whatever coalition is willing to attack isis, and to eliminate this terrorist threat. that means they ll stay partners. it means european partners. it may mean russia. but russia sure complicates the options that we have in syria, with the amount of aircraft, with the amount of arms that they have there. if we can focus those on isis versus the moderate opposition forces that are trying to defeat assad, we would make a real impact. but that s going to take a great deal of diplomacy that we have yet to see. there are been some interesting developments on intelligence issues really in the last week and i want to talk to you about those. today, at midnight, the nsa s bulk data collection of american phone records, that program expired as of midnight this morning. and now the nsa is going to need a court order from a judge to collect records on any american, and again we re not talking

month or two ago. there was not that buzz so cruz is gaining mind share among republican primary voters. carson is losing it i think partly because of the questions about his foreign policy acumen and the events overseas. people don t see him as tough enough. they like he s a healer. they like he s a uniter but he doesn t have that machismo that trump has. and that cruz has to some extent. tomorrow, bulk data collection of the nsa ends. it totally ends. it s totally changed. ted cruz is on one side of the issue, marco rubio on the other. marco rubio supporters, the super pac, 501(c)(4) have hit cruz on this. is cruz vulnerable? yes, he is. and the debate on the 15th in which i m a panelist, that will come up. if i have any hope to turn that towards a national security focus, that is a major deal. the french were not able to follow up, with the best homeland security in europe, were not able to follow the terrorists who attacked paris and the collection of metadata will matter.
whatever assistance it can so it s going to provide the information that it has. but brings us back to the same point we were just talking about. the u.s. intelligence is only going to be as good as our sources are. and i suspect frankly that that s inadequate right now. an issue that has come up in relation to this the fact that bulk data collection here in the united states expires tonight at midnight. what impact does that have on the war on terror and on investigations like this? i m not sure that the bulk data collection is really the key to stopping this. we are still collecting a lot of signals intelligence and a lot of interceptions, what s missing from the equation more than an electronic intelligence is human sources, that s the big gap for all of the western intelligence agencies is people inside isis. so when it comes to infiltrating this network, is there more that the u.s. could be doing? i know we re not in the lead on
reversed an earlier ruling that s found the nsa s bulk collection of millions of americans phone data was illegal. pete williams has details on the ruling. pete, forgive me. i said florida but i don t think i was correct on that. i ve got erika on the brain. bring us up to speed about this ruling. right. washington, d.c. what happened here, first thing, this changes nothing. okay? nothing is going to change as a result of w457d today. 2013, the end of the year, a federal judge said that the program is unconstitutional. this is the bulk data collection the nsa is collecting on all phone calls, the meta data number called and so forth. he put a hold on his ruling and that, the government appealed to the federal court of appeals. and today the court of appeals said we are going to lift that stay, we re going to send the case back to the trial judge to try again. two of the judges said that the people who sued here don t have any legal right to sue because
