the presidency. needless to say, there is absolutely no basis in fact or logic for these claims. that is not going to happen. the claim is frankly nuts, but as we all learned in january, that is not a reason for law enforcement to not take its adherence seriously. today we're learning even more about the failure surrounding that attack. senate hearing revealed there was a three-hour delay in deploying the national guard to assist capitol and d.c. police when the major general in command of the national guard said his troops were ready, armed and could have been there in 20 minutes. he also noted last summer when there was violence the secretary of the army allowed immediate deployment, though on january 6th, the secretary of the army did not. as cnn's jessica schneider now reports. >> i was frustrated. >> reporter: the commander of the d.c. national guard taking on top pentagon officials, disputing their contention that the guard was deployed to the cap capitol. >> the approval for chief sund's request would have come from the secretary of defense and be relayed to me by army senior leaders at 5:08 p.m., about three hours, 19 minutes later. >> reporter: walker says the call first came to him from capitol police chief steven sund minutes before rioters broke into the capitol. >> chief sund, his voice cracking with emotion, indicated that there was a dire emergency at the capitol and he requested the immediate assistance of as many available national guardsmen that i could muster. >> reporter: but walker couldn't deploy his forces without authorization from the secretary of the army and the secretary of defense. and when walker did ask for app approval, he says he was met with resistance. >> army senior leaders did not think it looked good, it would be a good optic. they further stated it could incite the crowd. >> was the issue of optics ever brought up by army leadership when the d.c. national guard was deployed during the summer of 2020? >> it was never discussed the week of june. it was never discussed july 4th and we were supporting the city. it was never discussed august 28th when we supported the city. >> did you think that was unusual? >> i did. >> reporter: while the request for troops was going up the chain of command, walker says dozens of his men and women were ready and waiting. >> what would have been the impact of sending those 155 right around that 2:00 timeframe? >> it could have made a difference. we could have helped to extend the perimeter and push back the crowd. >> reporter: they arrived within 20 minutes well after the peak of the violence. today's hearing unfolded as capitol remains fortified and the fbi is warning about a possible plot to breach the capitol tomorrow. >> the threats are ongoing? >> yes, sir. >> reporter: now these latest threats could prompt the house to stay late tonight to vote instead of coming in tomorrow, because there are real concerns about security at the capitol right now, especially since we're learning more about that joint bulletin that was issued by the fbi and dhs late last night. they warned violent extremists want to take control of the capitol and remove democratic lawmakers tomorrow. that bulletin also warns of a threat to president biden's still-to-be-scheduled address to a joint session of congress. >> thank you so much, jessica. joining us now, republican congressman michael mccaul of texas. congressman, thank you so much for joining us. a joint intelligence bulletin warning of the attack tomorrow, march 4th, on capitol hill, it was released at midnight. do you think law enforcement is more ready this time than they were on january 6th? >> oh, absolutely. the capitol is fortified like a compound. we have razor wire around the capitol complex. we have national guard surrounding the capitol. we feel much safer. i think to your piece prior to this, my big question has been all along, why wasn't the national guard deployed sooner? why did it take two to three hours and why weren't they part of the original security strategy as a prepositioned asset, whether seen or unseen? that could have been done and that could have saved lives and it could have prevented this thing. >> senator rob portman wants the former secretary of defense, chris miller, and former secretary of the army to testify, to answer these questions. do you agree? >> 100%. jake, my question has always been not so much what happened prior, although we know this is a preplanned attack, but what happened after the insurrection was occurring at the capitol and why did it take so long for the guard to respond? i think there's a lot of unanswered questions out there. i know the fbi has an ongoing investigation that i actually called for, and i hope we get to the bottom of it. >> it seems to me that whether we're talking about the attack on january 6th or this possible attack tomorrow, president trump, these people, these attackers worship him. they love him. they think that they're doing this in his name. do you think donald trump should be more forcefully saying clearly i'm not going to be inaugurated tomorrow? joe biden was elected fair and square? i feel like that could potentially quell a lot of these potentially violent threats. >> well, i think president trump has a responsibility to tell them to stand down. this threat is credible. it's real. it's a right-wing militia group that believes that the original -- because the original inaugural day was