The judgments denying bail to Jyoti Jagtap and Umar Khalid – from the Bombay and Delhi high courts respectively – reveal that UAPA adjudication continues to be inconsistent and judge-centric.
The Allahabad high court said no incriminating material was recovered from the possession of Mohammad Alam. He is the first out of the eight accused in the conspiracy case to be granted bail.
The Delhi high court was referring to a speech delivered by the scholar-activist Umar Khalid in Amravati in 2020, while hearing his appeal against refusal of bail.
The court granted bail to one accused person as he was a member of the group Al-Hind which is not banned and had attended meetings, while denying bail to the other as a prima-facie case had been made out against him.
