Thats where you want to look for the warm water that would indicate an el nino developing. The latest forecast coming in from noaa has an 0 chance of el nino continuing into winter of 2015 and 2016. But here is the huge headline. The strength could be strong to strongest. So, what would that mean for the bay area . For strong el nino there have been four events in 65 years, have of them have been wet, half have been drier. Meant 2 1 2 inches of surplus rain in San Francisco. Immigration court here in San Francisco has a backlog of nearly 30,000 cases. A dozen different judges hear cases four days a week in a private Office Building off montgomery street case loads often reach 65 people or more in one afternoon. Its a system even the top administrator in washington, d. C. Says is in bad need of repair. Would you agree the systems broken . I would. Reporter the need to speak out and try to change that system prompted director juan osuna to sit down for the first time and speak about these issues on camera. Our judges and the Appellate Tribunal decides who says it and who goes. Reporter the director oversees the executive office of immigration review or eoir a division of the u. S. Department of justice. The reality is that the system is overburdened. Absolutely. And that works to the detriment, not just the system itself but people waiting for their hearings a long time. Reporter after the backlog and overburdened cores for director osuna, one of the biggest shall use involves stories like these. Translator when i was in detention, i had a lady that told me she was an attorney so i paid her. In the end, she wasnt one. She just it was fraud. He charged us 3,000 and he didnt do anything for us. Certainly, judges need the decisional independence to not be worried about whether theyre handling enough case and going fast enough to satisfy their supervisory boss. Reporter technically, judges, such as Dana Lee Marx of u. S. s Immigration Court are attorneys and employees of eoir serving under osuna. They work for the executive not the Judicial Branch of government. Judge marx spoke to us as president of the judges union and did not speak for the Justice Department. Many many many knowledgeable lawyers in the field are coming to the conclusion that the Immigration Courts structure needs to be reformed. Reporter this point, director osuna disagrees. He says it would cost a lot of money and take a Major Overhaul to create a new separate Immigration Court system outside the u. S. Justice department. In my time i have never seen the Department Reach in and tell an immigration judge how to decide an individual case pending before him or her. In fact, the department the Justice Department has been extremely careful in respecting the decisional independence of immigrational judges and continues to do so. Reporter osuna credits the Obama Administration for beginning to change this bang lock system. Last year the eoir gotten a 11 jump in funding, 65 new judges hired in the last two years. The upcoming budget request asks for an additional 134 million in order to hire 55 judges and their staff. We are hiring a large number of Immigration Judges to make up not only for the new hires that we get but also for the significant attrition that we suffered through the budget restrictions over the last three years. Reporter but the director also admits all of this is only a temporary patch. It is a good start, but it is not enough. Reporter the real fix for what almost everyone agrees is a broken u. S. Immigration court system will have to come from Congress According to director osuna, something so far congress has been unable to do. The Immigration Court system like the rest of the Immigration Court system that we have in this country at dhs and other agencies is in serious need of reform. Reporter not only is all this taking a toll on the immigrants caught in this legal limbo, but its also taking a toll on the judges who must deal with the incredible backlog and sit in judgment. Director osuna says he is concerned that more and more Immigration Judges are choosing to retire early on take a break due to stressrelated health issues, further putting pressure on an already overloaded system. Scientists are testing the oil to find out where these tar balls are actually coming from. Beaches have periodic seepage from the ocean floor, you get tar on your feet occasionally in small quantities, thats not whats going on here. All oil spills are serious. So when we see anything on the water and the petroleumbased product, everything we got. Next step a lab test will reveal more details about the oil and where it is coming from.
