the music goes with the rain. >> pow. >> robin on medical leave. josh taking a break. glad to have elizabeth vargas and amy robach here with us. a lot of breaking stories to get to, including a big story for the romney campaign. they cannot catch a break. a new tape during a fund-raiser. romney tried to put it out last night. unusual post-10:00 p.m. press conference. >> at one point in this fund-raiser, he's on tape recorded saying, i will never convince these people, who don't pay taxes. he said they should take personal responsibility for their lives. the fallout is continuing. also breaking overnight, a dangerous prison escape, directly on our border with mexico. 130 inmates make a dash through an underground tunnel. setting off a massive search by police and soldiers just over the texas border. we're going to have the latest on that. that borderline continues to be volatile. and big news for anyone struggling to diet. the first prescription weight loss drug to hit the market in over ten years is out today. >> this is the miracle drug that everybody has been waiting for. let's get to the secret tapes from the campaign trail. it's "your voice, your vote." with just 49 days to go, abc's david muir is here. and no apology from mitt romney at that late-night press conference. he said say his words were inelegant. >> inelegant were the way he described them. he stood by the words last night. the argument he made behind closed doors for a group of wealthy donors, describing voters, nearly half of americans, that in his words, it's not his job to worry about. overnight in california, walking up to the podium with a forced smile in a hastily-arranged press conference. >> good evening, i understand there's a video that's been on the internet for a few weeks that has attracted some attention. >> reporter: that video, posted in clips by left-leaning "mother jones" magazine, shows mitt romney in the circle there, spking to wealthy donors at a fund-raiser, about the 47% of americans he says it's not his job to worry about. >> there's 47% that are wi him. who believe they are victims. who believe that government has the responsibility to care for them. who believe they are entitled to health care, to food, to housing, to you name it. that's an entitlement. and the government should give it to them. and they will vote for this president, no matter what. >> reporter: he says they don't pay income tax. and because of that, his message of lowering taxes doesn't resonate. >> and so, my job is not to worry about those people. i'll never convince them they should take personal responsibility and care for their lives. what i have to do is convince the 5% to 10% in the certain, that are independents. >> reporter: then, a joke. romney pointing out his father, the one-time governor of michigan, had been born to mexican parents. >> he was born in mexico. and had he been born of mexican parents, i'd have a better shot at winning this. but he was not. >> reporter: romney shares the strategy of carefully using his wife, ann, on the campaign trail. >> we use ann sparingly right now, so that people don't get tired of her. >> whoever has released the snippets, i'd appreciate if they released the whole tape so we can see all of it. >> reporter: overnight, romney standing by his words. >> i'm speaking off the cuff in response to a question. and i'm sure i could state it more clearly and in a more effective way than i did in a setting like that. >> reporter: we know some of those donors paid $50,000 to get into that fund-raiser in florida last may. in the tapes, romney talks about the kind of words to the donors he uses to pull in independents that might have voted for president obama last time. that the independent voters, in his words, loves to hear the phrase, he's in over his head, when talking about the president. are they going to like to hear that behind closed doors. let's get to political analyst, matt dowd. matt, you've worked in a lot of campaigns for both parties. where does this register on the richter scale? >> 6 or 7 on the richter scale. it does some damage. but i don't know if the foundation is damaged by all of this. the problem with all of this, one, simultaneously, he was saying because it helps the republican base. he thinks this is a turnout election. the ultimate problem is the people who switch back and forth are looking for signals. as you and i talked about, a number of times in the last three months, every time there's been an opportunity for mitt romney to move the undecided voters, he made a mistake or made a decision that hasn't helped him in the course of that. >> so many unforced errors, including at the convention. the next big challenge at the debate, october 3rd. >> this is like a decathlon. and there's been five events held. some predictable, some not. in each of the five events, he's not done well. we have one more predictable event left. he has to get points down. he's down by three or four