sex couples that live in states that recognize their marriage. this entire case is based on a woman who's partner of more than 40 years died. she had to pay more than $360,000 in taxes to inherit her same sex couples estate. >> it's just unfair any way. why should i be in the position of losing my house where as similar situated opposite sex couple doesn't have that problem. it's awful. >> reporter: now some crowds people who lined up to get inside and steal some of the 250-300 sceatas were allotted to members of the public they are starting to get in. and get their seats. meanwhile you will see protestors, the crowds grow here outside the supreme court just as you did yesterday. the oral arguments inside the supreme court they get under way in about an hour from now. and they are scheduled to last just under two hours. reporting live in washington, kyla campbell ktvu channel 2 news. supporters of same sex marriage being encouraged to wear the color red or use red in your social media. the group human rights campaign changed its logo for this week. it's usually a yellow equal sign on is a blue background. but it's been changed to a pink sign on a red background. a spokesperson says the color red was chosen because it symbolizes love. california lieutenant governor gavin knew? was gavin -- newsom was an early supporter. coming up at 6:15 gavin newsom gives his take on how he thinks the supreme court will rule on proposition 8. bay area transit leaders will hold a special meeting to discuss the latest construction problem on the new bay bridge. claudine wong joins us now from treasure island to tell us the problem involves dozens of giant bolts. it sounds kind of scary. >> reporter: well, let me explain to you what the bolts do. 9-17 feet long if they are really huge. they are called e-2 share key rods. what they do is you have the cable and then you have the roadway and then you have the pier that goes down into the water. the bolts are responsible for connecting all that together. it's good it's dark. the lights help us show you where this is happening. take a look at the tower you see the it will cable that stretches from that tower down to the deck. if you follow that all the way down as it comes down toward the eastern side of the span toward oakland, right where the lights hit the deck that is where they discovered this problem. what they did they had the bolts in place since 2008 but recently as we were approaching opening of this span, they started tightening them. when they tightened them they snapped. what they have figured out is that hydrogen is likely the problem. that the hydrogen got into the metal and that is causing them to be brittle. what is not clear is how extensive this problem is. i did talk to the mtc spokesperson. here's what he said about how big he sees the problem really is. >> but on a project of this size everything gets magnified. keep in mind these are bolts. the thing we all deal with every day but they are 17 feet long. everything on the bay bridge is magnified. and the size of these bolts is a great illustration of that. >> reporter: back live here. a live look at the bay bridge span this morning. so here's what is happening in the next few hours. the metropolitan transportation commission will meet. they have a meeting at 9:30. this was a regularly scheduled meeting but it has changed now. instead of having a committee they will have the full board. they will talk about possible solutions. we have learns solutions include tylotings of all 288 bolts on the span. some met with the party's regarding changing the name of the hp pavilion. so they don't have anything to report yet. but the city has not denied the report out that hp wants to pull its name off the building. the tech blog all things digital reports that ceo meg whitmans wants to prematurely get out of its $40 million, 15 naming rights deal. insiders reportedly say hp is reevaluating how it markets itself and what it sponsors. software giant sap is interested in taking over the naming right ifsen it's founder is a majority owner of the sharks. thousands of hockey fans fill the arena. locals were surprised to hear this news and another tech company could benefit from putting its name on the shark tank. >> to get name reck nation out. yeah. i think people would enjoy to have their name up there. but if hp doesn't want it, that is okay. >> reporter: most recently part of the ncaa tournament was held at the arena last week. this is a popular venue for concerts. the mayor spokeswoman told me they enjoyed a long and productive relationship with hp and the sharks and they are optimistic they will end up in a position that is beneficial for everyone. so we weren't really giving a clear cut answer. we know contracts are negotiated with the city manager's office. we hope to hear back from the city manager to see if we can get a more definitive answer on what is going on 32-year-old victim was gunned down friday night on harbor way. he's been identified as dallon pan of alameda. investigators say his mother-in- law was unloading her car when two robbers attacked her. they shot and killed pan when he came out of the house to protect her. california lieutenant governor gavin newsom is a sought after interview this week as the supreme court hears arguments on same morgan chase responded to suspicions about bernard madoff. the new york time says prosecutors expect the banks may have violated a federal law acquiring banks to alert authorities to suspicious transactions. jp morgan believes they acted in good faith and in compliance with the law. madoff is serving a 150 year prison sentence for fraud. google is starting to notify people who will become now 6:25. the city of oakland wants to limit the pay of the man who was hired to oversee the reforms of the police department. thomas frazier was appointed by a federal judge to this position this month. he's charged of executing court mandated reforms from the riders police corruption scandal. his base salary is $270,000. he can also convert $18,000 in medical care and executive leave into cash. the dispute is over retirement benefits. the city says he should get another $10,000 a year as a part-time worker but frazier right now wants nearly $70,000 in pension. the stanford women's basketball team is joining cal in the sweet 16. last night's cardinal tramped michigan 73-40. stanford now plays georgia in washington on saturday. that