And to have and go traffic on highway 4 and highway 24. That is typical. 205 is stop and go. In the south bay, someone asked me recently about 85. 85 is slow from about 87 up into saratoga. Getting filled in here. At 7 02, lets go back to the desk. The controversial measure declaring california a sanctuary state is headed to the capital. Rob malcolm is live in pittsburg where this is a major topic of discussion. Reporter yes. They are in the process of voting on the sanctuary status. Were getting reaction from yesterdays vote. Yesterday the state Senate Approved a legislation 2712 by party lines. Similar to the sanctuary policies of other bay area cities like San Francisco, oakland and san jose. It prevents local and state Law Enforcement from using resources to investigator arrest people for immigration violations. But the policy is facing opposition from police groups. Kevin of los angeles amended the measure to allow the department of corrections to notify the federal government up to two months before an undocumented immigrant convicted of violent or serious felonies is released. We will cooperate with our friends at the federal level but wont cooperate or lift a finger or spend a single state when were talking about separating children from their mothers. If you have felony child abuse, this bill shields you. If you take hostages to prevent an arrest and youre serving in our prison, this bill shields you. Reporter if california becomes a sanctuary state, the city of pittsburg would have to follow the law. Five Council Members in pittsburg say they cant justify becoming a sanctuary city and risk losing federal money. President trump has offered to pull federal money to sanctuary cities and states. Reporter the Senate Judiciary Committee Gave gorsuch its blessing moving towards a confirmation later in the week. But more Senate Democrats are on board for a filibuster. Yesterday crossing the critical 41 member threshold to block gorsuch. I cannot support this nomination. Reporter democrats see this as some measure of pay back for republicans refusal to consider president obamas peck for the court, garland. But republicans have a plan b, the Nuclear Option. A change that many in both parties are reluctant to see happen. That means the judges are going to be more id logical, not idealogical, not less. The Nuclear Option would mean that which ever Party Controls the white house would have more power to nomination justices from this point forward. This has been building up for years. Leigh martinez is in San Francisco with more on why the board of directors wants the ban. Reporter well, in the past, some of these ads have contained profanity or violent descriptions. These ads have prompted a lot of angry protests in city and Even National news because of these ads. Now, one controversial ad ran back in 2012, supporting israel and names an unknown savage. There was also a picture of adolf hitler with an islamic reader that read islamic jew hatred. The Antidefamation League called it antiislam. The railway didnt support the message but couldnt remove them because of First Amendment protection. Instead of removing the ads from the buses, they would give ad revenue to the human rights commission. The vote today would prohibit ads that contain a political or public issue intended to be insulting or offensive or harmful or disruptive to the transit system. New this morning, police are investigating two people stabbed in downtown san jose just about midnight. Authorities responded to reports of several people getting attacked right there near the San Jose Convention center. When officers arrived on scene, they found two people injured near the guadalupe river. The victims were transported to the hospital and are expected to survive. The attacker was seen running away. The man accused of kidnapping, drugging and sexually assaulting a 13year old girl is scheduled to be in court this afternoon. Timothy marble picked up the girl at a Sonoma County gas station last weekend. Marble and the girl smoked marijuana together and then he made sexual advances which she rejected. She escaped jumping out of the truck while he was driving. He will be formally charged with eight felony counts. The fire on san pablo avenue killed four people and forced more than 80 out of their homes. The fire was started by a burning candle inside an apartment with no electricity. Looking at the san mateo bridge, pretty much jam packed heading over to the highrise and over to the peninsula. This is a typical commute. You can see on the maps here the traffic is slow also in the hayward area as you drive south toward fremont. Highway 4 has grown, the backup. Highway 4 is backed up into pittsburg and over the hill to bay point. And in the south bay, 85 is slow from 87 northbound 280 and 101 are slow. New this morning, hours after North Carolina won the mens ncaa tournament the ncaa announced it will once again consider the state of North Carolina as a potential host for championship events after officials have replaced the controversial bathroom bill that required transgender people to use the bathroom that reflects their born gender rather than the gender they identify with. The ncaa said the board reluctantly voted for North Carolina as the new policy meets the minimal requirements. Russian investigators have identified a 22yearold man as the suicide bomber in yesterdays attack on a subway in st. Petersburg. Theres a growing memorial for the 14 people who died in the attack. 