A wrongful death lawsuit is being filed in federal court in the case of 13yearold andy lopez. He was carrying a fake gun when he was shot and killed by a Sonoma County sheriffs deputy. Today here in San Francisco, the family filed a federal civil rights lawsuit against the deputy who opened fire on that teenager as he was holding a replica assault rifle. Nearly two weeks after andy lopez was shot and killed by a Sonoma County sheriffs deputy, a federal lawsuit claims his death was unconstitutional. Lopez was carrying a replica of a gun that turned out to be a bb gun. Gelhaus shot lopez seven times. The lawsuit claims he was walking with the toy gun and had his back to the deputy who ordered him to drop the weapon. The lawsuit suggests improper training by the department. It reads, the Sheriffs Department encourages deputies to prematurely shoot suspects who pose no threat. Toda
