struggling to put out a wildfire in the east bay this morning. that blaze is burning at mt. diablo state park. so far, it is at least 50% contained. nbc bay area's christie smith is live this morning with the latest on the overnight efforts, and let's hope in those cooler temperatures they were able to make a little progress overnight. christie? >> reporter: good morning, bret. i can tell you it's already quite warm out here this morning. that has been helping firefighters overnight. what they're telling us, they're going to map this fire again at daybreak to get a better handle on exactly what it did overnight and what the plans are for today, but we can tell you that this fire was threatening at least one, possibly more rural homes here in the area of curry canyon and morgan territory east of mt. diablo, threatening but so far residents not packing up and evacuating. this was first reported yesterday around 4:00 in the afternoon in that blazing heat that we were dealing with. it was burning grass and oak trees. at least 200 firefighters out here from cal fire and surrounding fire districts helping out. we're told that helicopters and other aircraft expected to go up again at first light and begin helping again. crews, of course, trying to head off the flames, keep them away from homes in the area. but again, this is a very rural area. last word, as you said, that we have 50% contained, about 375 acres burned. we can tell you that one firefighter was slightly injured. apparently stepped into a hole and twisted his ankle. we'll keep on this, put some more calls into the fire department and we'll have the latest information for you when we check in again in about 45 minutes. reporting live in contra costra county, christie smith, nbc bay area news. >> thanks a lot, christie. two people are in the hospital with injuries from a boating accident in vallejo. it happened at about 5:00 p.m. yesterday at glen cove flmarinan vallejo. the man on board suffered burns over 60% of his body. a woman with him also reportedly badly burned. a man was burning excess fuel when his boat went up in flames. pack your patience for your commute today. high temperatures could mean a repeat of some of the troubles we saw for b.a.r.t. yesterday. the heat causes warping on the tracks, so trains would have to slow down, and that causes delays. and several b.a.r.t. train control rooms also overheated, leading to more delays. >> it's really hot in here right now, and the computer equipment is not talking to the operations control center, letting the operations control folks know that there's a train in the area. >> caltrain saw delays as well, so they'll have to slow their trains down too to prevent warping on the tracks. the hot weather forcing vallejo to open a cooling center after a midday power outage yesterday. 4,300 pg&e customers lost power. they do have power back on this morning, which is good news. >> it will be filled today. moving without packing a single box sounds great, but residents in one neighborhood in campbell aren't so thrilled about it. santa clara county is in the process of turning over pockets of unincorporated land to local cities. one of those pockets is a neighborhood wedged between san jose and campbell. last night 100 people protested at a community meeting with san jose officials. they say they would rather become a part of campbell because of massive budget cuts in san jose. so far, no official decision has been made. police say the driver of an suv that ran into five people near a bus stop in san francisco did not have a license. the suv jumped the corner of san bruno and arletta avenue in the visitation valley yesterday morning. right now two of the victims are listed in critical condition, the other three are in serious conditions. the 24-year-old female driver told investigators that the brakes on her ford explorer failed as she was coming down the hill on san bruno. the church trial of a presbyterian minister in napa is expected to wrap up tomorrow. the reverend jane spahr is accused of violating the laws of the presbyterian church when she married 16 same-sex couples back in 2008. during the time, gay marriage was legal in california. the redwood presbytery filed charges against reverend spahr for violating the church's constitution. it says marriage is between a man and a woman. as the issue is debated in federal court, more and more churches will be forced to perhaps have the same conversation. >> i'm hoping it will be, that it will be a step on the way of allowing clergy to marry same-gender couples, as they do heterosexual couples. >> many of the couples reverend spahr married are testifying as witnesses. if found guilty, she could have her ordination revoked. stock market begins this morning with a housing hangover at a seven-week low, and scott mcgrew joins us now. scott, no recovery yet. >> not when you take the nation as a whole, brent. when it comes to middle class housing and home sales, national association of realtors shocked even pessimists