The Court noted that the allegations were mostly against another person, one Amalendu Chattopadhyay, who was the then State General Secretary (Organisation) of the party.
Before the controversial release of the convicts in the case on August 15, they were out of jail for nearly or over 1,000 days each – on parole, furlough and temporary bail.
The court also took a poor view of the State for not having appealed against the leniency in the trial court's order, stating that the lethargy of the public prosecutor was deplorable.
