The District Court held appellees would be injured because illegal aliens will be chilled from participating in the enumeration. But that counting is now over and whatever chill ever existed has odd thawed. Appellees therefore pivot to possible future injuries but as of this morning career experts at the Census Bureau confirmed with me that they still dont know even roughly how many illegal aliens they will be able to identify, let alone how their number and geographic concentration may affect apportionment. And if they dont know, certainly the other parties of the case do not david the court should therefore follow the course charted out by the District Court judge last week, vacate the judgment below, allow the secretary to comply with the memorandum, and allow any effect on apportionment to be litigated as it normally would be. Is no merits, there procedural problem with the memorandum. The directionmade in two sets of numbers to decide the numbers being the real fight is substantiv
Thank you. Thank you. [ cheers and applause ] thank you so much. Thank you. Thank you so much. You just have no idea how warmi warming, how generous, your affection and im gratified by it. Im sorry we got here a little bit late and a little bit short. Earlier today i spoke to president bush and i offered him and laura our congratulations on their victory. We had a good conversation. We talked about the danger of division in our country and the ne need, desperate need finding Common Ground and coming together. Today i hope that we can begin the healing. In america it is vital that every vote count and every vote be counted. But the outcome should be decided by voters, not a protracted legal process. I would not give up this fight if there was a chance that we would prevail but it is now clear that even when all the provisional ballots are counted, which they will be, there wont be enough outstanding votes for us to be able to win ohio. Therefore, we cannot win this election. My friends,

Mr. Kennedy a radio wave is nothing more than electromagnetic radiation moving through the air. Thats all a radio wave is. Think of it as a imagine a pond, and think of a radio wave as a ripple or wave in that pond. The wave goes like this and has a peak and a valley and peak and a valley, and eventually it gets shorter and shorter. Thats what a radio wave is. And there are different kind of radio waves.
