and tennis star novak djokovic is heading to the australian open after being granted a medical exemption from requiring a covid vaccine. prince andrew's lawyers have been trying to convince an american judge to dismiss the civil sexual assault case against him. they say his accuser, virginia giuffre, can't sue because of damages she accepted in 2009 from the paedophile, jeffrey epstein, in return for dropping her claims against him and any other "potential defendant". prince andrew has consistently denied her allegations. 0ur royal correspondent, jonny dymond, has the latest. she says she was sexually assaulted by prince andrew three times. he denies every allegation and says he can't remember meeting her. today his lawyers argued the whole case should be dismissed. the civil case rests partly on this meeting in london, a night when virginia guiffre, here are aged 17, says she was forced to have sex with prince andrew. it is something the prince has consistently denied. you can say categorically that you don't recall meeting roberts, dining with her, dancing with her at tramp or going on to have sex with her at a house in belgravia? i can absolutely categorically tell you it never happened. do you recall any kind of sexual contact with her at any other time? none at all. today the lawyers battled in court for the first time. at the centre of their arguments, a deal struck between prince andrew's accuser and his former friend jeffrey epstein, who paid virginia guiffre half $1 million. their deal released any other person who could have been included as a potential defendant from further legal challenge by virginia guiffre. prince andrew's lawyers are needed to persuade the judge that the 2009 deal covered the prince. the court heard... the prince's lawyers demanded details of the allegations against their client but they were slapped down by thejudge. finally, questions were raised as to whether the prince could even use the 2009 deal. he is a third party, the court heard. thejudge said... the argument put forward by ms giuffre roberts council was strong. i thought the arguments put forward by prince andrew's council really met with what we call in america a very flat bench. the judge was simply not buying what they were selling. even if this case is dismissed, the prince is, say veteran royal watchers, badly damaged. when it comes to the monarchy, the monarchy is obviously an institution that is big enough to rise above what has happened but when it comes to prince andrew, one has to say that one can see no role in royal life for him in the immediate future or the intermediate future. now they wait. the judge in new york says a decision will come pretty soon. jonny dymond, bbc news. nada tawfik is in new york. here she explains to me more about what we heard today. this was a crucial moment in this case because prince andrew is asking a new york judge to throw out this entire civil case against him that was brought by ms. virginia gif is that what he's saying is he is covered, he has immunity under a settlement agreement that was reached by her and jeffrey epstein in florida in 2009. in court his lawyer said is unquestionable that the duke of york could be sued at that time in that case. therefore he qualifies as a potential other defendant. that is covered in this agreement from any further legal action. essentially, what he tried to do is get this case thrown out on a technicality. he is of course denied the allegations that he abused virginia giuffre. and these allegations are heard properly through prints aren't doing that andrew having to be interviewed and deposed in the case what are lawyers so the judge is that neither obscene or virginia matthew one ever intended for prince andrew to be covered by this agreement and back it was a confidential agreement that prince andrew he didn't even know about until this year. so it was interesting to hear the judge questioning both sides about their legal arguments. questioning both sides about their legalarguments. he questioning both sides about their legal arguments. he had a few opinions of his own to. tell me more about this 2009 agreement. how much do we know about what's in it and the circumstances around which it came? ., ., ~ , the circumstances around which it came? , .,, ., the circumstances around which it came? , ., ., came? look, this was an agreement that aid came? look, this was an agreement that paid virginia _ came? look, this was an agreement that paid virginia giuffre _ came? look, this was an agreement that paid virginia giuffre have - came? look, this was an agreement that paid virginia giuffre have 31. that paid virginia giuffre have $1 million to release epstein from any further legal claims. in fact it was so broad it talked about releasing him from crimes that were from the beginning of the world. it was secret up untiljust a few days ago. there was this big court battle to get this settlement released, the judges agreed that it could be made public. so we've really onlyjust gotten to see the details of this agreement ourselves. and it does mention that virginia giuffre alleges she was trafficked by epstein to his friends including royalty, visited black businessman, politician. that's again where prince andrews legal team are seizing on this agreement saying it also covers them. what was interesting today is that the judge looked at another part that comes right at the end of the agreement and the language on that says, the terms of the settlement are not intended to be used by any other person nor be admissible in any proceeding or case against or involving jeffrey epstein whether civil or criminal. but the judge involving jeffrey epstein whether civil or criminal. but thejudge is saying is this is someone who was not even supposed to be known to the public. it was post be confidential between jeffrey epstein public. it was post be confidential betweenjeffrey epstein and virginia giuffre. therefore prince andrew can't use the settlement and his gaze was up that's essentially what you're saying in the series but we are waiting for his final decision. —— case. the uk has reported another record daily number of covid infections. 