Well, alison its only been three days since that train filled with smoke and had to be evacuated and already tomorrow the very first lawsuit will officially be filed. Now, the man filing that lawsuit, his name is malbert rich, a 53yearold new yorker who according to his lawyer was just released from the Georgetown University hospital. He says he is suing to make metro safer. Now, he said hed also like some compensation though he wouldnt say how much and wouldnt discuss his injuries. But what he would discuss is that he believed that he was going to die when that train filled with smoke. He even sent a goodbye text to his mother and two of his children. Drivers. In leesburg very picturesque and had that snow globe effect for most of mid morning and early afternoon. We were on the roads in ashburn, chantilly and herndon as well. Drivers were taking it easy and driving with caution. That was good news. Vdot had 800 plows treating and salting the roads across Northern Virginia. Did seem like they were all over the place. Drivers we spoke with said that the roads seemed fine but they were hoping for a smooth rush hour. A little skittish maybe, yeah. I think its because its whiting out a little bit for people. Say if this was an accident or not but one person is confirmed dead today after their vehicle went in to what metropolitan police described to be 10 feet of water in the potomac. Reporter emergency crews are seen trying to revive the victim but it was apparently too late. Police tell us the person who saw this happen was a dc duck operator. The witness called in and basically stated that he saw a vehicle in the water 3 4ths of the way submerged and one person was seen, the silhouette of a person. Reporter a k9 unit surrounded the area to make sure there wasnt a second person who maybe jumped or fell out of the vehicle. We have Violent Crimes unit detectives respond to the seen as well as our major crash unit responding just to determine what we got, what likely happened. Based on what we know that had happened.
