York Board of Appeals taking more time on Gammon land use dispute

YORK, Maine  Fifty-four months have passed since the town s Board of Appeals sided with neighbors who claimed Gammon Lawn Care s operations at 650 York Street are impermissible. Fifty-three months have passed since the BOA issued written findings of fact that contradicted the board s own verbal decision with regard to the business owned by Josh Gammon. Eight months have passed since the Maine Supreme Judicial Court sent the dispute back to the town to fix the discrepancy between the BOA s verbal and written decisions. Now the BOA is taking another month to consider its next steps. The long-running land use dispute was back on the BOA s agenda Wednesday night, but when the matter came up for discussion, the members quickly decided to punt it to their next meeting, on Feb. 24.

York Board of Appeals to revisit Gammon Lawn Care property dispute

YORK, Maine  A full eight months after the Maine Supreme Judicial Court sent a long-running land use dispute back to the town for further proceedings, the York zoning Board of Appeals is slated to consider the matter again this Wednesday. The BOA will discuss the court s remand related to Gammon Lawn Care s operations at 650 York St., according to a meeting agenda released Friday. The meeting will be held via Zoom video conference due to the pandemic. No public comment will be allowed related to the Gammon property dispute since this matter was remanded by the court, the agenda states.  That s just how remands are, BOA Acting Chair Joe Carr said Friday.
