The Delhi High Court recently observed that absence of a law making adultery an offence does not provide people blanket immunity from marrying other persons during the subsistence of first marriage.
The High Court of Jammu and Kashmir recently stayed a Jammu court order to register an FIR which, among other offences, cited "adultery" as an offence, despite the Supreme Court decriminalising adultery in 2018.
The top court said its 2018 judgment striking down Section 497 of the Indian Penal Code was not concerned with the provisions of the armed forces Acts.
