quiet now. this is very close to the intersection of 14th and broadway, across from the oakland city center. the shooting happened right here at this t mobile according to police at 9:30 last night as you said dave. police said there were two men here and they got into an argument and 1 man pulled out a gun and shot the other person at least twice. that victim managed to go to a local store before he collapsed on the floor or night next to the doorway. the victim is described as a 27- year-old oakland man, he went to the hospital and had surgery but did not survive. the gunman escaped on foot and right now police are still questioning witnesses as of late last night. the other happened an hour later to 90 minutes later. this one happened near martin luther king and eddie street in oakland. not much information on that. it happened again 34th and ely, excuse me, north oakland. the victim died in that scene. not much details on that homicide. i want to show you something, though, because that is important. you see the sign. right at the bottom you can see that camera there. police are looking at videotape from that camera at least to see if they can get information from that. i don't see any cameras outside the t-mobile sign pt i am sure inside a store like that they may have video cameras that may help police. both of these murders came on the eve of a crime summit in oakland, more on that in my next report. >> as kraig was just mentioning all this happened before today's cream sum met meeting that follows the layoff of oakland police officers and comes a month after the police chief vowed to ask the federal government for help in reducing violent crime. among other things police will examine the recent success of the salinas police department. officers there work closely with federal and state officials to dramatically reduce street gang violence in salinas. >> this morning school kids in richmond are heading back to school and the city is making an extra effort to ensure they make it there. a tough new curfew prohibits them from being in any public place during normal school hours. supporters of the curfew say they can't afford to miss class time and face the risk of becoming involved in criminal activity. the long time director of the petalooma wildlife has been accused of embezzlement. there are allegations she mis- managed thousands for her personal use. investigators say she spent some of that money at hair and national salons and for massages and they say she also used museum money to pay for child care for her own kid. so far there has been no response from her attorney. >> a church trial begins this morning in napa for a retired presbyterian minister accused of violating official law by official 8ing the same sex marriages, when same sex marriage was legal in california. the presbyterian church allows ministers to bless same sex unions as long as you don't call them marriages, she is a lesbian who has openly criticized her church's position. effective september third planned parenthood clinics in six bay area counties can no longer use the name planned parenthood. the national planned parenthood organization will cancel its affiliation with planned parenthood golden gate because of financial and administrative problems. that effects cline ekes in several counties. planned parenthood cline ekes in san jose and concord plan to expand into those areas losing the y fill is a with the national organization. >> as steve has been telling us, it is going to be another hot day today in the bay area, even hotter than yesterday. that means another spare the air day. as temperatures rise air quality can become unhealthy. and the bay area air quality management district is asking people to avoid unnecessary foothill high school here in please san top. his football coach held practice for players at 6:00 in the morning yesterday so they could reduce the chance of anyone getting dehydrated. parents at the high school came to the school yesterday for late registration. classes begin tomorrow for students who missed a hot summer but are coming back just as the weather is heating p. this has been a much cooler than normal summer across the bay area, especially in the tri valley area where the temperatures are usually any the 90s, employees at places which usually see a lot of foot traffic during the summer, ice cream shops, saw their business effected. workers told us yesterday cooler days and nights kept some customers away but they might get a reprieve today. the expected high here in judge has stopped the flow of federal funds to labs working on stem cell research. alison burns joins us from our washington, d.c. news reasonable with what the judge's ruling means. good morning. >> reporter: good morning to you, pam. scientists say this ruling is a shock. it is going to mean that work is halted at dozens of labs across the country. president obama lifted the ban on federally funded embryonic stem cell research last year, but yesterday a federal judge put the ban back in place. the judge questioned how the embryos were destroyed and was not satisfied with the government's answer. we talked with art torres, who says california labs will still get state funding, but the ruling is devastating to people who have been waiting for the promise of stem cell therapy. >> what you have in this situation is that you have the ability to continue to do that but not under this order in any other state except for california, that is what is so descras truss for the future. >> -- nothing can take place. >> nothing. >> -- a lot of uncertainty about what this ruling means. the justice department is reviewing it and says it will give more direction to labs about what to do next. arizona where senator john mccain is facing a challenge by a tea party candidate. however recent poles are showing him with a comfortable lead. back here at home critical funding for california schools and counties will be delayed, all because of the state's budget stalemate. governor schwarzenegger, along with the state comptroller and the state treasurer say they will delay loom 3 billion dollars in payments. they say that money is needed to make pension and debt payments. california's budget is now 55 days late as that debate continues over how to close up a 19 billion dollar budget deficit. >> we are learning more about alameda's fire chief and his car troubles. some disgruntled firefighters recently took pictures of the chief filling up his personal car with free gas at a city pump. he said the free gas is a perk that he worked out with city leaders when he took the job three years ago. however, that perk is apparently not outlined in his contract. he faced similar allegations when he was fire chief in the lake tahoe area nearly 20 years ago. well, the state senate has approved a bill to officially end state efforts to cure gays. for 60 years the department of mental health was required to research the causes and potentially cures for homosexuality because gays were classified as sexual deviants but a new bill would put an end to that calling it discriminatory, the measure goes back to the assembly for final action. >> governor schwarzenegger will make the final decision on whether tv commercials designed to make california look good must be filmed in california. the state senate passd a bill that would require ads promoting tourism and agriculture to be filmed here in the state to boost jobs and would only apply to taxpayer funded state appeals court has upheld the murder conviction of marjorie noll are whose dogs fatally attacked her neighbor. she was sentenced to 15 years to life for second-degree murder. the appeals court agreed with the lower court she lebtly engaged in behavior that was a danger to human life. noll are's two dogs attacked diane whipple in the hallway of their pacific heights apartment building back in 2001. nollar can aappeal to california's supreme court. an experienced skydiver has been found dead after his family reported him missing from the by ron airport. 