218,000. though there's been some backlog in reporting because of christmas which needs to be factored in. earlier, borisjohnson led a press conference. together with the plan b measures that we introduced before christmas, we have a chance to ride out of this 0micron wave without shutting down our country once again. we can keep our schools and our businesses open and we can find a way to live with this virus. we've identified hundred thousand critical workers in areas from food processing to transport to our border for us and from the 10th of january we will be rolling out lateral flow testing for all these workers available on every working day. we will bring in the bbc*s ben wright to help us. felt like the prime minister holding his line? that's right he said it was a moment of utmost caution. it's clear why because of the first time there have been 200,000 daily infections recorded. there are 15,000 people in england with covid. the chief scientific officer said he couldn't say it now when the peak of the 0micron variant would be. couldn't tell along it would be in this critical phase of dealing with this new variant. but the prime minister does believe that the covenant that current measures in place a so called plan b that will pass just before christmas were enough to keep a lid on the 0micron variance now. he pretty much said there will be no further lockdown in the foreseeable future and no further restrictions to deal with the situation as it is at the moment. it's a sort of hold your nerve, steady as she goes press conference urging people to get the booster fault of the prime minister said there were 9 million eligible people who still haven't had their booster and he set out why there was a clear correlation between the boosterjob and ending up in hospital. to boosterjob and ending up in hosital. ., . , hospital. to what degree is the prime minister _ hospital. to what degree is the prime minister willing - hospital. to what degree is the prime minister willing to - hospital. to what degree is the prime minister willing to put i hospital. to what degree is the prime minister willing to put a | prime minister willing to put a figure on when further measures might be necessary? restrictions that were in place already where they had to stop the nhs getting overwhelmed we know that that means an overwhelming number of people in intensive care beds, that is not happen. it also means coping in terms of its staff level. we know it had a real impact on the number of people who can work. both the nhs and in other private sector industries in the public sector which is why you heard the prime minister saying he was going to be introducing from the 10th of january daily testing for 100,000 critical workers in an attempt to keep critical industries and supply chains going much indeed. millions of pupils across england and northern ireland have gone back to school today. in england, secondary students will have to take covid tests at school, and masks are being re—introduced. here's our education editor, bra nwen jeffreys. both teachers, martyn and lucy, got covid at the same time last term. lucy ended up in hospitalfor a night. we had talked about the amount of risk we were in in comparison to other people, i suppose, so... children in different schools. myself and lucy have both been teachers. i think we're on plan c, d, e and f at the minute. mark, a secondary head teacher, had a third of his teachers off at one point, so they brought back facemasks in classrooms — a precaution reintroduced for teenagers across england. communication in classrooms is impacted. i've got a couple of classes that i take. i'm well aware of the difficulties that teachers and students face, but in my view it's a short—term measure for impact to deal with people's health so we will continue to adapt and be fleet of foot in our approach, i think. today, tests on offer in england's secondary schools, then pupils are asked to test at home like the rest of the uk. for these teenagers in stoke, tests and masks are trade—offs. i think that face—to—face teaching is obviously always the most important aspect of school because we, you know, online you can't get the same sort of support from teachers. i think it'sjust a case of, like, cracking on with it cos, like, l if it's going to affect our - education, i think you should just wear it, yeah. it's a bit stressful because it's always on my face and i can't really breathe. but i mean, it's obviously got a positive side because it's helping people to stay safe. no—one wants a repeat of last year's