march 4th until the 20th amendment passed, they think this is the true inauguration day and that president trump should be inaugurated tomorrow. and that is the threat we face right now. >> we heard today the timeline of when the national guard was requested and the three hours it took for them to turn up. take a listen. >> chief sund, his voice cracking with emotion, indicated that there was a dire emergency at the capitol, and he requested the immediate assistance of as many available national guardsmen that i could muster. immediately after that, 1:39 call i alerted u.s. senior army leadership of the request. the approval for chief sund's request would eventually come from the acting secretary of defense and be relayed to me by army senior leaders at 5:08 p.m., about three hours, 19 minutes later. >> i know you just said you want to hear from the former acting secretary of defense, chris mi miller, and former secretary of the army. do you have any idea why it would take three hours and 19 minutes? the general testified he did not have remotely any problem the previous summer, last summer, when there were violence related to different protests from a different political point of view. it really looks suspicious. >> very. again, that's been my biggest concern all along. i was in the capitol when this was all going down. number one, why wasn't the national guard made part of this security strategy? number two, why did it take them three hours to respond? we have a d.c. armory down the street from here with guard troops. i don't know what happened. i think, you know, there are going to be some really tough questions at very high levels on this. we need to get to the bottom of it and find out the truth. i really feel for the police chief of the capitol, chief sund, who by the way didn't get this fbi thread that people were going to conduct violence and war at the capitol. he doesn't even see that until after the insurrection takes place. as a former federal prosecutor who led the joint terrorism task forces, that's not the way things are supposed to happen. after 9/11, after the boston bombings when i chaired the homeland security committee, we thought we fixed this breakdown in communication and apparently it's still a problem. >> i know you want to talk about the fact that you're reintroducing a bill, calling on the russian president, vladimir putin, to release trevor reede, an american, former marine, being held in russia. the biden administration just issued a slue of sanctions on russia for poisoning and imprisonment of opposition leader alexey navalny. are you concerned that if the biden administration hits russia too hard, too fast with these sanctions that your efforts to bring trevor reede home might get derailed? rate. one out of every eight infections the united states in the last week has come out of texas. this is not the time to drop mask requirements. look, we've seen what happens in this country when people get mixed messages. a year ago the cdc and task force were telling us not to wear masks, then they were telling us to wear masks, then the president of the united states was saying masks weren't for us. we know what happened. surge after surge. we're finally singing from the same page and we have these rogue states wanting -- not to spike the ball before the end zone. in those states, you know, the other team is winning. texas has a long way to go. this is not going to end well. >> dr. walensky, head of the cdc, is still encouraging individuals in places like texas and mississippi, to keep wearing masks even if it's not mandated in their states. do you agree? will that work? will that be enough? >> well, i completely agree with dr. walensky. look, local officials have to take control. the county officials, the judges in the various counties in texas, the mayors of the cities need to understand that what is going to happen, if that state opens widely, is what happened around the south and southwest in june and july and august, when states prematurely opened. the virus will spike. places like houston are just recovering from being overrun by covid cases in january. and they still haven't recovered from their deep freeze and power outages. >> right. >> now is not the time to do this. >> when it comes to vaccine hesitancy, we often talk about minority communities. take a look at this. a poll shows that 28% of republicans say they will definitely not get the vaccine. that's twice as many as the 14% of the black respondents who say the same. 12% of hispanics. the real vaccine hesitancy is among republicans. how can the u.s. change this? >> what a lost opportunity from the former president. you know, it was shocking to hear that the former president and first lady were vaccinated secretly in january. imagine if he had gone on camera, along with the first lady, rolled up his sleeves, got a vaccine and told his base, this vaccine is for you. i have these conversations every day with patients. i told a patient today, tell me why you're reluctant to get the vaccine, and we went through this point by point. if this is done from national leaders who people really respect or revere, imagine the difference there. so, you know, that's done. but now we need to reach these people on the local level and we need local republican leaders and republican clubs to go out and really at the grassroots level talk to people. we need this coming from physicians, local county health