on tuesday when it said home sales in july fell to their lowest level since 1995. before the dot-com boom. and the size of the decline, more than 25%, was huge. the biggest since lyndon johnson was president. now, the data is particularly disturbing because there are so many things that should be working. mortgage rates are at their lowest ever. there are plenty of homes s ts choose from. and those homes are, relative to the boom, are reasonably priced. all the factors are there for buying, but there is very little buying. the dow fell about 1.3%. futures call for that slide to continue today. now, you're going to get more home data today. new home sales, and then we'll get more reports after that. brent, oftentimes many of these reports are referring to the same sorts of situations and they can be conflicting, but this report we got yesterday, particularlying in. >> let's hope they conflict and we get better news today. san francisco mayor gavin newsom will announce a new option for green drivers this morning. he'll unveil toyota's new hybrid and the new charging station. that will be at the civic center plaza across from city hall. let's check the morning commute with mike. things getting busy out there? >> right now, a little early. but we'll get a nice, easy look at the bay bridge toll plaza. you see a steady flow of cars coming out of the maze. the maze approached no major delays. speeds creep down below 20 miles per hour for interstate 880. 580 as well as east shore freeway approaching the area. now look over at the caltrain status. talked about b.a.r.t. and the delays yesterday. no problems for caltrain and b.a.r.t. reports 35 trains reported on time. but caltrain, some of those delays are caused because of the heat, causing a possible warping of those tracks. that's pretty high temperatures. >> yeah, no kidding. that is really high. >> they slow the trains down and get those delays. >> it's so hot, i can't tell if it's because we've been so spoiled and cool. >> i think it's hot. >> actually get up to 98 degrees in san francisco, tieing the all-time high temperature for august. that is pretty amazing to get that right around the peninsula. san jose, one of the spots around 100 degrees. when you have a day that's hot, you can drop almost 30 degrees overnight and wake up to 75 degrees. that's what we have this morning in san jose. still no sign of a sea breeze yet. later today, we'll see that start to pick up. right now, 71 in oakland, and the cool location, if you want to call it that, san francisco, 67 degrees. that's almost a 30-degree drop from yesterday afternoon. west wind at 6. that should be quite a bit strong by the evening and that is the reason why, at least the coast and peninsula will start to cool by midafternoon. warm start to the morning, fast warming by lunchtime. i think we'll have a lot of 90s inland by noon today. as the ocean air-conditioning switches on, what we'll probably see is the coast and peninsula cooling off, and then everybody cooling off for tomorrow. air quality, still moderate around the bay area. that 86 i'm calling for san francisco, probably hit that around noon today and we'll hopefully level off as the sea breeze picks up. otherwise, inland, 90 to 100. tomorrow, that's when the sea breeze really kicks. we cool off dramatically as we get into the weekend. one more day of heat and much cooler tomorrow. we have new video this morning of a fire tornado spiraling through brazil. a whirlwind of flames twisting several yards into the air, fed by brush fires and strong winds. that scene brought traffic to a standstill on one highway there and you can see the fire has pretty much burned all the brush there. they have had leaks of drought leading to brush fires all across brazil. farmers are now banned from burning sugar field waste. teams will patrol areas south of the uc berkeley campus overnight tomorrow through saturday. the move follows an increase in violence, sexual assaults, and homicides in that area. extra police will also be added before and after home football games at cal. officers will be cracking down on underage drinking, fake i.d.s, and noisy parties. fines can be up to $2,500. a crime bill that allows convicted child molesters to be locked up for life is headed to a vote in the assembly. it's called chelsea's law after a san diego county team who was raped and murdered this year by a convicted sex offender. the bipartisan bill would increase penalties and sentences and would make treatment mandatory for the most dangerous offenders. chelsea's law was approved unanimously by the state assembly yesterday. love could be in the air in oakland. we'll show minutes. now to a bizarre story this morning. mexican marines found the bodies of 72 people at a rural location in northern mexico. they made the discovery after a shoot-out with suspected drug cartel gunmen. one marine died, three suspects died. it appears to be the largest cartel body dumping ground in mexico. frustration is growing, the death toll rising due to the massive flooding in pakistan. scuffles are breaking out among flood victims desperate for aid. soldiers were forced to fight off crowds that rushed them for clean water supplies. floodwaters have cut off about 800,000 people from rescue crews and supplies. it's been over three weeks since flooding started in the country, and so far 17 million people are affected. 