50 others were injured. The dna of the suicide bomber was found on a bag that was found and deactivated at another subway station. France has a lot of security at some of the most popular sites. California is facing a big bill when it comes to fixing damage from this winters storms. Caltrans estimates it will cost an estimated 60 million to fix the roadways. The most expensive project is in Santa Clara County where a section of highway 35 gave way. That will cost about 30 million. The replacement of the Pfeiffer Canyon bridge in Monterey County and work along highway 17 also on the list of costly repairs. On sunday, fema announced it is making more federal aid available to the california areas let by the storms. No word how much of that money will be used for the caltrans repair work. San jose mayor sam liccardo says the money cannot be used where it is needed most right now, getting 400 families forced out of their homes by flooding into permanent housing. For that the city will have to rely on donations and fundraising. Really to get the Community Back on its feet, weve got to enlist the community to do that. And weve had a lot of support so far. But were going to continue to ask for community help. The next appeal for help will come today. Thats when the mayor will unveil a new plan to get vehicles for those who had theirs damaged or destroyed during the flooding. The mayor will specifically ask for donations of cars today. He is making a special plea to car dealers for help. Testing a marin county Train Service is on hold because much a potential landfill in san rafael. It is south of the marin civic center. The agency says the recent rain loosened soil on the hills above the tracks and all of that soil has to be removed. The work has been going on for three weeks and should be done by next week. Smart says it stop testing trains in san rafael out an of an abundance of caution. The recent work is not expected to delay the start date. Up next, the impact it has had on road safety. Also 880 you can see slow traffic on 880 as you drive from about 238 all the way down to fremont. This has filled in. And highway 4 continues to be slow. Now it is stretching back to all of pittsburg at bay point into concord. This is a look at highway 24 as you drive through. It is heavy in lafayette. It gets better in orinda a the bay bridge toll plaza, even the carpool lanes are slow. I dont particularly like it when i see the carpool lanes slowing down. But even that is slowing down right now. 7 32, lets go back to the desk. Republicans and democrats in the u. S. Senate are headed for a showdown whether to confirm President Trumps nomination for the u. S. Supreme court. The Senate Judiciary Committee Approved gorsuch. It is up to the full senate to vote. Democrats have enough support for a filibuster. Republicans may use the Nuclear Option to lower the number of votes needed to confirm the nominee to a simple majority. Joining us in the studio is joe tuman. Why filibuster when they know that republicans will come back with the Nuclear Option. Lets explain to our viewer whats filibuster means. For anybody who didnt watch Jimmy Stewart and mr. Smith goes to washington. This about giving a speech and passing it off when youre about to lose your voice. Basically obstructing the process so no one can get a vote. We should be clear here in this process that were talking about the senate which is not the house. There is an important difference. The senate only has 100 members. Steep from tradition where they build relationships over a period of time. One of the problems with this thing, theyre calling it day Nuclear Option which is just a change in the rules as to how many votes. 60 down to 51. Simple majority. 50 plus one. It helps to destroy that tradition and threatens developing relationships with people when you need a vote across the aisle. So thats the problem with this. And the history of this real quickly for our voters, our viewers, pardon me, is that this is something suggested about by Richard Nixon when he was Vice President back in the 1950s, change these rules. No one ever took hem up on it. The democrats did in 2013. Harry reid who was the leader of the party at that point and the senate did change it for some cabinet level positions and lower federal court judge appointments because he was frustrated the republicans were doing what they think the democrats are doing today. And the moment he did it, it changed things in the senate. And everybody on both sides said, boy, we shouldnt do this because it is hurting the tradition of working with each other. Thats where we are today. At one level it is about confirming a Supreme Court. What this is about is changing the senate. And they call it Nuclear Option because when we think of dropping a nuclear weapon, you dont