officials. we need to target people, because this virus will not go away a bill this week that would add new i.d. requirements for absentee voting and reduce early voting hours among other changes. >> today i rise in opposition to hb-531 because it was predicated on a big, fat lie. >> reporter: it could directly impact voter turnout efforts like souls to the polls, which encourages black church goers to cast their ballots the sunday before voting day, calling it the most blatant ly racist attacks on voting rights in the south since jim ceo. many focus ond limiting voting by mail. >> no voter in the united states of america should have their access to the ballot dependent upon who holds the majority in their state's legislature. >> reporter: at the supreme court yesterday, arguments over a different arizona election law, which republican legislators already passed, claiming it would limit voter fraud. but when asked by conservative justice amy coney barrett why the gop agreed with the law, party lawyers admitted what some experts say is really behind this nationwide effort, telling the high court -- >> because it puts us at a competitive disadvantage relative to democrats. >> reporter: now voting advocates at the state level are increasingly trying to rely on congress doing something federally. hr-1 or for the people act will be voted on later today. it's likely going to pass the house. it's a massive government overhaul reform bill that includes protections on voting like making sure there's at least 15 days of early voting and same day and automatic registration, while preventing states from being able to prohibit absentee voting. jake, you mentioned former vice president mike pence's op-ed where he spread the lies about election fraud. the whole premise was hr-1. he called the bill reckless, anti-constitutional, anti-democratic if you have any idea of how republicans feel. >> republican official said they oppose this move because it put republicans at a competitive disadvantage. that's not actually a principle. >> reporter: out loud. >> diane gallagher, thank you so much. security is ramping up on capitol hill because of chatter by extremists about an attack tomorrow. dana, once again, republican senator ron johnson of wisconsin, who questioned whether the capitol attack was even an armed insurrection, he tried to push that narrative again today. take a listen. >> how many firearms were confiscated in the capitol or on capitol grounds that day? >> to my knowledge we've not recovered any on that day from any of the arrests on the scene at this point. i don't want to speak on behalf of metro or capitol police but to my knowledge, none. >> no one has been charged with an actual firearm weapon in the capitol or on capitol grounds? >> correct. >> five people were killed that day and dozens and dozens were injured. police officers losing an eye, losing fingers. even if the insurrectionists did not have guns, and the truth is, we don't know that, they wounded police and others with a variety of weapons. why is he even doing this? >> to rewrite history, jake. there's no other way to put it. i talked before coming on with you, with senator amy klobuchar, one of the chairs of that hearing, who went down the list with me of all the weapons that they did have, a lot of which, most of which cnn has reported. a baseball bat. baseball bats. flag poles, bear spray, chemical irritants, stolen police shields, stun gun. even if we didn't know all of that, because they were confiscated, we all saw the pictures. we all saw the video. we saw what the masses of people who were pushing in a violent way against the police officers and what they clearly intended to do if they got any of their potential targets would have done. and you don't need a firearm in order to achieve that. and so that is irrelevant to whether it was dangerous and what happened. and ron johnson is trying to -- it's basically gas lighting. there's no other way to put it. >> the chatter, eugene, about another possible capitol attack tomorrow is because of this qanon conspiracy, this deranged idea that trump will actually be sworn in as president again tomorrow. it's crazy, but people believe this. even after fbi director wray said yesterday there was no widespread voter fraud in the election that the fbi or department of justice knew of. mike pence is out with a new op-ed in the conservative w website the daily signal where he writes, falsely, after an election marked by significant voting irregularities and numerous share with millions of americans about the integrity of the 2020 election. what's going on here? what's the political calculation that he's now siding with the people who were trying to hang him? >> yeah. i think he wants to stay relevant in the republican party. you have to agree with former president trump to do so. what he's missing when he says he agrees with those millions of people, the millions of people believe that because then president trump stood in front of cameras early, early in the morning on election night and said there was voter fraud. he created that. it's completely cyclical. every republican you talk to, you talk to them in front of accuracy and on the record, they will not agree to that. it's true president trump lied and they are repeating those lies and that's part of what happened on january 6th. and all of that, now that former president trump is still the head of the republican