In March 2021, Waa sought leave to appeal his conviction for murder at the Court of Appeal, arguing the jury in his murder trial were misdirected by a jailhouse informant. He claimed the judge s directions concerning Witness A – a prisoner who gave evidence at his trial – were deficient. He claimed his trial should have been heard separately to his co-defendant Cullen, and said references Witness A made to another murder – that of Red Fox Tavern publican Chris Bush in 1987 – were highly prejudicial and inadmissible.
