City Attorney John Henley noted that Casper police officers are able to cite people for violations of the state law regardless of what Casper has on the books.
Council member Kyle Gamroth asked if there is any advantage to having the rule on Casper’s books versus relying only on state statutes.
Henley said a main difference is that having a rule within the Municipal Code would allow police officers to cite people into Municipal Court. Relying only on state law, people are cited into Circuit Court for violation of the minimum age rules.
Council member Bruce Knell said he didn’t see any reason why Casper shouldn’t align the Municipal Code with state law. He asked for Police Chief Keith McPheeters to comment on the issue.