come back from this thing. The more you damage relationships in the senate, the more you permanently change the nature of working with one another. Is gorsuchs confirmation a foregone conclusion. It is in the sense that the republicans in the senate if theyre willing to make this rule change can guarantee he will get through. And what it will mean in the future for future Supreme Court picks including when the democrats are in control, they will always get their nominees. You get the sense reading from republicans i dont want to but i would. Is this just how do you read a comment like that. I think theyre being sincere. Okay. I think theyre all aware of the fact this is not about the Supreme Court. This is in the end about permanently changing the nature of the senate. Remember ted kennedy who was, you know, very far to the left senator was really good friends with warren hatch, a very conservative senator from utah. And when the first died, the second was more sad than anybody else. Cried on the floor of the senate. Thats what the tradition is about, working with people when you have interest and require support in this way. When you go he this way, youre dividing the politics in the senate and the house and the congress are already triballized even within the parties. Doing this though institutionalizes it in the senate. Is this really about neil gorsuch or is this about merit garland . Thats another good point. Actually republicans in response to everything that i have said said they did it first. Right. It has that feel to it. You did it to us, were going to do it to you. You watch basketball. I know you were talking about Little League leading up to this. You might have noticed the last game with the warriors against the wizards that mcghee had a 3 point attempt with 7 seconds left. He said Im Old School and you dont break the rules. Next time we play, were going to do that to you. Thats when this is. When you go back and forth that breaks the tradition or the rules, you create an entirely different environment. Today is the deadline forbids on President Trumps border wall. The original deadline was last wednesday but u. S. Border gave an extension to answer questions from the companies. Among the questions is safety for the construction crews. Some potential bidders are asking if they will be protected from attacks from people who dont want the wall. The Administration Says between four to ten bidders will be selected to build prototypes for the wall. Allowing undocumented immigrants to obtain drivers licenses has reduced the number of hit and run crashes in california. The law took effect in january of 2015. More than 850,000 immigrants have obtained licenses since then. Researchers at the Immigration Policy Lab say granting those licenses reduced the number of hit and runs in the state because immigrants involved in crashes were less likely to leave the scene out of fear of being arrested or even deported. The study found that has saved insured drivers an estimated 17 million in insurance costs that would have absorbed from drivers fleeing collisions. There are new calls for the Dublin School district to build a Second High School. Parents say classrooms are already crowded. Enrollment is expected to increase. Alex savidge is live at the citys existing high school with more on the plans to build another one. Alex. Reporter yes. There is a big push underway in the city of dublin to try to Start Construction on the Second High School. We are here this morning outside of the existing high school. This is pub lynn high where there already are crowded classrooms and theyre looking at an influx of more students in the near future. Enrollment in the district is expected to increase by more than 6,000 students over the next seven years. Its been a year already since the school board agreed that there was a need to build a Second High School. Preferably a school that would accommodate at least 2500 students. And now there are a couple of online petitions, circulating to get the project started as soon as possible. Parents we talked to this morning whose children graduated from dublin high say it really is time for a second campus. I know some parents who have kids over there. It hasnt come up but i read a lot about it and you hear people talking about it in the stores, even starbucks that we definitely need another school. Things take time. It will take a while. Probably a couple more years. Reporter yeah. The process moving along slowly. The school board is still considering several possible sites for the new school. In regards to the financing with all of this, paying for the project, voters just last year in dublin passed a 238 million bond measure that would in part go to fund the construction of the Second High School. The money is there but a lot of parents and members of the community are saying lets pick a site and lets move forward with the project, preferably sooner rather than later. Thank you, alex. Today the San Francisco board of supervisors will start considering a plan to open up safe injection sites. Areas set up for people to inject drugs where there are also social and Health