33 miners trapped in a mine in chile are rationing their food. they do have supplies, but they can only eat small amounts every other day. they now know that rescuers are working to get to them, but what they don't know is that it's going to take several months. an important machine arrived yesterday. it has a drill with a diamond tip, but it's going to take three days to assemble that machine and then four months to reach the miners. they have been stuck there in a cave since august 5th. this morning, the results are in for key elections in five different states. the election featured u.s. senate, house, and gubernatorial races. but the two biggest contest were the senate races in arizona and florida. john mccain, one step closer to his fifth term in the senate, after spending more than $20 million to fend off the competition in the gop primary. critics argue the senator has lost touch with his conservative roots, but mccain says he's worthy of the job. >> i take nothing for granted. i'll fight with every ounce of strength and conviction i possess to make the case for my continued service in the senate. >> meantime, in florida, four-term congressman kendrick meek beat real estate mogul jeff greene in the democratic senate primary. experts are now trying to figure out what the message voters sent during the first round of primaries. the main lesson seems to be, don't count the incumbents completely out. despite voter anger over things like the economy, they may not be pushing washington insiders completely out. and democrats could keep their senate majority in november. >> i want to thank president obama for helping me with this victory. >> a new reuters poll shows that only 45% approve of president obama and the way he's handling the economy. so how are those new banking rules treating you? scott mcgrew says you may not be saving that much money. >> you're talking about the card act that went into effect monday. that's the credit card accountability and responsibility disclosure act or card act. we've been talking about those and how they change the way your banks can charge you money. the changes are all generally good for consumers, but make no mistake, the head of a major bank, let's say san francisco-based wells fargo is not going to tell its shareholders the company will make less money because of this government act. banks are in the business of making money. so they are going to find other ways. watch for higher annual fees. you may have already noticed a bump in fees for out of network atm use and credit card interest rates are hitting new highs. well, if there's something more dependable than banks wanting to make money, it's apple announcing something new. the latest talk in the blogasphere is that apple will announce a new effort, brent and laura, in its appletv project come december 7th. apple was the first to offer tv through itunes a couple of years ago, but they've been outpaced by -- you've got hulu and other big services. we'll talk about the radical changes in the bats. they lit up the san francisco red. san francisco getting started with three runs in the first and it was downhill from there. buster posey bringing in three more with this home run in the fifth. giants go on to win, final score, get this 16-5. they're going to go for the sweep again this afternoon. now, the as take on ohio's other team, the cleveland indians, that's at 4:00 this afternoon. and last night, gonzalez pitched seven shutout innings, picking up seven strikeouts. and jack cust helped with a two-run home run a little bit later on in the game and the as get the indians, five-zip. despite no approval from major league baseball and not making it to the november ballot, we still have our first look at that new as stadium in san jose. the baseball san jose organization released these digital pictures of the proposed cisco field, which would be located near highway 87 and the as pavilion. they have an open outfield, which means that visitors outside the park might be able to catch a home run ball. groundbreaking a still a long ways off. the debate is whether the giants own the territorial rights to san jose, so this thing may not ever happen. listen up, fellas. right now we have construction clears still clearing from 101 northbound, heading all the way up past alum rock and santa clara. watch for that coming into downtown. the slowing we saw earlier, that is cleared as well. and the volume will be picking up as well coming past san jose state, because classes are back in session today. you'll see a lot more cars through the area. yesterday we saw huge backups coming off of 680 northbound, 280 through this