Supreme Court of the United States’ recent groundbreaking decisions related to affirmative action in college admissions and the standard for religious accommodation under Title VII of the Civil Rights Act of 1964.
The Pregnant Workers Fairness Act, PWFA, expanded Title VII’s existing protections on pregnancy discrimination. Under the PWFA, employers must now provide reasonable accommodations to pregnant workers for known limitations related to pregnancy.
In Groff v. DeJoy, the Supreme Court raised the bar for employers assessing employee religious accommodation requests. The unanimous Supreme Court termed its ruling a clarification. Further litigation will provide guidance on how the clarified standard plays out.