Services offered. Supervisor london breed wants a task force to consider the idea already being used in canada. That group would include a represent from the Drug User Community as well as workers in the citys police and Homelessness Health departments. The department of Public Health say there are 20,000 people who inject drugs in San Francisco. The roads are broken. And theyre getting worse and theyre not going to get better unless we get a significant injection of money. The plan would be paid for by an increase in the states gas tax. Also an increase in vehicle registration fees. Supporters are using Television Ads to pressure lawmakers. Were doing over 1 Million Campaign ask trying to touch all demogram i demographics of voters. This is not something that i can support right now. The full senate is expected to take up the legislation on thursday. The 15th Oakland International film physical at this val begins today. The state department of fish and wildlife says bald eagles are making a come back in california. A pesticide put them on the endangered species list. Now more are being spotted thanks to conservation efforts. Biologists say there are more than 370 nesting sites statewide including 20 in the bay area. In milpitas, two bald eagles have set up a nest near the elementary school. I looked at my friend and said is that a bald eagle . I have been here since 81 and never seen one in this area before. Although the bald eagle is no longer on the federal endangered species list it has not been removed from californias. Walnut creek Police Searching for three men who stole laptops and phones from an apple store. It happened just before 9 00 at the store on south main street. Three men rushed into the store just before closing time and stole 18 iphones and three macbook pros. No one was hurt. Police will look at Surveillance Video from the store and nearby businesses to help find the robbers. The controversial measure to declare california a sanctuary state is headed to the capitol. It cleared the senate. Rob malcolm is joining us from pittsburg where this has become a major topic of debate in the city. Reporter it has been a hot topic in pittsburg as the city prepares to vote on its sanctuary status. Plenty of people are reacting to the vote. Yesterday the state Senate Approved a legislation 2712 by party lines. This is similar to the sanctuary policies of other bay area cities like San Francisco, oakland and san jose. It prevents local and state Law Enforcement from using their resources to investigator arrest people for immigration violations. But the policy is facing opposition from police groups. Senate pro testimony kevin of los angeles amended the measure to allow the department of corrections to notify the federal government up to two months before an undocumented immigrant convicted of violent or serious felonies is released. The counties that limit cooperation with ice, there is an average 35. 5 fewer crimes per 10,000 people in sanctuary counties. But the bill isnt fully cooked. It still allows for human traffickers. If youre convicted and serving in our prison as a human trafficker, this bill shields you from deportation. Reporter if california comes a sanctuary state, the city of pittsburg would have to follow the law. They cant justify becoming a sanctuary city and risk losing federal money. The muni riders say it is a very tough call for the city because they really de tested it but they do understand the First Amendment issues. The ads were coming from an outside group. And some of them contain profanity. Some of them contain violent descriptions. And they did spark some protests in the city and making national news. Now, one controversial ad ran in 2012, supporting israel and named an unknown savage. There was a picture of hitler and islamic leader. The ads were purchased by the American Freedom Defense Initiative that were called antiislam. At the time the muni did not support the message but couldnt remove them because of First Amendment protection. Instead of removing the ads to the buses they would give money to the knew hand rights commission. It sparked protests in the city. Muni riders disapprove of the ads but it is a tough decision to restrict free speech. I would like some sort of neutrality when it comes to politics. I dont like having politics in my face. Not in public places. It is probably a good idea. Everybodys opinion is important. Some are best kept to themselves. Reporter now, the vote today would prohibit ad thats concern a political or public issue, intends to be insulting or offensive and likely harmful or disruptive to the transit system. Police are trying to track down a person who stabbed two people in downtown san jose. About midnight, authorities responded to reports of several people being attacked at almond boulevard near the San Jose Convention center. When officers arrived on scene, they found two people injured near guadalupe river. They are transported to the hospital and are expected to survive there. Is no description of the attacker seen running away from the scene. The napa man accused of kidnapping, drugging and sexually assaulting a 