empty classrooms. the worry is rising cases among staff. there are some big differences from last year — so year—group bubbles have gone, which should mean fewer pupils being sent home. and, of course, more teachers and pupils have either been vaccinated or had coronavirus. only a half of teenagers have had at least one jab. apart from scotland, where more are vaccinated. no masks for primary pupils, vaccines only for the most vulnerable. here, already some staff are off. so currently we have four members of staff that have tested positive over the holidays, so they are not in school with us today. we have had around 90% of our staff have actually had covid. as wales and scotland also return in the coming days, everyone waiting to see if schools can manage through the next peak. branwen jeffreys, bbc news. straight to the us president biden is receiving a briefing on the virus and is remaking remarks as well. about 35 million in the past month. there is still 35 million people not vaccinated. and let me be absolutely clear, we have in hand all the vaccines we need to get every american fully vaccinated, including the booster shot. there is no excuse, no excuse for ever and he won being unvaccinated. this continues to be a pandemic of the unvaccinated. so we've got to make more progress. and for patients who still haven't gotten your kids vaccinated, please get them vaccinated. look out for their interest here. it's the best way to protect them. and for parents with kids too young to be vaccinated, surround your kids with people who are vaccinated. and make sure your masking in public so you don't get covid and give it to your kids. look, we have no reason to think at this point that 0micron is worse for children than previous variance. we know there to enact that our kids can be safe while in school, by the way. that's why i believe schools should remain open. they have what they need for that because of the american rescue plan in the first month we are in office or second month we are in office or second month that i signed in march we provided the states with hundred and 30 billion, with a b, $1 billion to specifically keep our students safe and schools open. funding for ventilation, ventilation systems to the schools, social distancing in classrooms, even larger classrooms with up on buses and everything from bus drivers to buses, the actual bus,... and all this process we've included an additional $10 billion for a testing for schools. that money went out to the states. and the states in the school districts have spent this money well, many of them. but unfortunately, some haven't. so i encourage the states and school districts to use the funding and protect the children and keep the schools open. countries across the world are seeing rises in cases was up here in the united states our team have been working around the clock during the holiday weeks for them in the last two weeks weeks for them in the last two weeks we have developed hundreds of military... we deployed hundreds of military... we deployed hundreds of military doctors and nurses to stop the hospitals in our states that are overrun and overworked because of unvaccinated covid—19 patients primarily. federal emergency emergency management association, fema is also working in our direction. working at hospital capacity. including whether they be beds. i directed fema to be ready to provide emergency hospital beds wherever and whenever they are needed. the federal government will be there. we've shipped nearly 2.4 million pieces of protective equipment to hospitals from bounds to gloves. and where doing now whatever we can to protect communities from the surge of hospital cases that are likely to see from the unvaccinated population. look, let me address three specific updates before i get my full debris from my team. first, booster shots. my full debris from my team. first, boostershots. i my full debris from my team. first, booster shots. i know doctor fauci i am like an echo chamber here. but repeating myself with what doctor fauci said very clearly. booster shots work. they significantly increase protection and provide the highest level of protection against 0micron. americans, we have given out over 70 million booster shots. importantly, 230 seniors received their booster shots. booster shots are free, safe and available. 0ver are free, safe and available. over 90 thousand vaccination sites for that let me say that again, free, available and at over 90,000 sites. we have added sites, added hours, added appointments, added walking capacity. we have booster shots for every american in the country. it's easier than ever to get a booster shot. and more importantly than it's ever been. the fda is also now offers booster shots for children ages 12 to 15. so with the final approval from the centers for disease control and prevention, the cdc, young people when that occurs young people ages 12 to 15 will be able to get booster shots later this week. second, testing. another*s remains frustrating, believe me, it's frustrating to me but we are making improvements. in the last two weeks we've stood up federal testing sites all over the country. we are adding more each and every day. google covid test near me, go there, covid test near me on google to find the nearest site where you can get a test most often and free. we have more capacity for every