is followed by cal taking on lsu. the winner of cook. >> we still following developing news coming in from san francisco. firefighters still busy. still at the scene of an apartment fire at third and mckinnon. tara moriarty has been out there since 4:30. you have new information and you say one person was taken into custody? >> reporter: yeah. neighbors say they saw one man being taken into custody. they say he had some sort of ongoing dispute with the landlord with the building. and that landlord pointed a finger at the man when police arrived. witnesses describe how a burned kitchen mat got into the garbage shoot where is where the fire appeared to have started. right now firefighters are manning hot spots for this fire that broke out 5.5 hours ago. >> reporter: it took firefighters about 2.5 hours to contain this fire and part of the challenge was a gas line that needed to be turned off. it took pg&e an hour and 15 minutes to get that valve off. about two dozen people were able to escape their homes and they evacuated the buildings with flats. one on mckinnon and another on third. and a bar was also dropped down. everyone got out safely but it was a close call. residents said they heard alarms going off and people pounding on each others doors. >> it looked like a big old gigantic infur know. i could see this close to my window. but when i stepped out back, i seen ashes like it was shooting out like a volcano. and it was coming down from the sky and i was like wow. look at this. >> reporter: the fire appears to have started in a garbage shoot. two firefighters received minor injuries. one hurt his knee and elbow. another suffered smoke inhalation. the two dozen residents are in a house nearby where red cross is placing them in temporary housing. meanwhile investigators trying to figure out what exactly sparked the fire. we understand that man has been detained. we don't know if he will be arrested for arson. we spoke with the owner of the two buildings. he has insurance but it won't cover the cost of rebuilding. he says his insurance only covers $1.5 million and it will take more than that. right now the future of all of the residents really up in the air. i'm tara moriarty ktvu channel 2 news. over night news contra costa county sheriffs deputy crashed a patrol car while rushing to a car. it happened around 1:00 this morning at san pablo avenue. the patrol car flipped on to its side when the deputies swerved to avoid crashing into a car. this morning in part two of the same sex marriage hearings the u.s. supreme court will hear oral arguments on the federal defense of marriage act. we are out there live. we us another cool morning. a lot of people out there as well. the defense of marriage act or doma defines marriage as between a man and woman. it excludes same sex couples from receiving the same federal benefits as hetero sexual couples. now people on both sides of the same sex marriage issue are carefully scrutinizing the supreme court justices comments in court yesterday during oral arguments on proposition 8. they held a vigil last night at the supreme court building. they say they are optimistic the supreme court will strike down prop 8 california's ban on same sex marriage. many of the justices questioned whether or not the court should take up the issue. if >> i think it was parent and interesting that so many of the justices asked a lot of questions about whether the sponsors to prop 8 have standing. which suggests to me there is a ruling that the court will not issue some broad ruling. >> if the court decides not to rule on prop 8 and same sex marriages would resume in california. we are not expecting to hear the supreme court until june. coming up at 6:45 we'll break down the numbers among supporters and opponents of prop 8. an eight-year-old girl who was shot in the leg with an arrow is recovering this morning. it happened during a field trip to berkeley's lawrence hall of science. it happened at 10:00 a.m. this morning. she was playing outside. investigators don't know if it was an accident or intentional. right now they are trying to figure out where the arrow came from. by the way the arrow was surgically removed. girl is said to be doing okay. we have an update on a story we've been following for months. it's about growing medical marijuana outdoors in concord. the concord city council voted to ban outdoor cultivation after some residents in one neighborhood complained. but last night at a meeting most of the speakers didn't want all marijuana farms forced indoors. the law also makes it illegal to grow marijuana where you can see it through an opening like a window. the ban is supposed to take effect before june but critics say they will continue to fight it. happening now big changes on the golden gate bridge. for the first time in 76 years there are no toll collectors. brian is in san francisco to show us how drivers are adjusting. brian. >> reporter: good morning. well certainly marks a new era for the golden gate bridge. as well as commuters and visitors. take a look for yourself. for the first time in 76 years cars are moving through the toll booths. as technology has taken over the structure. as tolls will no longer be collected physically here at the bridge. >> bye everyone. >> reporter: now around midnight this morning the last human toll taker left her booth at a family room of applause. for the first time tolls across the bridge will be taking through prepaying at certain booths and gas stations and fast track transponders or scanners that will gather your license plate information and you will get a bill in the mail later. the golden gate bridge authority says it streamlines cost and traffic at the same time. thus eliminating the need for human toll takers before they left some commuters gave those toll takers gifts and said thunk. we also talked with a few as they left their post for the last time and say leaving is very emotional. >> we're all very close. so you know it's sad. >> people are what made this job what it is. a lot of kind people. and you know, i have my memories and nobody can take them away from me. >> about 28 toll taking positions were eliminated. i talked to a golden gate bridge authority there are eight positions that still needed to be regiven out to different people. signs are posted before you hit the bay bridge about to change. they expect a bit of confusion this first week. not only with