PITTSBURGH – Litigation between a Western Pennsylvania woman and a pair of elevator manufacturers, over the plaintiff’s being trapped inside a pair of elevator doors due to a faulty sensor, has been settled.
Katherine L. Gardone of Monroeville first filed suit in the Allegheny County Court of Common Pleas on Aug. 7 versus Schindler Elevator Corporation of Morristown, N.J. and Walnut Ivanhoe Partners, LP, also of Monroeville.
“Upon information and belief, defendant Walnut owned, maintained and controlled real property located at 4175 Ivanhoe Drive, Monroeville, PA 15146. Schindler owned, maintained and controlled the elevator located there and built, installed, and maintained that same elevator,” according to the lawsuit.

PITTSBURGH – A Wyndham hotel alleges that it does not know how a hypodermic needle was found in one of its beds and struck an Ohio plaintiff, a needle the plaintiff claims potentially exposed her to HIV.
Dr. Elizabeth L. Bonds and Bryan Timpe of Columbus, Ohio first filed suit in the Allegheny County Court of Common Pleas on May 29 versus Wyndham Pittsburgh University Center of Pittsburgh and RLJ Lodging Trust, of Bethesda, Md.
“On Dec. 9, 2018, Dr. Bonds was an overnight guest at the Wyndham Pittsburgh University Center, staying in Room 229. When Bonds proceeded to get into the bed, she felt a pain in her left foot. Bonds removed her sock and discovered that the tip of a hypodermic needle was stuck in her foot. Bonds notified hotel management and an incident report was completed,” the suit stated.

PITTSBURGH – Pepsi denies all responsibility for injuries suffered by a Western Pennsylvania man, who claims that a company employee collided into him while pushing a cart full of products in a Getgo supermarket in Pittsburgh, leading him to fall and become seriously injured.
Michael Connolly of Oakmont first filed suit in the Allegheny County Court of Common Pleas on Dec. 9 versus Giant Eagle, Inc. (doing business as “Getgo”) and Chad Fink of Pittsburgh, plus Pepsi Co., Inc. of Purchase, N.Y.
“On June 11, 2020, at approximately 11:30 a.m., plaintiff was a business invitee, licensee and/or otherwise legally on defendants’ premises. While on defendants’ premises of the Getgo, the plaintiff was struck by a Pepsi Co., Inc. employee pushing a dolly cart of products, located near the entrance/exit. The contact caused plaintiff to fall to the ground, causing serious and permanent personal injuries,” the suit stated.

PITTSBURGH - Eastern Area Special Schools of Monroeville is seeking damages from the parties responsible for an allegedly botched roofing job done at its campus, according to documents filed in February the Allegheny County Court of Common Pleas.
In June 2012, Siemens Industry Inc. was hired by the plaintiff to install a new roofing system. Siemens was tasked with repairing and recoating the existing roof, installing a polyurethane foam and silicone topcoat layer, adding a seven-drain runoff system and replacing delaminated areas of the subroof.
Siemens used roofing system components manufactured by BASF Corporation for the project; this defendant provided a 15-year guaranteed warranty for the components.

PITTSBURGH – A health care company has been dismissed from a wrongful death action initiated by an Allison Park woman, who alleges that a variety of nursing care facilities and other parties committed collective negligence led to the death of an elderly man.
Carrie M. McCarthy (as Administrator of the Estate of Robert Herman Fritz and on behalf of the Wrongful Death Beneficiaries of Robert Herman Fritz) of Allison Park first filed suit in the Allegheny County Court of Common Pleas on Dec. 28 versus Arden Courts of North Hills of Pittsburgh, and others.
“Robert Herman Fritz was a resident of Arden Courts of North Hills, from Nov. 13, 2015 through Nov. 27, 2019, and suffered various injuries while a resident there including, but not limited to, falls and a fractured hip, which contributed to his death on Feb. 13, 2020,” the suit stated.