13year old girl will appear in court this afternoon. Prosecutors say timothy marble picked up the girl at a gas station last weekend. Marble and the girl smoked marijuana together and then he made sexual advances, which she rejected. She escaped by jumping out of his truck while he was driving. Marble is expected to be formally charged with eight felony counts. A News Conference is set for today foam people displaced by the deadly fire last week in oakland. It killed four people and forced more than 80 others from their home. It was started by a burning candle inside of an apartment. Ten people are still staying at the gluing center but the shelter will end by 7 00 tomorrow morning. Syrian officials have not commented as of yet. Russian investigators have identified a 22yearold man as the suicide bomber in yesterdays attack on a subway in st. Petersburg. This is the east shore freeway. 31 minutes from the carquinez bridge to the macarthur maze. And at the bay bridge toll plaza, this is about 15 to 20 minutes. This is a normal commute. We havent had a lot of new things going on. I always check with chp to make sure that i havent missed anything. It looks like recently, about three minutes ago, a new accident reported northbound 101 at story road in san jose. We will check on that area for you next time. At 8 31, lets go back to the desk. New this morning, a San Francisco woman is warning muni riders about a man she says has been molesting women. She posted this photo of the suspect on the website nextdoor. She has seen him rubbing up against unsuspecting female passengers. More people have said they have witnessed or experienced the same thing. We know that San Francisco police are now investigating. To the east bay where students and parents in dublin say they desperately need a New High School in the city. 2400 are already at Dublin High School and that will increase sharply in the next few years. They have been at this for a year or so now and they have not Broken Ground on the Second High School. There is a push from parents and members of the community to try to get the second campus. They say the existing one, dublin high, where we are this morning, where they are on spring break right now, they say this campus has very crowded classrooms and the district is also bracing for a big influx of new students in the very near future. Now, according to a report from the bay area news group, they are expecting that enrollment here in the district will increase by more than 6,000 students in just the next seven years. Now, a year ago the district and the school board agreed to Start Building a Second High School. But they still have not Broken Ground. There are now a couple of petitions circulating in the area, calling for the project to start as soon as possible. Parents whose children graduated from dublin high told us this morning that they particular it is time to build the Second School. I think its a great idea. We have too many houses coming in with families and kids. I mean, traffic is a mess. But we need another high school. Its just too crowded. Its hard to get up and down the stairs sometimes because its like its a rush. Its a mad house. Reporter the school board is right now considering several possible sites for that Second High School here in dublin. Preferably that school would accommodate at least 2500 students. Again, to accommodate the influx of students, the increase in enrollment expected in the come years. As far as paying for the project, voters just last year passed a 238 million bond measure to Fund Construction for that Second High School. So the funding would appear to be all in place. Now its up to the school board to decide ultimately on the site where that Second School will be. But theres a big push among parents and people in this area to try to get this project going. Going. And alex, you talk about a population boom. I think dublins population has doubled in the past 20 years or so. You see all of the housing going up on 580 where there used to be open hills. Right. It is all housing and those kids need a place to go to school. Reporter yeah. Certainly. In all of that time, you have all of the new people moving into the city and just the one high school. It is being pushed to the limits here. And it is finally time to do something. And, again, they have been kind of planning on this. And they put the funding in place a year ago. But here we are a year later. They still havent moved forward here and chosen a site for the second campus. A lot of people are saying, all right, lets get the ball rolling. Alex savidge in dublin. Thank you. A hearing is scheduled tonight at the Jefferson Union High School Board meeting after parents say their son was targeted because of his race. It happened in pacifica two weeks ago. A female School Administrator brought their son into an office while investigating a report that coding was passed around the campus. The woman made him remove his shirt while in the office. She put her hand like this and told him to spin around or turn around. So she laid her hands on my son. Education code requires a Second School employee to be present during