area. 101, 87, 880, they all showed big slowing. so the commute is definitely back for the south bay, and the peninsula as well. 880 coming through oakland. good slowing in the northbound direction as well, coming past the coliseum, the current home of the as. and traffic flows nicely around the bend here. southbound side, we saw good slowing right around the transition over to 92. pretty early in the commute yesterday. about 6:30 is when we started to see some slowing down towards 50 miles per hour. we'll watch for that again today. this curve moving smoothly. another curve through the sunol grade. southbound side starting to show some slowing coming through the construction zone. that's the h.o.t., the hot lane. and with don't have a sea breeze developing yet this morning, but it will be picking up this afternoon. again, 75 right now in san jose. oakland, 71 degrees. really need to see the winds crank up to provide some cooling. west wind at 6 in san francisco. 67 degrees and that sea breeze should be turning stronger as we head into the afternoon. now, speaking of san francisco, an earlier start to the game today, should be well into the 80s. so it's the sunblock instead of sweater weather as you head out to the ball game. but i think around, say, the eighth or ninth inning, we'll see the sea breeze pick up and cool off as we head towards the evening. our weather headlines this morning, waking up to mostly 70s this morning. in fact, mt. diablo this morning, some of the hilltops in the low 80s to get the day started. around lunchtime, the coast, well into the 70s and 80s. 90s by noontime. and the difference will be around 3:00 or 4:00, as the ocean air-conditioning starts to cool in, we should see some cooling, especially for the coast today. as we go through the next few days, air quality should improve. but as long as high pressure holds its ground for one more day, inland spots, talking 90s, and 100-degree temperatures for concord, livermore, and areas south of san jose. and as the sea breeze turns stronger, especially around this time tomorrow, it will lead into a cooldown from thursday, friday, and into the weekend. highs in the 70s as we get into saturday and sunday. inland temperatures today, we're off to a running start, as we like to say, with 70s and 80s in some of the warmest spots this morning, having no trouble jumping into the 90s by lunchtime. san francisco and oakland, we should see our highs probably around 11:00 or noon, factoring into the sea breeze, picking up the midafternoon, if that doesn't materialize, may see another day of 90s in parts of the peninsula. tomorrow, for sure, that sea breeze will be going strong, we'll be cooling off and actually turning chilly as we head towards the weekend. big drop in temperatures headed our way, getting started tomorrow. >> a wide range of wardrobe as well. thanks a lot. wine makers are battling it out in the nation's only contest of wines made from fruit grown in colder temperatures. in all, there are more than 330 entries this year. they come from 60 wineries in 17 cold climate states. university of minnesota has developed several cold hardy grapes that are used to make a variety of wines. several awards are up for grabs including best red, best white, and best specialty wine. the winning wines [ male announcer ] wells fargo. with you when it's time to save. ♪ smoke caused parts of the east bay. firefighters are working to get a handle on a big brush fire. good morning, and thanks for joining us. i'm laura garcia-cannon. >> and i'm brent cannon. it is coming up on 5:30 and we have another day of potentially dangerous weather ahead. meteorologist rob mayeda has more on how to keep your family safe. because, you know, rob, we've been used to a cold summer, and all of a sudden, not only hot, but record hot. it could be dangerous. >> yeah, you know, it really adds to the respiratory stress. we issue a hot advisory around the bay area, not only for the high temperatures, but the effects it has on your body through the afternoon. 67 in san francisco right now, on our way at least into the 80s. san jose and oakland seeing temperatures in the 70s right now. now, notice the temperatures around lunchtime. already mid-90s in parts of the bay area. hottest places again today getting towards 100 degrees around the tri-valley and morgan hill. but notice san francisco. some signs of cooling again today. we'll talk about that in a few minutes. laura? >> talking about the effects of the heat, the soaring temps could also slow your commute. nbc bay area's kris sanchez live at the fremont b.a.r.t. station this morning. chr >> reporter: it wasn't just one transit system, it was a one-two punch for commuters, because that triple digit heat meant trouble for the rail lines themselves, and also for the commuters that run the whole system. that was the situation on the b.a.r.t. line yesterday. i'm here at the fremont b.a.r.t. station, where riders were stuck when the b.a.r.t. train control rooms overheated because of