A wrongful death lawsuit is being filed in federal court in the case of 13yearold andy lopez. He was carrying a fake gun when he was shot and killed by a Sonoma County sheriffs deputy. Lz also alex savidge has more. Reporter andy lopezs parents called the shooting unreasonable and unjustified. Today here in San Francisco, the family filed a federal civil rights lawsuit against the deputy who opened fire on that teenager as he was holding a replica assault rifle. Nearly two weeks after andy lopez was shot and killed by a Sonoma County sheriffs deputy, a federal lawsuit claims his death was unconstitutional. Lopez was carrying a replica of a gun that turned out to be a bb gun. Gelhaus shot lopez seven times. The lawsuit claims he was walking with the toy gun and had his back to the deputy who ordered him to drop the weapon. The lawsuit suggests improper training by the department. It reads, the Sheriffs Department encourages deputies to prematurely shoot suspects who pose no threat. Todayant activist working with the lopez family talked about this. The family filed the suit because they feel their son was murdered by sheriff gelhaus. And that, you know, as it will be stated in the documents, its a wrongful death. Reporter this is an unlimited civil claim seeking unspecified damages. The suit comes as the criminal investigation continues. The Santa Rosa Police department is heading up that inquiry and the fbi is also investigating. An attorney representing Sonoma County told ktvu the filing of a civil lawsuit before the criminal investigation is unusual. Lopezs parents and their attorney conducted their investigation into the shooting and their own autopsy and they will discuss the findings during a News Conference set to begin at 1 00 this afternoon inside the Office Behind me in San Francisco. It happened overnight in the area of Market Street and octavia boulevard, considered one of the busiest and dangerous intersections in the city. Brian flores is at that intersection with what weve learned about the victim. Good afternoon, brian. Reporter good afternoon, tori. Weve been keeping in touch with the medical examiners office. At this point, they have yet to positively identify the victim. They are currently looking at fingerprints to obtain a positive i. D. An intersection considered one of the busiest, if not the most dangerous, many say despite recent changes that they are not surprised that this continues to happen. This accident happened harnd midnight. The man in a wheelchair was trying to cross market when police say the driver of a car hit him as he was making a right turn from southbound 101 to market. The driver stayed at the scene for several hours and from video he appeared shaken up and coherent. He lee he looked to be wearing a Security Guard jacket. 56 collisions occurred at this intersection according to records. Despite camera being on last friday and a norightturn sign, commuters say safety issues continue. Ive seen that in general. Ive seen it on well and market on beale and market and he died as well. Its sad. If you reduce the number of cars, where are they gonna go . I dont know what could be done quite honestly. Maybe an overpass or an underpass or something. Reporter now, at this point, investigators say they will be reviewing the footage from the video cameras in their investigation. These cameras went live pretty recently on november 1st. As we take it back out here live, the sign was put out here recently, the violations will cost drivers 238. All right. Thank you, brian. The man accused of killing a federal investigator appeared in an oakland courtroom a few hours ago for a preliminary hearing. Randy alano faces life in prison without the possibility of parole if convicted of killing san drew coke. Police found her body in vacaville back in august nearly a week after she was reported missing from her oakland home. Investigators say the man met coke about 20 years ago when he was intarscated at san incarcerated incarcerated at santa rita jail and they dated briefly. New information about the man accused of opening fire at l. A. X. Police say paul ciancia texted his family on the morning of the shooting that he was going to kill himself. Los Angeles Police officers got to his apartment 45 minutes after he left for the airport. Police say ciancia killed one tsa screener and wounded two others and a passenger. Some are calling for better security at tsa checkpoints. Part of that investigation will be a review of the security measures that were in place not only at l. A. X. But i think a review of the security arrangements that exist in other airports as well. Police officers shot ciancia four times. Hes heavily sedated following surgery for his wounds and is currently under 24hour guard. A new study from uc berkeley raises concerns about the outsourcing of airport workers. According to the study, the share of airport workers outsourced to contractors grew from 19 in 2001 to 26 by 2011. During the same period, airport workers saw their hourly wages fall by an average of 15 . The study says the airport workers declining pay affects airport efficiency, safety and security. The study was financed by the Service Employees international