though the prior d.a., bruce castor, declined to prosecute many years ago, that mr. steele s decision to prosecute is based on new evidence. in other words, some of the deposition that was released from the andrea constand lawsuit in which mr. cosby testified under oath, that in that deposition, he testified that he did give quaaludes to some women with intent to have sex, although his attorneys objected to his answering, did he do that without their knowledge and consent? so he never answered that. he did testify that he gave pills to andrea constand. he said that was bebenadryl. right. he apparently, just in shorthand summary, that he never heard her say that she didn t want him to touch her in a sexual way. of course, if she was incapacitated by the drugs, which is what the district attorney alleges, then if that
where a former employee who has gone public with her accusations. cosby said the contact was consensual. the defense he has used as dozens of women made similar accusations. back with the panel. kirsten, start with you. he said it was consensual. he also admitted in deposition he had procured quaaludes before drug other women. he admitted he gave this woman benadryl he says. he has admitted to drugging women and having relations with them. and i think that this is, you know, this is very sick stuff, really, when you get right down to it. this is somebody we all know as this beloved figure that we all grew up with who was preying on women up to 50 women. and i think it s also some people have suggested why didn t these women come, you know, come out sooner talking about this, and i would say i think that our attitude toward sexual assault has really changed over the years.

well, first of all, we have let s start with number one. they claim that they were given drugs, and then taken advantage of by mr. cosby. mr. cosby has admitted, he got prescriptions, not for his own use, but to use with other women. quaaludes. controlled substances. a sedative that knocks you out. makes you incapable of consentsing consents i ing to anything. that s number one. number two, he said at least to terrese, one of the seven women i represent, that he had sex with her after he gave her the quaaludes. that s what she says, too. when asked, did she consent, he says, i don t know. but she knows i didn t consent. so i don t know how much farther you have to go beyond that.
it is only because of that deposition from a civil trial ten years ago that we know that bill cosby does say that there was some sexual contact. without that deposition being admissible, the case would be a whole lot more difficult. it would still be a case, but you re absolutely right. that s why the first d.a. who investigated it didn t go forward with it. i think it functions on two levels. one, it s sort of the broad, global view. you say, 50 women say he did this to them. all right. in a very similar way. then you look at this individual case and you say, god, she must be telling the truth. now let s fast forward and try this case individually miss constant didn t report this for one year after she said it happened. monique presley, his unique, very aggressive defense lawyer says, you know something, quaaludes were taken off the market by the fda in 1985. this is 2004.