an air-conditioning problem. that put trains into manual mode. and that meant driving trains at 25 miles an hour instead of 75 miles an hour. so you can imagine the backup there is. on caltrans, the trains were slow as well, but for a different reason. when it is this hot, caltrain slows down the trains so they don't warp the track themselves. passengers were steaming. though today is expected to be a few degrees cooler, commuters are expecting more of the same, and that's why one commuter tell us he will take b.a.r.t. from fremont to daly city and carpool in the evening. >> i think like myself, a lot of other people probably feel the same way. you know, they would rather find a much cooler route, you know, because it's extremely hot. it's a nightmare. >> reporter: now, we will know in a few hours how the evening commute will shake out. it seems like most of the folks who commuted in the morning hours, they were not affected this early in the day. we'll have to see how that works out for them. it could turn out that a few degrees of temperature that the commute will be a grind if many of these folks, at least on the way home. kris sanchez, nbc bay area news. students who just returned to class are now certainly feeling the heat. there are a few bay area school districts that do not have air conditioned classrooms. and because of record high temperatures reaching triple digits, some schools ended up canceling after school sports. the cdc says the key to keeping cool is using common sense. if you can, drink sports beverages, because they replace the body's natural salts and minerals. wear appropriating clothing and wear a sunscreen with an spf of 15 or higher. make sure you pace yourself. all the heat is making firefighting efforts overnight very tough. crews worked overnight on the curry fire near mt. diablo park. so far, it's 50% contained. one firefighter sprained his ankle. nbc bay area's christie smith will have a live report from the fire zone coming up at 5:45. 11 homes now destroyed in a fire in southern oregon. that one breaking out in the town of ashland. burned about six acres of grassland, so it wasn't really big, but it did destroy all of those homes. the flames are out, however firefighters are still on the scene. they stayed there overnight to make sure it didn't re-kindle and flare up again. a bidding war over an east bay tech company continues. scott mcgrew joins us. >> it's three par, here's a company that nobody's heard of, basically, outside of fremont and all of a sudden it's in the news. you've got two major companies bidding over it. a huge bidding war between hewlett-packard in palo alto and dell down in texas. it turns out that three par is at the center of cloud computing, at a time that both high pressure and dell realize the physical computers they sell, not a business that's going to pay off for much longer. three par says it will start talking to high pressure today about its bid, but still welcomes a counterbid from dell. whatever happens, it's making those investors in the fremont company very, very rich. and san francisco based wilhelm sonoma is recalling baby bottle warmers called biba, they apparently work too well, getting hot enough to cause burns. return it to the store for a refund. here's something i thought you might like. what do to technology and sumo wrestlers have in common, and what kind of technology do they like best? they like the ipad. why? because they have so much trouble using the iphone. reuters says the wrestlers' officiating body in japan will distribute ipads to athlete there is, because they can't text message and use the buttons on the iphone very well. the ipad -- >> because it's bigger? >> it's like an iphone for them. >> they hold it up to their -- >> i have little potato fingers myself and i'm not even a sumo wrestler and i have trouble hitting those little keys. >> he just wants an ipad. let's talk about frank, tropical storm frank, joining strength along the mexican pacific coast, dumping heavy rain on some of the country's most popular resort destinations. at least one river overflowing so far. so far, at least 50,000 people are affected by this storm. national hurricane center says the storm could become a hurricane by week's end. all right. want to check in with rob, taking a look at some of those conditions. i mean, the weather's kind of crazy. you've got the flooding in pakistan, hurricanes, hot weather here. >> driven by the summer weather. you know, frank, good news with that, that storm will move away from the mexican coastline, probably stay south of cabo san lucas as it weakens. the heat, these are the leftovers from yesterday. a lot of warm air left behind. 75 to start off the morning in san jose. 71 in oakland. 