points, with a pretty solid lead. he has to do well in the four remaining events. >> the campaign tried to reset their campaign yesterday. that's what they were trying to do. >> they're going to try to probably reset the campaign in the aftermath of this. it comes down to the first debate on october 3rd. that's the only opportunity he's going to have to shift from the unforced errors, to shift from the crocks in the foundation and try to repair it in the final 30 days. >> we'll all be watching. thanks, guys. let's turn to the big battle being waged by the royal couple to shut down publication of those photos of kate topless. a huge victory just moments ago in french court. the magazine that first printed the photos was ordered to hand them all over, within 24 hours. jeffrey kofman is just on the outskirts of paris this morning, with the latest. good morning, jeffrey. >> reporter: good morning to you, elizabeth. they are the photos that buckingham palace has called grotesque. and moments ago, a french court seems to have agreed. granting prince william and catherine middleton, a rare injunction, of the pictures of a topless kate. the french court can't take back the magazines sold. but it can stop anymore being printed. it's been ordered to hand over all digital copies of the photos by noon tomorr pictures of a to with william in the south of france, first appeared in the french magazine "closer." they have rocketed around the world on the internet. and for once, that isn't stopping the royals from fighting back. in court here in france, the lawyer for the duke and duchess said, they were profoundly shocked and troubled. they called the photos a breach of their personal intimacy. saying the couple had no knowledge of the photographs being taken. the photos have been published in the an italian magazine. the same magazine that upset the royals 15 years ago, when it published photos of diana's final moments. they are trying to show that oh-so british stiff upper lip. but 15 years of william's mother died after being pursued by the paparazzi here in france, it's very raw. like diana, kate is good for business. >> when they're in private and have a reasonable expectation of privacy, they are off-limits. >> reporter: now, the british tabloids will not touch the pictures. but the dublin "irish times" has published them. he has threatened the editor and has threatened to close down the paper. let's bring in abc news chief legal correspondent, and my "20/20" co-anchor, chris cuomo. good to see you this morning. does this stop further publication of any of the photos, the rulings moments ago? >> this is for the media. for the legal community, it's not a big deal. why? french privacy laws, very strict. well-known. it was expected that the courts would say don't publish this anymore, "closer," french newspaper. but the fine is de minimis. business-wise it makes sense for them to publish. the irish and others can follow suit without any respect for this resolve. >> and the order to hand over the photos and the digital copies, sounds big like a big step. is it? >> to me, it sounds like nothing. as we all know as parents, digital copies of pictures are innumerable, especially when they're out on line. the idea that it's the old days and you can hand over the negatives is naive. this is what we would call a placating verdict. and it's a win into a bigger analysis that needs to be done here. this is the most public couple in the world. the only behavior they can control is their own. so, if they don't want pictures of them taken this way, they're the only ones that can control it. >> quickly, the defense was, she was on a balcony you could see from the street. is that a valid defense? >> for most people, yes. you'd say, could you see me or not? did i have an expectation of privacy or not? this is a different couple with different analysis. the u.k. tabloids isn't using the pictures. to achieve that is no small feat. >> thank you so much. let's head over to amy robach, in for josh elliott, with the top stories this morning. >> we begin with breaking news. a prison break along the u.s. border with mexico. 130 inmates are on the loose at this hour. they escaped through a 21-foot tunnel in a town just across the border from texas. now, an intensive search is under way. abc senior justice correspondent, pierre thomas, has the latest from u.s. homeland security officials. pierre? >> reporter: good morning, amy. this is a prison escape of epic proportions and looks highly sophisticated. the mexican town is right on the border, only three miles from eagle pass, texas. homeland security officials tell us they are aware of the break and looking into it. customs officials will be on alert. and all border checkpoints and hunting for unusual activity in that region. amy? >> pierre, we know it's about 130 inmates. what do we know about them? how dangerous are they? >> reporter: what has officials so concerned is this could be