mayor, chuck reed, which could involve thousands of city workers. >> it was certainly the elephant in the room at the state of the city address in san jose. >> i want to make sure our employees and retirees get paid what they have accrued. >> tonight, the controversy uncovered by nbc bay area's investigative unit. tonight, a follow-up to that probe. we begin with our investigative unit. >> we're disappointed. we're frustrated. and we're upset. >> to find out there's been dishonesty along the way, is difficult to even comprehend. >> reporter: city employees and union reps are speaking out, following an nbc bay area investigation that revealed the retirement cost prediction used by the mayor of san jose wasn't based on real data. >> mayor reed lied, misled and deceived the public and the members of t san jose city council, concerning the true fiscal conditions of san jose. >> reporter: five unions filed this complaint with the city of san jose, saying chuck reed misrepresented the facts, to sell a fiscal disaster. our investigation found the mayor claimed retirement costs could reach $650 million by 2015. even though the official projection stood at $400 million. >> the mayor was told not to use that number. that the number was $400 million. that was the projection. >> i don't recall anybody ever saying not to use that number. i understood it was a rough estimate off the top of his head. >> reporter: we caught up with the mayor after the complaint was filed. do you regret using the figure $650 million? >> no. i think that's a ballpark figure for the kinds of problems we might experience. >> reporter: what about the people who were upset you were using that figure without anything to back it up? >> they can be upset. it's their right. >> reporter: council members are also speaking out. >> this would be a big marketing scheme to push a pension reform scheme that the mayor wants. and not necessarily what's best for the city of san jose. >> what is the council making decisions based on? it's not $650 million because of the budget method in the commentary. i know i'm confident in my own decisionmaking and as i look at my colleagues, documents that we rely on, that we've been relying on, numbers have nothing to do with $650 million. >> as a result of that probe, state assembly member, jim beale, is now calling for a delay of the city's planned pension reform measure, expected to appear on the upcoming june ballot. >> when you put stuff on the ballot, you really need to focus on having the accurate information to the voters. and right now, we don't have that. in san jose. >> beale is asking for an independent review of the city's finances. san jose's city council has until march to decide whether to take the reform measure off the june ballot. mayor reed has enjoyed a five-year honeymoon. since taking over for the embattled ron gonzales in 2007, reed's straightforward approach has been popular in san jose. but in the wake of our report, things are changing in real-time. tonight, mayor reed in the spotlight like never before. george kiriyama joins us from downtown san jose. we saw something different tonight, didn't we? >> reporter: oh, yes. and mayor chuck reed tried to talk about the city's retirement benefits, there was union members listening to every word. we heard mayor reed use the $650 million figure often, referring to retirement cost projections. but not one time did he use that figure in tonight's speech. so, i asked him after the speech, i asked mayor chuck reed, if he's backing away from the $650 million figure. and i also asked h ioff the pension reform initiative should be taken off the june ballot. and this is what he had to say. >> $650 million is still a reasonable ballpark estimate of the pessimistic scenarios. when you're doing projections, you try to have a base case, a pessimistic case and an optimistic case. and the folks opposed to it being on the ballot, don't want the people of san jose to decide. it's a political stunt. it's political theater. we're going to have a ballot measure in june. you have to expect that. >> it was unfortunate in the thing, in his state of the city, where he said he's still moving forward with the ballot measure because of the fact that we believe that if we want to find some real solutions, that we need to have some real negotiations. and we need real numbers in order to do that. >> that was yolanda cruz, one of the union presidents reacting to mayor reed's speech. mayor chuck reed did highlights of the past year during his speech. among them, praising the mayor's gang prevention task force. 2011, of gang-related violence down from the year before. he also touted the destination home initiative, which provided homes to thousands of previously homeless people. >> thank you. this could be the beginning of a long battle between both sides. if you'd like to read the full ethics complaint against mayor reed, go to our website at nbcbayarea.com. and search pension. we've built the largest investigative unit in the country and we want you to be a part of it. you can call us at -- or e-mail us at the unit at nbcbayarea.com. eight more school employees put out on leave. more fallout from the alleged abuse in redwood city. she's accused of kick and slapping at least two of her special needs preschool students at roosevelt elementary school. today, the redwood city school district put eight more staffers on leave, to investigate whether they followed proper procedures in the handling of those allegations. the alleged abuse happened between december and january. but an aide didn't come forward until february 