in light of the fact that we had such a significant number of individuals in one particular section in del rio, texas, that we were moving people to other customs and border protection processing centers to ensure the safe and secure processing of those individuals, and we will assess the ability to exercise the title 42 public health authority in those processing centers, and if any of the exceptions apply, then we'll place those individuals in immigration enforcement proceedings. if we are able to expel them under title 42 because that is indeed a public health imperative as determined by the centers for disease control, we will do so. with that, i'm take questions. >> i was hoping you could explain more about agents on the border acted in a way that violated policies or procedures. can you tell us what they did wrong. and second question has to do with what this episode, how it informs your thinking about the ongoing asylum review and whether perhaps if the administration were to take a more permissive stance toward asylum, membership in a particular social group, this episode could be seen as one of many in the future. >> so i think if i may, you're conflating two very different phenomenon, two very different processes. first of all, the images as i expressed earlier, the images, horrified us in terms of what they suggest and what they conjure up in terms of our history and that page of history hasn't been turned entirely. that means there's much work to do and we are focused on doing it, but i will not prejudge the facts. i do not in any way want to impair the integrity of the investigative process. we have investigators who are looking at it independently. they will draw their conclusions according to standard operating procedures and the results will be determined by the facts that are adduced. with respect to the asylum process, that's an independent process, i'm not sure i understood your question. if you're asking about the definition of a particular social group and just for everyone's benefit, asylum laws provide, first step in asylum process is a claim of credible fear. economic need, flight from generalized violence does not qualify as credible fear. rather, credible fear is fear of persecution by reason of one's membership in a particular social group. what is the definition of a particular social group, significantly constrained, that's an understatement in the trump administration and there's a body of law that speaks to that definition and that definition is currently under review. >> secretary, forgive me, just to follow-up on this point. the question was if this administration were to take a more permissive stance toward that issue, could this be what we experienced the last couple weeks the first of many similar instances to occur in this country on the border? >> what instance are you referring to? >> we have 15,000 migrants the united states government had to now process. >> we determined, we determined the standards to apply in a claim of persecution according to principles that a government should be both domestically and in the international architecture with the treatment of individuals who are fleeing persecution by reason of their membership in a particular social group. it is not a tool of deterrence to define what a particular social group means. >> the people who are under the bridge, you talked about some of them have gone to mexico, some of them were flown to haiti, the others, are they spread out at cpb holding facilities, have some been released into the community or to family members awaiting hearing? what's their status? >> let me be clear. some have been returned to haiti indeed. others have been moved to different processing facilities along the border in light of operational capacity. and then many of them will be returned to haiti from there. and if any of the exceptions apply, they will not be returned to haiti but placed in immigration enforcement proceedings. i should say, released is a very general term and i may need to drill down on that if i may. individuals, some of them are detained, some of them are placed on alternatives to detention. we remain in touch with them. we monitor them to ensure their appearance in court at the designated time of appearance. does that answer your question? >> it does. >> and i can provide the data if i need to the broader question is it seems there are borderard crise that pop up like whac-a-mole or unaccompanied minors, and is there a plan to maybe have, you know, like fema type teams that go to these crisis points or is the goal somehow to stop having these crises. >> you mentioned fema, so two points, if i may. let me first address the -- well, let me go in reverse. from an operational response perspective, we address the challenge of unaccompanied children in march, and i said then that we had a plan, we were executing our plan and it would take time, and in fact, within 60 days or so, we went from an average time of unaccompanied child in a border patrol station of 124 hours to less than 25 hours. and we did that through our operational capacity throughout the department of homeland security, as directed by the president in an all of government effort. here, last weekend, we had approximately 15,000 individuals in the del rio section. i committed to addressing that within 10 days, and today we have none, and that was because of the department of homeland security's assets with the assistance of others across the government. that is something very different than the fact of the dynamism of a regular migration writ large and the fact that this is a situation that has occurred from time to time ever since i can remember in my more than 20 years of government service. and the president has spoken very powerfully about this from day one. and before he assumed office. first and foremost, and most fundamentally and foundationally, we are dealing with a broken immigration system. and we need legislative reform. and everyone agrees in a world where unanimity is so difficult to achieve, there is one thing as to which there is unanimity, and