Comments filed for proposed Marsy's Law procedural rule – The Florida Bar

Mar 09, 2021 By Gary Blankenship Senior Editor Top Stories A proposed procedural rule implementing the 2018 Marsy’s Law victims’ rights constitutional amendment should be adopted, according to comments submitted to the Supreme Court. The court received only two comments as well as a response from the Rules of Judicial Administration Committee on the proposed new Rule of Judicial Administration 2.423. One comment from the Florida Court Clerks & Comptrollers supported the proposed rule and the second, from a coalition of news organizations, urged support with some changes, subject to court rulings interpreting the amendment. In response, the RJAC urged the court to adopt the proposed rule, noting neither comment expressly opposed it.

Some rules updates questioned by probate lawyers

Feb 12, 2021 By Gary Blankenship Senior Editor Top Stories Supreme Court justices raised the possibility of sending at least part of a rules package back to committee because of an ongoing dispute over how it could affect filings by probate practitioners. The court held oral arguments February 11 on Rules of Judicial Administration amendments that focused on keeping pace with an electronic instead of paper-based court system. The amendments for the first time include the Florida Courts E-Filing Portal in the rules and also address electronic signatures, including by court officials, and e-service matters. Committee studies the electronic filing of exhibits

Korn With more and more court proceedings, including trials, being conducted online, the Bar’s Rules of Judicial Administration Committee will be looking at how exhibits, which used to be carried to the courtroom, can be submitted electronically. The RJAC briefly discussed the issue at its January meeting and committee member Tom Hall, liaison to the Florida Courts Technology Commission, updated the FCTC at its February 5 meeting. In a separate interview, RJAC Chair Michael Korn said the issue is being assigned to a subcommittee and he hopes to have a report ahead of the committee’s next scheduled meeting in June.
