Anyone who owns or controls a building with a cooling tower is required to test and disinfect their cooling tower. We have just learned that the death toll is now up to 10. The number of cases is at 100. Eyewitness News Reporter marcus solis is in the melrose section of the bronx with the latest update on the story. Marcus . Reporter dare and shirleen, the number of cases has slowed. Only three new cases but two of them fatalities. To make sure that the outbreak is under control, a new Health Department order regarding those cooling towers which are at the heart of this outbreak. Building owners will be required to test the cooling systems within 14 days and failure to comply will be considered a misdemeanor. The mayor announcing the numbers r number of cases in the the number of cases in the bronx has hit triple digits, 100 and ten fatal. The state Health Commissioner was in the bronx with ruben diaz touring complex concourse plaza. The state has been doing the lab testing for the city and will now provide the testing for free for building owners, testing that is now mandatory. The order instructs the owners or managers to test and disinfect their cooling tower within the next 14 days. Failure to the commissioners order is a misdemeanor. We are doing this out of an abundance of caution. Everyone understands that the outbreak has been limited to one community in our city. And the mayor emphasizing that most buildings in the city dont have cooling towers. They feel they have the outbreak under control. This is a significant changing forward. Much more at 5 00. Newark changed the arrival pattern so we can get to the east side of the newark penn station. You can see the Fire Department activity on the tracks. This is just outside of the station. If you look closely, right over here, you can see there is still smoke billowing out through the area, not a tremendous amount but enough smoke that they are going to have to remain with Service Suspended through the area. You can see the scorch marks up and down the platform. And the Fire Department is working on the situation. We will bring the shot out to give you an idea where this is in relation to New York Penn station. That is it at the top of the screen. That is where the track fire was. That is why service is suspended both the north jersey coastline going into New York Penn station from newark penn station. At the time that we heard about the story, there were flames visible. This is what strictly vegetarian on church avenue in flatbush looked like early on july 23rd. Police say a suspect walked up to the building and intentionally through a device outside of it. Luckily the upper floors of the building were empty. Surveillance video captured the man walking away and sparking the blaze. So far police have no motive and have made no arrests. Frightening moments in the bronx as a manhole cover blows off, smashes through the bottom of an mta bus and injuries a passenger. It happened to a bx 11th bus near 170th street and inwood avenue. The manhole weighed as much as 100 pounds and hit a female passenger. She was not seriously hurt. We are following developing news out of manhattan about a contract deal reached with new york citys Fire Department. Mayor de blasio is expected to announce any moment that the city has settled a long standing dispute with the Uniformed Firefighters Association over disability pen sons. An agreement has been reached to withdraw a lawsuit filed by the Firefighters Union against City Council Speaker Mark Viverito over the pension benefits. Reporter we just got word that part of the search was suspended for the day. The helicopter searches and dive teams are done. The park virus will continue the foot patrols on the beach. They got started early this morning at 8 00 this morning. Unfortunately, there is still no sign of that missing swimmer. When we got out of our van, we saw a helicopter. It was really low to the ground. We were wondering what was going on. Helicopters and dive teams, the backdrop for a beautiful beach day in sandy hook. This massive recovery effort hard to avoid as well as questions from little beachgoers like these. How can the police get him back to his home. Reporter three rescue boats all prepared to recover a missing swimmer thursday. A 25yearold man went under wednesday evening around 7 30 at beach b in an unprotected area, where there is no lifeguard on duty. At this point we dont know swimming. Reporter the Monmouth County Sheriffs Office leading the operation in part using a sonar to take pictures of the ocean floor. It has been tweeting out updates all day. The Shallow Water at beach b is only 3 feet deep but quickly drops off to 50 feet. A beach like this is like you have to understand the ocean. Yourself. Reporter this is a live picture of beach d of the Gateway National recreation center. The search today has only affected beach b. The other beaches are open all day. The only people on beach b today other than those rescuers was the family of that missing 25yearold swimmer waiting and hoping that they would pull him out. Robert sims is in court at this hour to be sentenced for his role in the attack on Alex Committee i dont know leon in 20 alexian leon. He stood trial along with wojciech