student searches. It is unclear if the administrator will face discipline. The family says they believe that their son was targeted because he is a Pacific Islander and other families have told similar stories about the school. The district plans to address the issue later tonight in a meeting. The transportation of Governor Brown now advances to the full state senate. The roads are broken. And theyre getting worse and theyre not going to get better unless we get a significant injection of money. The plan would be paid for by an increase in the states gas tax and an increase in registration fees. Supporters are using Television Ads to pressure lawmakers. Well, were doing over a Million Dollar campaign and trying to touch all demographics of california voters in every area and every language. Because this affects everyone. Not on this bill. What sways me is good policy. This bill has good ideas but a lot of short comings and isnt something that i can support right now. The full senate will take up the legislation on thursday. Governor brown and scotlands first minister signed a joint agreement to fight climate change. They signed the agreement yesterday in Browns Office in sacramento. The agreement commits the two administrators to Work Together to reduce Greenhouse Gas emissions and tackle climate change. Today is the deadline forbids for trumps proposed border wall. The deadline was last wednesday but there was an extension given to answer questions from the companies. Among those questions seems to be the safety for the construction crews. Some potential bidders are asking if they will be protected from attacks by people who dont want the border wall. The Administration Says between four and ten bidders will be selected to build prototypes for the wall. The department of Homeland Security has announced steps to prevent visa fraud, the visas used by employers to bring Foreign Workers to the united states. A lot of Tech Companies rely on the program. New round of flu making its way across the country. A new report that shows flu shots are actually saving lives, especially when it comes to children. A pedestrian was struck and killed by a car in san jose. It happened about 8 00 last night at monterey road. Officers say the driver struck the pedestrian and slammed right into a tree. The pedestrian was pronounced dead at the scene. The driver of the vehicle is cooperating with the investigation. In the meantime the family of a san jose man killed in a crash with a big rig last friday is opening up about the incident. He was taking his 10yearold daughter to school when he slammed into a semitruck backing into a construction site. The child was in the back seat and survived. She suffered a cut above her eye but quite shaken about the sudden loss of her father. Im just broken. From all of this. It happened all of a sudden. We dont know why. But now hes an angel of god. Investigators are still looking into the cause of that crash. Witnesses say the driver may have been blinded by the morning sun. They also cite a lack of Traffic Controllers in the busy construction area to warn drivers. One man died when his boat capsized around noon time when waves flipped the boat over around the National Sea Shore in marin county. The waves sent two men and two dogs overboard while one man died, the dog and the other man were able to make it back to the shore. A vallejo man arrested last week in connection with a deadly shooting has been released without being charged. Sap toes was arrested after the shooting in ocean view. Three innocent bystanders were shot. One died. A pancake eating contest took a tragic concern at a university in connecticut. A 20yearold student at Sacred Heart University died after choking while eating a number of pancakes. When First Responders arrived at the scene, they were unable to clear her airway. This is the second tragedy for her family. The womans father was a Port Authority officer who was killed in the 9 11 attacks. Today San Franciscos board of supervisors will consider a plan for safe injection sites. Those are areas set up for people to inject drugs where there are also social and Health Services offered. Supervisor london breed wants a task force to consider the idea already being used in canada. It would include a representative from the Drug User Community as well as workers in the police homelessness and health departments. There are more than 20,000 people who inject drugs in San Francisco. A second wave of flu is spreading across the country. The news come as the cdc releases a new report about how important it is to get a flu shot. 75 of the children dying from complications of the flu between 2010 and 2014 were not vaccinated before getting sick. The agency says if children did get the flu shots, as many as two thirds of deaths could have been prevented. The findings show how important it is to get the flu vaccine each season regardless if tour healthy. A rattlesnake warning in the bay area. The latest incident happened last night near 19th and webster. A tree came down and hit several vehicles. The trunk and tree limbs did considerable damage to a mans pickup truck.
