City of Clairton refusing to pay contractors for roadwork project, suit says

PITTSBURGH - The City of Clairton, along with its engineering firm, KLH Engineers, Inc, is facing charges in the Allegheny County Court of Common Pleas from a general contractor who says the city is refusing to pay costs owed for a roadwork project. According to a February complaint, Independent Enterprises, Inc, was hired by Clairton to mill and resurface certain city roads. Independent Enterprises entered a contract with Clairton for the project with terms to pay a total of $625,515.60 in payment plans.  The contractors reportedly encountered situations that added expenses to the project, and presented the claims and requests for payment to the city. The contractor successfully completed the project without payment being made by the city. 

Suit says natural gas company failing to turn off its service exacerbated fire at Penn Hills property

Stutman PITTSBURGH – Litigation has been launched against a natural gas company, whose alleged negligence in failing to turn off the gas supply to a Penn Hills building allegedly exacerbated the effect of a structure fire which took place at the property. The Travelers Indemnity Company of America and Travelers Casualty Insurance Company of America of Hartford, Conn., Churchill Center, LLC of Pittsburgh and Big Shot Bob’s Penn Hills, LLC of Penn Hills filed suit in the Allegheny County Court of Common Pleas on Feb. 16 versus Peoples Natural Gas Company, LLC and Peoples Gas Company, LLC, both of Pittsburgh.

Injured Family Dollar shopper update: Judge refuses to strike recklessness allegations from complaint

Gee | Post & Schell PITTSBURGH – An Allegheny Court judge has denied objections made by Family Dollar that a Pittsburgh man injured in one of its stores did not adequately plead allegations of recklessness, and ordered the retailer to answer the complaint. Charles Lyles of Pittsburgh first filed suit in the Allegheny County Court of Common Pleas on Oct. 30 versus Family Dollar Stores of Pennsylvania, LLC of Chesapeake, Va. and Family Dollar Store No. 1982, of Pittsburgh. Lyles averred he was shopping in the subject store on April 9, 2019, when the dangerous condition presented itself and the subject incident took place. “This aforesaid dangerous condition consisted of a box/crate/tote and/or otherwise a dangerous trip hazard in a walkway and/or pedestrian pathway that created an unsafe, uneven condition upon the site and a neglect to have said situation fixed, repaired and/or otherwise properly remedied. State court judge overrules objection in home damages action against Pittsburgh Water & Sewer Authority

Fouse | Clark Hill PITTSBURGH – A state court judge has overruled preliminary objections from the City of Pittsburgh’s Water and Sewer Authority, in a lawsuit from a pair of Pittsburgh landlord-tenant neighbors who alleged that it defectively designed and later failed to repair a deteriorating storm sewer culvert – which caused storm water runoff to flow into the plaintiffs’ residences. Sandra C. Hill and Alan Ricketts first filed suit in the Allegheny County Court of Common Pleas on Dec. 7 versus the Pittsburgh Water and Sewer Authority. All parties are of Pittsburgh. “Plaintiff Hill is the lawful owner of a duplex (multi-family home) on property located at 8882-8884 Frankstown Road, Allegheny County, Pittsburgh, Pennsylvania 15235. Plaintiff Ricketts is a tenant who resides in the subject property,” the suit said.

Erie Insurance refutes defenses of dehumidifier manufacturer in suit over $360K house fire

Ziccardi | Gaul & Associates PITTSBURGH – An Erie insurance company is seeking to repudiate defenses put forward by the manufacturers of a dehumidifier, which allegedly caused a fire leading to nearly $360,000 in property damages. Erie Insurance Exchange (as subrogee of Ellen Marino) of Erie initially filed suit in the Allegheny County Court of Common Pleas on Dec. 15 versus Gree USA, Inc. of City of Industry, Calif., John/Jane Doe of Monroeville and ABC Corporation. “On or about Oct. 15, 2019, a dehumidifier manufactured, assembled, sold or distributed by defendant (hereinafter referred to as “dehumidifier”) malfunctioned, failed and caught fire resulting in fire, smoke and other damages to plaintiff’s insureds,” the suit stated.