67 in san francisco. and that's the site to watch, not only for the sea breeze, but we've got an earlier start to the giant's game today, just before 1:00, i think we'll be well into the 80s. then, by, say, the seventh inning stretch, we'll see that sea breeze cranking up and cooling things off. for the peninsula and coast, highs reach around lunchtime. the rest of the bay area, pretty hot. 90s to 100 degrees above inland for the hottest places in our inland valleys. that's why we have the heat advisory up for the inland valleys tomorrow. tomorrow, highs only in the 70s. sometimes when it gets this hot, the rails and the roadways can buckle from all the heat. we don't see that too often here in the bay area. >> and as we saw with b.a.r.t., too, the computers overheat to go. >> can you imagine being on a hot, sticky train with a lot of your closest new friends? >> yeah, yeah, i can imagine. no delays reported for that system. rob talked about the giants' game today, should be beautiful. dry right now, but it's a little early. it's a 12:45 game. more traffic on the bay bridge as folks head into town. any avenue into the city, you might want to consider mass transit. no delays reported yet in caltrain. that station right by the ballpark. easy drive on tupphe upper deck the bray bridge toll plaza. steady volume coming off the maze. watch for metering lights in an hour. if you're in the south bay today, watch out for zombies, they will be on the loose. and apparently there's nothing to fear. turns out they do have a heart. nbc bay area's bob redell is live now -- that is not bob redell. i don't know -- bob, what is going on? >> we're doing great. mike, before we get to the grill, let's talk a little bit of football. 49ers, you got to love coach mike singletary and everybody talking about alex smith again this year. what do you see for the 49ers? >> i see them winning the division, i really do. in part, i think they're a very good team and arizona has taken a step back without kurt warner. they have not solved their quarterback issues with either mike leinart or derek anderson. nobody has stepped up. alex smith again getting a chance to be the number one pick in the draft. i have a few questions about that. but running the ball with gore, the defense led by patrick willis, they'll win the division this year. >> let's skip across the bay to the raiders. they've had a rough ride the past couple of seasons. is this the time they're going towner around and start heading in the right direction? spl i really think they are. last year you see what went on. when that team was behind, they had no confidence in jamarcus russell. when bruce came in, they had some confidence. i like jason campbell, always have. i think he's going to do a good job there. defensively, they needed to step up and stop the run. they bring in a linebacker from alabama. i like him right up the gut as well to be tough against the run. i think this could be a 500 ball club, maybe 8-8, possibly 9 in 7, which would be a shock in the bay. >> that would be a step in the right direction. let's talk grilling. i see you have quite a spread going on there. >> we know everybody can't get to the game, so we're talking about grilling at home, right in your backyard with your family and friends. we use the max lite kingsford charcoal, and my recipe this year will be steak pizza. we're not ordering pizza, we're grilling pizza. you can grill whatever you want. put your own personal ingredients and make your own type of pizza. >> he's got the pizza smelling great, a heck of a lot better than ordering in. you know, labor day is not a time to put away your charcoal grills. labor day is a time to extend the summer fun, okay. labor day, football season, that's the time to fire it up. what i've got here, he's got a few mexican flavors going on with his pizza. i decided to do a grilled gawk mo guacamole and a coal-fired pico deguy owe. >> go to kingsford facebook, a great promotion, college football showdown. you can pick against me or pick against others around the country, get a chance for a $10,000 backyard makeover if you pick your games well. >> sounds awesome. mike and chris, we do appreciate your time this morning. not even 6:00 here, but i can definitely go for a little pico. thanks, guys. >> thanks a lot. well, the raiders are dealing with a little bit of bad news today. head coach tom campbell made a surprise announcement at last night's practice that one of his most promising players is out. >> let's talk about who didn't practice today. chad has had a procedure on his knee, an arthroscopic procedure. i can't tell you yet as to a timeline, but we'll know that pretty quick. >> campbell did say he hopes the wide receiver will be back for the season opener on september 12th. he missed his first eight games last season after breaking his foot in a training camp. it's 5:46 right now. you're watching nbc bay area news. >> rob will have a look at the forecast coming up in just a bit, because he's keeping tabs on just how hot it's going to get. first, we want to check in with kris sanchez this morning. and she is taking a look at another scorcher as well. kris? >> reporter: good morning to you, brent. we are here at the fremont b.a.r.t. station, but this is not the only place where the commute