party, that's not going anywhere at all. >> eugene, you just spoke with the head of the national republican congressional committee about what he sees as trump's role in these upcoming primaries. what did he have to say? >> his whole job is to keep -- on trying to get the republican majority, but he is the first republican leader to say publicly to president trump, we don't really want you to engage in these primaries. president trump is going to -- has already waged war on these ten people who voted to impeach him. and it would not be help ful, ad he would like him to stay out of it. that's not something we've heard from someone like kevin mckarth. >> i pence's op-ed calls for them to vote for had hr-1. pence's stance, vice president pence describes the stance like this. quote, it proves -- i'm sorry, fox. i'm reading this incorrectly. fox describes pence's stance as this. it proves -- vice rather, vice says, quote, it proves as pence looks to stay relevant in the modern republican party with an eye on potential 2024 presidential run, he's willing to play footsie with the elements of the party that were calling for his head just a few weeks ago. dana, does pence have any chance of winning the republican nomination? 2024? trump has already made him an enemy and people close to trump are saying if he runs again, he's not going to pick pence. >> they are but if anybody knows how mechlt rcurial trump is, it's mike pence. so he is trying to -- you know, a relatively young guy in politician's terms these days, and trying to stay in the former president's good graces, but he's also trying to toe the larger line that diane just reported in her excellent piece, which is keep it at the state level where a lot of republican legislatures are trying to roll back the ability for a lot of people to vote, which really helped. you saw how many people voted in 2020. and he says in his op-ed that it is the states, not the, in his words, the leftists in the house who want you powerless at the ballot box. this is the way that republicans, even those who say the big lie is, in fact, the big lie, the way that they are still trying to court the trump base is by using the terms election reform. frankly, using it pretty loosely, in talking about all the ways that they want to change the ballot box, which is obviously a response to the lie in 2020, but they're making it as if it was much broader. >> dana bash, eugene daniels, appreciate it. the biden administration says it's a challenge, not a crisis biden's pick to be budget chief, officially pulling her nomination. while officials say biden hasn't settled on a replacement, a long-time democratic congressional staffer getting an unprecedented boost from the top three house democratic leaders today, saying in a joint statement young would be, quote, a tremendous asset to the biden/harris administration. sources telling cnn young, biden's so far, 13 of the biden's 23 cabinet level nominees moving toward the senate, which is also voting on the $1.9 trillion relief bill. making late changes and pressing forward. >> we've come a long way but we have a long way to go. >> reporter: with biden signing off on an agreement to tighten eligibility for stimulus checks, phasing out checks at $80,000, down from $100,000, and $160,000 for couples, down from $200,000, all as republicans united in their opposition to the bill planning a marathon vote process to try and split democrats from the package, with biden scheduled to continue his hill lobbying blitz later tonight. this time with house democrats. >> he rolls up his sleeves, gets involved in them, too. and he's confident that this is a package with all the components documents revealing an emerging crisis at the border, even as the biden administration refuses to call it a crisis. the documents reveal a growing trend of unaccompanied children coming into the u.s. overwhelming facilities during a pandemic. and, on average, children are remaining in border patrol custody longer than the law permits. cnn's priscilla alvarez. >> reporter: unaccompanied migrant children coming to the border. to put this in perspective, in the last 21 days border patrol encountered 340 migrant children. these are not levels that have been seen since 2019. when there was a crisis on the border. now this is a vulnerable population. border facilities are not designed nor intended to care for these children. they depend on health and human services department to place these children in shelters, but hhs here is also working under limited capacity due to covid-19 precautions put in place last year. so behind the scenes, officials scrambling to accommodate these take some key points from the governor's apology from this news conference. as you just heard, he apologized multiple times. he essentially said he was embarrassed, that he didn't mean to offend anyone or, you know, make anyone feel very uncomfortable. and he outright denied any claims of inappropriate behavior, as you also just heard th there. and so with all of that, he was definitive on the fact that he is not going to resign, saying anyone who is saying he should is really just playing politics at this point. so, this is the first time that we've heard from governor cuomo since these allegations from three separate women, two of them former staffers, who have come forward within this just last week. i want you to hear more of what he had to say. >> again, i didn't know at