person a test, we should see waiting i shortened and more appointments freedom. if you want to test yourself at home we have three options now. one, drug stores and online websites are restocking. two, actually, the more tests are available working to continue to become available. next week our requirement that your insurance company reimburse you for at—home test takes a set so you will get reimbursed. so if your insured you could buy the test and get paid for it. the second thing i want to mention it is, many states and local governments and health care providers are passing out free at—home test that you can pick up. just find out where they are. and finally as i announced recently, the federal government is launching a website this month where you can get tests shipped to your home for free upon your request. the third point i like to speak about is also on treatments. forthose like to speak about is also on treatments. for those at high risk who do get covid—19 we now have a new visor pill that greatly reduces the risk of hospitalisation and death postop —— visor. i'm pleased to say than a christmas eve we shipped out the first batch of these bills that we received, we purchased and received with him and more will be shipped this week. they are already saving lives. but due to complexity of making the pill it takes months literally to make a pill. production is in full swing. the united states has more pills and enter the country in the world and our supply is gonna ramp up over the coming months as more of these pills are manufactured. today i'm directing my team to work with pfizer to double our order from 10 million to 20 million treatment courses to be delivered in the months ahead. we may need even more. that's the estimate we need right now. we've already placed the largest order in the world. now i'm doubling that order. these pills are going to dramatically decrease hospitalisations and deaths from covid—19. they are a game changer. and have the potential to dramatically alter the impact of covid—19, the impact it's had on this country and our people. look, let me conclude with a quick recap. if you are vaccinated and boosted you may get covid but you are highly protected against severe illness. schools can and should be open this winter, we have all the tools to keep kids safe. unvaccinated kids are at risk yet the vaccinated are going to protect them. if you're vaccinated get boosted. folks, i know we are all tired and frustrated about the pandemic. these coming weeks are going to be challenging. please wear your mask in public to protect yourself and others. we are going to get through this, we are going to get through this, we are going to get through this, we are going to get through it together. we have the tools to protect people from severe illness due to 0micron. if people choose to use the tools. we have the medicines coming along that can save so many lies and dramatically reduce the impact covid has had on our country. there is a lot of reason to be hopeful in 2020. for god sakes, please take advantage of what's available. please, you are going to save lives may be yours, maybe your child. please take advantage of what we already have, 0k? thank you. now i'm going to get this briefing started. thank you very much. well, this feed as you can tell has gone quiet afterjoe biden made those initial statements about the situation with the pandemic. and a camera person seems to be changing their camera angle as well. we expected to hear some of that briefing, the president was being joined by several leading scientists who are going to brief him and everyone watching on the state of the pandemic. we already know the headlines, statistics around the state of pandemic. america is now set the highest daily total of covid cases for any country since the start of the pandemic. clear of1 million cases. the surgeons very much being blamed on the 0micron variant as you would expect, it's a surge was being replicated albeit not to that degree in countries around the world. actually, there were echoes between what we heard from borisjohnson a little earlier on that record number of cases in the uk. the prime minister saying please get your booster shot, if you have a cup vaccinated all, please get a vaccine. emphasising the importance of the vaccines will that we are the same bear from joe biden for the puk and the us have slightly different policies on which children should get vaccinated but we heard president biden saying if your child is eligible, please give them the job. if it too young to be eligible please surround them with people that are vaccinated. 