union. Stricter gun control laws may be coming to sunnyvale if voters approve a measure tomorrow. Reporter a year after the shooting at Sandy Hook Elementary School in connecticut, sunnyvale mayor is leadth push for stricter gun control here. I guess it was a low crime rate in newtown, too. Reporter measure c requires a gun owner to tell police within 48 hours if their gun is lost or stolen. It prohibits ammunition magazines that can hold more than ten rounds. Gun owners are required to lock their guns away ifs firearms are not in their immediate possession firearms are not in their immediate possession. Not the way to do it. Reporter they would be required to maintain ammunition sales. Those prohib interred from owning guns would be deterred from purchasing ammunition. This establishes distance restrictions between gun stores and mark parks parks and schools. If approved, owners and employees would have to pass background checks and stores would be required to install alarm systems and surveillance cameras. Two battling a house fire discovered multiple Marijuana Plants in the home. Firefighters arrived at the home on altamont road in unincored unincorporated san leandro. Newschopper2 was overhead. Everyone was able to get out of the house. One person was hurt but fire officials dont know the extent of the injuries. The district says they will be used to keep kids safe, secure school sites and discourage any damage to School Property. Its not just vandalism. But theres actual breakins and loss of School Property or destruction of School Property. Sometimes it can be graffiti on the walls. The district is paying more than 120,000 to install the cameras. Last year, it spent about 177,000 on security cameras at two of its high schools. Looks like there is enough support in the senate to pass legislation that would keep most employers from discriminating against gay and lesbian workers. Ktvus Kyla Campbell explains how the bill would protect workers and who is pressuring lawmakers today. Reporter the senate is expected to vote later today. This bipartisan bill would keep employers with 15 or more workers from hiring, firing, compensating or promoting employees based on their Sexual Orientation or gender identity. Its the first major piece of gay rights legislation since congress entered the ban on gays serving open in the military. In washington, im Kyla Campbell, back to you. San Francisco Police hope a surveillance photo will help them find a missing brazilian sturnt. The photo was taken on halloween on 16th in the mission. It shows a man using a credit card belonging to 23yearold paulo netto. Several days earlier, his mother and sister say they received a panicked call from netto who has been missing for a work and he says people were following him and he was in trouble. Police in davis are investigating what appears to be an attempt to blow up a fraternity house. Students reported smealing gas around 1 00 yesterday afternoon and investigators determined that someone had intentionally created a gas leak and then had lit a fire to try to ignite the gas. Police say the explosion could have leveled the home and others nearby. So far, no arrests have been made. There are already traffic concerns ahead of tomorrows grand opening of the graden casino in rhone et park. Its expected to bring in 500,000 a year as well as draw 40,000 more cars to the area. The chp is making plans to prevent a traffic backup on highway 101 from the streets surrounding the resort. The Coliseum Authority wants the as to sign a five to eight year lease while the team and mlb would like two years. That would give the team an out if it finds a new today yim to play at. We have no advisory in place but i want to show you some areas, livermore reporting 14 miles per hour. Hayward reporting 14. San jose reporting 12 and the gusts to 20, 25 at times. A breezy afternoon in store with temperatures warmer than what we had yesterday. 21 reported at the airport in fairfield. I should say at the air force base in fairfield and gusting to about 30. That north breeze is going to continue. If i step way back, i can show you why. Ridge of High Pressure will strengthen and build its way toward the west coast. Sections of the old eastern span of the bay bridge are scheduled to start being dismantled this week. Crews have been preparing to tear down the old structure since the new span opened on labor day weekend. The demolition has been divided into three parts with large sections expect gd to be removed this week. The complete dismantling is expected to take three years and cost 239 million. This morning, the once uber popular smartphone maker announced a 1 billion Investment Agreement with fairfax. It also announced that the ceo hines will be stepping down and john chen will serve as interim ceo. Analysts say twitters initial public Stock Offering could now raise more than 2 billion. Regulatory filings show that twitter plans to price shares between 23 and 25. Thats a big jump from the original projected price of 17 to 20 a share. Market watchers expect twitter shares to start trading thissing with. And San Francisco mayor ed lee toured the stretch of Market Street where twitter has headquarters.
