The Crown was originally proceeding by Indictment against Leschinski, which is the more serious charge. Prosecutor Scott Bartlett, however, told the court that Leschinski’s parents offered to pay to send him to a drug treatment centre - The Village of Hope - in New Brunswick. Bartlett said that since the Crown had proceeded by indictment, Leschinski wouldn’t qualify for a Conditional Sentence Order (CSO) to be served in the community, allowing him to go to the drug treatment centre. So, to facilitate this, Bartlett asked the court to expunge Leschinski’s guilty pleas so the Crown could re-elect Summary Conviction, the lesser serious charge, which would allow him to serve a CSO rather than going to jail.

Swiftwolfe appears in N B court from Sask Pen on murder charge

Legal aid lawyer Cara Hill told the court she hasn’t been able to reach Swiftwolfe by phone inside the Saskatchewan Penitentiary. She asked for an adjournment to give her time to talk to him. Crown Prosecutor Oryn Holm agreed to the adjournment until Aug. 5 saying the Crown has minimal disclosure. Swiftwolfe was arrested July 7 at the Saskatchewan Penitentiary where he is currently serving four years on weapons charges, uttering threats, assault, evading/fleeing from police, and dangerous driving. Cassandra Fox, 24, is also charged with first-degree murder in Ham’s death. She was arrested at Pine Grove Correctional Centre July 5. She had a show cause hearing scheduled in North Battleford Provincial Court July 9 on charges in another incident but the hearing didn’t proceed. Her next court appearance is Aug. 5.

Two accused of killing Damian Moosomin have court appearances

Partridge and Blackbird’s attendances were waived in North Battleford Provincial Court July 6. An agent for Partridge’s lawyer asked the court for an adjournment to go over new disclosure defence received. The court heard that more disclosure is expected. Disclosure consists of the Crown’s case against the accused and usually includes search warrants, the charging document, details of the offence, audio/video and transcribed witness statements, statements from the accused, expert reports, exhibits, private communication intercept authorizations, evidence, and criminal records of witnesses and the accused. Stormy Wapass-Semaganis, 23, from Edmonton, Denver Roy, 36, from Sweetgrass First Nation, Melissa Semaganis, 41, from Poundmaker First Nation, and a young offender who can’t be identified in accordance with the Youth Criminal Justice Act were also charged in connection to Moosomin s murder.