an inside job. and the drug cartels could be behind the break. many are said to be tied to the massive narcotics trade. >> thank you so much. another major story developing overnight. the deadliest attack to avenge the american-made film mocking the prophet muhammad, a female suicide bomber slammed into a minivan at the airport in kabul, killing at least 13 people. a militant islamist group is claiming responsibility. a frightening scene in florida, after an suv driver smashed his way into someone's living room. he took off running, leaving his 4-year-old stepdaughter behind in the wreckage. no one was hurt. that driver arrested for drinking and driving without a license. and snowboarding star, shaun white, has been arrested in nashville. his black eye is visible in his mug shot. police charged white with drunkenness and vandalism. a hotel employee said he pulled a fire alarm. he hit his head when rtrying to run away. peyton manning tossed three interceptions in the broncos first three possessions last night. they fell to the falcons, 27-21. and finally, diamonds are a girl's best friend. we should all move to russia. authorities say they found a gigantic supply of indictments. they say there's enough to supply the market for 300 years. the diamonds are twice as hard as conventional diamonds. and therefore, are best for industrial use, not jewelry. we'll have the market flooded with diamond drill bits. there's no bling. >> they're really hard. not great. sorry. >> trillions. >> thanks. now, to tense moments on the tarmac at new york's jfk airport, after an anonymous phone call claimed hijackers were aboard the plane yesterday. the plane was surrounded by policemen, the pilot not told why. and his fury was caught on tape. >> reporter: manage you're a passenger, or a pilot, of a massive jet. you're told to go far away from the terminal. and you're surrounded by cops and emergency vehicles. no one tells you what's going on. one pilot blew his top. a rare moment of frustration and anger from inside the cockpit of an american airlines jet. >> tell us what's going on here. >> american 24 heavy, i still don't have any information. >> reporter: it's monday afternoon at new york's jfk airport. an american airlines flight 24 has been just ordered to taxi through a remote part of the runway, along with a finish airplane. the planes are surrounded by emergency vehicles. but the american pilot doesn't know why. >> they're still on the telephones here. >> they need to get off the phone and give me some information now. i'm the captain of this airliner. i need information pronto. >> reporter: police had been told hijackers wearing gas masks are hiding in the wheel wells of the jets. the pilot's still unclear about what's happening, becomes angrier. >> we're surrounded by emergency vehicles. there's a reason for this. someone has to give us the reason or we're going to evacuate the aircraft. you have 60 seconds. >> unless they have a legitimate reason to believe that the crew had been compromised and was under the control of somebody else, i don't see much justification at this particular point of not telling the captain what's going on. >> reporter: both planes were later searched and cleared. no threat was found. now, of course, nothing out of the ordinary found. american airlines said, we generally don't comment on security issues. and they haven't yet. but this is the captain of the ship. it's probably safe to say that most of the passengers on that plane, and most people listening at home right now, would probably want their pilot to do the exact same thing. george? "pop news." we have new pictures of ashton and mila. they've been able to keep their romance mostly secret. but no more. >> when you get the hand on the face in the kiss, that's passion. >> kissing ashton. >> wow. >> okay. right now, let's get to the bizarre murder trial in georgia. steve osunsami is covering this from atlanta. the defendant has spent ten years in jail for stalking this roommate, who they cross-examined yesterday. >> for ten years. you can imagine how upset she is him acting as his own attorney and grilling her on the witness stand. she moved into a friend who was murdered, before he went to jail. and now, after all these years, police have fingered him for that killing. >> it was a few days after you murdered carmen and stabbed nick. >> reporter: loretta spencer black, whose identity is being protected, facing down the man she helped put away for stalking her in 1994. >> i want to object. completely unresponsible to my question. and has -- >> it's really inappropriate that you stalked me and harassed me and you're sitting here asking me questions and i have to answer your questions. that's hard for me. >> reporter: he is now out prison and acting as his own attorney, on trial for his roommate's brutal murder. >> i would have done things differently. but i can't. i can't turn back time. i wanted to make it -- i wanted to make it