could be cooked, so to speak, by that triple digit heat. here at the b.a.r.t. station, the problem was overheated computers. the air-conditioning units that are supposed to keep the computers nice and cool, well, they shut down and that forced the agency to switch trains into manual mode. and when that happens, the trains go about 25 miles an hour instead of 75 miles an hour. you can imagine the backup there. on caltrain, trains were slowed too, but for a different reason. that's because when it's this hot, caltrain slows the trains down so they don't warp the track as they drive on by. on ac transit, passengers were just sticky and steamed. we talked with a dozen passengers this morning, most were delayed for about ten minutes or so, but we did find one who had an hour and a half late commute getting from downtown san francisco to fremont. >> i mean win just figured it was a train broke down. >> reporter: so you just kind of count on being late? >> pretty much, yeah. >> reporter: well, we will know in a few hours how the commute will shake out, but if yesterday was any indication, folks should really try to enjoy the morning commute, because it was the afternoon commute that really was the problem. in fremont, kris sanchez, nbc bay area news. >> all right. thank you, kris. and the hot temperatures also a problem for firefighters today. homeowners in a rural area of contra costra county keeping a close eye on a wildfire we've been covering. this one burning at the mt. diablo state park. nbc bay area's christie smith is live with the latest on the firefighting effort. and not only do they have to battle the flames, but the hot temperatures, christie. >> reporter: that's right. good morning to you, brent. here it is, not even 6:00 a.m. yet and it's already hot here in contra costra county. but it's not windy and firefighters are saying that's really helping them out, to fight this fire. and they tell me that it hasn't grown substantially overnight at all. this is burning just east of mt. diablo near curry canyon road, southwest of morgan territory road. initially, there was at least one home, maybe more threatened, but firefighters were able to protect that. there are more than 200 firefighters out here, and they're getting a break now from that roaring heat from yesterday when this fire broke out around 4:00 p.m. this fire is burning in a remote area, thick grass and oak woodland. hard to get to, but scary, nonetheless, if you live close enough to see smoke. latest word we have that this is about 50% contained, 375 acres burned. not sure yet, they say, exactly how it started, but they're checking to see if perhaps a downed power line played a part. firefighters telling us they hope to have this fully contained some time later today. reporting live in contra costra county, christie smith, nbc bay area news. >> we'll be following the progress there. thanks a lot, christie. let's talk apple. reportedly, they are reporting changes to the way it sells tv shows online. apple, in many ways, is late to this party. >> they really are. when you think about, it's kind of strange, because apple invented this idea of selling tv shows online for $1.99. this was several years ago. we've seen all kinds of services, though, most notably, hulu.com, do the exact same thing for free. this morning, dish, the satellite tv company, showing off its version of online television, again, for free, assuming you're a dish customer. cable company, comcast, has a similar program. all this comes as regular tv is under fire. you know, the kind where you just watch tv on tv. the cable industry says the number of subscribers fell, all of a sudden, as if everyone turned off their cable all at the same time, down 700,000 in the last three months. six of the eight largest cable companies said it was their worst quarter for subscribers ever. so back to apple. nbc, the new side of it, has confirmed that apple is in talks with the network, including the entertainment side of nbc, abc, cbs to provide 99 cent rentals of new tv shows on apple itunes and apple is working on a new upgraded appletv device. you know, many people, brent and laura, forgot apple even had a tv device. it's been a very, very small market for them. but apple is seeing this sudden crump in cable subscribers, this huge boost in hulu and what not, and saying, we want a piece of that. >> sure, exactly. everybody getting everything right there, in their living room. thanks. i don't know if you want this. transportation security administration using what it calls enhanced pat downs at two airports. right now the new method is only used by agents in boston and las vegas. the "boston herald" reports that the pat downs are more aggressive and agents run their palms over travelers' bodies. one traveler called the method invasive and probing. new this morning, good news for weary travelers. many hotels are picking up the airline baggage fees. chains like holiday inn just started a promotion offering to pay the checked baggage fee on some