Shelton man found not responsible for burning down North Shelton Zion Lutheran church

Kim Schmidt Kearney Hub KEARNEY — A judge has ruled a Shelton man is not responsible for burning down the North Shelton Zion Lutheran church by reason of insanity.  Mathew Poehler, 40, of Shelton, was charged with second-degree arson in Buffalo County District Court after the church was destroyed by fire on Dec. 11, 2019. Judge John Marsh made his ruling Thursday. Mat Poehler Marsh ruled Poehler s acts in burning the church were intentional; however, there was adequate proof to side with an insanity defense. During a 15-minute bench trial Monday before Marsh, Poeher s attorney, James Martin Davis, presented a report from Dr. Terry Davis, a forensic psychologist from Omaha who evaluated Poehler and said he had bipolar schizoaffective disorder at the time of the fire.

CUSTER COUNTY With Custer County District Judge Karin Noakes in quarantine, cases were held remotely on Thursday, January 21. The first criminal case of the morning was Trenton Esch, 44 of Broken Bow, who is facing alleged charges of first-degree murder (class IA felony), use of a firearm during the commission of a felony (class IC felony), and possession of a firearm by a prohibited person (class ID felony). During the telephonic hearing, Esch’s attorney, James Martin Davis, asked the court to continue the case as depositions along with other trial matters had not been completed by Davis or Special Deputy County Attorney Michael Guinan from the Nebraska Attorney General’s Office.
