Treaty and that treaty contained a specific provision that expressly states that we shall have a delegate in the u. S. House of representatives whenever Congress Takes provisions for the same and it was earlier in 1785 speaks about the deputy but 1835 treaty is the most clear. Our 1866 treaty which is the last treaty that we had with the United States reaffirmed our prior treaties. Both of those treaties ratified by the senate and were signed by president andrew jackson. And so, that is the background and basis for the treaty rights. Fastforward to the Cherokee Nation tribal constitution which has a provision that requires the principal chief to appoint a delegate to serve in the u. S.