u.s. carriers. hotels owned by intercontinental hotel group will reimburse any party up to -- excuse me -- see, i'm getting choked up about saving money. they'll pay you up to 50 bucks for a stay, and other hotels will knock the baggage price right off the price of your hotel. >> even the way you save money changing with the times. many coupons, still the traditional, paper ones. valpack has been sending those in the mailbox for nearly 40 years. but now they're moving beyond the familiar blue envelope. there's a website you can print your own deals and a coupon app for your cell phone. >> they want to see a dollar value on that. what they're looking at, this is worth $10 off, $20 off, $500 in their hand. >> $500? some of the same deals in your mailbox can be delivered on the screen of your phone. what's wrong with this picture? check out the guy in the background. a family of four, they were touring the state capital in madison, wisconsin, when they stopped to take a photo. little do they know, the snapshot captured more than a memory, it captured the image of a thief stealing the family's bag. the family showed the picture to security that nabbed that suspect. it's a good thing that camera was working, because the capital security camera was not. lindsay lohan scoring an early release from jail and she is also springing out of rehab ahead of schedule too. nbc news has confirmed that the hollywood starlet was released overnight. she served 23 days, but was originally sentenced to 90 days in rehab and 90 days in jail for violating the probation terms of a 2007 dui conviction. the 24-year-old spent only 13 days in jail, because of overcrowding and good behavior. her probation, though, runs through next august. all right. good behavior on the roadways this morning? let's hope so. but we're already seeing some backups? >> we are seeing some backups. we'll try to keep you ahead of schedule, like lindsay lohan. if you can beat the backup coming through livermore, do it. right now we see this slowdown coming out of the altamont pass, 15-minute drive from the pass over to the dublin interchange, the bulk of your slowing before you get in towards livermore, at the city limit there. westbound, highway 4, the slowing starting before you get to a street, to 160. moving over toward summerville. you'll see this area, willow pass, a burst of slowing as well. a burst of slowing is an oxymoron. a little later on in the commute, we'll follow this highway 4 commute, but we'll take you a little further back, further east, highway 12 is closed again as it was yesterday, from 7:00 a.m. to 4:00 p.m., between 160 rio vista, coming out of rio vista and i-5. that will affect you if you're heading over toward the central valley, sacramento county, that's due to construction work going on today and tomorrow, getting ready for those winter roadways. take 160 up toward walnut grove road in walnut grove, cut over to i-5. that will add about 35, 40 minutes on to your commute. keep that in mind. meanwhile, the commute at the bay bridge, the toll plaza, a smooth drive. easy volume as traffic coming through the maze. no major slowing yet. east shore freeway, 18 minutes off that. 880, a smooth drive as well. nice, nice look there. but the nimitz is starting to get clogged. more congestion there as we see the return from summertime light traffic. >> everyone hitting the roads once again. >> getting the summertime temperatures. we just did not have them all summer. and now to kick off the tail end of summer, we certainly have them. >> we had two months without summer and caught up all in one day yesterday, temperatures well into the 90s. here's a view, san francisco looking off to the east towards mt. diablo. we're closely watching that fire burning on the east side of mt. diablo. san francisco, 67 degrees. just a hint of a sea breeze this morning, a west wind at 6. hour by hour. lots of 70s through breakfast time. short leave weather all day long. notice san francisco and oakland. hottest temperatures of the day there, likely to happen around lunchtime. as we jump to 4:00, look at san francisco and the coast starting to cool off a little bit, but still 90s to above 100 degrees inland today. one more hot day inland today, and then that sea breeze turns stronger, especially by this time tomorrow, and that's going to lead to a big drop in temperatures as we approach the weekend. back to you. time now is 5:56. the 49ers get into a different type of gaming today. we'll explain that coming up. plus, your first look at the plans for a new as stadium in san jose. why the design could be good news for people wanting to catch a home run ball without buying a ticket. and our zombie is coming along pretty well. we've been showing the makeup transformation going under way. how you could also get this ghoulish look and why you probably want to do it, because if you go to an event tonight where it's appropriate, you'll need to look like that. taking a live look outside. beautiful bay bridge, is that not gorgeous?