1st. the letter will go out to parents tomorrow. but tonight, concerned parents of children who attend a south bay elementary school want to know why the school's principal was suddenly placed on administrative leave. san jose unified remains tigts-lipped as to why celia waite was escorted off the grounds last week. she was in the west north of foxworthy. the district plans to send out a letter to families, outlining further plans at that school. it's a twisted tale involving a prisoner, a letter and a boundty hunter. it could solve the mystery of a missing hayward girl. it could lead to answers for this bay area family, correct? >> reporter: it could. it's the only hope of a family of a girl missing over 20 years has right now. and they are focused on the search in calaveras county. today, along with search teams with dogs from santa clara county, made that discovery. >> there's a lot back there. >> reporter: neighbors are reacting to news human remains believed to be victims of convicted killer, leslie shermantine, in their neighborhood. >> the dog alerted. they found human remains. it was a skull. >> reporter: the sheriff's department is confirming it is a human skull and bone fragments. this morning, the search resumed in this rule area near his former home. sheriff's deputies started searching wednesday, after getting a tip from sacramento county bounty hunter, leonard pedilla. he says shermantine showed him a map, of where he buried bodies of people he murdered. he believes it belongs to a missing girl named cindy vander heiden. >> mr. pedilla has been in contact with our investigators as of late. it kind of allowed us to focus in on this area. >> reporter: also included in the letter, was a flyer of missing hayward girl, mykala garrity. the suspect in this case looks similar to lauren herzog, who is now dead. authorities are trying to figure out if shermantine can tell them about garrett's whereabouts. i received a letter from michaela garrett's mother tonight. she doesn't think the skull belongs to her daughter. she says she hopes it will bring peace to a family waiting to find a loved one. back to you guys. >> thank you, cheryl. very public comments made by san francisco sheriff roscoe ro kareemmy have addressed a billboard about domestic violence. here's the billboard that will go up. the shelter raised $4,000 to pay for the billboard during a two-week period. quote, it says, domestic violence is never a private matter. it's a correct reference to a comment made last month when he said the investigate was a private matter. the sheriff will stand trial on dmes ek abuse charges, february 24th. it's not mad cow. but it is just as dangerous. tonight, details about a rare disorder, found in one bay area county. can you hear me now? not so fast. health officials are weighing in about a disease that killed one woman and made another sick. they're two cases of a rare brain disorder. nbc's bay area's jean elle joins us from san francisco tonight. it's similar but it's not mad cow. what are the details? >> reporter: health d.s keep careful track of the disease. it's called ckg. it's a rare brain disease that can be associated with mad cow disease. and tonight, marin county has two cases. but officials are quick to point out they do not believe they're related to mad cow. one of the victims who died w eileen shaw. she was described as a woman who became sick and deteriorated quickly. her ex-husband she said died of conjunctive cjd. he's concerned about the diagnosis. >> she was aware of a second case, similar, in marin. and we were both surprised by that. because she reported to me there were only 38 cases in the whole united states. >> reporter: marin county health and human services issued a statement saying, at this time, we have excluded variant cjd, the type related to mad cow disease, as the cause in one of the two cases, based on information available to us. this conclusion is based on test results at a national reference laboratory. furthermore, we have no evidence that suggests a causal linkage between the suspect cases. nor is there any evidence to suggest a risk to the food supply. marin county has more investigation to do in both cases. but it wants to point out to the public there's no health risk of environmental risk. but the investigation continues. >> okay, jean. thank you. in the south bay now. not in my backyard. a group of parents want a radiation-free school zone. and they made it known at a school board meeting in san jose. they say verizon wants to build a cell tower. some parents believe their children will be exposed to dangerous amounts of radiation. >> and we'll try anything we can to try to stop it. >> the plan has to be approved by san jose's planning commission. and that could take several months. parents say they will appeal if the towers is approved. thousands of californias struggling to stay in their homes may soon get the news they've been waiting for. state and federal officials revealed the details. california homeowners, banks will pay $18,000, to provide other types of housing relief. advocates say while it won't help everyone, it is a huge step in the right direction. >> i'm hoping that some of this money for principal reduction is going to make it possible for a block of people, maybe for some thousands of california homeowners, to qualify for a loan modification, so they can actually keep their home. this tool could be incredibly powerful. >> state and federal leaders say the deal will finally hold banks accountable for pushing borrowers into foreclosure. why was the fbi keeping files on steve jobs?