stop. just stop. i just wanted it to stop. >> reporter: black and baker met on a paintball team. and he became obsessed with her. calling her at all hours. showing up and refusing to leave. and breaking into her home. >> he was harassing her on the phone. >> reporter: her roommate, carmen smith, was found murdered in the home they shared in 1995. smith's 5-year-old son was stabbed more than a dozen times and barely survived. >> i didn't realize this was going to turn into murder. if i would have known, i would have taken notes. >> reporter: for years, investigators suspected baker killed smith in an act of revenge. but in 2009, they announced they finally got it. a dna test of hair found on smith's body, tied him to the murder. he pleaded not guilty. and the would-be lawyer told jurors he and blass were a couple. >> there's so many different things that happened that you did. i can't remember everything that you did. i spent my entire life just to erase everything. >> reporter: we're expecting some really gripping testimony. that 5-year-old son who was stabbed so many times is now in his 20s, george. and is expected to tell his story on the witness stand any day now. >> what a moment that will be. thanks, steve. for more, we're joined by former prosecutor, legal analyst, sunny hostin. this is about as unusual scene i've seen in a courtroom. >> it really is. i did all this research preparing to come in today, trying to find cases where defendants in murder trials represented themselves. it's very, very rare. they usually say he who represents himself has a fool for a client. that's probably true. it's rarely successful. they often get convicted. ted bundy, dr. jack kevorkian, all represented themselves. all convicted. it's very rare. >> you saw in part, why yesterday. when the roommate came out and said, you murdered carmen. >> exactly. it's a situation that shouldn't happen. no one would ever operate on themselves. well, why would you represent yourself? and i think it's particularly difficult for the victims in this case because they are being cross-examined and questioned by their assailant. n you imagine? and we're going to have, later on in the trial, i think some time this week, the 5-year-old boy who is now a 20-year-old man, cross-examined by the man who stabbed him over 15 times. >> hard to imagine how that young man, now, can maintain his composure in that kind of situation. but the accused is under some pretty severe restrictions. he can't handle any of the evidence. >> that's right. he can't handle the knives in this case. he also can't approach the jury very closely. there's markers of tape on the ground. but many people are saying, that's unfair to him. i actually think the judge is doing him a favor. the last thing that he wants is this jury having this vision of him holding the instrumentality of the crime. i think the judge did him a favor by putting these restrictions in. but in any event, this is something that we just don't see very often. >> even though he made his mistakes, he does know his way around the courtroom yesterday. >> it's funny you should say that. i thought, my goodness. as criminal attorneys, we are well-trained. he filed 90 motions in this case. i read some of them. they're not terrible. and he is doing a decent job of representing himself. and so, you know, who knows what will happen? but the evidence in this case is pretty overwhelming. >> that dna evidence is tough. sunny, thanks very much. let's go to sam. you have a firenado. >> it's incredible to show you video. normally these things don't last very long. a fire tornado will kick up and last a minute or two. in this case, it lasted long enough to get not just still pictures, but incredible video. this swirling inferno, amazingly caught on tape. a stream of 100-foot-high flames ignites in the australian outback, where firefighters have been battling fires for nearly a week. it happened monday afternoon, when chris was scouting locations for a movieshoot. abc news licensed this video from the filmmaker. he was standing about 1,000 feet from all the action. >> i knew within 30 seconds this was a very unique event. probably globally. the sound of a jet engine. it was just -- it just didn't even look real. >> reporter: this dust devil with fire occurs when intense twisting ground-level winds come in contact with fire, propelling it upwards into a column of warm, rising air. the phenomenon usually lasts for just a couple of minutes. but tangey found himself in the middle of mother nature's fury for an astonishing 40 minutes. >> i've never seen anything so big move so quickly in my life. it was awe-inspiring, absolutely. and it's something i never expect to see again. >> something most of us will probably never see and certainly never see video like that again. they just don't last that long. but the heat is so intense and it's so dry there. when they picked up, they just kept going. from hot to cold. how is that?