0f please surround them with people that are vaccinated. of course the question for president biden and a question for president biden and a question for president biden and a question for prime ministerjohnson is they have been pushing these messages for some time. if they are not those messages on their own enough and will be further questions as to what should be done. we will be back with you and a couple of minutes' time. hello. i'm guessing today came as a bit of a shock to the system after that exceptionally warm start that you've expands on nguyen days, temperatures widely across the uk in the mid teens come up to 16 "the coming storm" looks at the conspiracy theories which motivated some of the people who stormed the capitol — including qanon — and some other false conspiracy theories that came before it. a year on from the capitol insurrection in washington dc on 6january 2021, gabriel gatehouse journeys into the dark undergrowth of modern america. gabriel gatehouse is the writer and presenter of the coming storm. what were you setting out to discover when you made this series? when i was in london glued to the tv watching the scenes you just played off january six last year, watching the scenes you just played offjanuary six last year, inside the capitol building, inside the senate chamber, i saw somebody are recognised. he was a man wearing horns on his head, he was draped in furs, bare—chested, covered in tattoos, and he became the face of that day. i picked him out because i had met him two months previously in arizona when trump supporters were disputing the result there. i spoke to him. the story he told me seemed at that time so crazy that i decided not to get an interview with him on camera. the story he told was essentially the queue and on conspiracy theory about this —— qanon conspiracy theory. two months later it turned out that story had made its way right into the heart of american democracy. i really set out to try and find the origin of that story and how it made its way into the american psyche. horse story and how it made its way into the american psyche.— story and how it made its way into the american psyche. how far back did ou the american psyche. how far back did you have _ the american psyche. how far back did you have to _ the american psyche. how far back did you have to go, _ the american psyche. how far back did you have to go, i _ the american psyche. how far back did you have to go, i wonder? - did you have to go, i wonder? really, you could go as far back as you would like. we have to take a frame. because of the centrality of hillary clinton, they believe she is the centre of it, we looked at the 19905 the centre of it, we looked at the 1990s and we looked at the conspiracy theories that had arisen there. these are the early days of there. these are the early days of the internet, 93, 94, 95, and we discovered an ecosystem of early chat rooms, right wing talk radio that was deliberately spreading conspiracy theories in that sphere that then sat there and bubbled under the surface for about two decades and erupted again as hillary clinton ran for the presidency. this really was the spark, the grit in the oyster which led to queueing on, which eventually led to those people storming the capital. the other thing we discovered was that there were people who were working on the trump campaign in 2020 who were deliberately trying to harness the power of qanon in order to try to get him re—elected. when the election was over they switched that movement from one about paedophiles into one about a stolen election. to what degree do you think qanon was central to the events of the 6th of january, as opposed to being a motivation for some of those involved?_ motivation for some of those involved? ,, ~ ., ., , ,, ., , involved? qanon has -- q has disappeared- _ involved? qanon has -- q has disappeared. this _ involved? qanon has -- q has disappeared. this was - involved? qanon has -- q has. disappeared. this was supposed involved? qanon has -- q has- disappeared. this was supposed to be the leader of qanon talking about how donald trump would save america from this paedophile ring. q has disappeared. but there has been a convergence between the beliefs of qanon and the beliefs about the stolen election, trump's view that the election was stolen, for which, need i add, there is absolutely no evidence. there might have been isolated cases of electoral malfeasance, but there was no fraud on a scale wide enough to change the outcome. but the fact is, according to recent polls around a third of all americans believe thatjoe biden is an illegitimate president. this narrative, which began with qanon and has now merged with the stolen election theory has got into the american psyche. it is hard to see how you put that genie back in the box. 0nce how you put that genie back in the box. once you have said about one election, that it is not reliable, that it has been stolen, that the electoral system in america is broken, it is hard to see how in future elections people will trust the result. when people don't believe they can change their leaders at the ballot box they start looking for other avenues. 1trier? "today i'm heading down under with an exemption permission. let's go 2022!" so how has djokovic, an elite athlete, received a medical exemption? the list of conditions isn't a long one. in australia you can be deemed medically exempt if you suffer from an inflammed cardiac illness or an acute medical condition. —— from an inflamed cardiac illness or an acute medical condition. if you had any potentially fatal reactions to an earlier vaccine dose. djokovic has never declared his vaccine status publically. so we cannotjudge that. or you can postpone your vaccination if you have tested positive for covid—19 in the last 6 months. we know that djokovic tested positive injune 2020. and he could have tested positive recently. tennis australia said djokovic's application went through two rigorous review panels. here's our tennis reporter russel fuller on the process. these medical exemptions aren't given away lightly. they are