Thirteen years after Lt. Colonel Prasad Purohit was arrested in the 2008 Malegaon blast case, involving right-wing extremists, the officer relied on fresh documents allegedly from the Army before the Bombay High Court to substantiate a decade old claim that his acts were in discharge of his official duty.
Purohit s claim is that he attended conspiracy meetings before the 2008 Malegaon blast while discharging his duties as an army intelligence officer and therefore sanction under Section 197 CrPC is needed to prosecute him.
A division bench of Justices SS Shinde and Manish Pitale was hearing Purohit s challenging the trial court s decision to take cognisance of the charge sheet filed against him in the absence of a sanction from the central government u/s 197(2) of the CrPC.

MUMBAI/BHOPAL: Member of Parliament from Bhopal Sadhvi Pragya Singh Thakur was airlifted from Bhopal and flown down to Mumbai where she was admitted to a super-speciality hospital on Saturday evening. She reached the private hospital around 6pm on Saturday.
The BJP MP, is facing a trial as one of the accused in the September 29, 2008 Malegaon blast case before a special National Investigation Agency (NIA) court in Mumbai.
She had appeared before the NIA court on January 4 and had said that she had certain health issues and medical tests were lined up. The special court granted exemption from personal appearance on health grounds on a plea by her defence counsel J P Mishra.

BJP MP Pragya Singh Thakur was airlifted to Mumbai for treatment on a chartered plane after she complained of difficulty in breathing on Saturday.
The Bhopal MP is admitted to the city s Kokilaben Hospital, the MP s office informed.
Last month too, the BJP MP was admitted to Kokilaben hospital.