the tolls but the speed limit going from to miles an hour to 25 miles an hour. that is a major concern right now is speed. not only are some people stopping at the toll booths wondering if they are going to pay but they are dealing with a range of speed as well. some are going over three miles over the speed limit which is 25 miles an hour. there are some that are going 60 miles an hour through the toll booths as well. but to keep in mind you need to keep moving through the toll booths this morning as you leave the golden gate bridge. we're live at the golden gate bridge i'm brian flores. >> yes. it's an adjustment which we will keep watching. and sal, you grew up here. did you ever figure this day would come? >> no, i didn't see it coming. i was laughing down here saying one of these days i'm going to go i used to know there were toll takers at the toll plaza. >> yeah. >> in that voice too. this is a look at highway 4 westbound. [ laughter ] and traffic is slow. maybe by the time i'm old and retired maybe there won't be anymore slow traffic. people will be able to transport themselves to their jobs. westbound as you come up to the toll plaza there is a 10-15 delay here at the pay gates. and if you're driving on the nimitz freeway we will look at a traffic time between 238 and mowry avenue about 17 minutes. which is not all that bad. here's another guy that knows how i feel. hello steve. >> sal, i remember. i remember gas at $1 a gallon. >> right. [ male announcer ] call to get u-verse tv starting at $19 a month for 2 years with qualifying bundles. rethink possible. a lot of low clouds around. local drizzle. it will be partly sunny and partly cloudy today. 50s and 60s. welcome back. good morning, to you. here's a quick look at some of the top stories we're following for you right now at 6:44. the u.s. supreme court takes another look at same sex marriage. this time it's the federal defense of marriage act. which excludes same sex couples from getting same federal benefits as heterosexual couples. one person has been taken into custody after this early morning apartment fire. it started about 1:00 a.m. at third and mckinnon in the bay view. the person of interest had a dispute with the landlord of the buildings. two dozen people are now homeless. the owner of the building says he may not be able to rebuild. our other top story few the latest construction problem on the bay bridge. claudine wong joining us live now. she's on treasure island to tell us this problem involves dozens of the giant bolts. claudine. >> reporter: that is right. the bolts are anywhere from 9- 17 feet long and crews were in the process of tightening the nuts on them when dozens of them snapped. broke. let me show you where the problem is from our viewpoint on treasure aland. if you take a look at the tower of the new bay bridge span. follow the cable all the way down into the oakland direction where it touches down to the skyway. that is where the bolts are located. i want to give you a look at that location from another viewpoint as well. because we have a graphic from the bay bridge project. if you take a look at the right side of your screen you can see where it says east toward oakland and that pier e-2. that is the location of the problem. basically what the bolts were doing is they connect that pier to the roadway to the suspension cable. just kind of connects all the pieces together. so obviously a pretty important role they are playing. and there is a lot of them. 288. but the ones that snapped were about 30 of them that came from a 2008 shipment. they were made in the united states but apparently some hydrogen got into the metal. that is the theory. caused them to be brittle and caused them to break. we talked to mtc this morning about how big this problem really is in the big picture. >> against the larger picture of the entire project, this is a minor speed bump but it happens to -- because it happens to come in the very last months before opening i think the schedule magnifies the importance of this as well. >> reporter: back live out here taking a look at the new bay bridge span. again that is how they are characterizing it this morning as a minor speed bump. they say these things happen that is why they test them. at this point here's the plan they will have a meeting with the commission that overseas this project to explain to the board exactly what is happening. they say the cost of fixing it will range between $1 million to $5 million. it's unclear how big the problem is. we you have 2008 shipment of bolts about 30 of them. but you have the same bolts throughout the bay bridge. they want to test those too that brings the number up to 288. it will take a few weeks to get all the testing done to get a real handle on what they are dealing with. live on treasure island claudine wong ktvu channel 2 news. you heard that right. you may be hearing those loud sirens today if you live along the coast. a tsunami warning test will take place later this morning along california beaches. in the north bay emergency workers will use a plane to broadcast information to the public. and test out a phone system and will have message boards in place all along the coast. sacramento city council has approved an arena deal to keep the city's nba franchise the sacramento kings. the city would pay roughly half the $448 million needed to build a new downtown arena in sacramento. the arena plan goes before a panel of nba owners one week from today. that committee will weigh sacramento plan along with a competing arena idea from seattle. stay tuned we'll bring you a live report from sacramento coming up at 7:18. as the supreme court takes on the issue of same sex marriage we want to take a look at the controversial issues by the numbers. according to a 2011 ucla study there are nine million gay, lesbian, bisexual, and trance gender people just in the united states. 142 that is the number of days in 2008 that same sex marriage was legal in california before voters banned it with proposition 8. roughly 18,000 same sex couples in california got married during that 4.5 month period when it was legal. we'll continue to stay on this story throughout the morning and throughout the day. for more on the legal battle over same sex marriage you can go to our website ktvu.com. we posted the full transcript of the prop 8 oral arguments. time now 6:50. let's talk traffic. sal, what are you focusing on?