that is the need for comprehensive immigration reform, and unfortunately it seems to remain elusive but our real dedication to achieving it is unrelenting, and we continue to do so. number one, number two, we have a three-part plan. we invest in the root causes to address the need, to address the reason why people leave the homes in which they live and take a perilous journey that they should not take. second, the building of safe, orderly and humane pathways, and third, rebuilding an asylum system and a refugee program that were dismantled in the prior administration. this takes time, and we are them all together? >> we're going to take a look. what we were focused on right now is addressing the urgency of the situation in del rio under that bridge. we are still getting through it. remember, as i mentioned in response to the prior question, we still have operational needs across the border with respect to this particular population of individual individuals. we're going to be taking a look at this. what the patrol is used to do for everyone's benefit is horses are able to cross terrain that might not otherwise be traversed and what they often do and in fact, most often do is assess the situation, and actually assist in helping people in distress, and that horse patrol, the horse patrol that the customs and border protection employs, the border patrol specifically has actually saved lives many times before, but we will take a look. >> and just because yours is such a sprawling department, you face multiple issues at once, the situation regarding afghan refugees that are being processed by your department, we have had a few questions on that that haven't entirely been answered. i'm just curious if you know how many cases of forced marriage or so called child brides of d thrks hs child in the system. >> to my knowledge we have not found one but i will tell you we have experts at the airport and beyond who understand that phenomenon very well, and know how to detect wrong, and he said there will be consequences. do you disagree with that? >> i know the president was echoing the sentiments of the american republic in response to the images and what the images suggest. i want to speak to the fact that this investigation will be based on the facts that the investigators learn and the results of the investigation will be driven by the fact. >> the president said they will pay. >> i think the president was speaking in terms of the horror that he observed from seeing the images and what they suggest. that investigation will have integrity, i can assure you squalid conditions, limited opportunities to go through asylum processes here. advocates have been warning about this situation for months. how much responsibility does the administration take for these situations continuing to pop up in various places. >> so if you're addressing the situation in del rio, i will tell you that it is unprecedented for us to see that number of people arrive in one discreet point along the border. that is unprecedented. we have the chief of the border patrol, raul o adveortiz is a 30-year veteran. what we do when we see something unprecedented is we respond and respond we did. >> steve. >> some democrats have wanted you to be more lenient on the asylum claims because of the earthquake that haiti went through. have you considered that at all, sir? >> let me speak to that. we studied the conditions in haiti a number of months ago as is our legal obligation to do so, and based on the country conditions that we observed and studied, what we did is we haiti for temporary protected status, for the haitian nationals resident in the united states were here prior to july 29th and we were mindful of the assassination that occurred and we were unsure of the results of that assassination in terms of the stability of the political order. once a new leader took office and things seemed to settle down, we determined that the july 29th date was equitable to address the humanitarian relief of haitian nationals already resident in the united states. we have continued to study the conditions in haiti, and we have, in fact, determined, despite the tragic and devastating earthquake that haiti is, in fact, capable of receiving individuals and we are working with haiti and with humanitarian relief agencies to ensure that their return is as safe and humanely accomplished as possible. i was around, i was at u.s. citizenship and immigration services on january 10th, 2010, the date of the last earthquake in haiti, and that was distinct from the earthquake that devastated people recently. tha that had far greater graphic repercussions. this one as devastating as it was was more geographically limited and we made a determination based on the legal standards and the facts that, in fact, individuals could be returned to the country as a whole. >> thank you very much, just to go back, please, to the images of these mounted border patrol officers, you said on saturday, or rather on the 20th, to ensure control of the horse, long reins are used. the person who took the photos of the border patrol agents says i've never seen them whip anyone. why is the president out there today talking about people being strapped. >> so let me correct the statements in your question if i may. it was on friday when i was -- actually, it was on monday, i believe, when i was in del rio on the ground, and i made the statements without having seen the images. i saw the images on the flight back and i made the statement that i did with respect to what those images suggested. the horses have long reins, and the image in the photograph that we all saw and that horrified the nation raised serious questions about what -- let me finish -- about what occurred and as i stated quite clearly, it conjured up images of what has occurred in the past. let me finish. there's also a question of how one uses the horse. and how one interacts with individuals with the horse. and so i'm going to let the investigation run its course. i'm not going to interfere with that investigation. the facts will be determined