55-year-old robert whip zit of martinez went skydiving sunday afternoon at bay area skydiving in east contra costa county. a search was launched when his family reported him missing yesterday morning. officials don't know why but say he did not deploy either one of his parachutes and was found half a mile from the drop zone. it has been another violent night on the streets of oakland. we will have details on two deadly in richmond. it is an effort to prevent students from skipping school. claudine wong joins us with the details. good morning. >> reporter: good morning, pam. yes, today is the first day of school here in richmond. the focus however today won't just be on the kids who are in the classroom. it will also be on the kids out of the classroom. the kids who decide not to show up for school. truancy is a big problem and police are hoping with the help of groups like the police athletic league here in richmond they can help fight this truancy problem. it is estimated that 4 million dollars in state funding was lost last year because kids just didn't show up for school. truancy rates here are double the state wide average and in richmond police say the rates of residential burglary rates by juveniles is too high. the idea behind is that kids who are not in school are often getting into trouble. so last april the city council on the recommendation of the police chief approved a daytime curfew in place from 9:00 a.m. to 2:00. >> we don't want to see students doing irresponsible behavior. we want to make sure that kids are in class so they will be able to learn. >> reporter: if a kid gets caught cutting school that child will go to a community center for counseling, then to juvenile court. basically they get a ticket with fines most likely going to the chronic offenders. kids are also through this getting social services for mental health, drug counseling and conflict resolution. there is also one other element of this program that police are considering crucial. that involves places like the place we are stand in in front of this morning. the police athletic league, one of several community groups helping out. part of the problem police say is that when they pick up a truant it takes hours to take down their parents do all the paperworkd a that keeps them from doing other parts of their job, so what they are hoping is that dropping the kids off here during the day will help alleviate that problem. we will have more on this program throughout the morning from here in richmond. live in richmond, claudine wong, ktvu channel 2 news. >> this morning police in oakland are search for suspects in two separate homicides, both killings took place last night. 1 in north oakland, the other downtown. police say a 27-year-old oakland man was killed outside a t mobile store on broadway and 12th around 9:30 last night. investigators say the unidentified victim was shot at least two times following a heated argument with another man. he died hours later at oakland's highland hospital. 90 minutes after that police were called to the scene of another deadly shooting at eddie and 34th. officers found a man shot in the head. he was pronounced dead at the scene of the his nail has not yt been released and investigators do not believe the two killings are connected. >> 5:33. a $5000 reward is being offered in santa rosa to catch a bank robber. police say the heavy set gunman you see him in this picture here robbed the bank on gurnville road 4:30 yesterday afternoon. he had a buzz haircut and wore dark framed glasses as you see here. no word yet on how much he got away with. in south san francisco the victim of an armed robbery fought off his attacker inside of his home and managed to hold him down until the police arrived. this happened at 3:30 saturday morning. police say the victim was attacked in the parking lot and managed to get away put the suspect then forced his way inside the victim's house. the two men struggled as the police were called. that suspect, identified as bryan o'rourke, was arrested and charged with assault with a deadly weapon. >> two college students are in jail this morning after being arrested on campus articled with semi automatic weapons, one of the guns a semi automatic 40 caliber pistol was loaded. the other was a tech nina salt pistol, the seem type used in the 101 california massacre in 1993 and is now banned in california, police say the two suspects were arrested after they left a journalism class. >> we don't know why they are armed if they are looking for another student at the school, so we didn't know what was going on, why they would be armed at school. >> they are identified as christian williams and reginald battle. officers say each had a concealed pistol i his backpack and say that battle is a known member of a violent east oakland street gang, both men are being held without bail. the san mateo county corp near is now working to identify the body that washed up on a pacifica beach. emergency crews found the body of a scuba diver yesterday near the beach. it is not clear what caused his death but investigators say he may have violated one of the fundamental safety rules of going out into the ocean. he apparently went into the water alone. >> that is the first thing that popped into our minds you know going into the ocean by yourself is pretty dangerous. even when you have a partner, so my suggestion is to be on the safe side always go in the water with a partner just in case something like this does happen. >> you know at this point all evidence points to an accidental drowning and police say there is no sign of foul play. >> 5:35. this could e the hottest day of the year. another spare the air day has been declared. there are also concerns about young is holding football class -- or football practice at 6:00 a.m. in order to keep kids out of the extreme heat. it is expected to reach 102 degrees right here in pleasanton later today. we watched parents at he high school come to the school yesterday for late registration, parents noted then their students are coming back to school just when the weather is heating up, which is usually not the case. parents and coaches are taking precauses to keep their athletes safe as the heat rises to normal scorching temperatures, at least one soccer practice has been cancelled today. due to temperatures which are expected to hit 107 in concord afternoon jim nas tigs classes have been cancelled at one gym in that city. these are a few spots where practices have been rearranged to take weather into account. we traveled all of the area yesterday and found ourselves at a high school asking how one coach keeps his players safe. >> we know all the symptoms and go through the first aid protect drivers who use fast track. under the bill transit agencies would be prohibited from selling or sharing driver's personal data. they would also be required to destroy information that could be