treated anomalously, all of the cases, so the panel would not have known it was novak djokovic applying. —— anonymously. it has to be approved by the australian technical advisory group body organisation, and a second panel made up of medical experts has to also give the green light to a player receiving a vaccination. i think that's what people need to have in the back of their minds but at the same time, clearly, people will reach their own conclusions if novak djokovic doesn't shed any further light on the subject, and they may well make their frustration felt. here's what djokovic has said before about compulsory covid jabs. in this facebook live in 2020 with other serbian athletes he said he is "personally opposed to vaccination and wouldn't "want to be forced to take a vaccine in order to to travel." then in an interview with the new york times, he clarified his comments. stating that his "issue is with someone forcing me to put "something in my body that i don't want. "for me that's unacceptable." and in november, his father called australia's mandatoryjab rules "blackmail" and said his son might not play the australian open as a result. well now that he is set to compete in melbourne, we are already seeing reaction from other players. here's seven time doubles grand slam championjamie murray. if it was me, i wouldn't be getting an exemption, but well done to him for getting cleared to come to australia and compete. 0ther other players have made it clear they are happy to play against anybody who has received a medical exemption. novak djokovic's exemption has sparked anger amongst people in australia with a lot of tweets being directed towards the state government. if you would like further reports from me and the team you can find them in lots of places on the bbc. if you are watching in the uk there are a whole array of reports in the new section on iplayer, you can subscribe to audio versions of our explainer is on the bbc sounds app. that's it for this addition. thanks very much for watching. see you tomorrow. all the best. hello. i'm guessing today came as a bit of a shock to the system after that exceptionally warm start that you experienced on new year's days, that exceptionally warm start that you experienced on new year's day, temperatures widely across the uk in the mid teens some up to 16 degrees in a few spots. this afternoon barely a few degrees above freezing. much closer to how it should feel injanuary. tonight, more snow showers across the north of scotland, even strong gale force winds as winds easing a little bit. for many a crisp and sunny start. a few showers in the north of scotland. not many across other western areas. a chance of rain showers over eastern coast of the uk. this is where the strong winds will remain with a bit —— adding a bit to the wind—chill factor. temperatures not far off the average for early january, around four to temperatures not far off the average for earlyjanuary, around four to 7 degrees in most parts of the uk. with clear skies and sunshine to end the day, and lighter winds, it'll be an even colder night to take us into thursday morning. where a few showers linger late in the day, there could be ice around, but it is there could be ice around, but it is the sharp frost into thursday morning, as low as minus six degrees in some parts of england. slightly milder air coming in some parts of england. slightly milderair coming in with in some parts of england. slightly milder air coming in with these weather fronts but they will be pushing into that cold air so we are likely to see snow for a time. getting to lower levels in parts of scotland. on the hills in wales and increasingly so into northern england and the north midlands. turning back to rain as the temperatures rise temporarily, then drop later on, sun and showers in its wake. not quite reaching east anglia until late in the day but even then it stays on the cold side after that frosty start, temperatures around 4 degrees. patchy frost to take us through into friday as that weather system clears. 0n friday as that weather system clears. on friday, sunshine and showers. with the westerly wind, the showers. with the westerly wind, the showers in the west may go over to the east. southern parts should stay bright and dry and temperatures around three to 8 degrees. that's how things are looking. goodbye for now. welcome to outside source. lawyers lawyer is arguing in court that the sexual assault civil lawsuit against them should be thrown out and they say cannot be sued because of an agreement signed by his accuser. the less registered more than a million year coronavirus cases in the past 24 hours sitting in your global record for daily infections. president biden is continuing to urge americans to get a booster shot. the uk has also set a new record surpassing 200,000 daily cases for the first time and boris johnson has this message. we cases for the first time and boris johnson has this message. we have a aood johnson has this message. we have a good chance — johnson has this message. we have a good chance of— johnson has this message. we have a good chance of getting _ johnson has this message. we have a good chance of getting through i johnson has this message. we have a good chance of getting through the i good chance of getting through the omicron wave without the need for further restrictions or