braszczok. Braszczok was sentenced to two years in prison yesterday. New information about the shooting following a hiphop concert at the pnc center in new jersey. Karon powell has been charged and arrested. Investigators say he was captured in east orange about 30 miles from the concert venue. Police say he fired multiple shots monday night. Two men, ages 23 and 24 were critically injured. Powell is being held on 750,000 bail. Pse g long island is racing to restore power to customers that have been without it since a destructive storm earlier this week. There are about 2300 still without electricity. More than 1900 customers dont have power. Service has been restored to 96 of the home affected. Pse g long island said a majority of the outages should be repaired later today. In cliffside park, new jersey, all water and gas service is expected to be back soon. A train collapsed on a road there and caused a water main break. Crews moved the 600,000pound piece of equipment off the main. They are now repairing the damage. The Water Service is coming back. A boil advisory will be in effect for the next day or two. Coast guard and Suffolk County crews sprang into action rescuing five people from the waters off long island. Boaters reported a fire aboard the 27foot boat in Great South Bay around 9 30 last night. They abandoned ship near robert moses causeway. Rescuers pulled them from the water before 10 00 p. M. A salvage crew towed the boat to a marina and no one was hurt. Police on long island are investigating what caused a tractor trailer driver to lose control of his truck and flip over on the l. I. E. This morning. The truck overturned near melville about 6 00 backing up traffic for miles during the morning commute. All westbound lanes were closed in the area for about two hours until the vehicle was removed. There were no serious injuries. Now to the race for president. He was shot by police after he unleashed pepper spray and attacked a man with a hatchet. A passenger became irate on a United Airlines flight in chicago when he was asked to turn off his cell phone. Officials say he refused, got up and walked to the front of the plane. Thats when he suddenly turned and punched a passenger who apparently said something to him. Chicago Police Officers boarded the plane, which was parked at the gate. He was wrestled to the ground after he struck one of the cops and is facing multiple charges. Rapper busta rhymes got out of jail early this morning after being arrested in a manhattan gym. His real name is trevor smith junior. He posted this picture after getting out. He is facing Assault Charges after police say he attacked an employee at the steel gym. Police say he threw a protein drink container at the man who was not seriously hurt. People are gathered on a nearby bridge delighted by seeing it. Officials with the Marine Mammal stranding center are monitoring the dolphin. Mayor de blasio has just laid out his plan to help new yorkers with Mental Illnesses. The city plans on spending 22 million in the next two years. Stacey sager is live outside city hall with more on the citys plan. Reporter this is really a plan to Weave Public Health and safety together. It targets the most severely mentally ill, those who are prone to violence. Its called nyc safe. Now, earlier today the mayor consistently played down much of the connection between this and the citys homeless situation but you know just this morning in east harlem, here at 125th and lex, police were restraining another emotionally disturbed homeless man on the streets, one of many on this particular corner in recent days. The mayors plan includes things like more peace officers in the shelters, clinical outreach especially given the murder last april of a shelter director in the bronx allegedly killed by one of the homeless men she was trying to help. The tragedies that we do know about that have been well reported that have been painful to hear recounted, they have yielded fear and alarm and sorrow. They have not yielded systemic change. We believe this systemic change and we are hear today to start the process of systemic change when it comes to addressing Mental Illness in this city. Once again, mayor de blasio trying to mention the homeless as little as possible in his press availability. This is part of a 22 million annual plan which in turn is part of a larger road map for Mental Health that the mayor plans to unveil in the fall. Prosecutors say he used excessive force. Police say that farrell just crashed his car when he went to a nearby home for help at 2 30 in the morning, alarming the homeowner. Officers say when they arrived, farrell charged them. Started coming towards the officers. Defense attorneys saying that farrell behaved aggressively and the officer feared for his life. Prosecutors say that feral, unarmed was the one afraid and running away from the taser light, not toward officers. Who polices the police when they do wrong. Kerik pling in facing up to not guilty facing up to 11 years in prison. In connecticut, a reward is being offered on the anniversary of a cold caseworker. Police hope someone will eventually come forward to help them solve this case. A 50,000 reward is available for information leading to an arrest and conviction.
